Quick answer
How do I hire a process server in Chesterfield County?
Send the filed papers, any home or work address you know and the date your case depends on. We confirm the address is truly in Chesterfield, since many county homes use Richmond mail, quote the tier in writing and log each visit. Routine service starts at a published $125; city addresses go through Richmond process service.
01Local service landscape
A Fast-Growing County With No Towns and Many Richmond Addresses
Chesterfield counted 364,084 residents in 2020 and an estimated 397,148 in 2025 (secondary figures), one of the larger jumps in the Richmond region. It has no incorporated towns, so every county address files in the same courts. The complication is the mail. Large parts of Midlothian and the northern county use Richmond ZIP codes, and a caption that reads Richmond may describe a Chesterfield home. Our Virginia locality rate map keeps the city and county separate.
South of the courthouse complex, the county changes character. Chester and Enon mix older neighborhoods with industrial land along the James and Appomattox rivers, and the southwest around Matoaca and Winterpock still has wooded lots and long rural roads. The independent cities of Colonial Heights, Petersburg and Hopewell sit just beyond the southern and eastern edges. We map each address before we quote, and Richmond-side defendants go to Henrico County service when they live north of the city.
- Midlothian and Bon Air subdivisions with Richmond mail
- Chester and the Route 1 corridor
- Rural roads in the southwest county
- Neighboring independent cities on the south and east
02Attorneys and law firms
For Firms Filing on Courthouse Road and at 701 East Broad
Chesterfield lawyers file in a single courthouse complex on Courthouse Road, and many also appear in the Richmond Division of the federal court downtown. Federal practice there moves quickly, and a late or flawed proof can cost a scheduling slot. We assign one coordinator per file, report after every attempt and draft returns to the caption. Our litigation support for Virginia firms page explains the intake checklist.
Firms outside Virginia often reach Chesterfield defendants who work for regional employers along the I-95 and Route 288 corridors or commute into Richmond. When the case belongs to another state, we serve under that court's rule and match its affidavit format, as described on our page for out-of-state filings. When the defendant lives in the city itself, we coordinate through our Richmond city page under one quote.
03Evasive and hard-to-serve
Cul-de-Sacs, Lake Communities and Defendants Who Know the Knock
Planned communities around Swift Creek Reservoir and the western county are built on winding streets and cul-de-sacs, where an unfamiliar car is noticed quickly. Some defendants stop answering the door once they suspect a lawsuit. We vary arrival times, park where it is lawful and visible, and write down every exchange with whoever does answer. Our approach to evasive defendants in Virginia explains how those notes support counsel later.
When nobody will accept the papers, Virginia provides a sequence under Va. Code § 8.01-296: a family member 16 or older who lives at the usual abode and is not a guest, then posting at the front door or main entrance. Counsel or the filing party then mails a copy and files a certificate of mailing at least 10 days before a default. Our explainer on posting service in Virginia details each step, and Delator Group's company profile describes the documentation habits behind it.
- Arrival times varied across mornings, evenings and Saturdays
- HOA gates and lake community entrances noted
- Family member identity and age recorded
- Posting only at the main entrance
04Family law, tenancy, debt and witnesses
Chesterfield Divorce, Custody, Unlawful Detainer and Witness Papers
Divorce complaints for Chesterfield residents are filed in the Circuit Court, while custody and support petitions go to the county's J&DR court. A spouse may accept service by signing a sworn proof of service before an officer authorized to administer oaths, or by a notarized waiver under Va. Code § 20-99.1:1. We bring that form when counsel prefers it, and the Virginia guide to serving divorce papers covers both routes.
Chesterfield's General District Court handles unlawful detainer cases, warrants in debt up to $50,000 and small claims up to $5,000. A private server may deliver the unlawful detainer summons, which must be served at least 10 days before the return day under Va. Code § 8.01-126; the Sheriff executes any writ. Our Virginia landlord-tenant papers page and witness subpoena delivery cover the rest.
05Documentation and challenges
A Return the Chesterfield Clerk Can File Without Questions
Under Va. Code § 8.01-325, a return by anyone other than a sheriff needs the server's affidavit of qualifications, the date and manner of service, the name of the person served, an annotation that a private server made the service, and the server's name, address and phone number. It is due at the clerk within 72 hours of service. Our plain-language Virginia service guide walks through each item.
Challenges in Chesterfield often focus on the household. Was the teenager who took the papers 16 or older, and does that person actually live there? Was the posted copy on the door the family really uses? Our log records the person's stated age and relationship, the door used and the time. If a defendant keeps evading, our page on what happens when Virginia defendants avoid service outlines the court options counsel may weigh.
