Quick answer
What does a wrongful death investigator do in Idaho?
A wrongful death investigation documents how a death happened and who may be responsible. In Idaho that usually means photographing and measuring the scene, identifying cameras and witnesses, collecting public and private records, and reconstructing the timeline for counsel. Delator does this for plaintiff and defense lawyers alike, using the same methods as its Idaho insurance and liability investigations.
01The statute
How Idaho's Wrongful Death Statute Works
Idaho Code 5-311 allows the heirs or personal representatives of a person whose death was caused by the wrongful act or neglect of another to bring an action for damages. As of the 2026 Idaho Code, "heirs" generally includes intestate heirs, the spouse, children, stepchildren and parents, dependent blood relatives and adoptive siblings, and a dependent putative spouse. The statute lets the jury award damages that are just under all the circumstances. Who may sue and for what is counsel's analysis; our Idaho investigators gather the facts that support it.
Under Idaho Code 5-219(4), the action generally must be filed within two years. Two years passes quickly when records requests, insurance negotiations and grief all compete for a family's attention, and the physical evidence does not wait at all. Skid marks fade, vehicles are repaired or salvaged, video is overwritten and witnesses move. The practical lesson is that investigation should start as soon as counsel is engaged, well before the filing deadline is in view, much as it does in our fatal hit-and-run investigations.
02Damages and fault
The Noneconomic Damages Cap and Comparative Fault
Idaho Code 6-1603 limits noneconomic damages in personal injury and wrongful death actions. The statute starts from $250,000 and adjusts the figure each July 1 based on the Idaho Industrial Commission's average annual wage adjustment, so counsel should check the current number. The cap does not apply to claims arising from willful or reckless misconduct, or from acts the factfinder finds beyond a reasonable doubt would constitute a felony. That makes facts about recklessness, impairment or criminal conduct especially important, and they are often the facts a defense investigation is built around, as on our Idaho DUI defense work.
Fault is allocated under Idaho Code 6-801. As the statute reads, a claimant's recovery is preserved only where the claimant's negligence was not as great as that of the party from whom recovery is sought, and damages are reduced in proportion. In a death case, the decedent's own conduct, such as speed, seat belt use or impairment, can become central. Both sides therefore need an accurate, independent account of what each person did. We document it without assuming the answer, and economic loss questions can be supported through our asset and financial research.
- Base cap of $250,000, adjusted every July 1
- No cap for willful or reckless misconduct
- No cap for conduct found to be a felony
- Recovery barred if claimant's fault is as great
03Vehicle deaths
Fatal Crashes on I-84, US-95 and Mountain Grades
Many Idaho wrongful death claims arise on the road. I-84 carries heavy freight and commuter traffic through the Treasure Valley and across the Snake River Plain. US-95 is the only road connecting the Panhandle with the rest of the state, with steep grades at White Bird Hill and the Lewiston Hill. US-12 follows the Clearwater and Lochsa rivers toward Lolo Pass, and I-90 climbs Fourth of July Summit and Lookout Pass. Our Lewiston investigators know the grades and curves where north-central crashes cluster.
We document the scene as early as possible: final rest positions if they can still be determined, gouges, debris, sight lines, signage and road surface, along with weather and lighting for the date and hour. We identify every camera that may have captured the crash and give counsel the details needed for preservation letters, including trucking and fleet telematics where commercial vehicles were involved. Where impairment is alleged, the criminal case under Idaho Code 18-8006 or the vehicular manslaughter statute may run in parallel, and our lawful scene surveillance can capture conditions at the matching hour.
04Workplace deaths
Deaths on Farms, Plants, Mines and Construction Sites
Idaho's work is physical. The state ranks first nationally in potato and trout production and third in milk, so farm, dairy and processing operations employ thousands. The Silver Valley's mining history includes the 1972 Sunshine Mine fire, the deadliest mining disaster in state history, and the Lucky Friday mine remains active. Construction across the fast-growing Treasure Valley, from Meridian to Kuna, adds another layer of risk. Worksite death claims often involve contractors, equipment manufacturers and property owners in addition to an employer. Our corporate investigations team maps those relationships early.
Worksite investigations focus on who controlled the site, what safety rules applied, what training and equipment the worker had, and what coworkers saw. Witnesses may be reluctant to speak while still employed, and some are seasonal or bilingual workers who move on. We interview with care, document each conversation and locate departed coworkers through lawful contact tracing. Whether a claim lies against the employer or only against third parties is a legal question counsel will answer; we gather the facts either way.
05Care and custody
Deaths in Nursing Homes, Hospitals and Correctional Facilities
Deaths of vulnerable adults raise both civil and criminal questions. Idaho Code 18-1505 makes abuse or neglect of a vulnerable adult likely to cause great bodily harm or death a felony, and Idaho Code 39-5303 requires listed professionals and facility employees to report suspected maltreatment to Adult Protective Services within 24 hours, and to law enforcement within four hours where it caused death or life-threatening injury. We gather staffing information, visitor and family accounts and public records for counsel, as described on our retirement home abuse investigations page.
Deaths in jails and prisons follow a similar pattern of controlled records and limited access. Idaho Department of Correction facilities include the complex near Kuna, institutions in Orofino and Cottonwood, and the women's center in Pocatello. Counsel typically obtains medical and incident records through discovery or records requests; we organize them into a timeline and locate former staff and inmates who may have witnessed events. As a nonresident requester, Delator receives public records answers on Idaho's 21-day nonresident schedule, so counsel may file urgent requests directly. See our correctional facility abuse investigations for related work.
