Eviction and Unlawful Detainer Service in Virginia

Virginia lets a private process server deliver the unlawful detainer summons that starts an eviction case, as long as it reaches the tenant at least 10 days before the return day. Delator Field Services serves that summons and documents every attempt. Executing the writ of eviction after judgment belongs only to the sheriff or high constable.

Quick answer

Can a private process server serve eviction papers in Virginia?

Yes, for the summons. Va. Code 8.01-126 lets an unlawful detainer summons be served under the general service statutes, which include private process servers, and it must be served at least 10 days before the return day. Only a sheriff or high constable may execute the writ of eviction. See the guide to serving a Virginia eviction for each stage.

01The rule that decides the work

Virginia Lets a Private Server Deliver the Unlawful Detainer Summons

A Virginia eviction case begins when the landlord gives a sworn statement and a magistrate, or a clerk or judge of the general district court, issues a summons for unlawful detainer. Va. Code 8.01-126 then says the summons may be served as provided in Va. Code 8.01-293, 8.01-296 or 8.01-299. Section 8.01-293 includes any adult who is not a party or interested in the case, which is how a private server fits in. Our overview of Virginia process servers explains that statute for every kind of paper.

That makes Virginia different from neighbors where only a sheriff or constable may touch eviction papers. Landlords and their counsel can choose the sheriff, whose civil process fee under Va. Code 17.1-272 is $12 per person served, or a private server when scheduling, attempt timing or a detailed record matters more. Delator Field Services serves the summons, logs every visit and completes the private server return so the clerk has proof on file well before the hearing, at the published rate for the locality shown on the Virginia process server rate finder.

Serving eviction papers in Virginia still has firm limits. The summons and any related witness subpoenas are papers we can deliver. Executing the writ of eviction, giving the officer's notice before execution and removing anyone from a property are not, and no private server may do them. Our page on business and registered agent service covers the commercial tenants whose summons goes to an agent instead of a residence.

02Timing

The 10-Day Rule and the Residential Hearing Clock

Va. Code 8.01-126 requires the unlawful detainer summons to be served at least 10 days before its return day. A summons served on day nine is a problem for the landlord, not a technicality, because the hearing may have to be reset and the clock started again. We read the return day the moment the papers arrive, count back, and choose a tier that leaves room for more than one attempt before the deadline. The rush and same-day service page explains the faster options when the window is already short.

For residential tenancies under the Virginia Residential Landlord and Tenant Act, the statute sets the initial hearing as soon as practicable but not more than 21 days from filing, and no later than 30 days if that cannot be done. That compresses the time available for service. A summons issued with a return day 21 days out leaves roughly 11 days to complete service, and Sunday attempts are generally barred by Va. Code 8.01-289, so the usable window is shorter than it looks. Our step-by-step Virginia eviction guide shows the sequence from filing to hearing.

Courts also run their own calendars. In Virginia Beach, for example, civil first returns on warrants and motions for judgment are heard on set weekday mornings in a designated civil courtroom, according to that court's page. We do not assume one court's schedule applies to another; we read the return day and time on each summons. The Virginia Beach process server page covers the Nimmo Parkway courthouse where those returns are heard.

03When the tenant is not at the door

Family-Member Service, Posting and the Mailing Step

Some tenants are hard to find at home once a case is filed. Va. Code 8.01-296 sets the order: personal delivery first, then a family member 16 or older at the usual place of abode who is not a temporary guest and is told what the papers are, and then posting at the front door or main entrance. Our servers try each step in that order and record why each earlier step failed. The Virginia posted service guide walks through the same sequence for other civil papers.

Posting does not finish the job by itself if the landlord wants a default judgment. The party causing service, or its attorney or agent, must mail a copy to the tenant at least 10 days before default may be entered and file a certificate of that mailing with the clerk. In general district court, mailing the affidavit for summons in unlawful detainer generally satisfies that requirement. We tell counsel the date and time of posting immediately so the mailing can go out the same day.

Before any default, the landlord must also file the affidavit about military service that the Servicemembers Civil Relief Act requires, stating whether the tenant is in military service or that it cannot be determined. Counsel or the landlord prepares that affidavit; we do not. What we can supply is the attempt log, which may note uniforms, base stickers or work schedules that help counsel answer the question accurately. Read what to do when someone avoids service for other options.

04After the hearing

The Writ of Eviction Belongs to the Sheriff or High Constable

Once a landlord obtains judgment for possession, the case moves out of a private server's hands. Va. Code 8.01-293 says only a sheriff or high constable may execute an order or writ of possession, including a writ of eviction from an unlawful detainer case. Delator Field Services does not execute writs, does not change locks and does not remove tenants or property. We say so in writing at intake so no landlord pays us for work the law reserves to an officer, and the statewide Virginia service overview lists the other acts reserved to sheriffs.

Va. Code 8.01-470 describes how the officer proceeds. The officer serves a notice of intent to execute at least 72 hours beforehand, either in person or by posting at the main entrance, with a copy of the writ and a statement of the tenant's rights. The sheriff should execute the writ within 15 calendar days of receiving it and in no event later than 30 days after it issues, and the order of possession generally remains valid for 180 days. The sheriff's fee for a writ of eviction under Va. Code 17.1-272 is $25.

If a tenant files an appeal or the case is reopened, new papers may need service, and those return to us. A subpoena for a property manager, a summons on a new party or a warrant in debt for rent owed after the tenant leaves are all ordinary civil process. The Norfolk process server page and the Richmond process server page describe the general district courts where many of those follow-on papers are filed.

