Quick answer
How do I hire a process server in Loudoun County?
Send the filed papers, every address you have and the deadline that matters. We tell you which Loudoun court the return goes to, quote the tier in writing and record every visit. Routine service begins at a published $125, and the Leesburg town service page covers addresses in the county seat itself.
01Local service landscape
Two Loudouns: Dense Suburbs in the East, Towns and Farms in the West
Loudoun grew from 420,951 people in 2020 to an estimated 449,749 in 2025 (secondary figures), and most of that growth is in the east around Ashburn, Sterling, Brambleton and South Riding. Those addresses mean apartment complexes, townhouse rows and HOA communities with similar street names. West of Leesburg, the county turns rural, with long driveways, horse farms and wineries. Our published Virginia county rates treat the whole county at the same starting point.
Loudoun has no independent cities inside its borders, which keeps locality questions simpler than in Fairfax or Prince William. It does have seven incorporated towns, and town addresses still go to the county courts in Leesburg. The county seat has its own page for Leesburg process service, while unincorporated communities such as Ashburn or Aldie are covered here. Neighboring Fairfax County service begins just across the Route 28 corridor.
- Apartments and townhouses in Ashburn and Sterling
- Seven towns, all filing in Leesburg
- Farms and vineyards in the western valleys
- Washington Dulles airport area on the Fairfax line
02Attorneys and law firms
A Service Partner for the Leesburg Bar and Visiting Counsel
Loudoun lawyers file a short walk from each other in downtown Leesburg: the Circuit Court clerk on East Market Street and the General District Court on Church Street. Federal cases go to the Alexandria Division. Firms need a server who knows which building the return belongs in and who will not let a 72-hour filing window slip. Our Virginia attorney intake process sets out how we report each step.
Corporate litigation reaches Loudoun often, because large technology and data center operators keep campuses around Ashburn and the Dulles airport area. Those companies are usually served through a registered agent rather than at a guarded campus gate, and our Virginia registered agent service page explains when that is the better route. Firms litigating elsewhere can rely on our handling of foreign-case papers for Loudoun witnesses and defendants.
03Evasive and hard-to-serve
Gated Drives, Long Lanes and Remote Workers
Western Loudoun brings access problems that eastern suburbs rarely do. A defendant may live at the end of a gravel lane behind a closed farm gate, with no mailbox at the house and dogs in the yard. We do not climb gates or cross posted land. The server records where the gate stood, whether anyone answered a call box and when the next attempt is planned. Our plan for hard-to-serve Virginia defendants shows how those records are kept.
In the east, the issue is usually timing. Many residents work in hybrid arrangements or long shifts at operations centers, so a home address may be empty one weekday and busy the next. Our servers rotate the hour of each visit and write every one down. If a defendant still cannot be reached, Va. Code § 8.01-296 provides substituted and posted service, and our Virginia posted service explainer covers the mailing step counsel completes.
- Farm gates and private lanes noted, never crossed
- Call box and intercom exchanges logged
- Shift and hybrid schedules worked around
- Posting only at the main entrance of the abode
04Family, housing, money and witness papers
Leesburg Divorce, Custody, Unlawful Detainer and Small Claims Papers
Loudoun divorce complaints are filed in the Circuit Court, and custody or support petitions in the J&DR court. Many spouses prefer to sign a sworn acceptance or notarized waiver of service under Va. Code § 20-99.1:1 rather than be handed papers at home, and we can bring that document. The Virginia divorce service guide explains when filing an answer also counts as accepting service.
Rental cases come to the General District Court on Church Street. A private server may deliver the unlawful detainer summons, and Va. Code § 8.01-126 calls for service at least 10 days before the return day. The later writ of eviction belongs to the Sheriff. That court also handles small claims up to $5,000, which our Virginia small claims papers page covers in more depth, and witness subpoenas in Virginia can be served across the county.
05Documentation and challenges
Proof of Service That Holds Up in Leesburg
Every return we prepare for a Loudoun court follows Va. Code § 8.01-325. It includes the server's affidavit of qualifications, the date and manner of service, the name of the person served, a printed note that service was by a private server, and the server's name, address and telephone number. It reaches the clerk within 72 hours of service. Our Virginia service methods walkthrough shows how each element fits.
When service is challenged, details carry the day. A posted copy at a side door of a farmhouse is open to attack if the front door was the main entrance, and a copy left with a visiting relative may not qualify as service on a family member. Our logs describe the entrance, the person spoken to and their stated relationship. For persistent avoidance, Virginia options when a defendant hides lists what counsel may consider.
