Quick answer

How do I hire a process server in Conway?

Send the filed summons and complaint, the defendant's address and any deadline. We confirm which Horry County court issued the papers, check that a private adult may serve them and send a written price. Routine Horry County service has a published starting rate of $125, and the Horry County countywide page covers Aynor, Loris and the beach towns.

01Local service landscape

The County Seat Behind the Grand Strand

Conway is the seat of Horry County, a county of about 427,500 people in 2025, and its Second Avenue courthouse is where the county's Common Pleas and family cases are filed. The city counted 24,809 residents in the 2020 census and about 30,600 in the 2025 estimate. Defendants named in Conway filings may live anywhere in the county, from the beach towns to Aynor, Loris and the farm country between. Our countywide Horry service page lists every town we reach.

Inland Horry County addresses can be spread out, with long rural roads, homes set back behind tree lines and mailboxes that do not match house numbers. We confirm the address and county before quoting, especially near the Georgetown and Marion county lines, where Routine rates are $140 and $145 rather than Horry County's $125. Defendants along the coast are handled through Myrtle Beach process service, and the South Carolina service rate map shows the neighboring counties.

02Attorneys and law firms

For Conway Counsel and Firms Filing at the County Seat

Firms near the Conway courthouse handle collection actions, real property and contract disputes, injury claims and family cases from across the county, and firms in Columbia, Charleston or another state may file in Conway without a local office. We review the papers first: the Horry County caption, the attached complaint and the defendant's name and address. If anything looks off, such as a missing complaint, we raise it before the first attempt. Our program for South Carolina law firms explains how reporting works.

SCRCP 4(c) excludes both parties and attorneys in the action from serving the summons, but any other adult 18 or older may. Firms sometimes ask whether a summons served by mail is enough; it can be, but a default generally needs the defendant's own signature on the receipt. Federal cases from Horry County go to the Florence division, which our Florence process server page covers, and the statewide South Carolina service overview explains coordination.

03Evasive and hard-to-serve

Rural Roads, Shared Driveways and Defendants Who Stay Out of Sight

Inland Horry County presents rural-service problems: several homes sharing one driveway, mobile homes without visible numbers, dogs in the yard and residents who do not open the door to strangers. We confirm we have the right house before approaching, identify ourselves plainly, and never leave papers with someone who does not live there. Each attempt is logged with the time and what was seen. The hard-to-serve defendants page for South Carolina describes the method in more detail.

When daytime visits fail, we shift to early mornings, evenings and weekends. S.C. Code 15-9-17 allows Sunday service except on someone going to, attending or returning from a religious service, so Sunday attempts are planned around that. If the defendant cannot be found in South Carolina after due diligence, counsel may ask the court for publication under S.C. Code 15-9-710; the publication guide for South Carolina explains it, and Rush service across South Carolina handles close deadlines.

04Family law, landlords and subpoenas

Family Court, Landlord Claims and Witnesses in Horry County

Divorce, custody and support cases filed at the Horry County seat are served under SCRCP 4 like any other civil action. The county's own materials recognize private process servers as one of the ways to serve a divorce summons, alongside certified mail, the sheriff and a signed acceptance. When personal delivery is chosen, our server confirms identity, hands over the papers calmly and records the details. A rule to show cause for contempt is other process, served by the sheriff or a court designee. The divorce service page for South Carolina explains more.

For landlords, the magistrate's rule to vacate is generally served through the sheriff's office, so we serve it only where the magistrate court confirms private service is accepted; we do not post or carry out writs of ejectment. We do serve landlords' civil summonses for unpaid rent or damage, and magistrate summonses under SCRMC 6(c), as our magistrate claims service page describes. Our South Carolina witness subpoena service covers hearing and deposition witnesses.

05Documentation

An Affidavit the Second Avenue Clerk Can File

A sheriff proves service by certificate; anyone else proves it by affidavit. SCRCP 4(g) requires the affidavit to state the date, time and place of service and the name and address of the person served, or a description if the name is unknown. Our Conway affidavits follow that order and carry the case caption and number, so they can be filed at the Second Avenue office or the Central Coast Complex. The guide to serving legal papers in South Carolina shows where proof fits.

Behind each affidavit is a log of every visit, including the failed ones, with times and observations. If a defendant later disputes service, counsel or a self-represented filer can point to specifics. Outside Tennessee, Delator may assign a vetted server it contracts with, and that server works under the same written documentation standard. Read about Delator Group's structure, and see the multistate rate map for cases spanning several states.

06South Carolina rules

The South Carolina Rules Behind a Conway Serve

A summons filed at the Horry County seat may be served by the sheriff, a deputy, or any adult of 18 or more who is not a party or a lawyer in the case, under SCRCP 4(c). The state does not license private servers, so those limits are what our Conway servers must meet. Orders, rules and writs generally call for an officer or a court designee, and we check with the court before accepting one. Our explainer on who can serve South Carolina process has the details.

