Quick answer

How do I hire a process server in Chesapeake?

Email the filed papers, the defendant's address and the return or answer date. We confirm the address sits inside the City of Chesapeake rather than Suffolk or Virginia Beach, identify the issuing court and send the price in writing. Chesapeake's Routine tier starts at $125, and the Virginia rate map by locality shows nearby figures.

01Local service landscape

Six Boroughs Spread Across About 338 Square Miles

Chesapeake was created in 1963 when the independent city of South Norfolk consolidated with Norfolk County after voters in both approved it. The city now counts six boroughs: South Norfolk, Butts Road, Deep Creek, Pleasant Grove, Western Branch and Washington. It is reported to be Virginia's second-largest city by both population and land area, with roughly 338 square miles of land. That size shapes every route we plan, and the Chesapeake-to-Portsmouth corridor often shares a single trip.

Interstate 264 begins at the Bower's Hill interchange with I-64 and I-664, which makes the city a crossroads for the whole region. Northern Chesapeake looks like any busy suburb, with Greenbrier shopping centers, Great Bridge subdivisions and apartment complexes. South of that, homes thin out toward the Great Dismal Swamp and the state line. We tell you up front when an address is remote enough to affect timing, and the Hampton Roads defendants guide explains how repeated visits are documented.

02Attorneys and law firms

A Single-City Circuit That Keeps Filings Simple

Some Virginia circuits stretch across several counties, but the 1st Judicial Circuit holds only the City of Chesapeake. Every circuit filing, every general district court warrant and every return ends up at the same Albemarle Drive address, which reduces mistakes about where proof belongs. Law firms in Chesapeake, Norfolk and Virginia Beach send us collection matters, contract suits, injury complaints and witness subpoenas. Our attorney service program for Virginia keeps the quote and the return with one contact, and service across the Norfolk line runs the same way.

Firms outside Virginia often reach us after suing a Chesapeake resident in another state's court. In that case the issuing state's service rules govern, and we follow the method counsel specifies while documenting each attempt. For a foreign subpoena that needs Virginia enforcement, the paper is first domesticated through the clerk of the circuit court where discovery will happen. Counsel can read how out-of-state papers are handled in Virginia and then send the clerk-issued subpoena for delivery.

03Evasive and hard-to-serve

Long Driveways, Gated Subdivisions and Night-Shift Schedules

A defendant in a Great Bridge cul-de-sac and one at the end of a half-mile farm lane in Pleasant Grove need very different plans. In newer subdivisions, the obstacle is often a gate, an HOA guard or a resident who watches the doorbell camera and never opens up. On rural parcels, it can be several structures on one lot and no clear front door. Each visit is logged with the hour, what we saw and who answered, building the record described in our service for evasive Virginia defendants.

Hampton Roads also runs on shifts, and plenty of Chesapeake residents commute across the region's tunnels and bridges for work. We ask counsel for any known hours and spread visits across early mornings, evenings and Saturdays. Virginia does not allow civil process to be served on Sunday under Va. Code 8.01-289, so a six-day pattern is the most a server can offer, and Chesapeake-adjacent Virginia Beach follows the same rule. When those efforts fail, the log supports counsel's next decision, whether that is substituted service or a request to the court.

04Family law, landlords and subpoenas

Family Cases, Unlawful Detainer, Small Claims and Subpoenas

In Chesapeake, a divorce complaint is filed with the circuit court clerk, while custody, visitation and support start in the Juvenile and Domestic Relations District Court. Virginia lets a spouse accept service in writing under Va. Code 20-99.1:1, and many attorneys request that first. When the other side will not sign, we arrange a discreet personal delivery and state on the return exactly who received the papers. The divorce service options in Virginia page sets those choices side by side.

For landlords, the general district court issues an unlawful detainer summons that a private server may deliver under Va. Code 8.01-126, at least 10 days before the return day. The writ of eviction that follows a judgment is executed only by the sheriff, and we do not post or deliver the sheriff's notice. Small claims cases up to $5,000 and subpoenas for witnesses are also common; see Virginia small claims papers and subpoena work across Virginia for details.

  • Divorce in circuit court; custody in J&DR
  • Written acceptance of service where counsel prefers it
  • Unlawful detainer summons only; no writs
  • Small claims and witness subpoenas

05Documentation

The Record a Chesapeake Return Leaves Behind

A sheriff's return and a private server's return are not the same document in Virginia. Under Va. Code 8.01-325, a private server must add an affidavit showing the person is qualified, state the date and manner of service and the name of the party served, mark the return as made by a private server, and list a name, address and telephone number. The return is due at the clerk's office within 72 hours unless the court directs otherwise. Our Virginia legal papers walkthrough puts that step in sequence.

Behind the return sits the attempt log: every Chesapeake address visited, the time, the vehicle or lights observed, and any conversation at the door. That log is what counsel relies on if a defendant moves to quash service or claims the papers went to the wrong house. Serves outside Tennessee may be carried out by vetted servers Delator contracts with, and they all document to the same written standard. The rush and same day service page covers what changes when the deadline is short, and the Virginia eviction papers service page shows how landlord files are documented.