06Virginia service rules
How Virginia Law Shapes a Loudoun Serve
Under Va. Code § 8.01-293, Loudoun process may generally be served by the sheriff or by any person 18 or older who is not a party or otherwise interested in the case. A private process server is one of those adults who charges a fee. Virginia has no statute that licenses or registers them, and each of our returns carries the required affidavit. The guide to who may serve process in Virginia explains the rule in full.
Several acts are reserved for officers: executing writs of possession, levying on property, serving capiases or show cause orders and serving protective orders. Va. Code § 8.01-289 keeps Sundays off the service calendar. Service within 12 months of filing is timely under § 8.01-275.1. If you are unsure whether your papers fit a private server, contact Delator Field Services before you send them.
07Local angle
Route 7, Route 15 and the Potomac Line
Loudoun's road grid sets the pace of a service day. Route 7 runs east to west from Sterling through Leesburg toward the Blue Ridge, Route 15 crosses north to south through Leesburg, and the tolled Dulles Greenway links the airport area with the county seat. We cluster eastern stops apart from western ones so a Lovettsville attempt does not follow a Sterling attempt at rush hour. Co-defendants to the south go to Prince William County coverage.
The Potomac River forms Loudoun's northern border with Maryland, and West Virginia lies beyond the Blue Ridge to the west. A Loudoun defendant who has moved across one of those lines can still be served for a Virginia case, because Va. Code § 8.01-320 lets any qualified adult serve outside the Commonwealth. Shenandoah Valley moves go through Winchester city service or Frederick County deliveries.
- Circuit Court clerk: 18 E. Market St., Leesburg
- General District Court: 2 Church St. NE, Leesburg
- 20th Circuit: Loudoun, Fauquier and Rappahannock
- Federal filings: Alexandria Division courthouse

FAQ
Frequently Asked Questions
Do Loudoun town addresses go to town courts?
No. Leesburg, Purcellville, Middleburg and the other incorporated towns sit inside Loudoun County, and civil papers from those addresses are filed in the county's Circuit Court or General District Court in Leesburg. Virginia towns differ from independent cities, which keep their own courts. Our Leesburg page covers the county seat in more detail.
What does it cost to serve papers in Loudoun County?
The published Routine starting rate for Loudoun County is $125. Loudoun Urgent jobs are priced at 1.5 times Routine, Rush jobs at twice Routine and Same Day Rush at three times Routine. The quote depends on the address, how soon you need service and how many defendants are involved, and we confirm it in writing before the first attempt.
Can a private server deliver papers in Loudoun?
Yes. Under Va. Code § 8.01-293, any person 18 or older who is not a party or otherwise interested in the case may serve most civil process, alongside the sheriff. Officers alone execute writs of eviction, levy on property and serve protective orders. The Virginia server qualification rules explain the line.
How do you handle a farm with a locked gate?
We do not enter posted or gated property without permission. The server records the gate, any call box response and the time, then plans a different approach, such as an attempt when the defendant is likely to drive out. If repeated attempts fail, the log supports counsel's next decision about substituted or posted service.
Can you serve a company at its Ashburn campus?
Usually the better route is the registered agent. Under Va. Code § 8.01-299, a Virginia corporation may be served through an officer, director or registered agent; foreign corporations follow § 8.01-301. Campus security often blocks visitors, so we confirm the agent's address with counsel first. See our company and LLC service page.
What if the defendant moved to Maryland or West Virginia?
For a Virginia case, Va. Code § 8.01-320 allows a nonresident to be personally served outside the state by anyone authorized to serve where the person is, or by any adult 18 or older who is not a party or interested. Whether that has the effect of personal service depends on long-arm jurisdiction, which counsel decides.
Who carries out a Loudoun eviction?
The Sheriff. A private server may deliver the unlawful detainer summons at least 10 days before the return day, but only a sheriff or high constable may execute the writ of eviction under Va. Code § 8.01-293(B). DFS never performs or announces that step. Our Virginia eviction service page explains what we do handle.
When is a Loudoun return due at the clerk's office?
Va. Code § 8.01-325 requires a person other than a sheriff to return the process to the clerk within 72 hours of service unless the court directs otherwise. If the deadline lands on a Saturday, Sunday or legal holiday, it moves to the next business day. We send the signed return in time to meet that window.
Can a defendant waive service instead?
In circuit and general district court, Va. Code § 8.01-286.1 lets a plaintiff ask the defendant to waive service. A defendant generally has up to 30 days to return the waiver, and a timely waiver extends the response deadline to 60 days after the request. A Loudoun defendant who declines without good cause may end up paying for the formal service that follows.
Do you serve on Sundays in Loudoun?
No. Va. Code § 8.01-289 bars service of civil process on Sunday except in narrow cases involving people escaping custody. We schedule weekday evening and Saturday attempts instead, which works well for many commuters in Ashburn and Sterling. Our rush and same-day service options help when the calendar is tight.
