Quick answer

Is insurance claim surveillance legal in Idaho?

Yes, when the investigator documents only what a claimant does in public view, from public places, without trespass, pretext or recording private conversations. Idaho's insurance fraud statute treats false or misleading claim information as a felony, so neutral evidence matters to both sides. Our Idaho insurance investigations team gathers it at $100 per hour.

01Idaho law

Idaho's Insurance Fraud Statute and Why Neutral Evidence Matters

Insurance fraud in Idaho is defined chiefly by Idaho Code § 41-293. It covers presenting false, incomplete or misleading material information in support of a claim, helping prepare such a claim, using runners and offering inducements to file a false claim. A violation is a felony carrying up to 15 years and up to $15,000, restitution is mandatory and each instance may be charged separately. The Idaho Department of Insurance Fraud Investigation Unit investigates referrals and takes tips at 1-866-939-7226.

Most suspect claims are not criminal cases, though. They are exaggerations, misunderstandings or recoveries that went unreported, and the carrier's real question is what the claimant can actually do. Insurance claim surveillance answers that question with facts rather than suspicion, and it protects honest claimants as often as it exposes dishonest ones. Our Idaho claims investigators work with adjusters and special investigation units, and our defense counsel support prepares evidence for litigation.

02Claim types

Auto, Premises, Disability and Property Claims in Idaho

Auto liability claims are a common source of surveillance requests in Idaho, from rear-end collisions in Treasure Valley traffic on I-84 to rural crashes on two-lane highways. Idaho's comparative negligence statute, § 6-801, bars recovery when the claimant's negligence is as great as the defendant's and otherwise reduces damages in proportion to the claimant's share, so the extent of injury and the claimant's own conduct both matter. When the other driver fled, our hit-and-run investigators work to identify them.

Premises claims, such as slips at a store or falls on an icy walkway, turn on the same questions of injury and activity. Long-term disability claims ask whether the claimant can work at all, which makes evidence of a second job or regular physical activity central. Property claims raise different issues: a reported vehicle theft may involve a car that was sold, hidden or given to a relative. Our stolen vehicle investigators handle those, and our stolen property recovery team traces equipment and other insured items.

03The work

What Idaho Claim Surveillance Captures

We document activity, not medical conclusions. Investigators record what the claimant does in public view: lifting, carrying, driving, working, exercising and recreating, with video, times and locations. The report compares observed activity with the injuries and limits the claim describes, using the information the client provides. Coverage starts with records research that confirms the claimant's address, vehicles and likely routine, which keeps field hours focused. Our Idaho field surveillance team conducts every shift.

Witnesses often add context surveillance alone cannot. Neighbors, former coworkers and people at the scene may know how the claimant lived before and after the incident, and their accounts can be tested against the video. Our witness background research locates and profiles them lawfully. We never interview a represented claimant or contact a claimant's physician, and the client decides whether any witness is approached.

Golf in Sun Valley, Boats on the Lakes and Fall Hunting Trips

Idaho's outdoor life gives claimants plenty of chances to show their real capacity. Golf courses around Sun Valley and Ketchum, boat launches on Lake Coeur d'Alene and Lake Pend Oreille, river fishing and fall hunting trips into the backcountry all involve lifting, twisting, walking on uneven ground or long hours behind the wheel. A claimant who reports that sitting for an hour is unbearable and then drives to the Sawtooths for a weekend raises an obvious question. Our Coeur d'Alene claim investigators cover the Panhandle lakes on Pacific Time.

Resort and backcountry coverage takes planning. Lodges, marinas and trailheads have limited vantage points and crowded parking in season, and long drives to the Wood River Valley or the mountains are quoted separately. We document only what is visible from public areas, such as a course's parking lot, a public launch or a trailhead, and never follow onto private land. When the trip ends at a hotel, our resort hotel surveillance methods apply.

06Timing

Limitation Periods, Service Deadlines and When to Run Surveillance

Idaho's civil deadlines shape when claims become suits. Personal injury and wrongful death claims generally carry a two-year limitation period under Idaho Code § 5-219(4), fraud claims generally three years from discovery under § 5-218, and written contract disputes, including some coverage disputes, five years under § 5-216. Once a suit is filed, I.R.C.P. 4(b)(2) generally requires service within 182 days, and Delator Field Services handles that through our Idaho legal process service.

