Quick answer

How do I hire a process server in Fulton County?

Send the filed papers, every known address and your deadline. We confirm the issuing court and its service practice, quote the tier in writing, log each attempt and return a signed affidavit within the proof window. Routine service carries a published starting rate of $125, and the Georgia county rate map shows the other tiers and counties.

01Local service landscape

One Long County, Fifteen Cities

Fulton County stretches from the Forsyth line near Milton to the Coweta line past Palmetto, and its roughly 1.1 million residents (2025 estimate) live in fifteen incorporated cities. A Johns Creek cul-de-sac, a Midtown high-rise and a warehouse road in South Fulton call for three different plans. We map each address before quoting, and our Atlanta process serving page explains how in-town addresses are scheduled around traffic and building access.

Distance is measured in traffic here, not miles. GA 400 carries the northern suburbs into Buckhead, the Downtown Connector merges I-75 and I-85 through the core, and I-285 rings the city with interchanges that can slow to a crawl at rush hour. Our servers plan attempts by corridor so two Sandy Springs addresses are not split across opposite ends of the day. The published Georgia rate map shows why every Fulton address shares the same metro starting tier, and our Alpharetta coverage describes the northern end in more detail.

  • North Fulton: Milton, Alpharetta, Johns Creek, Roswell, Mountain Park
  • Sandy Springs and the I-285 Top End
  • In-town Atlanta, Buckhead and Midtown
  • South Fulton, East Point, College Park, Fairburn, Union City, Palmetto

02Attorneys and law firms

Working for Atlanta Firms and Out-of-State Counsel

Most Fulton matters reach us from litigation teams who need a summons and complaint delivered together, a clean affidavit filed within five business days and no surprises at the default stage. We take instructions from the responsible attorney or paralegal, keep one point of contact through the file, and describe every attempt in plain terms. Our service program for law firms sets out the intake fields that save the most time in this county.

Out-of-state firms often have a Fulton defendant because so many companies keep offices or registered agents in Midtown, Buckhead and the Perimeter Center area. When a case was filed elsewhere, we match the Georgia delivery and the affidavit to the rule your court applies, as described on our papers from other states page. Federal matters filed in the Atlanta Division at 75 Ted Turner Drive are handled the same way.

03Evasive and hard-to-serve

Gated Communities, Concierge Desks and People Who Avoid the Door

North Fulton has many gated subdivisions, and in-town Atlanta has controlled-entry towers with staffed lobbies. Georgia's Civil Practice Act gives an authorized server limited entry to a gated or secured community after identifying the person to be served and showing photo identification and proof of appointment, under O.C.G.A. 9-11-4(f)(4). We plan around that rule, and around concierge policies, before the first visit rather than at the gate.

When someone simply will not answer, we change the hours, the days and the approach, and every attempt is written down with the date, time and what was observed. That record is what your attorney uses if the court is later asked about alternative methods or publication. Our guide for when a party dodges service and the page on difficult defendants explain what a diligence log should contain.

  • Gated subdivisions in Milton, Alpharetta and Johns Creek
  • Staffed lobbies and parking decks in Midtown and Buckhead
  • Shift workers near the airport and industrial South Fulton
  • Varied attempt times, each one logged

04Fulton family, landlord, claim and witness papers

Divorce Filings, Dispossessories, Magistrate Claims and Subpoenas

Divorce and custody papers filed in Fulton Superior Court are served under the same Civil Practice Act rules as other civil actions, and a spouse may instead sign an acknowledgment of service. We handle those deliveries quietly and confirm identity before anything changes hands. For magistrate civil claims up to $15,000, see small claims service in Georgia; the defendant generally has 30 days to answer.

Dispossessories are different. Since July 1, 2025, O.C.G.A. 44-7-51 allows an approved process server to serve the summons, but the statute does not define that term, and Fulton's Marshal's Department still schedules the eviction itself. We confirm the court's current practice before we accept a dispossessory, and we never carry out writs. The Georgia eviction paperwork page and witness subpoena delivery cover the details.

05Documentation and challenges

The Affidavit Your Fulton Judge Will Read

Georgia requires proof of service to state the date, place and manner of service, and a private server proves it by affidavit filed with the court where the action is pending. If proof is filed late, the defendant's time to answer does not begin until it is filed, which can push back a default. We return a signed affidavit promptly so counsel can file within the five-business-day window in O.C.G.A. 9-11-4(h), and rush handling for close deadlines shortens that turnaround when a hearing is near.

When service is challenged, the questions are usually whether the right person was served, whether an abode recipient actually lived there, and how diligent the plaintiff was. Our attempt log answers those questions with facts recorded at the time. Counsel who want to compare methods first can read how legal papers are served in Georgia, and Delator Group's background and standards explain how the documentation discipline started.

06Georgia service rules

Who May Serve Process in Georgia, in Plain English

Under O.C.G.A. 9-11-4(c), process may generally be served by a sheriff or deputy, a marshal, a citizen specially appointed by the court, a non-party adult appointed by the court or as a permanent process server, or a certified process server under 9-11-4.1. Certified servers must file a yearly notice of intent with each county sheriff who allows them. Our overview of who can serve process walks through each category.

