Quick answer
How do I hire a process server in Stafford County?
Send the filed papers, home and work addresses and your deadline, plus any commute details you know. We quote the tier in writing, plan visits for the hours a commuter is likely home and log each one. Routine work starts at a published $125, and addresses across the river fall under Fredericksburg process serving.
01Local service landscape
A Commuter County Between a Marine Base and a River
Stafford grew from 156,937 residents in 2020 to an estimated 170,803 in 2025 (secondary figures). It has no incorporated towns, so every address files at the Judicial Center on Courthouse Road. The north end around Aquia Harbour and Garrisonville is built for commuters, with subdivisions off Route 610 and quick access to I-95. The south end meets the Rappahannock at Falmouth, across from the City of Fredericksburg. Our Virginia rate map shows Stafford and Fredericksburg as separate entries.
Between those ends, the county stretches east to the Potomac shoreline at Widewater and west into farmland around Hartwood along Route 17. Marine Corps Base Quantico covers part of northern Stafford, and its gates are controlled by the command. That mix of commuter suburbs, river communities and rural roads shapes how we schedule. Defendants who live just over the northern line go to service in Prince William County.
- Commuter subdivisions in North Stafford
- Waterfront communities on the Potomac and Aquia Creek
- Falmouth on the Rappahannock
- Farms and wooded lots toward Hartwood
02Attorneys and law firms
One Circuit Shared by Eleven Localities and a Different Federal Division
Stafford sits in the 15th Judicial Circuit, which it shares with Fredericksburg, Spotsylvania, Hanover and the Northern Neck counties, so many local attorneys practice in several courthouses each week. Federal work is less intuitive: Stafford is assigned to the Eastern District's Alexandria Division, while Spotsylvania and Fredericksburg file in Richmond. We note the correct court on intake. Our support for Virginia attorneys page lists the details we collect.
Firms outside Virginia often need a Stafford defendant who works at Quantico, at a federal agency up the interstate or at a regional employer near Fredericksburg. When the case is pending elsewhere, we deliver under that court's rule and draft the affidavit to fit, as explained on our non-Virginia court papers page. Co-defendants south of the river are handled through Spotsylvania County coverage.
03Evasive and hard-to-serve
Dark Mornings, Late Evenings and Gated Lake Communities
A Stafford defendant who catches a commuter train, a slug line or an early express lane trip may leave home before 6 a.m. and return after 7 p.m. Weekday afternoons are often wasted visits. We plan early evening and Saturday attempts instead, with counsel's approval, and remember that Virginia bars civil service on Sunday under Va. Code § 8.01-289. Our Virginia service plan for evasive parties explains how those visits are logged.
Some Stafford communities have gated entrances or private roads. We do not drive past a closed gate or follow a resident in. The server records the gate, any guard's answer and the time, then tries again when the defendant is likely to come and go. If repeated attempts fail, Va. Code § 8.01-296 offers substituted service and posting, which our Virginia posting rules explainer describes step by step.
- Early evening and Saturday visits for commuters
- No Sunday service under § 8.01-289
- Gated entrances noted, never bypassed
- Each visit logged with time and observations
04Household, lease, claim and witness papers
Stafford Divorce, Custody, Unlawful Detainer and Small Claims
Stafford divorce complaints are filed in the Circuit Court, and custody or support petitions in the J&DR court. Military and commuter schedules can make a doorstep delivery hard, so many spouses sign a sworn acceptance of service or a notarized waiver under Va. Code § 20-99.1:1. We bring the document when counsel prefers that route. The divorce papers service guide for Virginia explains when an answer also counts as acceptance.
Landlords bring unlawful detainer cases in the General District Court at the Judicial Center. Va. Code § 8.01-126 allows a private server to deliver the summons, and service must be made at least 10 days before the return day; the Stafford Sheriff executes any writ. Small claims up to $5,000 are covered on our Virginia small claims service page, and subpoenas for Virginia courts are served across the county.
05Documentation and challenges
Affidavits a Stafford Judge Can Rely On
Every Stafford return follows Va. Code § 8.01-325. It includes the server's affidavit that they are 18 or older and not a party or interested, the date and manner of service, the name of the person served, a printed note that a private server made the service, and the server's name, address and phone number. The clerk receives it within 72 hours. Our Virginia service of papers guide explains each element.
When a defendant says service never happened, the dispute usually turns on facts that only a contemporaneous record can settle: the time of the visit, who answered, whether that person lived there and where a posted copy went. Our log captures each of them. If attempts keep failing, the page on Virginia defendants who dodge papers outlines the options counsel may weigh, including an order of publication on a diligence affidavit, and Delator Group's about page explains why we log this way.
06Virginia service rules
Virginia's Service Statute in a Stafford Context
Va. Code § 8.01-293 allows the sheriff or any person 18 or older who is not a party or otherwise interested in the subject matter to serve process. A private process server is one of those adults who charges a fee, and Virginia law sets up no license or registration for that work. DFS assigns only servers who meet the statute, and each return says so under oath. The Virginia guide on who may serve gives the details.
