Serving Papers in Murray and Across Calloway County

Murray had 17,307 residents in the 2020 census and is the seat and only city of Calloway County, home to about 39,400 people. Every Calloway Circuit and District Court case runs through the Judicial Building at 312 North Fourth Street, so papers served on a farm near the state line and in a campus-area duplex return to the same clerk. Murray was incorporated in 1844. Our Kentucky process serving rate map shows how Calloway compares with its neighbors.

US 641, which runs through town as 12th Street, is the main road in and out, linking north to Interstate 69 and south into Tennessee. Kentucky Route 94 runs east and west as Main Street, and Route 121 follows Fourth Street, while Route 80 passes just north of the city. Land Between the Lakes lies to the east. Defendants in the northern part of the county often work toward Benton or Paducah, and McCracken County service covers the latter.

Calloway County runs on Central Time. We schedule every attempt and log every entry in local time, so the return lines up with class schedules, shift calendars or other records counsel may compare later. Trigg and Graves counties next door each have their own circuit clerk, and Graves and Trigg County pricing is quoted separately when a defendant lives across the county line.

02Attorneys and law firms

Process Service for Calloway County Litigators

Murray firms, Paducah practices and Tennessee counsel with Kentucky defendants all use one intake. Send the filed summons and complaint, any return showing non-service, a description of the defendant and your calendar, and we reply with a written quote stating the court, tier and price. No attempt is made before you approve it. Our page on process service for Kentucky counsel lists what helps a first visit succeed.

Under CR 12.01, a defendant generally has 20 days after service of the summons to answer, and CR 4.02 requires the summons to state that window. CR 4.03 asks for proof to be filed promptly and within the same period. When a hearing is near, Kentucky rush and same-day service compresses the schedule, and Christian County process serving handles related defendants to the east. Your attorney can confirm how those deadlines fit the case.

03Hard-to-serve recipients

When a Murray Defendant Keeps Moving

College towns move. Leases turn over at the end of a semester, roommates change, and a defendant who lived near campus in spring may have left for the summer. We ask for the most recent lease, unit number, any forwarding address and a description before quoting, then vary attempts across mornings, evenings and weekends. KRS 454.135 gives defendants no exemption from civil service on a Sunday or holiday. Serving hard-to-reach Kentucky defendants explains how each visit is logged.

If a defendant has been absent from Kentucky for four months, has left the county to avoid service or is concealing themselves, CR 4.05 allows the clerk to issue a warning order on an affidavit from the plaintiff or counsel. A warning order attorney named by the clerk writes to the defendant and reports within 50 days, and the defendant is treated as summoned on the 30th day after entry. Warning order attorneys, explained covers the steps, and your attorney decides whether they fit.

04Family law, evictions, small claims, subpoenas

Family, Eviction, Small Claims and Subpoena Papers in Murray

Calloway County dissolution and custody cases are filed in Circuit Court. A respondent who will not sign a waiver of service and entry of appearance must be handed the petition personally, or have it offered on refusal. If the other spouse now lives across the Tennessee line, CR 4.04(8) may allow delivery there. How Kentucky divorce service works covers waiver, mail and personal delivery.

Murray has a large rental market, but forcible detainer warrants go to the sheriff or a constable under KRS 383.210, and the current AOC-215 notice is addressed to them. We stay out of that notice and any warrant of restitution. Outside areas that adopted URLTA, KRS 383.195 generally ends a tenancy at will on one month's written notice; counsel should confirm which rules apply. Kentucky rental dispute papers explains what we can deliver.

Small claims papers ($2,500 or less) normally go through the clerk's certified mail or the sheriff, and we help only when the court allows. Any person over 18 may serve a subpoena under CR 45.03, and Calloway County witness subpoenas come back with an endorsed affidavit and a note about KRS 421.015 mileage for out-of-county witnesses. Calloway County small claims papers explains when a private person may help.

05Documentation

Returns Built for the Calloway County Clerk

When CR 4.01(1)(b) applies and the clerk transfers the summons to an authorized person, the proof is that person's endorsed return. A person appointed under KRS 454.145 has to verify the return with an affidavit. We note on every return the date, time, place and manner of delivery, a description of the person served, and any refusal and offer. Serving papers in Kentucky from start to finish shows a complete file.

When service is disputed, the return is usually the first thing challenged. In multi-unit student housing, that means recording the building, unit, who answered, how the person identified themselves and the words exchanged. Failed attempts are documented the same way, because they may support a later warning order affidavit. Papers issued in Tennessee or another state are matched to that court's rule, which service of papers from other states explains.

06Kentucky service rules

Kentucky Law on Who May Serve in Murray

Under CR 4.01, the clerk issues the summons and, as the plaintiff directs, sends it by certified mail, transfers it to a person other than a mail carrier who is authorized to deliver it, or returns it to the filing party to arrange service. Under KRS 454.140 process is directed to the sheriff, and KRS 454.145 lets a court appoint an individual for a given paper on good cause. Kentucky has no private process server license, as Kentucky's server rules in plain English explains.

