Quick answer

How do I hire a process server in Owensboro?

Email the filed papers and the Daviess County address. We confirm how the summons issued and whether the clerk accepts private delivery, then send the tier and price in writing. Routine Daviess County service has a published starting rate of $155. Our Daviess County service page covers Whitesville and the rural communities outside the city.

01Local service landscape

An Ohio River City Where Two Highways Meet

Owensboro is the Daviess County seat and counted about 60,000 residents in the 2020 census. Daviess has only two incorporated cities, Owensboro and Whitesville, so most addresses outside the city sit in unincorporated farm communities. All civil cases from those places run through the circuit clerk at the Holbrook Judicial Center on East Second Street. Our Daviess County countywide page and the Henderson process server page cover the river counties to the west.

I-165, which replaced the Natcher Parkway in 2019, runs about 70 miles from I-65 at Bowling Green and ends at US 60 and US 231 in Owensboro. US 60 continues along the river corridor, so a server can work an east-side subdivision and a farmhouse near Utica on one planned route. Daviess County is on Central Time, an hour behind Louisville, and we log every attempt in local time. The Kentucky rate map by county shows how Daviess compares with its neighbors.

  • US 60 and US 231 through the city

02Attorneys and law firms

Service for Owensboro Firms and Lawyers Filing From Other Cities

Owensboro is one of four Western District of Kentucky courthouse cities, with federal court on Frederica Street serving an eleven-county division. Local firms send us collection suits, contract claims, injury complaints and deposition subpoenas, and lawyers in Louisville, Nashville and Evansville regularly need a Daviess County resident served. Our attorney service program for Kentucky keeps the quote, attempt notes and return together under one point of contact.

We check every set of papers before scheduling. A Daviess Circuit Court summons follows CR 4, a federal summons from the Owensboro division follows Federal Rule 4 and the joint local rules, and a subpoena from another state must be reissued by the Daviess circuit clerk before it can be served here. If the defendant turns out to live in McLean or Hancock County, we tell you before the first visit, and Madisonville process service handles the Hopkins County side.

03Evasive and hard-to-serve

Farm Lanes, Shift Schedules and Defendants Who Will Not Answer

Daviess County is largely agricultural outside the city limits, and many addresses are on long county roads with no house number visible from the pavement. We confirm the location before the trip, note landmarks in the log and never cross a closed gate without permission. In town, the challenge is more often a defendant on a rotating work schedule who is asleep during the day. Our explanation of serving evasive defendants in Kentucky shows how we plan around both.

When someone deliberately avoids the door, we vary the pattern: early mornings, evenings and weekends, with Sunday attempts allowed under KRS 454.135. Each visit is logged with the time and what was seen. If personal delivery still fails, counsel can review the options in the Kentucky guide on avoiding service, and urgent deadlines can move to same day process serving in Kentucky at a published multiple of Routine.

04Family law, landlords and subpoenas

Family Court, Tenancy Disputes, Small Claims and Witnesses

Daviess County dissolution and custody cases are filed in the circuit court, whose Family Court is listed at the Holbrook Judicial Center. A respondent may sign a waiver of service and entry of appearance or be served under the regular Civil Rules. In cases with minor children, KRS 403.044 has generally been read to delay testimony until 60 days after service, so counsel tracks the service date closely. The Kentucky divorce service page lays out the routes.

Eviction notices are outside our work. KRS 383.210 directs the forcible detainer warrant to the sheriff or a constable, who gives at least three days' notice of the trial, and we never carry out a warrant of restitution. Whether Owensboro has adopted URLTA could not be confirmed, so landlords should ask counsel which notice period applies before we deliver a pre-suit notice. Small claims usually go out by certified mail or the sheriff, as the small claims page for Kentucky explains, and witness subpoena service covers trial witnesses.

  • Daviess Family Court papers
  • Pre-suit notices only, never the AOC-215 notice
  • Small claims of $2,500 or less, where allowed
  • Subpoenas with mileage noted

05Documentation

What Goes Into an Owensboro Return

Each Kentucky delivery route has its own proof. Certified mail from the clerk is proved by the return receipt, a summons handed to a private server is proved by that person's endorsed return, and a court appointee's return must be verified by affidavit. Our Owensboro proof lists the date, the Central Time hour, the address and the manner of delivery, and it is meant to be filed promptly under CR 4.03. The Kentucky step-by-step service guide explains the filing step.

The return is backed by notes on every attempt, including failures: the time, what the server saw at the property and who answered. If a defendant claims they were never served, counsel has a record to point to. Outside Tennessee, a serve may be completed by a vetted server under contract with Delator, held to the identical written documentation standard. The statewide Kentucky process serving overview describes that structure.