Officers keep several functions: executing writs of possession or eviction, levying on property, serving capiases and show cause orders, and serving protective orders. Service within 12 months of filing is timely under § 8.01-275.1, and a circuit court defendant generally has 21 days to respond under Rule 3:8(a). If you are unsure whether a paper suits a private server, check with DFS on a Stafford case first.
07Local angle
Quantico Gates and the 95 Express Lanes
The 95 Express Lanes were extended south to US 17 near Fredericksburg in late 2023, so Stafford commuters now have tolled lanes for the entire trip north. That shapes when people are home. We schedule around peak periods and group North Stafford attempts apart from Falmouth and Hartwood attempts. When a defendant works in Northern Virginia, we can coordinate a workplace attempt through Fairfax County process service under the same quote.
Marine Corps Base Quantico is a frequent workplace for Stafford residents. Navy and Marine Corps rules let commanding officers permit service on an installation and designate a meeting place such as the legal office, but entry is the command's decision. We coordinate with counsel and use the base's process where allowed. Defendants who moved toward Richmond go through Hanover County delivery, and those in the Manassas area through Manassas city service.
- Circuit and General District courts: 1300 Courthouse Rd.
- 15th Circuit: eleven localities
- Federal: Alexandria Division, not Richmond
- Base service only through the command's process

Process Servers Near Stafford County
Stafford sits between two regions, so a case can easily reach either one. North of the county, Arlington County process service covers addresses inside the Beltway, and Alexandria service handles the independent city beside it. To the south, Richmond city coverage reaches the capital and its courts, and Chesterfield County service picks up the suburbs below the James. Each of those pages uses one written quote, the same attempt log and the same private-server return, and the Virginia statewide service hub explains how the Commonwealth's rules apply in each locality.
FAQ
Frequently Asked Questions
Is Falmouth part of Fredericksburg?
No. Falmouth is an unincorporated community in Stafford County on the north bank of the Rappahannock, and its papers go to the Stafford courts on Courthouse Road. The City of Fredericksburg, across the river, is an independent city with its own courts and a separate published rate. We confirm the locality before quoting.
What does Stafford process service cost?
The published Routine starting rate for Stafford County is $125. A Stafford Urgent request runs one and a half times Routine, Rush runs double and Same Day Rush runs triple. The price reflects the address, the deadline and the number of people to serve, and we confirm it in writing before the first attempt.
Who can serve Stafford court papers?
The sheriff, or any person 18 or older who is not a party or otherwise interested in the case, under Va. Code § 8.01-293. No state license exists for this work in Virginia. Writs of eviction, levies, capiases and protective orders remain officer work. Our statewide process service overview explains which papers DFS can take.
Can you serve someone stationed at Quantico?
Entry to Quantico is the command's call, not ours. Navy and Marine Corps regulations allow commanding officers to permit service and to designate a place such as the legal office, and a person need not accept out-of-state process there. We coordinate through counsel and the command where it allows service, or attempt at the person's off-base home instead.
My defendant commutes to D.C. When should you try?
Usually early evening on weekdays or Saturday mornings. Many Stafford commuters leave before sunrise and return after dark, and civil service is barred on Sunday under Va. Code § 8.01-289. Tell us any schedule details you have, and we will plan visits accordingly and log each attempt with the exact time.
Who serves the eviction writ in Stafford?
The Stafford Sheriff. Va. Code § 8.01-293(B) keeps writs of possession and eviction with sheriffs and high constables, and § 8.01-470 requires at least 72 hours' notice before execution. Our part ends with delivering the unlawful detainer summons in time for the return day. Our Virginia eviction service guide has more.
Why do Stafford federal cases go to Alexandria?
The Eastern District of Virginia's local rules assign Stafford County to the Alexandria Division, while Spotsylvania and Fredericksburg belong to the Richmond Division. The difference matters for where counsel files and which clerk receives a federal proof of service. We serve federal summonses under the Federal Rules and draft the proof for the right division.
What happens after a summons is posted on the door?
Under Va. Code § 8.01-296, posting is allowed when no qualified family member is available at the usual abode. The party causing service or its attorney or agent then mails a copy and files a certificate of mailing at least 10 days before a default judgment can be entered. We coordinate with counsel so that step is not missed, and our Stafford-area guide to posting lays out the timeline.
Can a Stafford defendant waive formal service?
Yes. Under Va. Code § 8.01-286.1, a plaintiff may request a waiver, and a defendant who returns it on time gets 60 days from the request to respond. A defendant who refuses without good cause can be made to pay later service costs. If the waiver does not come back, we serve the papers in the usual way, often on a rush or same-day basis when time has run short.
Do you serve Stafford companies through the SCC?
No. When a Virginia business has no registered agent who can be found, the Clerk of the State Corporation Commission becomes its agent, and that filing goes through the SCC Clerk's office with a $30 fee per defendant. We serve officers, directors and registered agents in person, as our registered agent service page explains.