06Unknown drivers
Fatal Hit-and-Run Cases and Unidentified Defendants
When a driver leaves the scene of a fatal crash, Idaho Code 18-8007 generally makes it a felony, and the civil claim cannot proceed against an unknown person. Finding the driver may depend on vehicle fragments, paint transfer, nearby cameras, body shop repairs and witnesses who noticed a damaged vehicle afterward. We canvass businesses and residences, identify cameras along likely escape routes and follow repair and parts leads. Our hit-and-run witness tracing explains that process in more detail.
Even when the driver is never found, the work matters. Uninsured motorist coverage, claims against a vehicle owner or employer, and road design questions may all depend on what the investigation establishes about the vehicle and the scene. We coordinate with law enforcement through counsel rather than duplicating their work, use lawful skip tracing to reach witnesses who moved, and we report every lead, including dead ends, so counsel knows exactly what has been checked. Families in eastern Idaho can work with our Idaho Falls investigators for interstate and US-20 crashes, and with our Rexburg team farther north.
07Preservation and cost
Preserving Evidence Before It Disappears, and What It Costs
The first weeks matter most. We give counsel a preservation list covering vehicles, telematics, phones, cameras, scene conditions, employer and facility records and witnesses, ranked by how quickly each is likely to be lost. Idaho's size affects logistics: Boise to Coeur d'Alene is roughly 380 to 390 miles, and the Panhandle keeps Pacific Time, so North Idaho scene work is planned as its own operation through our Coeur d'Alene investigators.
A wrongful death investigation is billed as civil litigation support at $100 per hour with a $1,000 minimum. Remote items, such as a deep-dive background check on a driver or defendant at $300, are priced separately. The scope and price are confirmed in writing before work begins, and any expansion is approved in writing. We work for plaintiff and defense counsel alike and report what the evidence shows. Rates appear on our Idaho service pricing page and engagement terms on the attorney services page.

Statewide coverage
Wrongful death investigation support across Idaho
Treasure Valley deaths on I-84 and in the growing suburbs are supported by investigators assigned to Boise and Nampa. Eastern Idaho cases on I-15 and US-20 are handled from Idaho Falls and Pocatello, and Magic Valley farm, dairy and highway deaths from Twin Falls. Panhandle, Silver Valley and Lewiston-area cases keep Pacific Time and are planned separately because of distance and the single north-south highway. Every assignment, whichever region it falls in, begins with a ranked preservation list, a written scope and a single point of contact for counsel and the family.
FAQ
Frequently asked questions
How long is the deadline for a wrongful death claim in Idaho?
Idaho Code 5-219(4) generally sets a two-year limitation period for wrongful death actions, running from the act or occurrence that caused the death. Some exceptions may apply, and claims against government entities can have their own notice requirements. Talk with a lawyer promptly, and start the investigation early, because evidence disappears long before the deadline.
Who can bring a wrongful death claim in Idaho?
Under Idaho Code 5-311, the decedent's heirs or personal representatives may bring the action. Heirs generally include the spouse, children, stepchildren and parents, intestate heirs, dependent blood relatives and adoptive siblings, and a dependent putative spouse. Counsel will determine who should be the plaintiff in a particular case and whether a personal representative needs to be appointed first.
Is there a cap on damages in an Idaho wrongful death case?
Idaho Code 6-1603 caps noneconomic damages, starting from $250,000 and adjusting each July 1 with the Industrial Commission's wage adjustment. It does not cap economic losses, and it does not apply to willful or reckless misconduct or to conduct the factfinder finds to be a felony beyond a reasonable doubt. Counsel can confirm the current figure.
What if the person who died was partly at fault?
Idaho Code 6-801 reduces recovery in proportion to fault and, as written, bars it where the claimant's negligence is as great as the defendant's. In a death case, the decedent's conduct can be at issue. An independent account of what each person did helps both sides, which is why we document facts without assuming the outcome.
Do you work for insurance companies and defendants too?
Yes, through their counsel. Defense lawyers need the same accurate scene documentation, witness accounts and records as plaintiff lawyers, and often need facts about the decedent's conduct or about other potentially responsible parties. Our Idaho insurance investigations page describes related work for carriers and adjusters, and we report what we find even when it does not help the client.
Can you find a driver who fled a fatal crash?
Sometimes. We follow vehicle fragments, paint transfer, cameras along likely routes, body shop and parts leads, and witnesses who saw a damaged vehicle. We coordinate with law enforcement through counsel rather than interfering with their investigation. Our fatal hit-and-run tracing describes the methods in detail, and every lead we check, including dead ends, is reported to counsel.
How do you handle deaths in nursing homes?
We gather staffing information, family and visitor accounts, public inspection information and other records counsel obtains, and locate former staff who may have witnessed care. Idaho law requires certain people to report suspected abuse or neglect of vulnerable adults to Adult Protective Services within 24 hours. See our Idaho retirement home abuse investigations.
When should an investigator be hired?
As early as possible, ideally within days of the death or as soon as counsel is engaged. Vehicles are repaired or salvaged, video is overwritten, and scenes change with weather, construction and season. Early work also gives counsel time to send preservation letters before the evidence is gone, and lets witnesses be interviewed while memories are fresh.
What does this kind of investigation cost?
It is billed as civil litigation support at $100 per hour with a $1,000 minimum. Remote research such as a deep-dive background check at $300 is priced separately. The scope and price are confirmed in writing before work begins, and any expansion is approved in writing too. Our Idaho pricing page lists every rate.
Are Idaho private investigators regulated?
Idaho has no statewide private investigator license, though some cities, including Chubbuck and Coeur d'Alene, regulate investigators locally, so confirm current requirements for work in those cities. Delator Group holds a Tennessee private investigation firm license, and that standard governs its Idaho death investigations. Our guide to vetting an investigator lists questions to ask any firm.
