Routine service starts at $125, and the county-by-county rate map covers nearby counties.

01Local service landscape

A Growing Suburban County Built Around Three Interstates

DeSoto County grew from 185,313 residents at the 2020 Census to an estimated 197,918 in 2025, a gain of nearly seven percent. Southaven is the largest city, Olive Branch and Horn Lake follow, and Hernando is the county seat. Much of the growth is new subdivisions and apartment complexes, so mapping data lags behind real addresses, and DeSoto County investigators can confirm a house number or a recent move before a server drives to it.

I-55 runs north through Hernando to the Tennessee line near Southaven, I-269 forms an outer loop from Hernando to the state line, and I-69 joins I-55 north of Hernando. Those roads carry a daily commute toward Memphis, and that commute shapes when people are home. Related files often lead south to Oxford and Lafayette County or east toward Tupelo and Lee County, and we price every stop in one written quote.

Mississippi Cases With a Memphis Address, and Memphis Cases With a Mississippi Witness

DeSoto County sits inside the Memphis metro, so cross-border files are routine. A Mississippi case may name a defendant who lives in Southaven but works in Tennessee, and a Tennessee case may need a witness who lives in Olive Branch. Our Mississippi litigation support for attorneys keeps both kinds of file with one coordinator, and Delator Field Services also serves papers in Tennessee, its home state, so the Memphis side does not require a second vendor.

For Mississippi cases, an out-of-state defendant can generally be served by certified mail, return receipt requested, with restricted delivery for individuals under M.R.C.P. 4(c)(5). For a Tennessee case that needs a DeSoto County witness, Mississippi has not adopted the Uniform Interstate Depositions and Discovery Act, so counsel generally submits the foreign subpoena to the clerk of the county where discovery will happen under Rule 45(a)(3). We serve the Mississippi subpoena that issues and can run a background check on the witness before deposition.

03Evasive and hard-to-serve

Commuters, Shift Work and Defendants Who Cross the State Line

Early, late and overnight shifts keep some DeSoto County defendants away from home at odd hours, and a commute into Memphis adds more time on the road. Servers schedule attempts across mornings, evenings and weekends, read subdivision layouts and gate rules, and log each visit with date and time. When a house is plainly vacant or for sale, we stop and report rather than keep billing trips, and a quick records skip trace usually comes next.

A defendant who expects papers can hop the state line and stay with relatives in Memphis. When that pattern shows up, a Delator Group investigator can take the file through evasive person locates, and judgment creditors can use skip tracing for debtors who moved. If the defendant still cannot be found on diligent inquiry, the attempt log supports the sworn showing for publication under M.R.C.P. 4(c)(4), which requires a notice in each of three consecutive weeks.

04Family law, evictions and subpoenas

Chancery Papers, Hernando Justice Court and Witness Subpoenas

DeSoto County's family docket is heavy, and the chancery records office on Highway 51 South in Hernando handles divorce, custody, support and contempt filings. Starting in January 2027, DeSoto is scheduled to form a chancery district of its own. The special summons now in M.R.C.P. 4(i) is returnable on a hearing date the court sets, and an irreconcilable differences divorce generally requires personal service or a written waiver under Miss. Code Ann. § 93-5-2. A spouse who suspects concealed property can start with hidden assets in a Mississippi divorce.

The DeSoto County Justice Court moved to 3423 Industrial Drive in Hernando in July 2022, and it hears claims up to $3,500 and many evictions. A 2021 Attorney General opinion addressed to the DeSoto County board confirmed that the constable is responsible for justice court service, and a private server is used only after the constable has not returned process and the plaintiff asks in writing. Removal after judgment is reserved to a sheriff or constable. Screening a tenant before the lease avoids many of these cases.

  • Rule 4(i) special summonses for chancery hearings
  • Justice court papers after a written request
  • Subpoenas, including domesticated foreign subpoenas

05Documentation

Affidavits Built for Contested Hearings in Hernando

Under M.R.C.P. 4(f), a server who is not a sheriff proves service by affidavit, and our affidavits state who was served, where, when and how, along with the court and case number. The field log behind each one lists every attempt, the ones that failed included. Our statewide Mississippi serving standards apply here exactly as they do on the coast or in the Delta, and serves outside Tennessee may be carried out by vetted servers Delator contracts with under the same written standard.

Disputed service in a suburban county often comes down to which house, which door and which relative. The log records the address, the hour, a description of the person who answered and, for abode service, the relationship and apparent age of whoever accepted the papers. When a defendant files an affidavit saying service never happened, investigative consulting can prepare the server's account and assemble supporting records, and jury research for DeSoto County trials is available when the case goes further.

06Mississippi rules

How a DeSoto County Serve Works Under Mississippi Rule 4

Mississippi does not license process servers at the state level, as our guide to hiring where no state license exists notes, and M.R.C.P. 4(c)(1) generally allows any non-party at least 18 to serve a summons. If a party asks in writing, the sheriff will serve instead and return the papers within 30 days. Personal delivery comes first. If it cannot be made with reasonable diligence, papers may be left with the defendant's spouse or a family member above the age of sixteen at the usual place of abode, then mailed first-class, with service complete on the tenth day after mailing.