Delator Field Services holds no Kentucky license, certification or appointment, because the state does not issue them. For each Murray job, we confirm with the Calloway County clerk or court how the summons will issue and whether private delivery or a special appointment is needed before we accept the papers. If only an officer may serve a paper, we say so, and that paper goes to the sheriff.

CR 4.04(2) generally permits only personal delivery, an offer on refusal, or delivery to an agent authorized by appointment or law. There is no household substitute, so a summons is never left with a roommate, even one who offers to take it and promises to pass it along. Companies are served through an officer, a managing agent or the entity's Kentucky registered agent.

A University Town a Short Drive From Tennessee

Murray State University was founded in 1922 as Murray Normal School and now enrolls more than 10,000 students, which shapes much of the city's housing and daily rhythm. We do not assume any campus service policy; when a defendant lives or works on university property, we discuss the approach with counsel before any attempt. A process server in Murray also watches the academic calendar, since breaks and graduations can empty a neighborhood quickly. Hopkinsville process service handles defendants who have moved toward the Pennyrile.

Calloway County borders Henry and Stewart counties in Tennessee, so cross-border papers are common. A Kentucky summons for someone living in Tennessee can generally be delivered there by any person over 18 under CR 4.04(8), with an affidavit stating that the server personally knew the person served. Tennessee papers served in Murray follow the issuing court's rule. Delator Group is a Tennessee firm headquartered in Nashville, so Tennessee practice is familiar ground. Our Kentucky statewide page explains coverage for the rest of the state.

FAQ

Frequently Asked Questions

Who can serve process in Murray?

Under CR 4.01, the Calloway County clerk can send the summons by certified mail, transfer it to a person authorized to deliver it, or return it to the filing party to arrange service. Under KRS 454.140 the sheriff serves process, and a court may appoint someone for an individual paper under KRS 454.145. Kentucky issues no license to private servers, so we check the clerk's practice first.

How much does it cost to serve papers in Murray?

Routine service in Calloway County has a published starting rate of $195. The Urgent tier starts at $293, Rush at $390 and Same Day Rush at $585. The exact price depends on the address, the documents and your timing, and it is put in writing before the first attempt. The multi-state process serve pricing map compares other counties and states.

Where is the return filed after a Murray serve?

Returns in Calloway Circuit and District Court cases are filed with the Calloway County Circuit Court Clerk at the Judicial Building, 312 North Fourth Street. CR 4.03 expects proof to be filed promptly, inside the window the defendant has to answer. Federal cases from Calloway County are in the Western District's Paducah division at 501 Broadway.

Can you serve a student near Murray State?

Yes, at an off-campus home, apartment or workplace, using the same personal delivery rules as anyone else. We have not assumed any campus service policy, so when a defendant lives or works on university property, we discuss the approach with counsel first. Semester breaks matter, so tell us about any move-out date you know of.

Can you serve a Kentucky summons on someone in Tennessee?

Generally yes. CR 4.04(8) lets anyone over 18 deliver the papers personally beyond Kentucky's borders, other than to minors, people of unsound mind or prisoners. The affidavit has to state when and where delivery happened and that the server personally knew the person. Without an appearance, that kind of service will not support a personal judgment, a point for counsel to weigh.

Can papers be left with a roommate in Murray?

Not for a summons. Under CR 4.04(2) a summons generally goes to the individual in person, is offered if they refuse, or goes to an agent authorized by appointment or law; roommates do not qualify. Only officers serving eviction notices may use the family-member option in KRS 454.030, and those notices are not ours to serve.

Can you serve an eviction notice in Murray?

No. The sheriff or a constable receives the forcible detainer warrant under KRS 383.210, and the AOC-215 notice is addressed to them. The notice and any restitution warrant stay with officers; we handle neither. For Murray landlords, we can deliver a written pre-suit notice where the lease allows and serve a separate rent suit, as the guide to Kentucky eviction papers explains.

Do you serve small claims papers in Calloway County?

Calloway District Court small claims papers generally go out by the clerk's certified mail or through the sheriff, and the state handbook does not mention private servers. If mail does not reach the defendant, learn from the clerk which methods the court permits before you engage us. Small claims papers in Kentucky explains our limited role, and Marshall County and other nearby rates are on the county map.

What if the defendant left Murray after graduation?

Send any new address you have. If it is in another Kentucky county, we quote that county separately, and if it is out of state, CR 4.04(8) may allow delivery there. If no address is known and the defendant is absent or concealed, counsel may consider a warning order, as when someone avoids Kentucky service describes.

Do you serve subpoenas for Calloway County hearings?

Yes. Subpoenas may be served statewide by any person over 18 under CR 45.03, by delivering a copy to the witness or offering one. A witness traveling from another county is allowed state-employee mileage under KRS 421.015. Other parties generally must receive notice before a non-trial subpoena is served, so counsel should take care of that first.