06Kentucky rules

Kentucky Service Law Applied to a Daviess County Case

When a Daviess complaint is filed, CR 4.01 has the clerk issue a summons and then follow the plaintiff's direction: certified mail restricted to the addressee, transfer to an authorized person who is not a mail carrier, or return to the plaintiff to arrange service. KRS 454.140 points process to the sheriff unless a party asks otherwise, and KRS 454.145 lets a court appoint a person for one paper. Kentucky has no private server license, as the Kentucky who-may-serve guide explains, and Kentucky papers for Indiana defendants follow CR 4.04(8).

We confirm with counsel and the Daviess clerk how the summons will issue and whether private delivery is accepted before taking any Owensboro job, and papers that only an officer may serve go to the sheriff. CR 4.04(2) requires personal delivery, an offer on refusal, or delivery to an authorized agent, with no household option. The answer is generally due 20 days after service. These are summaries, not legal advice. Read more about Delator Group.

Papers From Indiana and Other States, Served in Owensboro

Indiana lies across the Ohio River from Daviess County, and courts there regularly issue papers for people who live or work in Owensboro. Kentucky has no statute that regulates how another state's summons is served inside Kentucky, so the issuing court's rule governs. Tell us which rule your court uses for service outside its state, and we match the Kentucky delivery and the affidavit to it. A process server in Owensboro should read that rule before the first attempt, and we do.

Subpoenas work differently. Under KRS 421.360, a party submits the foreign subpoena to the circuit clerk in the county where discovery is sought, here the Daviess clerk, who issues a Kentucky subpoena that is then served under CR 45.03. Motions to quash go to the Daviess Circuit Court. Our foreign subpoena and out-of-state papers page covers the details, and papers for Bowling Green process service down I-165 follow the same process.

FAQ

Frequently Asked Questions

Who can deliver a summons in Owensboro?

It depends on how the Daviess clerk issues it. CR 4.01 lets the clerk mail it, transfer it to an authorized person other than a mail carrier, or return it to the plaintiff to arrange service, and KRS 454.140 directs process to the sheriff by default. Subpoenas may be served by any person over 18 under CR 45.03. We confirm the route before accepting the job.

How much does a process server in Owensboro cost?

Daviess County's published Routine starting rate is $155, which puts Urgent at $233, Rush at $310 and Same Day Rush at $465. The final price depends on the address, the paper and the deadline, and we send it to you in writing before a server is assigned. Rural addresses are quoted up front rather than adjusted afterward.

Can papers be left with a family member in Owensboro?

A Kentucky summons cannot. CR 4.04(2) requires delivery to the defendant personally, an offer if the person refuses, or delivery to an agent authorized by appointment or by law. Only an officer serving a forcible detainer notice may leave it with a family member over 16 under KRS 454.030. Our return identifies the person who actually received the papers.

Do you serve forcible detainer papers in Daviess County?

No. The forcible detainer warrant and the AOC-215 eviction notice are directed to the sheriff or any constable, and so is the warrant of restitution after judgment. We can deliver a landlord's pre-suit written notice and serve papers in a separate civil suit for rent or damages. The eviction service guide for Kentucky landlords explains the sequence.

Can you serve Indiana court papers in Owensboro?

Yes. Kentucky has no statute governing how another state's summons is served here, so the Indiana court's own rule for out-of-state service controls. Tell us that rule and we match the delivery and affidavit to it. Indiana subpoenas usually need to be reissued by the Daviess circuit clerk under KRS 421.360 first, then served under Kentucky's subpoena delivery rules.

How long does an Owensboro defendant have to answer?

Generally 20 days after service, under CR 12.01, with the summons stating that deadline as CR 4.02 requires. The AOC-105 civil summons counts the 20 days from the day after delivery. A defendant summoned by warning order is deemed summoned on the 30th day after the order is entered. Your attorney should calculate the exact date.

What if an Owensboro defendant is hiding?

We report each attempt and keep the log. When a defendant has left the county to avoid service or is concealing themselves, CR 4.05 lets the clerk issue a warning order on an affidavit, and the clerk appoints a warning order attorney who writes to the defendant and reports within 50 days. Our guide to warning order attorneys explains the process.

Is a witness protected from other lawsuits while in Owensboro for a subpoena?

KRS 421.180 says a person who is not a resident of the county, and is there only because a subpoena required it, cannot be served with a summons in another suit while traveling to, attending or returning from that appearance. We keep that rule in mind when a witness and a defendant are the same person, and counsel decides how to proceed.

Can a company be served at its Owensboro office?

Usually through the registered agent under KRS 14A.4-040, or an officer, managing agent or the chief agent in the county where the action is brought under CR 4.04(5). If the agent cannot be found with reasonable diligence, certified mail to the principal office is available. The business service page for Kentucky explains how we confirm the recipient.

Do you serve federal papers in Owensboro?

Yes. The Western District of Kentucky holds court at 423 Frederica St. in Owensboro, and its division covers Daviess and ten other counties. Federal summonses follow Federal Rule 4 and the joint local rules, and we return proof suited to the federal file. Get in touch with Delator Field Services with the case number and deadline.