Companies are served through an officer or a managing, general or authorized agent, and Miss. Code Ann. § 79-35-13 points first to the registered agent for a registered entity. Service must generally be completed within 120 days of filing under Rule 4(h), and the answer is generally due 30 days after service. These are summaries, not legal advice. The Mississippi guide to service of process and the article on recording laws in Mississippi cover related limits.

07The state line

Why a Tennessee Firm Fits a County That Lives Half in Memphis

Delator Group is headquartered in Nashville and holds itself to Tennessee's licensing standard everywhere it works, which makes DeSoto County a natural fit. A single coordinator can handle a Southaven defendant, a Memphis employer's registered agent and a Shelby County witness without the file changing hands. The work still follows Mississippi rules on this side of the line, and we confirm with counsel which state's rules govern each document before an attempt.

Federal cases from DeSoto County are heard in the Northern District of Mississippi's Oxford Division, not in Memphis, and the clerk's office for every Northern District division sits at 911 Jackson Avenue East in Oxford. That surprises out-of-state counsel used to filing in the Western District of Tennessee. We draft the return for the court that issued the summons, and criminal defense investigations in Mississippi support defense teams in Oxford Division cases. Workplace investigations for DeSoto employers are handled separately.

FAQ

Frequently Asked Questions

What does process serving in DeSoto County cost?

Routine service in DeSoto County has a published starting rate of $125, with Urgent at $188, Rush at $250 and Same Day Rush at $375. A second address, a Memphis-side stop or a locate can change the figure, and every change goes into the written quote before the first attempt. You approve the final price before any server heads out.

The defendant lives in Southaven but works in Memphis. Where do you serve?

Usually at home in Mississippi, timed for evenings or weekends, because workplace access depends on the employer. If the case calls for it, Delator Field Services can also attempt service in Tennessee, its home state. For a Mississippi case, counsel may instead use certified mail with restricted delivery under Rule 4(c)(5) for a defendant who actually lives out of state.

What is the process for a Tennessee subpoena aimed at a DeSoto County witness?

Mississippi has not adopted the Uniform Interstate Depositions and Discovery Act. Under M.R.C.P. 45(a)(3), counsel generally submits the out-of-state subpoena to the clerk of the county where discovery will be taken, and the clerk issues a Mississippi subpoena on the same terms. We then serve that subpoena personally and tender the fee and mileage. Your attorney can confirm the details, and our out-of-state surveillance team handles related cross-border work.

Where is the DeSoto County Justice Court now?

The justice court moved to 3423 Industrial Drive in Hernando, next to the county's adult detention center, in July 2022, after years on Highway 51 North in Southaven. It hears claims up to $3,500 and many evictions. The constable serves its process first, and a private server is used only after a written request when the constable has not returned it.

Can you serve eviction papers in DeSoto County?

If the court accepts a private server, yes. The constable takes justice court eviction papers first, while county court filings generally follow Rule 4, and we verify the court's practice before taking any file. After judgment, only a sheriff or constable may remove a tenant, and we never attempt it. Landlords considering a sale can review real estate risk work as well.

Can a DeSoto County serve be completed through a relative?

Yes, but only as a fallback. If the defendant cannot be reached in person with reasonable diligence, M.R.C.P. 4(d)(1)(B) allows the server to leave papers at the usual home with a spouse or a willing family member past age sixteen, and a first-class copy is then mailed. Ten days after the mailing, service is complete, and our affidavit names the relationship of the person who accepted.

Which federal court handles DeSoto County cases?

The Northern District of Mississippi's Oxford Division, under 28 U.S.C. § 104, not the federal court in Memphis. The Northern District's clerk's office for all divisions is at 911 Jackson Avenue East in Oxford. We serve federal summonses under Federal Rule 4 and prepare the return for the Oxford clerk. Lafayette County investigations support related work in Oxford.

Is DeSoto County still part of a multi-county chancery district?

As of 2026, DeSoto shares a chancery district with other counties, and 2025 redistricting legislation is scheduled to make DeSoto a chancery district of its own starting in January 2027. DeSoto County already has its own circuit court district. None of this changes how papers are served, but it can change hearing schedules, so check the docket before setting a deadline.

What happens when a DeSoto County defendant disappears?

We stop, send counsel a summary of every attempt and wait for direction. A locate is often the next step, and missing person searches can surface a new address in Mississippi or Tennessee. Where diligent inquiry still fails, counsel may file a sworn showing and request service by publication under M.R.C.P. 4(c)(4), which runs over three consecutive weeks.

Is Delator Field Services located in DeSoto County?

No. Delator Field Services is the process serving division of Delator Group, a licensed Tennessee private investigation firm headquartered in Nashville. We coordinate DeSoto County serves through vetted servers working to one documentation standard, and Tupelo-area investigations in Lee County and the rest of north Mississippi run the same way, with the price in writing first.
