01Local service landscape
Fifteen Municipalities From the River Suburbs to the Ridge
Lexington County had about 317,588 residents in 2025, living in 15 municipalities and a wide band of unincorporated communities. The eastern edge is river suburbs, West Columbia, Cayce, Springdale and the Lexington side of Columbia and Irmo. The middle is the fast-growing town of Lexington and the Lake Murray shoreline. The west and south turn rural toward Gilbert, Batesburg-Leesville, Pelion and Swansea. The Richland County service page covers addresses that land across the Congaree.
Three interstates frame the work. I-20 passes Lexington and West Columbia on its way from Augusta to Columbia, I-26 runs northwest toward the Upstate, and I-77 begins at its junction with I-26 in Cayce. We group attempts by those corridors so a Chapin stop and a Pelion stop do not share one evening. The South Carolina service overview explains coverage in the other counties.
- River suburbs: West Columbia, Cayce, Springdale
- Town of Lexington, Red Bank and Oak Grove
- Lake Murray shoreline, Irmo and Chapin
- Rural west and south: Gilbert, Batesburg-Leesville, Pelion, Swansea
02Attorneys and law firms
For Columbia-Area Firms Filing on East Main Street
Many lawyers who practice in Columbia also file regularly at the Marc H. Westbrook Judicial Center in the town of Lexington. They need papers delivered as a set, an affidavit that matches the caption and a written report after each attempt. Our South Carolina attorney program lists the intake fields that keep a Lexington file moving, including subdivision and lake access notes that save a wasted trip. Firms with defendants in several states can check the multistate pricing overview.
Out-of-state counsel often have a Lexington County defendant because so many Midlands residents commute into Columbia and live across the river. When the issuing court sits in another state, we match the South Carolina delivery and affidavit to that court's rule for out-of-state service, as described on our cross-border papers page. Federal summonses from the Columbia division are handled under Federal Rule 4.
Delator Group is a Tennessee firm headquartered in Nashville and has no office in Lexington County. Serves may be carried out by vetted servers Delator contracts with under a single documentation standard, and every server assigned is at least 18 and not a party to, or an attorney in, the case. The Delator Group story explains the structure behind that standard.
03Evasive and hard-to-serve
Lake Houses, Gated Neighborhoods and Commuters Who Leave Early
Some Lake Murray homes are reached by long private drives or through neighborhood gates, and some owners are present only on weekends. Commuters who cross into Columbia leave early and return late. A defendant in either group may need attempts outside ordinary hours. We schedule early, late and weekend visits when counsel approves and write each one into the log. Our page on difficult service in South Carolina explains how that record is built.
South Carolina permits Sunday service under S.C. Code 15-9-17, with one exception: a person heading to, attending or leaving a religious service. When a defendant cannot be found in the state after due diligence, the court or the clerk of common pleas may order service by publication on an affidavit, with the summons published once a week for three weeks. The publication guide for South Carolina covers that step, and our Lexington town service page focuses on the county seat itself.
- Lake Murray homes behind gates or long private drives
- Weekend-only residents at lake properties
- Early-leaving commuters bound for Columbia
- Rural farm addresses toward Pelion and Gilbert
04Family, landlord, claim and witness papers
Family Court, Magistrate Claims and Landlord Matters in Lexington
Family cases in Lexington County are supported by the Clerk of Court, and their summonses and complaints are served under SCRCP 4 like other civil matters. A cooperating spouse can sign the Acceptance of Service form (SCCA 400.03), which then serves as the proof. Contempt rules to show cause are other process under Rule 4(c), handled by the sheriff, an officer or a court-designated person, so we do not offer them routinely. The divorce papers guide covers each route.
Lexington County's magistrate services pages post the civil rules that govern those courts. SCRMC 6(c) allows the sheriff, a deputy, a magistrate's constable or any adult who is not a party or attorney in the case to serve a magistrate summons, and SCRMC 6(g) requires a private server to make an affidavit of service. Ejectment works differently: the rule to vacate usually goes through the sheriff's office and only a constable or deputy sheriff executes a writ. We serve the rule only where the court confirms private service is accepted, never post or execute a writ, and do serve rent and damage suits. See our landlord papers service.
