Quick answer
What do corporate espionage investigations in Idaho usually involve?
Most begin with a departing employee, a contractor or a leak. Investigators work with counsel and forensic specialists to establish what information existed, what reasonable steps protected it, who accessed it, where it went and what the recipient did with it. Those facts map onto the Idaho Trade Secrets Act. Our Idaho corporate investigations group plans the work with your attorney.
01What it looks like
What Corporate Espionage Looks Like in Idaho Companies
Idaho's most widely reported trade secret case shows the stakes. In 2020, federal prosecutors in Northern California announced that Taiwan's United Microelectronics Corporation had pleaded guilty to stealing trade secrets from Boise-based Micron through former employees of a Micron subsidiary, and agreed to a $60 million fine. The co-defendant, a Chinese state-owned chipmaker, was later acquitted at trial in 2024, according to news reports. With Micron's new fabs planned in Southeast Boise, suppliers and contractors across the Treasure Valley now handle sensitive process information, and our Boise corporate investigators understand that environment.
Most Idaho cases are far smaller and more ordinary. A sales manager leaves a Meridian distributor with the customer list, an engineer at an eastern Idaho contractor takes design files to a startup, or a food processor's recipe and supplier pricing show up at a competitor. The damage can still be serious for a mid-sized company. Our Meridian team and Idaho Falls investigators handle those matters regularly, starting with what counsel needs to prove.
02Idaho law
The Idaho Trade Secrets Act in Plain Terms
Under Idaho Code § 48-801, a trade secret is information, such as a formula, method, program or device, that has economic value because it is not generally known or readily ascertainable by proper means, and that the owner takes reasonable efforts to keep secret. Misappropriation generally means acquiring a secret through improper means, which the statute says can include theft, bribery, misrepresentation, breach of a duty of secrecy and electronic or other espionage, or using or disclosing it without consent. Our investigative consulting team frames the evidence around those elements.
The remedies give counsel real options. Courts may enjoin actual or threatened misappropriation under § 48-802, sometimes for a period that removes any head start the defendant gained. Damages under § 48-803 can include actual loss and unjust enrichment, and willful and malicious misappropriation can bring exemplary damages up to twice that amount. Claims must generally be filed within three years of when the misappropriation was or should have been discovered, under § 48-805, so delay matters. Our Idaho attorney services explain how counsel retains us.
- Economic value from secrecy
- Reasonable efforts to keep it secret
- Improper means includes espionage
- Three years from discovery to file
03First steps
Preserving Evidence Before It Disappears
The first days after a suspicious departure matter most. Company laptops, phones and accounts should be preserved before anyone reissues or wipes them, and access logs, email and file-sharing records should be secured under counsel's direction, steps our workplace theft team also uses. Forensic imaging is work for qualified digital forensic examiners, and we coordinate with them rather than improvise. Our role is to build the human and documentary timeline around the data: who had access, what changed in the employee's behavior and who they talked to. Our workplace surveillance specialists document conduct lawfully where needed.
Idaho Code § 18-2202 makes knowingly accessing a computer system without permission a crime, and it becomes a felony when the access is used to commit fraud or theft or to damage data. That statute protects the company, but it also limits the company's own response. Logging into a former employee's personal email, guessing passwords or accessing a competitor's systems is off limits. We preserve what the company lawfully owns, and our guide to lawful investigator work in Idaho explains the boundaries.
- Preserve devices before reissue or wipe
- Secure logs and accounts through counsel
- Forensic imaging by qualified examiners
- No access to personal or competitor accounts
04Building the facts
Interviews, Records and Lawful Field Observation
Coworkers often know more than the logs show. We interview colleagues, supervisors and IT staff about what the departing employee said, asked for and carried out, and we document those conversations carefully for declarations. Public records add context: new business registrations with the Idaho Secretary of State, domain registrations, job postings and press releases can show when a competing venture took shape. A new LLC formed weeks before a resignation is a common finding, and our business partner research supplies the entity searches.
Field observation can confirm whether a former employee is working for a competitor in breach of a restriction or meeting with a client they promised not to solicit. Observation happens only from public places, and Idaho Code § 18-7008 makes entering posted or fenced property without permission a crime in many cases. Idaho is a one-party consent state under § 18-6702, so intercepting conversations you are not part of can be a felony. Our employee surveillance service applies those limits on every assignment.
05Our boundaries
Investigating Espionage Without Committing It
A company that responds to theft with its own misconduct can lose the case and face claims of its own. We do not pose as customers or recruiters to extract a competitor's information, bribe insiders, place trackers on vehicles the client has no right to or record conversations covertly. The Idaho Trade Secrets Act lists misrepresentation and espionage among improper means, so those tactics could turn the victim into a defendant. We tell clients plainly when a requested tactic crosses the line, as our guide to vetting Idaho investigators recommends any firm should.
Everything we do is designed to be explained under oath. Every interview is documented, every public record is sourced and every observation is logged with time and place. If a case reaches the U.S. District Court in Boise or a state district court, our investigators can testify about how the evidence was gathered. Corporate espionage investigations in Idaho succeed when the record is clean, and our corporate malfeasance team follows the same rules when the problem is internal fraud rather than outside theft.
