Serving Papers in Frankfort and Across Franklin County
Frankfort is Kentucky's capital and the seat of Franklin County, with 28,602 residents in the 2020 census and about 52,600 in the county. Franklin Circuit and District Court cases are filed at the courthouse on Saint Clair Street, and the Eastern District's Frankfort office is a few blocks away on West Broadway. A serve, a filing and a return can often be finished downtown in one day. Our Franklin County rate table shows how the county compares with its neighbors.
The Kentucky River makes an S-turn through the middle of town, with downtown and South Frankfort on opposite banks and Bellepoint on the west side north of Benson Creek. US 60 and US 460 run east and west, US 127 and US 421 run north and south, and Interstate 64 passes south of the city. River crossings and hills shape how attempts are grouped, and Woodford and Anderson County pricing shows how nearby counties compare. Addresses out I-64 toward Lexington are handled through Lexington process service.

02Attorneys and law firms
Process Service for Franklin County Litigators
Frankfort sees a steady flow of cases involving government, regulated industries and the people who work for them, along with ordinary civil and family matters. Louisville and Lexington firms often handle those cases from a distance. Send the filed summons and complaint, a description of the defendant and the case calendar, and we answer with a written quote stating the court, tier and price. The law firm intake page for Kentucky shows what to include.
CR 12.01 generally gives a defendant 20 days after service of the summons to answer, and CR 4.02 requires the summons to state that period. CR 4.03 asks for proof to be filed promptly and within the same window. When a hearing is near, rush process serving in Kentucky shortens the schedule, and Georgetown process service handles related defendants up US 460. Counsel can confirm how each deadline applies.
03Hard-to-serve recipients
When a Frankfort Defendant Is Never Home
Many Frankfort residents keep regular weekday office hours, which means an evening or weekend attempt at home often works better than a visit to a secured state building. Others commute from Anderson, Shelby or Scott County. We vary attempt times deliberately, and Kentucky gives defendants no exemption from civil service on a Sunday or holiday under KRS 454.135. Each visit is logged with date, time, place and what happened, as Kentucky evasive defendant service explains.
When a defendant has left the county to avoid service, is hiding or cannot be reached because their residence is unknown, CR 4.05 lets the clerk issue a warning order on an affidavit from the plaintiff or counsel. The clerk appoints a warning order attorney, who must try to notify the defendant by mail and report within 50 days, and the court allows a reasonable fee taxed as costs. Warning orders and constructive service covers the details, and your attorney decides whether to use them.
04Family law, evictions, small claims, subpoenas
Family, Eviction, Small Claims and Subpoena Papers in Frankfort
Franklin County dissolution and custody cases are filed in Circuit Court, where the family court handles them. If a respondent will not sign a waiver of service and entry of appearance, the petition must be delivered personally or offered on refusal. In cases with minor children, KRS 403.044 generally delays testimony until 60 days after service or another triggering event, so the service date matters. Kentucky divorce paper delivery describes the approach.
Forcible detainer warrants are directed by KRS 383.210 to the sheriff or a constable, who gives at least three days' notice of trial, and the warrant of restitution after judgment also goes to an officer. We do not serve either one. We can deliver a landlord's written notice before suit where the lease permits, and serve a separate suit for rent or damages, as eviction-related papers in Kentucky explains.
Small claims of $2,500 or less usually go out by the clerk's certified mail or through the sheriff, and we assist only where the court allows. Subpoenas can be served by any person over 18 under CR 45.03, and Frankfort subpoena service includes the endorsed affidavit and a note about KRS 421.015 mileage. Small claims delivery in Kentucky explains when the court might permit a private person to help.

Returns Built for the Franklin County Clerk
If the clerk transfers the summons to a person authorized to deliver it under CR 4.01(1)(b), that person's endorsed return is the proof. A person appointed by the court under KRS 454.145 must verify the return by affidavit. Our returns state the date, time, place and manner of delivery, identify or describe the person served and note any refusal and offer. Serving legal papers in Kentucky, step by step shows a complete file.
Challenges to service usually start with the return, so precise details matter: the building and floor, a physical description, the words exchanged and whether the person accepted or refused. Failed attempts receive the same care, because they may later support a warning order affidavit. When papers came from a court in another state, the proof is matched to that court's rule, which service of out-of-state papers in Kentucky explains.
06Kentucky service rules
Kentucky Law on Who May Serve in Frankfort
Under CR 4.01, the clerk issues the summons and, at the plaintiff's direction, sends it by certified mail, transfers it to a person other than a mail carrier who is authorized to deliver it, or returns it to the filing party to arrange service. KRS 454.140 directs process to the sheriff, and KRS 454.145 allows a court to appoint a person for a particular paper on good cause. Kentucky has no private process server license, as our guide on who may serve explains.
Delator Field Services holds no Kentucky license, certification or appointment, because the state has none to give. For each Frankfort job, we confirm with the Franklin County clerk or court how the summons will issue and whether private delivery or a special appointment is needed before we accept the papers. When only an officer may serve a paper, we say so in writing and it goes to the Franklin County sheriff instead. Kentucky process servers statewide follow the same check in every county.
Individuals are served personally under CR 4.04(2), by offering the papers if they refuse, or through an agent authorized by appointment or by law. There is no household substitute, so a summons is never left with a family member. Corporations are served through an officer, a managing agent or the chief agent in the county where the action is brought, and service on Kentucky registered agents covers entities with an agent on file.

