Quick answer
How do I hire a process server in Madison County?
Send the filed papers, every address you know and the deadline. We confirm with the Madison clerk at 101 West Main Street how the summons issued, quote the tier and price in writing, and log each attempt. Routine starts at a published $130, and our Richmond process service page covers the county seat in more depth.
01Local service landscape
Two Cities on I-75 and a Lot of Country Between
Madison County has about 102,000 residents and just two incorporated cities, Richmond and Berea, both strung along I-75 south of Lexington. Richmond is the county seat and the larger city, home to Eastern Kentucky University, while Berea, home to Berea College, sits farther south where the Bluegrass gives way to foothills. Much of the county outside those cities is farmland and winding roads. The Richmond city service page covers in-town addresses in more depth.
I-75 is the spine of the county, and nearly every trip between Richmond, Berea and the rural edges starts from one of its exits. Our servers group attempts by exit and by direction from town so that a farm address near the Garrard line and an apartment near campus do not compete for the same window. For the southern city, see Berea process serving, and the statewide DFS page explains coverage in the counties farther south.
- Richmond and the EKU neighborhoods
- Berea and the southern I-75 exits
- Farm roads toward Clark and Garrard
- Foothill roads toward Estill, Jackson and Rockcastle
02Attorneys and law firms
A Shared Circuit and a Lexington Federal Clerk
Madison shares the 25th Judicial Circuit with Clark County, but Madison cases are filed with the Circuit Court Clerk at the courthouse on West Main Street in Richmond, and family cases are heard at a separate building on North First Street. Counsel need to know which building issued the papers, and we read the caption before the first attempt. The DFS service program for attorneys explains the intake fields that keep a Madison file moving.
Federal law still lists Richmond as a place where the Eastern District may hold court, but the court lists no clerk's office there, so federal filings from Madison go through the Lexington clerk on Barr Street. Firms from Lexington, Louisville and other states send us Madison papers regularly. When the case is pending outside Kentucky, we match the delivery and affidavit to the issuing court's rule, as our out-of-state papers page describes.
03Evasive and hard-to-serve
Semester Moves, Campus Rules and Rural Driveways
Two college towns mean a large student and renter population, and leases often turn over between semesters. A defendant who lived near campus in the spring may be gone by August. University and college campuses also set their own access rules, which were not researched for this page, so we do not assume a server can enter campus buildings. We focus on residential addresses, check timing with counsel and log every attempt.
In the rural south and east, homes sit far apart and long driveways make a repeat visit obvious. When a defendant clearly avoids service, the attempt log carries dates, times and observations rather than impressions. Kentucky allows a warning order under CR 4.05 when someone hides so that a summons cannot be served or leaves the county to avoid it. Our guidance for avoided service in Kentucky and service for difficult defendants explain that record.
- Semester lease turnover in Richmond and Berea
- Campus access set by each institution
- Long rural driveways and farm lanes
- Varied attempt times, each logged
04Family, landlord, claim and witness papers
Family Court on First Street, Rentals and Subpoenas
Madison Family Court papers are served the same ways as other Kentucky civil summonses: personal delivery, the clerk's certified mail, or a respondent's waiver of service and entry of appearance. Where minor children are involved, a 60-day period counted from service generally runs before proof on the merits, so prompt delivery matters. The Kentucky divorce service page explains each choice, and our small claims notes for Kentucky cover the $2,500 docket.
Whether Richmond or Berea has adopted Kentucky's landlord and tenant act could not be confirmed from a current list, so notice periods should come from counsel. Outside adopting areas, KRS 383.195 generally calls for one month's written notice to end a tenancy at will. Once a forcible detainer is filed, the notice is directed to the sheriff or a constable by KRS 383.210, which keeps DFS out of that step. We serve separate rent or damage suits and Kentucky subpoena papers.
05Documentation and challenges
A Return Built for a Madison County Hearing
Kentucky's CR 4.03 wants proof of service filed promptly and within the time the defendant has to respond, which is generally 20 days after service under CR 12.01. When a person other than a mail carrier makes delivery, the endorsed return is the proof under CR 4.01(1)(b). We return a signed proof quickly, and the Urgent and Rush options are available in writing when a hearing is set soon.
Service challenges in Madison County usually focus on identity, particularly at rental addresses with several occupants. Kentucky allows no household substitute for a summons, so our servers record a description of the person served, any refusal and how the papers were offered. The guide to serving papers in Kentucky explains the methods, and Delator Group's background explains the firm's documentation approach.