06Going to court
Building the Record for a Restraining Order or Injunction
When information is actively being used, counsel may need a temporary restraining order quickly. The court will want a clear timeline, specific descriptions of what was taken, evidence of the protective measures the company used and proof of the risk of continuing harm. We organize declarations, exhibits and chronologies in a form counsel can file. Under the Trade Secrets Act, courts must also protect alleged secrets during litigation through measures such as protective orders, in camera hearings and sealed records, which shapes how exhibits are prepared. Our Nampa investigators support Third District filings.
Once papers are filed, they must be served. Delator Field Services offers Urgent, Rush and Same Day Rush service at 1.5, 2 and 3 times a county's routine rate. In Ada County the published starting rate is $125 for routine service, and every price is confirmed in writing before the first attempt. Our Boise process server page covers Ada County, and our Pocatello process servers cover eastern Idaho defendants.
07Prevention
Reducing Exposure Before the Next Departure
Trade secret protection depends partly on proving reasonable efforts to keep information secret, so prevention also strengthens any future case. An information risk audit reviews who can reach sensitive data, how access ends when people leave, whether confidentiality and noncompete agreements are signed and current, and how vendors handle shared information. Idaho Code § 44-2701 allows reasonable written noncompetes for key employees and key independent contractors, which counsel can tailor. Our Idaho risk audits start at $1,200 and end with a written list of fixes.
Hiring is another control point. Screening senior candidates and engineers for prior trade secret disputes, and asking about restrictive agreements with former employers, reduces the chance of importing someone else's information into your company. Exit interviews that remind departing staff of their obligations, and prompt account shutdowns, close common gaps. Our executive candidate screening covers the hiring side, and our Post Falls investigators support Panhandle manufacturers with the same program.
- Access reviews for sensitive data
- Signed confidentiality and noncompete agreements
- Prompt account shutdown at departure
- Screening hires for prior disputes

FAQ
Frequently asked questions
What counts as a trade secret in Idaho?
Under Idaho Code § 48-801, a trade secret is information with economic value because it is not generally known or readily ascertainable, which the owner takes reasonable steps to protect. Customer lists, pricing, formulas, processes, source code and supplier terms can qualify. Information anyone could find easily, or that the company never protected, usually does not. Your attorney decides how to frame the claim.
How soon should we call after an employee leaves?
As soon as you suspect a problem. Devices get reissued, accounts are closed and memories fade quickly. Claims under the Idaho Trade Secrets Act must generally be filed within three years of discovery, but injunctions depend on speed. Call counsel first if you have not already, and we can begin preservation planning the same day.
Can you search a former employee's personal phone or email?
No. Accessing personal accounts or devices without authorization can be a crime under Idaho Code § 18-2202 and could harm your case. Company-owned devices and accounts can be preserved and examined under counsel's direction by qualified forensic examiners. Personal devices usually require consent or a court order obtained through discovery.
Do you do forensic imaging of computers?
We coordinate with qualified digital forensic examiners for imaging and analysis rather than doing it ourselves. Our work builds the human and documentary side of the case: interviews, public records, entity research and lawful observation. Combining the two gives counsel a timeline that explains what the data shows, and our Idaho Falls and eastern Idaho team often coordinates both.
Does Delator hold an Idaho investigator license?
The state does not issue investigator licenses in Idaho. Certain cities, such as Chubbuck and Coeur d'Alene, regulate investigators or detective agents locally, and we confirm their requirements before field work there. Delator Group is a licensed Tennessee private investigation firm and applies that standard here. Our Chubbuck page discusses local rules in that city.
Can a competitor be liable for hiring our employee?
Possibly, if the competitor knew or had reason to know that information it received was obtained by improper means or in breach of a duty of secrecy. The Idaho Trade Secrets Act's definition of misappropriation covers those situations. Evidence of what the competitor knew and when is often central, as our Idaho legal limits guide notes, and our interviews and public-record research help counsel show it.
Is a noncompete enforceable in Idaho?
Idaho Code § 44-2701 allows written noncompetes for key employees and key independent contractors when they are reasonable in duration, geography and type of work and no broader than needed to protect the employer. Enforceability depends on the agreement and the facts, so counsel should review it. We can document whether a former employee is working in breach, lawfully and from public places.
What if the theft involves a federal court case?
Federal claims under the Defend Trade Secrets Act, or criminal referrals, may lead to the U.S. District Court for the District of Idaho in Boise, Coeur d'Alene or Pocatello. Our investigation and reporting standards are the same either way. Counsel decides where to file, and we can testify about how evidence was gathered. See our Idaho investigations overview for related work.
Can you serve the restraining order quickly?
Yes. Delator Field Services offers Urgent, Rush and Same Day Rush service at 1.5, 2 and 3 times the routine rate for the county, with logged, time-stamped attempts and a signed affidavit. Ada County routine service starts at a published $125, and the final price is confirmed in writing. Our Idaho process serving page has details.
What does an espionage investigation cost?
Investigations are billed at $100 per hour under a written scope with a cap agreed in advance. Most departing-employee matters are contained to a defined set of interviews, records and observation. Information risk audits start at $1,200. Urgent service of court papers is priced separately from each county's published starting rate.
