Quick answer

How do I hire a process server in Rockdale County, Georgia?

Start by sending the filed papers, the addresses you know and the date you need. We learn which servers the Rockdale County court accepts, confirm the tier and price in writing, assign the job and return a signed affidavit for the Court Street clerk. Routine service starts at a published $125, and the Georgia rate map compares the surrounding counties.

01Local service landscape

A Compact County With a Single City

Rockdale County holds an estimated 98,000 people, and Conyers is its only incorporated city. Everything outside Conyers is unincorporated county, so a defendant with a Conyers mailing address may live well beyond the city limits. The county's courts sit together on Court Street, which simplifies returns: Superior Court and State Court papers both come back to the same building. Our Georgia process serving hub explains how we handle a one-city county like this.

Interstate 20 crosses the county east to west, linking Conyers with DeKalb County and Atlanta on one side and Newton County on the other. Residential addresses range from older in-town streets and apartment complexes to large subdivisions and wooded lots in north and south Rockdale. We review each address before quoting and note when it sits near the DeKalb, Gwinnett, Walton, Newton or Henry line. The published rates across Georgia counties list each neighbor, and Newton County service covers Covington to the east.

02Attorneys and law firms

Rockdale Circuit and State Court Service for Metro Counsel

Rockdale County cases are filed by Conyers practitioners, by Decatur and Atlanta firms with east metro clients, and by out-of-state counsel handling injury, contract, collection and family matters. Because the circuit covers one county, judges and clerks are concentrated in one place, but defendants often live or work across the line in DeKalb, Gwinnett or Newton. Our Georgia law firm service gives each office one contact for the quote, the log and the affidavit.

Each file gets a read-through before a server is chosen. Typical issues include a defendant whose Conyers mailing address is actually unincorporated county, a company whose registered agent is in Fulton County, and a case that belongs in State Court rather than Superior Court. For corporate defendants, our service on Georgia registered agents follows O.C.G.A. 9-11-4(e)(1), and when a defendant works in Lawrenceville, our Gwinnett County process servers can attempt there with counsel's approval.

03Evasive and hard-to-serve

Commuter Hours, Apartment Gates and Unanswered Doors

Many Rockdale residents commute along I-20 toward DeKalb and Atlanta, which empties neighborhoods during business hours. Apartment communities near the interstate may use controlled entry, and some defendants rely on doorbell cameras to avoid opening the door. We spread attempts across dawn, evening and weekend windows with counsel's approval and keep a dated log of each visit. Our Georgia service for avoiding defendants explains the method.

Controlled-entry residential communities fall under O.C.G.A. 9-11-4(f)(4), which generally lets an authorized server go in for a reasonable time once the guard or manager is told who is being served and has seen identification and proof of appointment. Our servers carry those documents when a gate is expected. If attempts still fail, counsel can review the log and consider other methods through the court, as described in our guide to dodged service and Georgia publication rules.

04Family law, evictions, small claims, subpoenas

Conyers Family Cases, Apartment Evictions, Small Claims and Witnesses

Rockdale Circuit divorce and custody papers are generally delivered under O.C.G.A. 9-11-4, unless the responding spouse prefers to sign an acknowledgment. When that spouse has moved to another county, sheriff service would need a second original, while a private server the court accepts can usually go straight to the new address. Georgia generally waits about 31 days after service or acknowledgment before a decree can be entered. Parties can read Georgia's divorce paper service guide.

Apartment communities near the I-20 interchanges produce a steady flow of dispossessories. Georgia's 2025 amendment to O.C.G.A. 44-7-51(a) lists an approved process server next to sheriffs and constables, yet nothing in the law explains how approval works, so we ask the Rockdale magistrate court before taking one and leave all writs to deputies. Claims up to $15,000 follow 15-10-43, and our Georgia magistrate claim service handles them. A witness from outside Rockdale must be offered the $25 daily fee and 45 cents per mile.

05Documentation and challenges

Affidavits for the Court Street Clerk

In Georgia, a server who is not a sheriff or marshal generally proves service with an affidavit stating when, where and how the papers changed hands. O.C.G.A. 9-11-4(h) sets a five-business-day target for filing that proof, and a late return pushes back the defendant's answer clock without undoing the service. Our affidavits come back quickly so the Court Street filing is not the bottleneck. Read the Delator Group overview for the people behind each record.

The affidavit is written from field notes: arrival time, building and unit, who came to the door and what they said. If copies were left at the home, it explains which resident accepted them and why that person qualified. Because Rockdale borders five counties, addresses near a line get an exact location note, which helps if a defendant later argues the papers went to the wrong place. Concerns about a challenge can come through our secure contact page, and witness work goes through our Georgia witness subpoena delivery.

