Quick answer
What does an employee background check in Idaho actually search?
A careful Idaho screen searches the court system's public case indexes for all 44 counties, which hold electronic records from 1995 forward, then pulls clerk files for older or unclear entries, checks federal court indexes and verifies references. Federal consent rules apply when the report informs a hiring decision. Our Idaho price list shows each check level, and Boise employers can request county file pulls.
01Where the records live
How Idaho Court Records Feed a Pre-Employment Screen
Idaho's trial courts publish case information through the iCourt Portal and the older Supreme Court Data Repository, and during the system transition a statewide search has to cover both. Electronic records reach all 44 counties and generally run from 1995 forward, with some older case data. Public entries show party indexes, case summaries and calendars, while Social Security numbers, addresses and driver's license numbers are withheld under Idaho Court Administrative Rule 32. That last point matters, because a name hit with no address cannot be tied to a candidate without more work, which is where our records consulting team earns its fee.
For a case filed before electronic indexing, or for a summary that leaves the disposition unclear, the request goes to the clerk in the county where the case began. Felonies and larger civil suits sit in district court, while misdemeanors, small claims and evictions are handled by the magistrate division, so one county can hold both kinds of file. We pull the underlying documents before reporting anything that could cost a candidate the job, and our Nampa investigators handle many of those Canyon County requests at the courthouse on Albany Street in Caldwell.
- iCourt Portal plus the older Data Repository
- Electronic records generally from 1995 forward
- Personal identifiers withheld under I.C.A.R. 32
- Older files pulled from the county clerk
02State repository
Idaho State Police Repository Checks and When They Are Required
The Idaho State Police Bureau of Criminal Identification runs the state's central repository of arrest records supported by fingerprints. According to ISP, a name-based check costs $20 and a fingerprint-based check costs $25, and requests go in by hand delivery, fax or mail rather than email. The repository holds Idaho arrests only. Dismissed charges stay on file with the dismissal noted unless an expungement is approved, and juvenile records are excluded unless the person was charged as an adult. We explain those gaps before an employer leans on a repository response alone, and our guide to lawful investigator work in Idaho covers the boundaries.
Some roles must go through ISP by law or by contract. Organizations that serve children, older adults or people with disabilities can join ISP's National Child Protection Act program, which ISP lists at $33.25 per employee for state and federal fingerprint checks. Fingerprinting is offered at the Meridian headquarters on South Stratford Drive, and applicants outside the Treasure Valley use local law enforcement. When a mandate applies, we say so plainly. Where none does, our court research fills in what a repository answer leaves out, and care-facility operators often use both.

FCRA Disclosure, Authorization and Adverse Action in Idaho Hiring
When an outside firm compiles information about a person for an employment decision, the report is generally a consumer report under the federal Fair Credit Reporting Act. Employers usually need to give a standalone written disclosure, collect the candidate's signed authorization and certify compliance to the screening provider before the report is ordered. We confirm the release is on file before any research begins, and new human resources teams can lean on our Idaho corporate investigations group to set up the paperwork correctly the first time.
If a report may lead to a rejection, the FCRA generally calls for a pre-adverse action notice with a copy of the report and a summary of rights, a reasonable pause for the candidate to respond, and then a final notice. The statute also generally limits how far back non-conviction items can be reported for most positions. Those same reporting rules shape our rental applicant screening, and any employer unsure about its forms should bring in employment counsel before the first denial goes out.
- Standalone disclosure separate from the application
- Signed authorization before research
- Pre-adverse action notice with the report
- Final notice after time to respond
04Idaho law
Idaho Human Rights Act Limits on Screening Decisions
The Idaho Human Rights Act, at Idaho Code § 67-5909, generally bars employment discrimination based on race, color, religion, sex, national origin, age or disability. It reaches employers with five or more employees during 20 or more calendar weeks of the current or prior year, under § 67-5902, so many small Idaho businesses are covered. Complaints are generally due within one year under § 67-5907, and the Idaho Human Rights Commission also handles federal charges the EEOC defers to it. Applying the same screening standard to every candidate in a role is the simplest defense, which our compliance audit work tests directly.
