Quick answer
How do I hire a process server in Newton County, Georgia?
Provide the filed documents, all addresses you know and the date that matters. We confirm which servers the Newton County court accepts, quote the tier and price in writing, assign a server and return a signed affidavit for the clerk in Covington. Routine service starts at a published $125, and our statewide service overview explains the process.
01Local service landscape
A Courthouse Square, Five Small Towns and Open Country East of Atlanta
Newton County holds an estimated 126,000 people. Covington, the county seat and largest city, sits on Interstate 20 east of Atlanta. Oxford lies just north of Covington, Porterdale to the southwest, and Mansfield and Newborn in the rural southeast. Social Circle crosses into the county from Walton. Our Georgia statewide process serving covers each town, and Rockdale County service handles neighbors to the west.
West Newton has filled with subdivisions as growth moved out from the Atlanta metro, while the east and south remain farms, woods and homes on long county roads. Many residents commute west along I-20 toward Rockdale, DeKalb and Atlanta, which leaves neighborhoods empty during the day. We review each address before quoting and note when it sits near the Rockdale, Walton, Morgan, Jasper, Butts or Henry line. Published figures for each neighbor appear on the Georgia rate map.

02Attorneys and law firms
Alcovy Circuit Service for Covington and Metro Counsel
Newton County cases come from Covington practitioners, from Atlanta and Conyers firms with east metro clients, and from out-of-state counsel handling commercial, injury, construction and family matters. Employers along the I-20 corridor also generate contract, employment and collection disputes. Our Georgia attorney process serving gives each office one contact for the written quote, the dated attempt log and the signed affidavit.
We review papers before assigning a server. Common issues include a defendant who moved from Covington to Walton County within the same circuit, a company whose registered agent is in Fulton County, and a Social Circle address that may fall on the Walton side of the line. For corporate defendants, our Georgia registered agent service applies O.C.G.A. 9-11-4(e)(1), and cases that move to DeKalb are handled by our DeKalb County process servers.
03Evasive and hard-to-serve
Commuters, Farm Lanes and Doors That Stay Closed
Avoidance in Newton County changes with geography. In the western subdivisions, commuters leave early and come home late, and doorbell cameras let a household decline to answer. In the rural east, a home may sit far down an unmarked lane behind a closed gate. We vary attempt times across mornings, evenings and weekends with counsel's approval and record each visit with observations. Our Georgia service for evasive people explains how the log is kept.
The gated-community provision in O.C.G.A. 9-11-4(f)(4) does not reach a lone farm or house behind its own gate, and our servers wait for permission rather than going through. If a defendant appears to be concealing themselves or cannot be found after due diligence, the attempt log is what counsel uses to support any request to the court, including publication under 9-11-4(f)(1). Our guide to avoided service in Georgia and the publication overview explain the steps.
04Family law, evictions, small claims, subpoenas
Alcovy Circuit Family Papers, Rentals, Claims and Witnesses
Divorce and custody papers in the Alcovy Circuit are generally served under O.C.G.A. 9-11-4, though a cooperative spouse can sign an acknowledgment that replaces formal delivery. Because Walton shares the circuit, one spouse may live in Monroe or Loganville while the case is pending in Covington. A final decree is generally not available until roughly 31 days have passed since service or acknowledgment. Parties can read how divorce papers are served in Georgia.
Rental homes in west Newton keep the magistrate court busy with dispossessories. Since July 1, 2025, O.C.G.A. 44-7-51(a) permits an approved process server to serve the summons alongside the sheriff and constables, but approval is undefined, so we confirm the Newton County court's practice before accepting and never carry out writs. Magistrate claims up to $15,000 follow 15-10-43, and our Georgia small claims delivery handles statements of claim. Witnesses who live outside Newton must be offered the $25 daily fee plus mileage at 45 cents.
- Divorce, custody and support papers
- Dispossessory summonses after the court confirms its practice
- Statements of claim up to $15,000
- Subpoenas with the out-of-county tender
05Documentation and challenges
Affidavits Prepared for the Usher Street Clerk
Georgia generally expects a private server to file an affidavit stating the date, the place and the way the papers were delivered. O.C.G.A. 9-11-4(h) calls for filing within five business days, and if proof is late, the defendant's answer time does not begin until it is filed. We return affidavits promptly so a Covington filing stays on track. Read who Delator Group is to understand the standard behind every record.
Each affidavit is built from notes taken at the attempts: arrival time, road and lane details, who answered and what was said. Where abode service was used, the affidavit says who took the copies and why that resident qualified. For farmhouses and homes off county roads, we add landmarks and access details so a later claim of a wrong address can be answered. Concerns about a challenge can come through the DFS request form, and witness deliveries are handled by our subpoena service for Georgia courts.
06Georgia service rules
Who May Serve Papers in Newton County Under Georgia Law
Under O.C.G.A. 9-11-4(c), the people generally allowed to serve are sheriffs and deputies, court marshals, citizens a court specially appoints, non-party adults a court appoints for a case or as permanent servers, and servers certified under 9-11-4.1. A certified server must file an annual notice of intent with the sheriff of each county and may serve only where that sheriff accepts certified servers. Our Georgia server eligibility guide covers each route.