DFS itself holds no Georgia certification or court appointment, and we do not suggest otherwise. For each Fulton file, we assign a server who meets the requirements of that court and paper type and confirm it in writing before accepting the serve. Where a court will not accept a private server for a particular paper, we say so and the papers go through the Sheriff or Marshal. The Georgia process serving hub lists the statewide rules, and you can ask us about a specific Fulton court before filing.

07Local angle

Three Courthouses Downtown, One Address on the Return

Fulton is unusual because its civil papers are split by court. The Sheriff's civil section serves Superior Court process, while State and Magistrate Court papers are routed to the Marshal. Both the State and Magistrate Courts sit in the Justice Center Tower on Central Avenue, while the Superior Court clerk is on Pryor Street. We read the caption first, so the affidavit is written for the court that actually issued the summons.

Many Fulton cases also reach into neighboring counties. Atlanta's city limits cross into DeKalb, Hapeville and College Park border Clayton, and Sandy Springs shares the Chattahoochee with Cobb. When a defendant lives across a line, we coordinate service there under the same written quote, through our DeKalb County servers or Clayton County service, so one case keeps one consistent record.

  • Superior Court clerk: 136 Pryor St. S.W.
  • State and Magistrate Courts: 185 Central Ave. S.W.
  • Federal courthouse: 75 Ted Turner Dr. S.W.
  • Appellate courts: 330 Capitol Ave. S.E.

Process Servers Near Fulton County

Fulton borders several metro counties, so a single case can need service in more than one. FAQ

Frequently Asked Questions

Who can serve process in Fulton County?

Georgia generally allows a sheriff or marshal, a court-appointed or permanent process server, or a certified process server whose notice of intent the Fulton Sheriff accepts. Which a court will take can depend on the paper type. We assign a server who meets that court's requirements and confirm it in writing first. Our Georgia service FAQ hub summarizes the statute.

How much does a process server in Fulton County cost?

Routine service has a published starting rate of $125 across the county. The faster tiers are multiples of that figure: Urgent at 1.5 times, Rush at double and Same Day Rush at triple. What you actually pay depends on the address, the deadline and the documents, and it is confirmed in writing before the first attempt is made.

Does the Fulton Sheriff or the Marshal serve my papers?

The Fulton County Sheriff's civil section handles Superior Court papers, and State and Magistrate Court papers go to the Marshal, at (404) 612-4451. A qualified private server is an alternative where the issuing court accepts one for that paper. We read the caption, check the court, and tell you which route applies before quoting, so the papers are not sent to the wrong office.

Can a Fulton server leave papers with a family member?

Usually, yes. O.C.G.A. 9-11-4(e)(7) generally allows leaving the papers at the defendant's dwelling with a person of suitable age and discretion who lives there. A roommate's guest or a passing neighbor does not qualify. The affidavit describes the recipient so the court can judge it, and your attorney decides whether abode service fits the case.

How do servers get into gated communities in North Fulton?

O.C.G.A. 9-11-4(f)(4) generally lets an authorized server enter a gated or secured community for a reasonable time after naming the person to be served to the guard and showing photo ID and proof of appointment. A lone residence behind its own private gate falls outside that provision. We plan entry before the visit, as explained in our notes on hard-to-serve parties.

Will you serve a dispossessory in Fulton County?

Only after we confirm the Magistrate Court's current practice. Georgia's statute added an approved process server in 2025 without defining the term, so courts differ. Fulton's Marshal's Department schedules the eviction itself, and we never carry out writs, set-outs or lockouts. Our Georgia dispossessory guide explains the 7-day answer period and tack-and-mail.

What if the defendant lives outside Fulton County?

A Georgia summons can generally be served anywhere in the state. For magistrate claims, service outside the county uses a second original. We coordinate the out-of-county serve under the same quote, follow the receiving county's practice, and send one affidavit per defendant, ready for the Fulton clerk. Our Gwinnett County service page shows how that works next door.

How fast must proof of service be filed?

Under O.C.G.A. 9-11-4(h), the person serving generally files proof within five business days of service. Late proof does not void the service, but the defendant's time to answer does not start until proof is filed. We return the signed affidavit quickly so counsel can file on time, and Rush or Same Day options exist for tight hearings.

What happens when every Fulton attempt fails?

Georgia allows service by publication when a defendant cannot be found after due diligence or is concealing himself, shown by affidavit, under O.C.G.A. 9-11-4(f)(1). Courts expect a real record first. Our logged attempts support that affidavit, and the publication service overview explains the clerk's four-notice process and the 60-day answer period.

Do you serve federal papers from the Atlanta Division?

Yes. Federal summonses and subpoenas issued by the Northern District of Georgia are served under the federal rules, and the affidavit is drafted for that court. Tell us whether the case is in the Atlanta Division at 75 Ted Turner Drive or another district, and include any waiver correspondence already sent.