Idaho has no at-will statute. Courts have presumed that employment without a fixed term is at will, while recognizing exceptions for implied contracts, the covenant of good faith and public policy, according to published compendiums of Idaho case law that your counsel can confirm. A background finding that leads to a termination should therefore be documented carefully. If the decision is later challenged, our page on wrongful termination matters in Idaho explains how the screening file often becomes evidence.
05Industry needs
Screening for Semiconductor, Research, Food and Agricultural Employers
Idaho hiring is being reshaped by a few large projects. Micron, headquartered in Boise, has announced plans for two memory fabs in Southeast Boise and estimates about 3,500 direct hires as part of that investment, according to local reporting. Contractors and suppliers around that build will screen thousands of workers, and positions with access to clean rooms or proprietary process data call for more than a basic check. Firms in that supply chain often pair screening with our trade secret protection work once a hire is in place.
Eastern Idaho draws on a different employer. Idaho National Laboratory in Idaho Falls reports more than 5,500 employees and close to 8,000 people working on its desert Site when other contractors are counted. Federal clearance processes run separately from private screening, but subcontractors still need sound checks on the people they place. In the Magic Valley, food processors and dairies hire for production and transport roles, and our Twin Falls investigators and Idaho Falls team handle courthouse pulls in each region.
06What you can order
Basic and Deep-Dive Check Levels With Their Prices
The basic remote background check costs $102. It confirms identity and address history, searches the public court indexes across Idaho and any other state where the candidate lived, reviews related civil filings and checks federal court indexes. It suits most hourly, seasonal and entry-level positions. The deep-dive check costs $300 and adds employment and education verification, professional license confirmation through the issuing board, a closer look at civil litigation and a broader review of public sources, which fits supervisors and anyone handling money, patient data or controlled inventory.
Field work is billed at $100 per hour. It comes into play when an older case file must be pulled from a clerk, a former employer's existence has to be verified on the ground or identity documents conflict. Each engagement starts with a written scope that lists the check level, the jurisdictions and the price. Employers comparing options can read our Idaho investigator cost guide, and anyone wanting the firm's wider picture can start with our overview of Idaho investigations.
- Basic remote check: $102
- Deep-dive check: $300
- Clerk file retrieval: $100 per hour
- Scope and price confirmed in writing
07Accuracy and follow-up
Matching Records to the Right Person and Rechecking Staff
Because public court entries in Idaho omit addresses and identification numbers, misattribution is the biggest risk in a name-based search. A candidate in Rexburg can share a full name with someone in Bingham County, and an index hit alone cannot separate them. We tie each record to at least two identifiers, such as a date of birth with a verified address history, and leave out anything we cannot attribute with confidence. That same discipline governs our litigation witness research, and our locate specialists confirm past addresses so the right counties get searched.
Some employers rescreen drivers each year or recheck staff who move into roles with cash, data or keys. Consent rules generally apply to rescreening too, so counsel should confirm whether the original authorization covers it. A specific suspicion about one employee is different and calls for an investigation that may include interviews and lawful observation of a workplace. Idaho is a one-party consent state under Idaho Code § 18-6702, so recording conversations you are not part of can be a felony. Those limits apply to employee background checks in Idaho and to every follow-up inquiry we run.
- Two identifiers before any record is reported
- Disputed entries rechecked with the clerk
- Rescreening follows the same consent rules

How it works
How an Idaho employee check runs
- 01
Define the role
We agree in writing on the position, the check level, the counties and states involved and the categories to report, using the same criteria for every candidate in that role.
- 02
Confirm the release
You deliver the standalone disclosure and collect the signed authorization. We confirm it is on file before any research starts and flag roles that need an ISP fingerprint check.
- 03
Search and verify
We search iCourt and the Data Repository, pull clerk files where entries are unclear, verify references and tie every record to at least two identifiers before it goes in the report.
- 04
Report and support
You receive a written report. If you consider adverse action, we provide what the notice requires and recheck the source promptly if the candidate disputes any entry.