06Georgia service rules

Georgia Law on Who May Serve in Rockdale County

Georgia keeps a defined list of who may serve. O.C.G.A. 9-11-4(c) generally names the county sheriff and deputies, court marshals, citizens the court specially appoints, non-party adults appointed for a case or as permanent process servers, and process servers certified under 9-11-4.1. Certification is county by county in practice: a certified server files an annual notice with each sheriff and can work only where that sheriff takes such servers. Our explainer on Georgia process servers covers each category.

Nothing we publish says a DFS server holds a specific Georgia certification or appointment. A Rockdale County serve is assigned to someone the issuing court accepts, and the written acceptance of the job says so. If a document must go through the sheriff, we tell you and send it there. Georgia generally permits service on a person in hand or at the home through a qualifying resident, and the answer is usually due within 30 days. Ask counsel how these general points apply. Our guide for serving papers in Georgia adds detail.

07A Rockdale County angle

The Georgia International Horse Park and Event Weekends

Conyers is home to the Georgia International Horse Park, built on about 1,139 acres for the 1996 Olympic Games, where it hosted equestrian events, mountain biking and the riding and running portions of the modern pentathlon. The park still holds shows and festivals, and large events can bring heavy traffic to nearby roads. We do not attempt service at event venues and plan attempts around major dates where deadlines allow.

The same pattern applies across the east metro. When a Rockdale defendant moves west into DeKalb, our DeKalb County process servers take the papers; when someone heads south toward McDonough, our Henry County team follows the same standard. Firms that also handle matters in Tennessee, Kentucky or the Carolinas can compare published figures on the multistate rate comparison map before sending papers.

FAQ

Frequently Asked Questions

Can someone other than a deputy serve papers in Rockdale?

Generally, yes. Georgia's service statute covers marshals, specially appointed citizens, court-appointed and permanent process servers, and certified servers in counties whose sheriff accepts them, in addition to the sheriff. Rockdale courts may prefer one route for a given paper, so we ask first, match the server to the answer and confirm it in writing.

What will it cost to serve papers in Rockdale County?

The published Routine starting rate is $125. Urgent is billed at 1.5 times that, Rush at twice it and Same Day Rush at three times. If the defendant keeps commuter hours and needs dawn or late attempts, we raise it before starting and you approve the written figure. The Georgia county price comparison shows the nearby counties.

Is every Conyers address inside the city?

No. Conyers is Rockdale County's only incorporated city, but many homes with a Conyers mailing address sit in unincorporated county. For service and filing, that usually makes little difference because the county courts are all in Conyers, but we record the exact location in the affidavit in case it matters later.

Where do Rockdale County federal cases go?

Rockdale is part of the Atlanta Division of the Northern District of Georgia under 28 U.S.C. 90, with the courthouse on Ted Turner Drive S.W. in downtown Atlanta. A federal summons is served under Federal Rule of Civil Procedure 4 rather than the Georgia statute, and our return is prepared to meet the federal court's requirements.

May a family member at a Conyers home accept service?

Possibly. O.C.G.A. 9-11-4(e)(7) generally permits leaving copies at the defendant's home with a resident who is of suitable age and discretion. A babysitter or visitor usually does not qualify. Whether to rely on abode service is counsel's choice, and the affidavit identifies who accepted, the address and the time of delivery.

Can DFS serve an eviction summons in Rockdale County?

The answer comes from the Rockdale County magistrate court, which we contact before agreeing. HB 270 placed approved process servers in the dispossessory statute on July 1, 2025, but did not say who approves them, and sheriffs still serve these summonses in many counties. Lockouts, set-outs and writs are not services we provide. Landlords can read Georgia eviction service steps.

What if the defendant is never home during the day?

We schedule attempts in the early morning, evening and on weekends with counsel's approval, and a workplace attempt may also be an option. Every visit is logged with the date, time and observations. If the person still cannot be served, counsel can review options. Our Georgia hard-to-reach defendant service explains the documentation.

How soon can a Conyers serve be attempted?

Under Routine service, expect the first attempt a few days after we receive the papers. Urgent, Rush and Same Day Rush shorten the wait at 1.5, 2 and 3 times the Routine price, and a same-day request depends on server availability that day. Give us the hearing date and we will reply in writing with a workable plan. See Georgia rush service.

Is DFS located in Conyers?

No. DFS is the process serving arm of Delator Group, whose only headquarters is in Nashville, Tennessee; there is no office in Georgia. Rockdale papers are assigned to servers the issuing court accepts, and the deliverables never change: a price confirmed in writing, a dated record of attempts and an affidavit signed by the server.

What details should a Rockdale County request include?

The filed papers, the defendant's full name, each home and work address, gate codes or apartment details you are entitled to share, a photo or description, vehicles and the deadline. For a subpoena, have the witness fee and mileage payment ready. Papers issued in another state follow our Georgia service of foreign papers process and affidavit format.