Serving Papers in a Government Town
Public administration employs a large share of Frankfort's workforce, and that shapes the work here. When the Commonwealth or one of its agencies is the defendant, CR 4.04(6) generally calls for service on the Attorney General or an assistant attorney general, not on a clerk at a front desk. Counties are served through the county judge, and cities through their chief executive or city attorney. A process server in Frankfort confirms the right recipient with counsel before the first attempt, and Franklin County service coverage applies the same check countywide.
The Secretary of State's Summons Branch is also in Frankfort, on Capital Center Drive. Under KRS 454.210, the circuit clerk, not a private server, sends papers there for certain nonresident defendants, and the office mails them on. It does not serve foreign companies already authorized to do business in Kentucky, whose registered agent is served instead. Kentucky State University and distilleries such as Buffalo Trace add their own employers to the mix, and Shelbyville process serving covers addresses west on I-64.

FAQ
Frequently Asked Questions
Who can serve process in Frankfort?
Under CR 4.01, the Franklin County clerk can send the summons by certified mail, transfer it to a person authorized to deliver it, or return it to the filing party to arrange service. The sheriff is the default officer under KRS 454.140, and KRS 454.145 lets a court appoint a person for one paper. Kentucky does not license private servers, so we confirm the clerk's practice before we start.
How much does it cost to serve papers in Frankfort?
Routine service in Franklin County has a published starting rate of $130. Urgent begins at $195, Rush at $260 and Same Day Rush at $390. We set the final price from the address, the documents and the timeline, and put it in writing before the first visit. The multi-state process serving map compares other counties.
How is a Kentucky state agency served?
CR 4.04(6) generally provides that the Commonwealth and its agencies are served through the Attorney General or an assistant attorney general. Counties are served through the county judge, or the county attorney if the judge is absent, and cities through their chief executive officer or city attorney. We confirm the correct recipient with counsel before any attempt, because the wrong office can mean invalid service.
Does the Secretary of State in Frankfort serve out-of-state defendants?
For some. Under KRS 454.210, the circuit clerk sends the summons and complaint to the Secretary of State, which mails them to the nonresident defendant by certified mail, and service is deemed made when the office returns it. The office does not serve foreign companies authorized to do business in Kentucky; their registered agent is served instead. A private server is not part of that route.
Where is the return filed after a Frankfort serve?
Returns in Franklin Circuit and District Court cases are filed with the Franklin County Circuit Court Clerk at 222 Saint Clair Street. CR 4.03 wants proof filed promptly and inside the defendant's response time. For federal cases in the Eastern District's Frankfort division, the clerk's office is at 330 West Broadway.
Can papers be left with a spouse or roommate in Frankfort?
Not for a summons. CR 4.04(2) generally requires delivery to the individual personally, offering the papers if the person refuses, or delivery to an agent authorized by appointment or law, and there is no household substitute. The only household rule applies to officers serving eviction notices under KRS 454.030, and we do not serve those notices.
Can you serve an eviction notice in Frankfort?
No. KRS 383.210 directs the forcible detainer warrant to the sheriff or a constable, and the AOC-215 notice is addressed to them. That notice, and any restitution warrant, is outside what we serve. We can document a landlord's written pre-suit notice where allowed and serve separate suits, which the guide to Kentucky eviction service explains.
Do you serve small claims papers in Franklin County?
Franklin District Court small claims papers generally go out by the clerk's certified mail or through the sheriff, and the state handbook does not mention private servers. If mail service fails, ask the clerk which delivery options the court will accept before you send papers to us. Franklin County service details describe how we handle the rest of the county.
Can you serve a subpoena on someone who works for the state?
Yes. Any person over 18 can serve a subpoena anywhere in the state under CR 45.03, by handing or offering a copy to the witness. Access to state buildings depends on their security rules, so a home attempt is often simpler. Witnesses from another county are allowed mileage under KRS 421.015, and notice generally goes to other parties before a non-trial subpoena is served. Subpoenas for Frankfort witnesses are returned with an endorsed affidavit.
What if a Frankfort defendant cannot be served at all?
When a defendant is absent from Kentucky, has left the county to avoid service, is concealed or has an unknown residence, CR 4.05 allows a warning order on an affidavit, and the clerk appoints a warning order attorney. CR 4.09 still lets the plaintiff personally serve the defendant in Kentucky before judgment. When someone avoids service in Kentucky explains the choices.