Remote checks cover candidates from every Idaho county, and clerk file retrieval reaches all 44 courthouses. Treasure Valley employers in Boise, Meridian and Nampa account for much of the volume, while eastern Idaho hiring centers on Idaho Falls, Pocatello and Rexburg. In the Panhandle, Coeur d'Alene and Post Falls employers often recruit from Spokane, so Washington records come into play, and appointments there run on Pacific Time. Magic Valley processors round out the map. Coverage for every region is summarized on our statewide coverage page.
FAQ
Frequently asked questions
Can Idaho employers ask about criminal history on a job application?
We have not found a statewide Idaho law barring private employers from asking, but we have not reviewed every city ordinance, so employment counsel should confirm before you finalize an application. Federal EEOC guidance still favors an individualized look at whether a conviction relates to the job. Treating similar records the same way for every candidate also lowers your exposure under the Idaho Human Rights Act.
Is an iCourt search enough on its own?
It is a strong start, but it has limits. Electronic records generally begin in 1995, personal identifiers are withheld, and a statewide search currently means checking both iCourt and the older Data Repository. It will not show records from other states or federal courts. A sound screen adds clerk file pulls, federal indexes and searches wherever the candidate lived. Our checklist for vetting an Idaho investigator explains what to ask any provider.
How long does an Idaho background check take?
Timing depends on how many counties and states are involved, whether a clerk must retrieve an older file and how fast former employers answer. We do not quote turnaround in hours. Basic remote checks usually move fastest, and we tell you at the start if a rural clerk's office or a slow reference is likely to add time. ISP repository requests are processed in the order received.
Do you need the candidate's permission?
For any report used to hire, promote, retain or reassign someone, the federal FCRA generally requires a standalone disclosure and the candidate's written authorization before the report is obtained. We do not start consumer-report research until the employer confirms the signed release is on file. Research done for litigation or other purposes follows different rules, which we explain when you first call.
Does Idaho require private investigators to hold a license?
Idaho has no statewide private investigator license, though some cities, such as Chubbuck and Coeur d'Alene, regulate investigators or detective agents locally, and requirements should be confirmed before field work inside city limits. Delator Group is a licensed Tennessee private investigation firm and applies Tennessee's licensing standard wherever it works. Our Chubbuck investigations page discusses local rules in that city.
Will a dismissed charge appear on the report?
A dismissed case can still appear in court indexes unless it has been sealed, and ISP keeps dismissed charges in the repository with the dismissal noted until an expungement is approved. Under the FCRA, older non-conviction items generally may not be reported for most positions. We report outcomes accurately, flag dismissals clearly and leave out items the federal rules bar.
Can you check candidates who lived in Washington, Oregon, Utah or Montana?
Yes. Panhandle employers regularly hire people from the Spokane area, and Treasure Valley and eastern Idaho employers draw from Oregon, Utah and Wyoming. We confirm address history first, then search courts in each state where the candidate resided, all within the same written scope. For candidates with Wyoming history, our Wyoming investigations overview describes coverage there.
What happens if a candidate disputes the report?
The FCRA generally gives the candidate a right to dispute the report and have it reinvestigated. We pull the source record again, contact the county clerk if needed and issue a corrected report if an error is confirmed. Hold a final decision until that process ends. If the dispute grows into a claim, our attorney support services are available to the party that retains us first, after a conflict check.
Do you verify degrees and former employers?
Verification is part of the $300 deep-dive check. We contact registrars and former employers using contact details we confirm independently, never numbers supplied only by the candidate. For Idaho schools such as Boise State University, the University of Idaho and Idaho State University, we follow each registrar's confirmation process, and we note in the report whenever an employer declines to answer.
Can you look into an employee we already have concerns about?
Yes, although that is an investigation rather than a screening. We plan the scope with your counsel, check whether the employee recently complained or filed a claim that raises retaliation concerns, and use interviews, records and lawful observation. Our employee surveillance service covers field observation, which never involves trespass under Idaho Code § 18-7008 or recording in places where a person expects privacy.
