Quick answer

How do I hire a process server in Myrtle Beach?

Send the filed papers, the defendant's Grand Strand address and any deadline. We identify the court behind the papers, make sure the document is one a non-officer may deliver, and email a written quote. Routine Horry County service has a published starting rate of $125, and the Horry County service page covers Surfside Beach, Loris and the other towns.

01Local service landscape

Serving Papers Between the Bypass and the Boardwalk

Myrtle Beach counted 35,682 residents in the 2020 census, yet the city functions as the commercial center of a county of more than 427,000. US 17 splits here: the Bypass, opened in 1981, runs west of the beach, while US 17 Business carries the tourist strip closer to the ocean. Those two roads shape how a server plans a day of attempts, especially in summer traffic. Our Horry County countywide service page lists the inland and coastal towns we reach.

Housing near the beach ranges from oceanfront condominium towers and hotels to long-term rentals and newer subdivisions off the Bypass. A defendant may list a resort address that is really a seasonal job, or a condo that belongs to someone else. We confirm the address with counsel before quoting, then plan around building access. For defendants who live inland, the Conway process server page covers the county seat, and the statewide South Carolina rate map shows neighboring Georgetown County at $140.

02Attorneys and law firms

For Grand Strand Firms and Counsel Far From the Coast

Grand Strand practices file collection suits, premises and vehicle injury claims, contract disputes and family cases, and many of their defendants live in other counties or other states. Firms in Columbia, Charlotte or Tennessee may also need a Myrtle Beach resident served without making the drive. We begin with the papers, checking the Horry County caption, the attached complaint and the name of the defendant. Our South Carolina service program for law firms shows how quotes, attempt notes and affidavits reach you.

Horry County gives coastal counsel a practical choice of clerk offices: the main office on Second Avenue in Conway and the Central Coast Complex on Hinson Drive in Myrtle Beach. We note which office will receive the affidavit so the paperwork matches. Remember that an attorney of record cannot serve the summons personally under SCRCP 4(c), although any independent adult may. The South Carolina process server hub explains how Delator Field Services coordinates statewide.

03Evasive and hard-to-serve

Front Desks, Seasonal Jobs and Defendants Who Move Often

Resort housing creates its own obstacles. Condominium towers and hotels often have staffed lobbies that will not confirm whether someone is a guest or owner, and many restrict access to upper floors. Seasonal workers change addresses between spring and fall. We do not misrepresent who we are to get past a desk; we time attempts for when the defendant is likely to come and go, and we document what building staff said. Our hard-to-serve defendant strategy for South Carolina shows the approach.

Sunday attempts are generally allowed under S.C. Code 15-9-17, though not on someone traveling to, attending or leaving a religious service. When repeated visits fail and counsel believes the defendant is avoiding service, the attempt log supports a request for publication under S.C. Code 15-9-710, which requires an affidavit of due diligence. The guide to publication service in South Carolina explains the order, and Urgent and Rush service options are available for tight deadlines.

04Family law, landlords and subpoenas

Family Court Papers, Rental Disputes and Coastal Subpoenas

Horry County family cases are filed with the Clerk of Court, and the county's self-represented divorce packet lists four ways to serve: restricted-delivery certified mail, a signed Acceptance of Service, the sheriff of the county where the defendant lives or works, and private process servers. When counsel chooses personal delivery, our server confirms identity before handing over anything and keeps the exchange brief. Rules to show cause go to the sheriff or a court-designated person instead. Our divorce and custody papers service page compares the options.

Landlords in rental-heavy Myrtle Beach should know that the magistrate's rule to vacate is generally served through the sheriff's office, and we serve it only where the magistrate court confirms private service is accepted. Writs of ejectment are never posted or executed by our servers. We do serve summonses in suits for unpaid rent or damage, and magistrate claims up to $7,500 under SCRMC 6(c), as the small claims service page explains. The witness subpoena page covers hearings.

05Documentation

Affidavits That Answer the Questions a Court Will Ask

SCRCP 4(g) requires the proof of service to state the date, time and place and to identify the person served by name and address, or by description when the name is not known. Non-officers swear to their service in an affidavit. Our Myrtle Beach affidavits add the building or unit details that matter at resort properties, and for abode service we describe the resident who accepted the papers. The step-by-step guide to serving South Carolina papers shows how proof fits the case.

Underneath each affidavit is a dated log of every visit, including failed attempts and conversations with building staff. If a defendant later says they were never served, counsel can point to the specific times and observations. Firms with cases in several states can compare rates on the multistate pricing map. Outside Tennessee, Delator may assign a vetted server it contracts with, and that server works under the same written documentation standard as every DFS serve. The about Delator Group page explains the firm's structure.

06South Carolina rules

The Service Rules Behind Every Horry County Serve

An Horry County summons may be served by the sheriff or a deputy, or by any adult 18 or older who is not a party and not counsel in the case, per SCRCP 4(c). The state keeps no license roll for private servers, so those age and independence limits are the test our assigned servers meet. Other process, such as court orders, rules and writs, generally goes through the sheriff or a person the court designates, so we confirm what the court requires before accepting it. The who-can-serve guide for South Carolina has more.