06Virginia service rules
The Virginia Framework for a Chesterfield Serve
Va. Code § 8.01-293 permits a sheriff or any person 18 or older who is not a party or otherwise interested in the subject matter to serve process, and it defines a private process server as such a person who charges a fee. No license or registration is required by statute. Every server DFS assigns meets that test and swears to it on the return. Our Virginia rules on eligible servers explain the statute.
Certain acts stay with law enforcement: executing writs of possession or eviction, levying on property, serving capiases and show cause orders, and serving protective orders. Sunday service of civil papers is barred by Va. Code § 8.01-289, and service within 12 months of filing is timely under § 8.01-275.1. If a paper's status is unclear, talk with DFS about a Chesterfield case before it goes out.
07Local angle
Route 288, the Parkways and the Appomattox Edge
Chesterfield's road network loops around itself. Route 288 arcs across the western county, I-95 and I-295 run along the east, and the Chippenham and Powhite parkways funnel traffic toward the James River bridges into Richmond. A Midlothian attempt and a Chester attempt can be close on a map and far apart at rush hour. We group stops by corridor, and co-defendants north of the river go to Hanover County coverage when they live past Henrico.
Ettrick, home to Virginia State University, sits on the Appomattox River across from Petersburg, and students and staff there may move often between semesters. Rental turnover near campus means addresses go stale quickly, so we confirm current occupancy with counsel before the first attempt. Defendants who move toward the Peninsula fall under Williamsburg service, and those heading west may land in Albemarle County deliveries.
- Circuit and General District courts: 9500 Courthouse Rd.
- 12th Circuit: Chesterfield and Colonial Heights
- Federal: Richmond Division, 701 E. Broad St.
- Petersburg, Hopewell and Colonial Heights are separate cities

FAQ
Frequently Asked Questions
My defendant's address says Richmond. Is it Chesterfield?
It may be. Much of northern Chesterfield, including parts of Midlothian and Bon Air, uses Richmond mailing ZIP codes, but the City of Richmond is a separate locality with its own courts and sheriff. We confirm the actual locality before quoting so the papers and the return match the court that issued them.
What is the price to serve papers in Chesterfield?
The published Routine starting rate in Chesterfield County is $125. Chesterfield Urgent work is figured at 1.5 times Routine, Rush at twice and Same Day Rush at three times. The final number depends on the address, the deadline and the number of people served, and we confirm it in writing before the first attempt.
Can someone other than the Sheriff serve papers in Chesterfield?
Yes. Va. Code § 8.01-293 allows any person 18 or older who is not a party or otherwise interested in the case to serve most process. Officers keep writs of eviction, levies, capiases and protective orders. Our Virginia service of process overview explains which papers fit a private server and which stay with deputies.
Can papers be handed to a teenager at the house?
Only if the teenager is a family member at least 16 years old who lives at the defendant's usual place of abode and is not a temporary guest, and the server explains what the papers are. We record the person's stated age and relationship. If no one qualifies, posting at the main entrance is the next option.
How long does a Chesterfield defendant have to respond?
In circuit court, generally 21 days after service of the summons and complaint under Rule 3:8(a) of the Rules of the Supreme Court of Virginia. The summons states that deadline. In general district court, the return date on the warrant controls. We return proof promptly so counsel can count from a firm service date.
Do you serve the writ of eviction in Chesterfield?
No. Under Va. Code § 8.01-293(B), only a sheriff or high constable may execute a writ of possession or eviction, and the officer gives at least 72 hours' notice first. We serve the unlawful detainer summons only. Our Virginia eviction service guide lays out who handles each stage of a Chesterfield rental case.
How do you serve a business that has no registered agent?
If a Virginia corporation or LLC fails to keep a registered agent, or the agent cannot be found at the registered office with reasonable diligence, the Clerk of the State Corporation Commission becomes its agent. That filing goes through the SCC Clerk's office with a $30 fee per defendant, not through a field server. See our registered agent page.
Can you serve a defendant at a Chesterfield workplace?
Yes, where the employer allows a visitor to reach the person or the defendant comes to a public area. We do not enter restricted areas or argue with security. Each exchange is logged, and if the workplace will not work, we return to home attempts at different hours, as our hard-to-serve defendant service page describes.
Are subpoenas from Virginia attorneys served the same way?
Virginia State Bar members may issue certain civil subpoenas under Va. Code § 8.01-407, and a court may decline to enforce one served less than five calendar days before the appearance date. We serve attorney-issued and clerk-issued subpoenas alike, and we ask for them early so the timing does not become an issue; see Chesterfield subpoena handling.
What if the defendant moved to Colonial Heights or Petersburg?
Both are independent cities with their own sheriffs and, for Petersburg, its own circuit court. A Virginia summons can still be served there, and we coordinate the attempt under the same written quote and return format. Colonial Heights shares the 12th Circuit with Chesterfield, so some of those cases stay on Courthouse Road.