06Kentucky service rules
Plain-Language Kentucky Service Rules
When a Madison complaint is filed, CR 4.01 has the clerk issue the summons and, as the plaintiff directs, mail it by certified or registered mail, transfer it to a person other than a mail carrier who is authorized to deliver it, or return it to the plaintiff to arrange service. A summons may issue for service in any Kentucky county. The sheriff receives process by default under KRS 454.140, and our Kentucky who-can-serve guide explains each route.
Kentucky has never set up a license for private servers, and DFS does not claim any license, appointment or court listing anywhere in the state. For each Madison file, we confirm with the clerk or court how the summons will issue and whether private delivery or a special appointment under KRS 454.145 is needed before accepting it. If only an officer may serve, the papers go to the Sheriff. You can get in touch with DFS about a Richmond case before filing.
07Local angle
Where the Bluegrass Meets the Foothills
Madison County sits at a transition. North of Richmond, the land is rolling Bluegrass farm country close to Lexington; south of Berea, the roads climb toward the foothills and counties with much higher published tiers, such as Jackson at $190 and Rockcastle at $175. A Madison case with a co-defendant across one of those lines can change the price, so we show each county's tier in writing before any attempt is made.
Madison residents also commute north to Lexington for work and east toward Winchester, and a growing number of households have members in more than one county. When a co-defendant lives across a line, we coordinate service under one written quote through Fayette County service or Winchester process serving, and the Kentucky county price map shows the published tier for each neighboring county.

- Family Court: 119 N. 1st St., Richmond
- 25th Circuit: Madison and Clark
- Federal clerk: Lexington, 101 Barr St.

FAQ
Frequently Asked Questions
Where are Madison County cases filed?
Most civil cases are filed with the Circuit Court Clerk at the Madison County Courthouse, 101 West Main Street in Richmond. Family Court sits separately at 119 North First Street. No court location in Berea is listed, so Berea residents use the Richmond buildings. Our Kentucky DFS hub explains how county courts work statewide.
How much does a Richmond process server cost?
Routine service in Madison County has a published starting rate of $130. Pick a faster tier and the base scales up: half again for Urgent, twice for Rush, three times for Same Day Rush. Your price depends on the address, distance into the rural county, the number of people and the deadline, and we confirm it in writing before any attempt.
Can you serve someone on a college campus?
Campus access is set by each institution, and those rules were not researched for this page, so we do not promise entry to campus buildings. We usually serve students and employees at residential addresses or at public locations where counsel confirms service is appropriate, and every attempt is logged with the time and place.
Do you serve eviction notices in Richmond or Berea?
No. KRS 383.210 directs the forcible detainer warrant to the sheriff or a constable, and the AOC-215 eviction notice is addressed to them. Restitution warrants after judgment are theirs as well. We can serve related civil suits and hearing subpoenas, and our Kentucky eviction steps guide explains the order of papers.
Can a summons be left with a roommate in Richmond?
No. Kentucky's CR 4.04(2) requires delivery to the individual personally, offering the papers if the individual refuses, or delivery to an agent authorized by appointment or law. Roommates, partners and other occupants do not qualify, which is why our servers confirm identity carefully at shared rental addresses near both campuses.
What if the defendant moved away after the semester?
If the defendant is still in Kentucky, a new summons can issue for service in any county under CR 4.01(2). If they left the state, CR 4.04(8) allows certified mail or personal delivery by any person over 18. If no address is known, counsel may consider a warning order attorney under CR 4.05.
How long does a Madison defendant have to answer?
Generally 20 days after service of the summons under CR 12.01, and the summons itself states that period. CR 4.03 expects proof of service within the same window, so we return the signed proof promptly. When a hearing is approaching, counsel can choose a faster tier in writing before we begin.
Where do federal papers from Madison County go?
Madison is in the Eastern District of Kentucky's Lexington jury division. Richmond appears in the statute as a place of holding court, but the court lists no clerk's office there, so filings go through the Lexington clerk at 101 Barr Street. We serve federal summonses under the federal rules and prepare the proof for that court.
How are Madison County businesses served?
Usually through the registered agent named with the Secretary of State under KRS 14A.4-040, or through an officer, managing agent or the chief agent in the county under CR 4.04(5). Out-of-state companies authorized to do business here are served through their agent. Our Kentucky agent and entity service page explains each option.
Do witnesses from Clark or Estill County get mileage?
Yes. KRS 421.015 allows mileage at the state-employee rate to a witness who lives outside the county where they are subpoenaed, and counsel handles the payment. CR 45.03 lets anyone over eighteen serve the subpoena by delivering or offering a copy. Our subpoena service in Kentucky page explains the proof.