Surveillance is most useful at a few points: soon after the claim, when the claimant's routine is set; before a deposition, when the claimant will describe their limits under oath; around an independent medical exam; and before mediation or trial. A claimant who has moved can be found first through our Idaho skip tracing service. Our guide to serving legal papers in Idaho explains service options for counsel.

What Insurance Claim Surveillance Costs in Idaho

Claim surveillance is billed at $100 per hour, with mileage to rural and resort areas disclosed before the first shift. Most files begin with records research and two or three targeted shifts timed to the claimant's routine or an upcoming deposition or exam. That focus keeps cost in proportion to the reserve. Every rate appears on our Idaho investigations pricing page.

Related work is priced separately: a basic remote skip trace is $102, a deep-dive background check is $300 and a field asset investigation starts at $1,000, which our Idaho asset investigators use when collectability or subrogation is at issue. The scope, hours and total are confirmed in writing, and added shifts require approval. To open a file, send us the claim details or call (629) 310-8667.

FAQ

Frequently asked questions

Is insurance fraud a felony in Idaho?

It can be. Idaho Code § 41-293 makes presenting false, incomplete or misleading material information in support of a claim a felony carrying up to 15 years and up to $15,000, with mandatory restitution. Whether to charge anyone is a decision for prosecutors, often after a referral to the Department of Insurance Fraud Investigation Unit.

Can you put a claimant under surveillance before suit is filed?

Yes. Surveillance is often most useful early, when a claimant's routine is established and before activity changes in anticipation of litigation. We document only what is visible from public places. Counsel or the adjuster decides how the evidence is used during negotiation, and our Idaho claim investigation services explain the options.

How does Idaho's comparative negligence rule affect claim surveillance?

Under Idaho Code § 6-801, a claimant whose negligence is as great as the defendant's cannot recover, and damages are otherwise reduced by the claimant's share. Surveillance does not usually address fault directly, but it does bear on the extent of injury and damages, which matter under any allocation of fault.

Do you use social media to investigate claimants?

We preserve public posts that show activity, with dates and context. We do not create false profiles, send friend requests or message claimants under a pretext. Public social media is a useful lead, and field surveillance then confirms what the posts suggest with time-stamped video and an investigator who can testify.

Can you document a claimant golfing or skiing?

Yes, from public areas. Golf courses, ski areas, marinas and trailheads have parking lots and public spaces where activity may be visible. We plan vantage points in advance and never follow onto private property. Travel to resort areas such as Sun Valley is quoted separately because of the distance from Boise.

What if the claimant lives in a rural area?

Rural surveillance takes more planning. Long roads, few vantage points and neighbors who notice strangers make coverage harder, and posted or fenced land is never entered. We study maps and routines first and sometimes recommend fewer, well-timed shifts. Mileage is quoted in writing before the first trip, and our Idaho Falls claim surveillance team handles many eastern Idaho farm-country files.

What happens when the claimant has moved?

Usually. A remote locate runs $102, while one that requires field work starts at $1,000. Once the claimant is found, we can document activity at the new address, including in another state, at the same hourly rate with travel quoted first. Our multi-state claimant surveillance explains how that is coordinated, and our claimant locate service handles the search.

Will your investigators testify?

Yes. Our investigators can testify about what they personally observed and how the video was recorded, at deposition, mediation, arbitration or trial. Reports are written with that in mind: clear times, places and descriptions, and an honest note of any gap. Admissibility and weight are for the court, and our attorney support team can help counsel prepare.

Is Delator licensed for claim surveillance in Idaho?

Idaho issues no private investigator license at the state level. Some cities, including Chubbuck and Coeur d'Alene, regulate investigators or detective agents locally, so requirements there should be confirmed. Delator Group is a licensed Tennessee private investigation firm and applies that standard to its Idaho claim work, including insurance, written scope and neutral reporting.

What does insurance claim surveillance cost in Idaho?

The hourly rate is $100, and mileage or travel is quoted before work starts. Most files start with records research and two or three targeted shifts. Locates start at $102 and asset investigations at $1,000. The scope, hours and total are confirmed in writing. See our Idaho rate schedule for every figure.
