01Local service landscape

Where Forrest County Serves Happen

Forrest County is compact, about 470 square miles, with an estimated 79,000 residents in 2025. Nearly everyone lives in or around Hattiesburg and Petal, the county's two municipalities, while Glendale, Rawls Springs and the Forrest side of Eastabuchie fill in the north. Part of the De Soto National Forest reaches into the county, so some southern addresses sit on long, wooded roads. Each job is priced in writing through our Mississippi process serving desk before a server leaves.

Hattiesburg itself crosses into Lamar County, and the western neighborhoods and new subdivisions often do. A Hattiesburg mailing address therefore does not settle which county's officers and courts apply. We check the parcel before the first visit and note it on the affidavit. If the address may be outdated, a quick address verification is cheaper than a second trip, and the statewide pricing map shows how Forrest compares with its neighbors.

02Attorneys and law firms

Serving for Hattiesburg Counsel and Outside Firms

Hattiesburg is home to the Southern District's Eastern Division courthouse as well as the Forrest County courts, so attorneys here juggle state and federal deadlines in the same week. Firms from Jackson, the Coast or out of state may need a Forrest County witness or defendant served without making the drive. Our services built for Mississippi law firms give one contact for the quote, the attempt log and the affidavit.

The Eastern Division hears cases from twelve counties, including Lamar, Jones, Covington and Wayne, so a single federal case may need service across the Pine Belt. We coordinate those addresses under one written quote and return matching affidavits. When the file needs witness interviews or background research, our Forrest County investigators can take it on under a separate scope, and case strategy consulting is available as well.

03Evasive and hard-to-serve

Defendants Who Avoid the Door in Forrest County

In a city with many apartment complexes and rental homes, the most common problem is a defendant who has moved without telling anyone. Others work nights or travel for work along I-59. Our servers vary the hour and day of each attempt, check unit numbers and mailboxes where visible, and record cars in the driveway so the log reads as a real effort if diligence is ever questioned.

When three or four tries have not produced contact, we stop and recommend a better step rather than repeating the same visit. That might be an evasive defendant locate to find a new home or employer, or a brief workplace observation to confirm a schedule. Neither starts without a separate written quote and the client's approval, and a debt collection locate is available for judgment files.

04Family law, evictions, small claims, subpoenas

Family, Landlord and Subpoena Papers in Forrest County

Chancery papers make up much of the work here: divorce complaints, custody petitions, support and contempt matters. The special summons that used to live in Rule 81(d) moved into M.R.C.P. 4(i) on July 1, 2026, and it commands an appearance on a date the court sets. Mississippi law also now generally presumes joint custody as of mid-2026, a presumption a parent can rebut with strong evidence. Our guide to custody evidence in Mississippi covers what can be documented lawfully.

Residential landlords generally give a three-day written notice for unpaid rent under Miss. Code Ann. § 89-8-13 before filing. Justice court eviction and small claims summonses go to the constable first. Where a private server is permitted, we confirm it with the court before accepting the papers. Subpoenas under M.R.C.P. 45 must be served personally on the witness with a day's fee and mileage. Our walkthrough of Mississippi service explains each step.

  • Divorce and custody complaints
  • Rule 4(i) summonses and contempt petitions
  • Rent demand notices and eviction papers where permitted

05Documentation and challenges

A Paper Trail Built for Contested Service

Every Forrest County affidavit is drafted from the server's notes at the time of each visit, not from memory a week later. It states the documents delivered, the person who received them, the address, the date and the time, and how identity was confirmed. Abode service entries name the spouse or family member above sixteen who accepted, the relationship they gave, and the date of the follow-up mailing that starts the ten-day clock. This is the same Delator documentation approach used on every job.

If opposing counsel moves to set aside service, the questions are predictable: was the right person served, was the house really the defendant's usual abode, and was the mailing sent. Our file answers each one with the log, any photographs and the postal record. The server can testify if needed. Raise any concern about a difficult address through the Delator contact form before the first attempt.

06Mississippi service rules

How Mississippi's Civil Rules Handle Service

Service of a summons in Mississippi is generally governed by M.R.C.P. 4. Rule 4(c)(1) permits any non-party who is at least 18 to serve, Rule 4(c)(2) lets a party ask the sheriff in writing, and Rule 4(c)(3) allows first-class mail with a sworn acknowledgment that must come back within 20 days. A business is generally served through an officer or a managing or general agent, and under Miss. Code Ann. § 79-35-13 the registered agent comes first. More detail sits in our statewide Mississippi overview.

The plaintiff generally has 120 days from filing to finish service under Rule 4(h), and the defendant then has 30 days to answer under Rule 12(a). Where a defendant cannot be found after diligent inquiry, publication once a week for three successive weeks may be available on a sworn showing. These summaries reflect the rules as of 2026 and are not advice; counsel should confirm the right method. Our guide to hiring help where Mississippi issues no license explains how to vet a server.

07A Forrest County angle

Camp Shelby and Serving Military Households

Camp Shelby sits at the southern edge of Hattiesburg along US 49, spanning parts of Forrest and Perry counties. It is a Mississippi National Guard post and a state-owned training site covering roughly 129,730 acres, according to published descriptions. Guard members, contractors and families live throughout the county, and some defendants spend weeks at a time in training or deployed.

Two points matter. A private server cannot simply walk onto a military installation, so we plan service at an off-post residence or coordinate with counsel on access. And the federal Servicemembers Civil Relief Act can affect default judgments against service members, so attorneys usually confirm military status before asking for one. We note any military connection in the log, and counsel can review our Mississippi litigation support for status checks. Files reaching south go to Harrison County process serving, and Pine Belt files to service across Jones County.