05Business tenants and guarantors

Commercial Leases, LLC Tenants and Personal Guarantors

Commercial unlawful detainers follow the same summons statute, but the tenant is usually a company. Va. Code 8.01-299 generally allows service on a Virginia corporation through an officer, director or registered agent, and on a Virginia LLC through its registered agent. A store manager or receptionist is not on that list, so we confirm the entity's registered agent and registered office before the first attempt. Foreign entities are handled under Va. Code 8.01-301, and the registered agent serves in Virginia page explains both routes.

If the registered agent cannot be found at the registered office with reasonable diligence, Virginia law makes the Clerk of the State Corporation Commission the agent, and that filing is made through the Clerk's office in Richmond rather than by a field server. The fee is $30 per defendant under Va. Code 12.1-19.1. Our attempt log at the registered office gives counsel the facts needed to show that diligence before taking that route. For entity tenants in the capital region, the Henrico County process server page covers the Parham Road courts.

Personal guarantors are often named alongside the business. Va. Code 16.1-77 says the general district court's dollar limits do not apply to unlawful detainer claims for rent or damages against a person obligated on the lease or a guarantee, so a guarantor's summons can sit in the same case. Each guarantor is served as an individual at a home or workplace, priced by the locality where service happens on the Virginia rate map.

07Where landlord work concentrates

Hampton Roads, Richmond, Northern Virginia and College Towns

Hampton Roads is home to Naval Station Norfolk, Joint Base Langley-Eustis and Joint Expeditionary Base Little Creek-Fort Story, and some tenants there live or work on an installation. Base access is controlled by each command, so when such a tenant has moved onto an installation we tell counsel and look for an off-base address or the method the command allows. Water crossings shape routing, and the Chesapeake process server page describes how attempts are planned around them.

The City of Richmond's general district court handles civil matters in two buildings: the John Marshall Courts Building on North 9th Street and the Manchester courts building on Hull Street, south of the James River. We read the courthouse on each summons, because the return goes back to the court that issued it. In Northern Virginia, controlled-access apartment towers in Arlington, Alexandria and Fairfax County slow service on residential tenants, and the Alexandria process server page covers the King Street courthouse.

College towns produce a steady flow of student-lease disputes. Blacksburg's papers are returned to the Montgomery County courts in Christiansburg, Harrisonburg's go to Court Square, and Charlottesville's city courts sit apart from the Albemarle County courthouse on Park Street. Each locality has its own published rate, and the Blacksburg process server page explains the Christiansburg return. Student tenants may leave town between semesters, so a summons issued in May may need a home address elsewhere, sometimes out of state.

FAQ

Frequently asked questions

Does Delator Field Services serve eviction papers in Virginia?

Yes for the summons: Va. Code 8.01-126 lets a private server deliver the unlawful detainer summons, and we also handle hearing subpoenas and related warrants in debt. We do not execute writs of eviction, deliver the officer's notice before execution or remove anyone from a property. Those acts belong to the sheriff or high constable under Va. Code 8.01-293.

How many days before the hearing must the summons be served?

At least 10 days before the return day stated on the summons, under Va. Code 8.01-126. Because residential hearings are generally set within 21 days of filing, the window is short. Send the summons as soon as it issues, and consider faster service tiers if the return day is already close.

Can the summons be posted on the tenant's door?

Generally yes, after personal delivery and delivery to a qualifying family member have failed. Va. Code 8.01-296 allows posting at the front or main door. The landlord or counsel must then mail a copy at least 10 days before default and file a certificate of mailing; in general district court, mailing the affidavit for summons generally satisfies it. See how posting works in Virginia.

Who serves the notice before the sheriff executes the writ?

The officer does. Va. Code 8.01-470 requires the officer executing the writ to serve a notice of intent at least 72 hours beforehand, in person or by posting, with a copy of the writ. A private server does not deliver that notice, and Delator Field Services does not offer it.

What does it cost to serve an unlawful detainer summons?

Our published Routine starting rate depends on the locality: $125 in Virginia Beach, Norfolk, the City of Richmond and Fairfax County, and up to $255 in Highland County. Urgent, Rush and Same Day Rush are 1.5, 2 and 3 times Routine. You approve the final figure in writing before we start. Check any locality on the Virginia county and city price finder.

How is a business tenant served?

Through an officer, director or registered agent for a Virginia corporation, or the registered agent for a Virginia LLC, under Va. Code 8.01-299. Foreign entities fall under 8.01-301. If the agent cannot be found at the registered office with reasonable diligence, service may go through the Clerk of the State Corporation Commission. Read about serving Virginia companies.

Can you serve a tenant on a Sunday?

No. Va. Code 8.01-289 generally bars service of civil process on Sunday. We schedule attempts on weekday mornings, weekday evenings and Saturdays instead, and we count those lost days when planning around the 10-day rule. A summons that arrives on a Friday with a tight return day may need Rush or Same Day Rush on Saturday.

What if the tenant lives on a military base?

Installation access is controlled by the command, and a command may designate a place for service, such as the legal office. We tell counsel early and look for an off-base address or a method the command allows. Before any default, counsel must also file the military service affidavit the Servicemembers Civil Relief Act requires. Our hard-to-serve defendants page covers related situations.

What will the return show?

Under Va. Code 8.01-325, the private server return shows the server's affidavit of qualifications, the date and manner of service, the name of the person served, a notation that a private server made service, and the server's name, address and telephone number. It generally goes to the clerk within 72 hours of service, and counsel receives a copy with the attempt log.

Can you serve a former tenant who moved out of state?

Often, yes. A separate damages case may need service on a former tenant now living elsewhere, and Va. Code 8.01-320 generally allows out-of-state service by any adult who is not a party or interested in the case. Delator Field Services coordinates service in several states under one written quote.