We never suggest that a DFS server holds a particular Georgia credential. A Newton County job goes to a server the issuing court accepts, and our written acceptance states that. Documents a court reserves for the sheriff are sent to the sheriff, and we explain why. Georgia generally allows service in hand or at the defendant's home, and the answer period is usually 30 days. This summary is general information; your attorney can confirm. The Georgia legal paper service guide adds detail.
07A Newton County angle
Covington's Square on Screen and Timing Service Around It
Covington has a long screen history. Scenes for the first five episodes of The Dukes of Hazzard were filmed there in 1978, In the Heat of the Night used the town from 1988 to 1995, and The Vampire Diaries also filmed in and around Covington, with many scenes shot on the downtown square. Visitors still come to see those locations, and filming or events can close streets near the courthouse. We plan downtown attempts around those days where deadlines allow.
Production companies, location vendors and event organizers sometimes become defendants in contract disputes. Service on a company is generally made through an officer, a managing agent at a Georgia office or the registered agent, and we identify the right person before visiting. When the agent is in Atlanta, our Atlanta process servers can take the papers, and defendants who moved east toward the university town are served by Clarke County process serving.

Process Servers Near Newton County
Newton County sits between the east metro and the farm country beyond it, so cases often cross a line. Lithonia and Stonecrest defendants are served through our Stonecrest process servers, and McDonough and Stockbridge addresses go to Henry County process serving. Papers bound for the university town are handled by our Athens servers, and Conyers falls under the Rockdale team. Whichever county the defendant ends up in, the paperwork stays the same: a written quote, a dated log and a signed affidavit.
FAQ
Frequently Asked Questions
Is private service of process allowed in Newton County?
In most civil cases, yes. Beyond the sheriff, Georgia recognizes court marshals, specially appointed citizens, court-appointed and permanent process servers, and certified process servers in counties whose sheriff accepts them. Which of these a Newton County court will honor can vary, so we ask before we accept the papers and assign a server who fits.
What are the rates for a Newton County serve?
Newton County shares the $125 published Routine starting rate with other metro counties. Urgent costs one and a half times that, Rush costs double and Same Day Rush costs triple. Farm-lane addresses and repeated evening visits are raised with you up front, and the price is confirmed in writing before we start. The Georgia county rate finder lists neighbors.
Is Social Circle in Newton County?
Part of it is. Social Circle extends into Newton County from Walton County, so an address there may fall on either side. We check the location before the first attempt. Both counties are in the Alcovy Circuit, but the clerk and sheriff differ, which can affect filing and any sheriff service by second original.
Where are Newton County federal cases filed?
Federal law, 28 U.S.C. 90, places Newton County in the Atlanta Division of the Northern District of Georgia, together with Rockdale, DeKalb and Fulton. Filings go to the courthouse on Ted Turner Drive in Atlanta. A federal summons is served under Rule 4 rather than the state statute, and our return is written to that standard.
Can an adult relative in a Newton County home accept the papers?
Possibly. The abode provision in O.C.G.A. 9-11-4(e)(7) generally lets copies be left at the defendant's home with a resident who has suitable age and discretion. A relative who is only visiting would not normally qualify. Counsel makes the call on abode service, and our return names or describes the person and the time of delivery.
Will DFS serve a Newton County eviction summons?
We will ask the Newton County magistrate court first. HB 270 added approved process servers to the dispossessory statute in July 2025 but left the term undefined, and in many counties the sheriff still serves these summonses. If the court accepts private service, we can help; carrying out a writ or a lockout is never part of the job. Landlords can read Georgia's eviction service guide.
Do you serve in Porterdale, Mansfield and Newborn?
Yes. Porterdale sits southwest of Covington, while Mansfield and Newborn are small towns in the rural southeast of the county. Homes there may be set back on long drives, and a closed farm gate is not something the gated-community rule lets a server pass. We plan those attempts in daylight and record the location precisely. Our difficult service help in Georgia explains the log.
What turnaround should I expect around Covington?
A Routine order's first attempt usually comes within several days. If that is too slow, Urgent, Rush and Same Day Rush shorten the window at 1.5, 2 and 3 times the Routine rate, and Same Day work is only confirmed after we check server availability. Send the hearing date and we will reply in writing with what is achievable. See expedited and same day service.
Does DFS have a Covington office?
No. DFS is part of Delator Group, which is headquartered in Nashville, Tennessee and has no office in Georgia. For Newton County papers we use servers who satisfy the issuing court's requirements, and you still get the same written price, the same time-stamped attempt record and the same signed affidavit that every DFS serve includes.
What helps a Newton County serve succeed?
The filed papers, the defendant's full name, any home and work addresses, directions for rural property, a photo or physical description, vehicle information and your deadline. Subpoena requests should include the witness fee and mileage payment. Papers issued by another state's court follow our service process for out-of-state papers and its return format.
