Routine Carroll County service has a published starting rate of $125, and our Carroll County process serving page covers the outlying towns.

01Local service landscape

Serving Papers in Carrollton and Carroll County

Carrollton is the Carroll County seat, with 26,738 residents at the 2020 census, and the county was estimated at about 131,036 in 2025. U.S. 27 passes through the city center, Georgia Routes 16, 113 and 166 cross town, and the city has ready access to Interstate 20 to the north. Downtown is Adamson Square, named for Congressman William C. Adamson, and the Little Tallapoosa River flows through the northwest part of the city. Our Douglasville process servers handle the next county east along I-20.

Beyond the city, Carroll County runs from Villa Rica and Temple in the north to Bowdon near the Alabama line and Roopville to the south. Villa Rica also extends into Douglas County and Bremen into Haralson County, so we confirm the parcel's county before quoting, because that decides the court and sheriff. Carroll addresses on the Douglas side move to our Douglas County service team. The Carroll County process service page lists every Carroll town.

02Attorneys and law firms

Carrollton Service for West Georgia Lawyers and Metro Firms

Carrollton lawyers handle family, injury, property and business cases on the Newnan Street docket, and Atlanta and Alabama firms often need a Carroll County defendant served. Industry is part of the mix: Southwire, founded in Carrollton in 1950, is now one of the world's largest wire and cable manufacturers, and other plants benefit from I-20 access. We read each set of papers before scheduling, confirm the court and server type and send a written quote. Our Georgia law firm process service desk keeps one contact on every file.

A company is generally served through an officer, a managing agent at a Georgia office or plant, or its registered agent, under O.C.G.A. 9-11-4(e)(1)(A). If none can be served, the Secretary of State may act as agent once the plaintiff certifies the required mailing. A front-desk employee is not automatically a managing agent, so the server asks for the right person and records the answer. See our Georgia corporate service of process page for what to send, and our Newnan Division coverage for federal filings.

03Evasive and hard-to-serve

Rural Roads, Student Rentals and Defendants Who Avoid Service

Carroll County mixes in-town apartments with farms, long private drives and homes along county roads toward Bowdon and Roopville. Our servers do not climb gates or cross posted land; they plan attempts for when the defendant is likely to come and go and log each visit with lights, vehicles and who answered. In town, controlled-entry apartment buildings near campus require the same patience. Our page on Georgia defendants who are hard to serve explains the method, and guarded subdivisions follow 9-11-4(f)(4).

When a defendant clearly avoids service, the dated log is the evidence counsel needs. Georgia courts expect reasonable diligence, especially when a suit is filed near a limitation deadline, and a detailed log carries more weight than a general statement. If service still fails, the court may consider publication under 9-11-4(f)(1). Our guide for when someone avoids service in Georgia and the service by publication walkthrough describe the steps.

04Family law, evictions and subpoenas

Divorce, Dispossessories, Magistrate Claims and Subpoenas in Carroll County

Carroll County divorce and custody cases are filed in the Superior Court on Newnan Street. A cooperative spouse can sign an acknowledgment of service, and otherwise the papers are delivered personally or at the home under the Civil Practice Act. We serve family papers calmly and confirm identity before handing anything over. Our Georgia guide on divorce service and the family papers service page explain each option.

The University of West Georgia and West Georgia Technical College bring a steady rental market and semester-end lease disputes. Since July 1, 2025, O.C.G.A. 44-7-51(a) has allowed an approved process server to serve a dispossessory summons alongside the sheriff and constables, but the statute does not define approval. We ask the Carroll Magistrate Court about its practice before accepting a dispossessory and never carry out writs. Deposit and damage claims up to $15,000 appear on our magistrate court claim service page.

05Documentation

A Carroll County Return With the Right Caption

Carroll County filings need proof of a private serve in the form of an affidavit stating the date, place and manner of service, filed within five business days with the court where the case is pending. The defendant's answer period generally does not begin until proof is filed, so a prompt return matters. Each Carrollton affidavit we prepare is signed, copies the caption exactly and is backed by a log of every attempt. Rush files keep that record through our Georgia same-day and rush service.

If a defendant challenges service, the affidavit and log show who accepted the papers, where and why the server believed that person qualified. In Carrollton, as elsewhere outside Tennessee, the serve may be made by a vetted Georgia server under contract with Delator, working to Delator's written documentation standard. Witness returns follow the same format, and out-of-county witnesses must receive a $25 daily fee plus 45 cents a mile under O.C.G.A. 24-13-25, as our Georgia subpoena service page explains.

