Quick answer

What does a misdemeanor defense investigator do in Idaho?

A misdemeanor defense investigation finds and documents the facts defense counsel needs for a magistrate division case: locating and interviewing witnesses, preserving private video, obtaining public records, photographing the scene and testing the timeline in the police report. Delator handles this within its broader Idaho criminal defense investigation practice, working only at counsel's direction.

01The stakes

Why an Idaho Misdemeanor Deserves Real Investigation

Under Idaho Code 18-113, a misdemeanor without its own penalty is generally punishable by up to six months in county jail, a fine of up to $1,000, or both. Some misdemeanors carry more: second-degree stalking under 18-7906 allows up to a year in jail. A conviction can also affect professional licenses, immigration status, housing applications and future charges, because several Idaho statutes escalate a repeat offense into a felony. Counsel weighing those collateral risks can compare our approach on Idaho felony defense files.

Escalation is the reason a small file needs careful facts. A second or later violation of Idaho Code 18-6710, the harassing electronic communications statute, is generally a felony. Repeat impaired driving charges, repeat stalking and certain theft aggregations work the same way. If the first conviction rests on an unexamined account, it can shape the next case for years. A focused misdemeanor defense investigation costs far less than litigating that history later. Our Idaho investigation team scopes the work to what the charge actually requires.

02The court

How Misdemeanor Cases Move Through the Magistrate Division

In Idaho, misdemeanors are heard in the magistrate division of the district court in each county. A case might be an Ada County file at the courthouse on West Front Street in Boise, a Canyon County file in Caldwell or a Bannock County file in Pocatello. Pretrial conferences come quickly, and Idaho Code 19-3501 generally requires a misdemeanor to be tried within six months of the not-guilty plea unless good cause is shown or the right is waived. Our investigators assigned to Caldwell and western Canyon County plan their work around those dates.

Outcomes in the magistrate division are often negotiated, and facts drive negotiation. A witness statement that contradicts the officer, a video clip showing who started a confrontation or a receipt proving the client paid can change what the prosecutor offers. Idaho Code 19-2601 also lets a court withhold judgment and place a defendant on probation, which counsel may pursue with good mitigation material. We gather that material too, through character and background research on the client's work and community ties where counsel asks.

03Common charges

Theft, Stalking, Trespass and Electronic Harassment

Petit theft is any theft that does not meet Idaho Code 18-2407's grand theft tests, which include property worth more than $1,000. Valuation and identification are where these cases are usually contested, so we review loss-prevention and employee theft records, register logs and video frame by frame. Second-degree stalking under 18-7906 requires a course of repeated nonconsensual contact, and the statute now reaches surveillance by electronic means. Our page on stalking investigations in Idaho describes how we reconstruct contact histories from both sides.

Criminal trespass under Idaho Code 18-7008, amended in 2026, turns on whether the person knew or had reason to know they were not welcome. Posted signs, fluorescent paint at corners and access points, fencing and a prior order to leave can all supply that knowledge, and a first offense may be an infraction in some circumstances. We photograph boundaries, signs and paint and map access routes. Electronic harassment cases under 18-6710 depend on full message threads, which we help counsel assemble alongside cyberbullying and online conduct research.

  • Second-degree stalking: course of conduct
  • Criminal trespass: notice and boundaries
  • Electronic harassment: complete message history

04Field work

Witnesses and Video in a Small-Case Timeline

Misdemeanor files rarely get the follow-up a felony receives, so the police report may name only one or two witnesses. We canvass the location, identify employees, neighbors and bystanders who were present, and interview the ones counsel approves. In college towns such as Moscow and the BYU-Idaho community in Rexburg, witnesses may leave at the end of a semester, so early contact matters. Each interview is written up in a dated memo with the questions asked and the answers given.

Private video is often the single most valuable piece of evidence and the first to disappear. Store, bar, apartment and doorbell systems commonly overwrite footage within days or weeks. We list every camera that may have captured the incident, note its owner and retention practice where known, and give counsel the details for preservation letters. Where a phone recording exists, our summary of Idaho's recording law explains why a participant can generally record a conversation under Idaho Code 18-6702, while recording others secretly can be a felony.

05Records

Public Records Requests as an Out-of-State Firm

Dispatch logs, incident reports, 911 audio and some body-worn camera footage may be obtainable through public records requests, though criminal discovery from the prosecutor remains the main channel and counsel decides which route to use. Idaho Code 74-103, as amended in 2025, gives nonresident requesters a 21-day response window, extendable to 35 days, compared with three working days for residents. Delator is a nonresident requester, so when time is short counsel may prefer to file in the client's name. Our investigative consulting for Idaho counsel can map the fastest route for each record.

Court records matter as well. A client's prior misdemeanor history, the complaining witness's prior filings or protection orders, and related civil cases can all affect strategy. We search the available court records, confirm identities by date of birth and address rather than by name alone, and report what we found and where. Background work on a complaining witness is always limited to lawful public sources and approved interviews, consistent with our guide to vetting how investigators work.