SCRCP 4(d)(1) permits delivery to the defendant personally, at the dwelling with a resident of suitable age and discretion, or to an authorized agent. Restricted-delivery certified mail and a qualifying commercial delivery service are also allowed for a summons. Where the limitations period has run by filing, SCRCP 3(a) generally requires actual service within 120 days, and the answer is generally due 30 days after service. Your attorney can confirm, and our business entity service covers companies.

Serving Papers From the Horry County Divorce Packet

Horry County publishes a self-represented divorce packet built on statewide court forms: the Summons (SCCA 400.01), the Complaint (SCCA 400.02), an Acceptance of Service (SCCA 400.03) and an Affidavit of Service by Mailing (SCCA 400.04), among others. The packet lists four service routes, and one is a private process server, for a fee. A process server in Conway who receives a packet summons delivers the summons and complaint together and returns an affidavit the filer can take to the clerk.

The packet's summons gives the defendant 30 days to respond, not counting the day of service, or 35 days if service was by restricted-delivery certified mail. Filers who are unsure whether the other spouse will cooperate sometimes try the Acceptance of Service first and turn to personal delivery if it is not signed. We do not give legal advice, but we can explain our part of the process. The guide to serving divorce papers in South Carolina and our out-of-state papers page cover related questions.

Process Servers Near Conway

Conway filings often name defendants outside Horry County. Those to the west in the Pee Dee are handled through Florence County service and the Sumter process server page. Defendants who moved down the coast toward the Lowcountry go to Charleston process service or the Berkeley County process servers. Every one of those jobs follows the same routine as a Conway serve: a written price before the first attempt, varied and logged visits, and a signed affidavit that meets SCRCP 4(g) for whichever clerk receives it.

FAQ

Frequently Asked Questions

How much does a process server in Conway cost?

Horry County's published Routine starting rate is $125. Urgent is priced at $188, Rush at $250 and Same Day Rush at $375. Rural distance and timing can shape the final figure for a Conway job, and you get it in writing before a server is booked. Neighboring Georgetown and Marion counties appear on the county rate finder for South Carolina.

Can I hire you if I am filing my own divorce?

Yes. Self-represented filers may use a private process server, and the Horry County divorce packet lists that as one of its four service routes. Send us the filed summons and complaint and the other spouse's address. We serve them together and give you a signed affidavit to file. We cannot give legal advice about the case itself.

Who may serve a summons in Horry County?

The rule, SCRCP 4(c), names the sheriff, a deputy, or anyone 18 or older who is neither a party nor an attorney in the case. A spouse in a divorce case cannot serve the other spouse. Private servers do not hold, or need, a state license. Court orders and writs generally go through the sheriff or a court designee.

What is an Acceptance of Service?

It is a form, SCCA 400.03 in the Horry County divorce packet, that the defendant signs to acknowledge receipt of the papers. Under SCRCP 4(j), a written acceptance signed by the person served or their attorney and delivered to the person making service needs no other proof. If the other spouse will not sign, personal delivery is the usual next step.

Will you serve an eviction in Conway?

Not the rule to vacate unless the magistrate court confirms private service is accepted, because the magistrate courts checked in South Carolina send it through the sheriff's office. Enforcing a writ of ejectment is for a constable or a deputy sheriff. Civil summonses for rent or damages are papers we do serve, and the South Carolina ejectment service guide explains the process.

Can papers be left with a relative in Conway?

Abode service lets papers be left at the defendant's dwelling or usual place of abode with a person of suitable age and discretion living there (SCRCP 4(d)(1)). A relative who lives at the house can qualify, but one who lives next door or is visiting cannot. The affidavit names or describes that relative and explains how we knew they lived at the house.

When are subpoenaed witnesses paid?

Witnesses are owed $25 per day plus mileage from home under SCRCP 45, and that payment is made at the witness's arrival, not handed over with the subpoena. A non-party deposition subpoena must be issued and served in the county where the witness lives, works or regularly does business in person.

Is Sunday service allowed in Horry County?

Generally yes. S.C. Code 15-9-17 lets judicial papers be served on Sunday unless the person is on the way to, at, or returning from a church or religious service. Our Horry County Sunday visits are scheduled with that exception in view. The guide for when someone avoids service discusses timing.

Which clerk office should receive the affidavit?

Either. Horry County's main Clerk of Court office is at 1301 Second Avenue in Conway, and a second office operates at the Central Coast Complex on Hinson Drive in Myrtle Beach. Our affidavit carries the case caption and number so it can be filed at whichever location the attorney or filer prefers. Our Myrtle Beach service page describes the coastal office.

Can you serve a Conway defendant who has left South Carolina?

Counsel decides the route. SCRCP 4(f) allows service outside the state only when a statute provides, and Under S.C. Code 15-9-750, hand delivery of the summons in another state stands in for publication and is complete when made. SCRCP 4(h) allows the server to swear the proof before a notary there.