06Georgia rules

Georgia Service Rules Applied to Carrollton Cases

For Carroll County cases, O.C.G.A. 9-11-4(c) generally allows service by the sheriff or a deputy, a court marshal, a citizen specially appointed by the court, a non-party adult appointed by the court as a process server or permanent process server, and a certified process server under 9-11-4.1. Before working in Carroll County, a certified server would need a yearly notice of intent that the Carroll sheriff accepts, and some sheriffs decline. We confirm what the Carroll court accepts and never claim a certification or appointment we have not verified. Our Georgia guide to authorized servers explains each.

A Carrollton individual is generally served personally, at the dwelling with a resident of suitable age and discretion, or through an authorized agent. The server should act within five days of receiving the papers, though a later serve is not invalid for that reason alone, and service may be made anywhere in Georgia. A defendant who waives service answers 60 days after the request was sent. These summaries are not legal advice, and the complete Georgia service guide adds detail.

What Georgia's 51st Judicial Circuit Means for Carrollton Papers

Effective January 1, 2025, Carroll and Heard counties left the Coweta Judicial Circuit and became the West Georgia Circuit, Georgia's 51st. The Coweta Circuit kept Coweta, Meriwether and Troup counties. Older pleadings, form banks and law firm templates can still name the Coweta Circuit for a Carroll County case, so we read every caption and, when it looks out of date, flag it to counsel before serving. How pending cases were transitioned is a question for the clerk, not for us. Our Coweta County servers handle the former partner counties.

Heard County, the West Georgia Circuit's second county, starts at a published Routine rate of $180, reflecting its smaller population and distance from the metro. Franklin is its county seat. Papers from Carrollton bound for Heard County are coordinated under the same quote and affidavit standard. The Carrollton GreenBelt, described as the largest paved loop in Georgia, also means some residents are out walking or cycling on evenings and weekends, which we factor into attempt timing. The Georgia county rate map lists Heard and every other county.

FAQ

Frequently Asked Questions

Which judicial circuit is Carrollton in?

Since January 1, 2025, Carrollton and Carroll County are in the West Georgia Judicial Circuit, Georgia's 51st, which also includes Heard County. Before that, both were part of the Coweta Circuit. We check every caption for the change and flag anything that looks out of date to counsel before serving.

How much does a process server in Carrollton cost?

Carrollton papers start from Carroll County's published Routine rate of $125. For Carroll County, Urgent runs $188, Rush $250 and Same Day $375. Heard County starts at $180. Your Carrollton price turns on the address, the deadline and the papers, and we confirm it in writing before anyone knocks.

Do you serve papers in Heard County too?

Yes. Heard County is the second county in the West Georgia Circuit, and Franklin is its county seat. Heard County service has a published Routine starting rate of $180. We coordinate it under the same written quote and affidavit standard as Carroll County. The statewide Georgia rate finder shows every tier.

Can you serve a University of West Georgia student?

For Carrollton students, home service comes first. We do not enter residence halls, classrooms or restricted campus buildings without authorization, and any campus approach is discussed with counsel first. Many student tenants leave at semester's end, so we suggest serving early when a case allows. See our hard-to-serve defendants service for students who avoid the door.

Can you serve a dispossessory in Carrollton?

Only after we confirm the Carroll Magistrate Court's practice. Georgia law has allowed an approved process server to serve the summons since July 1, 2025, alongside the sheriff and constables, but it does not say who approves one. Evictions and writs in Carrollton stay with law enforcement, never with us. The Georgia eviction service guide sets out each step for Carrollton landlords.

How long does a Carroll County defendant have to answer?

In Carroll County superior and state court, the answer is generally due 30 days after service, and the count generally waits until proof of service is filed. Magistrate claims also allow 30 days. A Carroll County dispossessory answer is due seven days after actual service, moving to the next business day when day seven is a weekend or holiday. Counsel should calculate the exact deadline.

Do you serve papers in Villa Rica and Bremen?

Yes, after we confirm the county. Villa Rica extends into Douglas County and Bremen into Haralson County, so the parcel's county decides the court and sheriff involved. Carroll-side addresses stay in the West Georgia Circuit. Our Douglasville service page covers the Douglas side of Villa Rica.

Can a Carrollton defendant who moved to Alabama be served?

Georgia allows personal service outside the state in some cases, including in place of publication, and the defendant then generally has 30 days to answer. Out-of-state serves for Carrollton cases run under the same written quote and documentation standard. Our service of papers across state lines page explains what counsel should send.

What does a Carroll County affidavit of service include?

The date, place and manner of service, a name or description of the person served, the exact case caption and the server's signature, as O.C.G.A. 9-11-4(h) requires for private service. It is prepared for filing within five business days, and a log of every attempt supports it.

Does Delator Field Services have a Carrollton office?

No. Delator Field Services, the process serving division of Delator Group, runs Carrollton files from its Nashville, Tennessee headquarters and keeps no Georgia office. We coordinate Carroll and Heard County service through servers who meet the issuing court's requirements, confirmed in writing before the first attempt, and every file keeps one contact from intake to affidavit.