06Across Idaho

Forty-Four Counties, Two Time Zones and Long Drives

Idaho's misdemeanor courts sit in every county seat, from Bonners Ferry near the Canadian border to Malad City near Utah. The Panhandle and the Lewiston area keep Pacific Time, and the south keeps Mountain Time, so a hearing set for 9 a.m. in Coeur d'Alene is not 9 a.m. in Boise. We state the zone on every appointment and every timestamp. US-95 is the only road connecting the Panhandle with the rest of the state, which is why we plan Coeur d'Alene area field work as its own operation.

Winter matters to scheduling and to the facts. A scene photographed in July may look nothing like it did during a January incident, and snow on Lookout Pass or the White Bird grade can delay travel. We note weather and daylight for the incident date and, where possible, document the scene in comparable conditions. For incidents along the I-84 and I-86 corridors in southern Idaho, our Twin Falls and Magic Valley coverage keeps travel short.

Retained and Appointed Counsel, Scope and Cost

We take direction from the defense lawyer, which keeps the work inside the defense strategy and helps protect it as attorney work product. Since October 2024, trial-level public defense in Idaho has been provided through the State Public Defender, and requests for investigative funds generally follow Idaho Criminal Rule 12.2, which asks for the scope, the provider's qualifications and an estimated cost in advance. Our support for Idaho appointed counsel explains how we prepare that information. Private firms can review our engagement terms for law firms.

Misdemeanor defense investigation work is billed at $100 per hour with a $750 minimum, and $1,500 when multiple charges are filed. The scope and price are confirmed in writing before any work begins, so there is no retainer quietly being spent. Many misdemeanor assignments are narrow: one scene visit, two interviews and a records request. We say so in the estimate rather than padding it. If the case later grows into a felony, the work already done carries forward and is not repeated. Counsel can see every rate on our published Idaho rate schedule.

FAQ

Frequently asked questions

What is the usual penalty for a misdemeanor in Idaho?

Under Idaho Code 18-113, a misdemeanor without a specific penalty is generally punishable by up to six months in county jail, a fine of up to $1,000, or both. Many offenses set their own penalties, and some, like second-degree stalking, allow up to a year. Your attorney can explain the exposure for a specific charge and how prior history affects it.

Is an investigator worth it for a misdemeanor?

Often, yes. Misdemeanor files rarely receive detailed follow-up, so one overlooked witness or video clip can change the result. A narrow, written scope keeps the cost proportional. Because several Idaho statutes escalate repeat offenses into felonies, getting the first case right also protects the client later. Our guide to Idaho investigator costs shows how estimates are built.

Which court hears misdemeanors in Idaho?

The magistrate division of the district court in each county hears misdemeanors, along with infractions, small claims and many family matters. That means a misdemeanor in Kootenai County is heard in Coeur d'Alene, and one in Twin Falls County in Twin Falls. We work in all 44 counties and schedule around each court's calendar.

How fast must a misdemeanor go to trial?

Idaho Code 19-3501 generally requires a misdemeanor to be brought to trial within six months of the date the defendant enters a not-guilty plea, unless good cause is shown or the right is waived. Counsel manages that clock. We schedule interviews, scene visits and records requests so findings arrive well before the pretrial conference, and trial subpoenas can go out through Delator's Idaho process servers.

What is a withheld judgment?

Idaho Code 19-2601 allows a court to withhold judgment on terms it sets and place the defendant on probation. Whether one is available and appropriate is a question for defense counsel and the court. Mitigation information about employment, family responsibilities and treatment can support the request, and we can gather that material when counsel asks through our Idaho attorney services.

Will you interview the person who made the complaint?

Only if counsel approves and it is lawful and appropriate, and never where a no-contact order or protection order applies. Many cases are better served by interviewing independent witnesses and gathering records. Every approach to a witness is planned with counsel and documented. Our guide to lawful investigator conduct in Idaho describes the limits we observe.

Can a private recording be used in a misdemeanor case?

It depends, and admissibility is counsel's call. Idaho Code 18-6702 generally permits interception when one party to the conversation consents, so a participant may usually record their own call. Recording other people secretly, or hiding a device to capture them, can be a felony. We help counsel establish who made a recording, when and how.

How long do public records take?

Idaho Code 74-103 gives residents an answer within three working days, extendable to ten, while nonresident requesters such as Delator get 21 days, extendable to 35. No response is treated as a denial. When a deadline is close, counsel may file requests directly or use criminal discovery, and we plan the investigation accordingly.

What does a misdemeanor defense investigation cost?

Investigative time is billed at $100 per hour with a $750 minimum for a misdemeanor and $1,500 when multiple charges are filed. Both are put in writing for counsel before any work starts. If the charge is upgraded, completed work carries forward. Full rates are listed on our Idaho pricing page.

Does Idaho require private investigators to be licensed?

Idaho has no statewide private investigator license. Some cities regulate investigators locally, including Chubbuck and Coeur d'Alene, so confirm current requirements for work inside city limits. Delator Group holds a Tennessee private investigation firm license and applies that standard to its Idaho work, with insured, vetted investigators and written reports prepared for court use.