Individuals may be served personally, at their dwelling with a resident of suitable age and discretion, or through an authorized agent. A summons may also be sent by restricted-delivery certified mail or a qualifying commercial delivery service, but a default generally requires a receipt signed by the defendant. Under SCRCP 12(a), the defendant then generally has 30 days to file an answer. These are plain summaries, not legal advice, and the registered agent and business service page covers companies.

07Myrtle Beach angle

When the Defendant Was Only Visiting

Many Myrtle Beach lawsuits arise from a visit: a traffic collision, an injury at a rental, or a dispute with a vacationing tenant. By the time the case is filed, the defendant is often back home in another state. For nonresident drivers, S.C. Code 15-9-350 treats driving in South Carolina as appointing the Director of the Department of Motor Vehicles as agent for service, and counsel decides whether that statute fits. A process server in Myrtle Beach should raise the question early.

Where counsel prefers personal delivery outside South Carolina, SCRCP 4(f) allows it only when a statute provides, and S.C. Code 15-9-750 gives out-of-state personal service the same effect as publication, and it is complete the day the papers change hands. Proof made outside the state may be by affidavit before a notary under SCRCP 4(h). Our out-of-state papers service page explains how we coordinate that delivery, and Florence process service covers the federal division seat.

Process Servers Near Myrtle Beach

Grand Strand cases regularly reach inland and down the coast. Defendants in the Pee Dee are handled through Florence County service, and those who moved south along US 17 toward the Lowcountry through the Charleston process server page or Mount Pleasant process service. Other Charleston-area addresses go to the Charleston County process servers. Each one of those jobs follows the same routine as a Myrtle Beach serve: a written price before the first attempt, logged visits and a signed affidavit.

FAQ

Frequently Asked Questions

How much does a process server in Myrtle Beach cost?

Routine service anywhere in Horry County starts at a published $125, so Urgent works out to $188, Rush to $250 and Same Day Rush to $375. The exact figure turns on the property, the document and how soon you need it, and it is sent to you in writing before dispatch. Neighboring counties have their own rates on the county pricing map for South Carolina.

Can you serve someone staying in a hotel or condo?

We can attempt it, but a hotel room or a rented condo is usually not the defendant's dwelling house or usual place of abode, so papers cannot be left with whoever answers. Building staff may refuse to confirm a guest. We attempt personal delivery where building rules allow, never misrepresent ourselves, and record what staff told us so counsel can decide the next step.

Who is allowed to serve a summons on the Grand Strand?

SCRCP 4(c) allows the sheriff, a deputy, or any person at least 18 who is not a party or an attorney in the case. There is no statewide license for private servers to verify. Orders, rules to show cause and writs are handled under a separate sentence of the rule and generally go through the sheriff or a person the court designates.

Do you serve evictions in Myrtle Beach?

We do not serve the rule to vacate unless the magistrate court confirms private service is accepted, because the magistrate courts checked in South Carolina route it through the sheriff's office. A writ of ejectment is carried out by a constable or deputy sheriff, never by DFS. Landlords' civil summonses for rent or damages are a different matter, and the South Carolina ejectment guide explains the sequence.

Which clerk's office gets the affidavit?

Horry County has a main Clerk of Court office at 1301 Second Avenue in Conway and a second office at the Central Coast Complex, 332 Hinson Drive in Myrtle Beach. Counsel chooses where to file. We prepare the affidavit with the case caption and number so it can be filed at either location without changes. The Conway county seat service page describes the Conway office.

Is certified mail an option instead of a server?

SCRCP 4(d)(8) allows service by certified or registered mail restricted to the addressee with a return receipt, and 4(d)(9) allows a qualifying commercial delivery service. Service is effective on delivery, but a default generally requires a receipt the defendant signed. Visitors and seasonal residents often never sign, which is why many coastal attorneys prefer hand delivery.

What about a defendant who lives in another state now?

Counsel may consider S.C. Code 15-9-350 for nonresident drivers, or personal service outside South Carolina, which S.C. Code 15-9-750 treats as equivalent to publication and complete on the day served. Proof outside the state may be by affidavit before a notary under SCRCP 4(h). The guide on defendants who avoid service covers related steps.

When are witness fees paid on a subpoena?

Under SCRCP 45, a witness receives $25 a day plus mileage from home to the place named in the subpoena, and the money is tendered when the witness arrives, not at service. A non-party deposition subpoena must be issued and served in the county where the witness lives, works or regularly transacts business in person.

Can papers be served on a Sunday at the beach?

Generally yes. S.C. Code 15-9-17 allows a process server to serve judicial documents on Sunday, but not on someone who is going to, attending or returning from a church or other religious service. We plan any Sunday attempt with that in mind and record the time in the log so the affidavit and the log agree.

Do you serve papers for Horry County federal cases?

Yes. Horry County belongs to the Florence division of the District of South Carolina, so federal cases are heard at the McMillan Federal Building in Florence. Federal Rule 4 allows service by a non-party adult and permits state-law methods. We read the summons, note the response period and return proof suited to the federal clerk.