06Virginia rules

Virginia's Service Rules as They Apply in Chesapeake

Va. Code 8.01-293 lets the sheriff or any adult 18 or older who is neither a party nor interested in the outcome serve process, and it defines a private process server as such an adult who charges a fee. There is no statewide license to hold. The same statute reserves certain acts to officers, among them writs of possession, levies and capias or show cause orders, and we decline those. The who may serve process in Virginia guide explains each exception.

For an individual, Va. Code 8.01-296 starts with personal delivery. If the defendant is away from the usual place of abode, a family member 16 or older who lives there, not a visitor, may receive a copy along with an explanation. If no one qualifies, the copy may be posted at the main entrance, and the filing side must then mail a copy and file a certificate of mailing at least 10 days before a default judgment. We handle the posting and coordinate the mailing with counsel, as our posted service explainer describes. Counsel handling a tenant file can read the unlawful detainer service guide as well.

07Chesapeake angle

When the Defendant Lives Just Across the North Carolina Line

Chesapeake shares a border with North Carolina, and the Dismal Swamp Canal runs south toward that state alongside U.S. 17. Defendants sometimes move a few miles across the line and assume Virginia papers can no longer reach them. Va. Code 8.01-320 allows a nonresident to be served outside Virginia by anyone authorized where the person is found, or by any adult 18 or older who is not a party or interested. Whether that service carries the weight of personal service depends on long-arm jurisdiction, a question for counsel.

We also see the reverse: papers from a North Carolina court for a defendant who now lives in Western Branch or Deep Creek. In that situation the issuing state's rules govern the method, and we follow counsel's instructions and record each attempt. A process server in Chesapeake who works both directions keeps the paperwork straight across the line, and you can confirm current pricing on the multistate process serving rate map before sending a cross-border file. Our overview of Delator Group explains the Nashville firm behind the work.

Process Servers Near Chesapeake

Chesapeake shares borders with several Hampton Roads cities, so files often cross a line. Papers going north into downtown or the Navy neighborhoods go through service in Norfolk, and those east toward the resort strip use our Virginia Beach process servers. Westbound defendants past Bower's Hill fall under Suffolk serves, and Peninsula addresses reached over the Monitor-Merrimac crossing go to Newport News service. Each of those jobs runs on the same written quote, dated log and Virginia-form return, so a multi-city case file stays consistent from one clerk to the next.

FAQ

Frequently Asked Questions

Who can serve legal papers in Chesapeake?

Under Va. Code 8.01-293, the sheriff or any adult 18 or older who is not a party and has no interest in the case may serve process. A private process server is that kind of adult working for a fee. Virginia has no statewide license, but every return a private server files must include an affidavit of qualifications.

What does a process server in Chesapeake charge?

The published Routine starting rate for the City of Chesapeake is $125, with Urgent at $188, Rush at $250 and Same Day Rush at $375. The real price depends on the papers, the address and the deadline, and we confirm it in writing before a server is assigned. The Virginia process serving hub shows how tiers work.

Is my address in Chesapeake or Virginia Beach?

It matters, because each independent city has its own courts and its own published rate. A mailing city on an envelope is not always the legal locality. Send us the full street address and we confirm the locality before quoting, which also tells counsel which clerk will receive the return.

Can a family member accept papers for the defendant?

Under Va. Code 8.01-296, a family member age 16 or older who lives at the defendant's usual place of abode may receive a copy when the defendant is not found there, as long as they are not a temporary guest and are told what the papers are. Roommates who are not family do not qualify under that subsection.

Can you serve an eviction in Chesapeake?

We serve the unlawful detainer summons. Va. Code 8.01-126 permits private delivery of that summons, provided it reaches the tenant 10 or more days ahead of the return day. We do not execute the writ of eviction or give the sheriff's 72-hour notice; only the sheriff handles that. Our Virginia landlord papers page covers the timeline.

What if the defendant moved to North Carolina?

Va. Code 8.01-320 allows a nonresident to be served outside Virginia by a person authorized there or by any adult 18 or older who is not a party or interested. Whether that service counts as personal service depends on long-arm jurisdiction, so counsel should confirm it. We can coordinate the out-of-state delivery and document it.

Do you serve papers on Sundays in Chesapeake?

No. Va. Code 8.01-289 prohibits serving civil process on Sunday except in narrow cases, such as persons escaping custody. We schedule early-morning, evening and Saturday attempts instead, so the attempt log still shows effort spread across the week. That pattern usually matters more to a judge reviewing diligence than the number of visits alone.

How fast must the return be filed?

Va. Code 8.01-325 requires a private server to return the process to the clerk within 72 hours of service unless the court directs otherwise. A deadline that lands on a weekend or legal holiday moves to the next business day. Our returns are prepared within that window for the Chesapeake clerk, and same day service in Virginia keeps that timing on short deadlines.

Can you serve a business with a Chesapeake address?

Yes. A Virginia corporation may be served through an officer, director or registered agent under Va. Code 8.01-299, and an LLC through its registered agent. If the registered agent cannot be found at the registered office with reasonable diligence, the Clerk of the State Corporation Commission may become the agent, and that filing runs through the Clerk's office. Read about serving Virginia registered agents.

No. Delator Group is a Tennessee firm headquartered in Nashville and has no Virginia office. Delator Field Services coordinates Chesapeake serves through vetted servers who follow our documentation standard. Reach Delator Field Services with the papers and deadline, and we reply with a written quote before any visit. Questions about other localities go to the same contact.