05Documentation and challenges
What Goes Into a Lexington County Affidavit
Proof of service under SCRCP 4(g) must state the date, time and place of service and the name and address of the person served, or a description if the name is not known. We follow that list in every affidavit and keep the attempt log that sits behind it. Even if proof is never filed, the service itself stays valid under the rule, but a missing affidavit invites an argument nobody needs. Our same-day and rush tiers keep the paperwork complete on short notice.
Challenges in Lexington County tend to involve split households and second homes. If a server left papers with a family member, the affidavit should show that the person lived at that dwelling and was of suitable age and discretion. A lake house that the defendant visits only now and then may not be a usual place of abode at all, and our notes say what the server learned. The South Carolina service methods guide explains each option.
06South Carolina service rules
Two Rule Sets: SCRCP for Circuit Court, SCRMC for Magistrates
In circuit and family court, SCRCP 4(c) lets the sheriff, a deputy or any person at least 18 who is neither a party nor an attorney in the action serve a summons, while orders, rules and writs generally need the sheriff, another officer or a court-designated person. Magistrate court follows the parallel SCRMC 6(c). South Carolina has no statewide license for private process servers, and DFS does not claim any license or appointment here. The explainer on eligibility to serve South Carolina papers has more.
Both rule sets allow personal delivery, abode delivery to a resident of suitable age and discretion and delivery to an authorized agent, plus restricted-delivery certified mail, and the circuit court rules also allow a qualifying commercial delivery service. Mail service supports a default only if the defendant signed. In circuit court, actual service generally must occur within 120 days after filing if the limitations period has run (SCRCP 3(a)). Answers are generally due in 30 days in both courts. Your attorney can confirm the details.
07Local angle
A Circuit That Reaches Far Beyond the Suburbs
The 11th Judicial Circuit pairs Lexington County with three much smaller neighbors: Saluda, Edgefield and McCormick. Circuit judges rotate, but each county keeps its own clerk, so a Lexington case can still name a co-defendant in a rural county with a very different service landscape. Published starting rates show the gap, with Saluda and Edgefield at $185 and McCormick at $225 against $125 in Lexington, as the county rate map shows.
Closer to home, the county line with Richland runs through Columbia, Cayce and Irmo, so confirming the county for each address is part of every quote. When a co-defendant lives across a line, we coordinate service through Aiken County papers or the Columbia city service page under one written quote, so the whole case carries one consistent record. You can call or email DFS about a Lexington file before filing if a county line is in doubt.

- 11th Circuit: Lexington, Saluda, Edgefield, McCormick
- Federal court: Perry Courthouse, Columbia

FAQ
Frequently Asked Questions
Who may serve a summons in Lexington County?
In circuit and family court, the sheriff, a deputy or any person at least 18 who is not a party or an attorney in the case may serve a summons (SCRCP 4(c)). Magistrate court adds a magistrate's constable under SCRMC 6(c). Our South Carolina process serving hub explains how DFS handles each paper type.
What does a Lexington process server cost?
Lexington County carries a $125 published Routine starting rate. Faster tiers multiply it: Urgent by 1.5, Rush by 2 and Same Day Rush by 3. The final price depends on the address, lake or gate access, how many people need service and your deadline, and it is confirmed in writing before any attempt is made.
Can you serve someone at a Lake Murray house?
Yes, with planning. Some lake homes sit behind neighborhood gates or at the end of long private drives, and some are occupied only on weekends. Abode service at a second home works only if it is the defendant's usual place of abode, so we report what we learn to counsel before relying on it.
Will you serve a rule to vacate in Lexington County?
Not routinely. Magistrate courts we checked route the rule to vacate through the sheriff's office, and only a constable or deputy sheriff executes a writ of ejectment. Only if the magistrate court confirms that a private server is acceptable do we accept the rule. Our ejectment guide for South Carolina explains the tenant's ten days.
How long does a Lexington County defendant have to answer?
Generally 30 days after service of the complaint in circuit court under SCRCP 12(a), and within 30 days from the first day after service in magistrate court under SCRMC 7(b). After certified-mail service of the self-help divorce summons, the period is 35 days. A precise service date in our affidavit keeps those calculations simple.
Do you serve papers on Sundays in Lexington County?
With counsel's approval, yes. S.C. Code 15-9-17 allows a process server to serve judicial documents on Sunday, except on a person going to, attending or returning from a church or other religious service. Sunday visits can help with weekend-only lake residents, and each attempt is logged with its exact time.
How are Lexington County businesses served?
Usually through the registered agent, or an officer or managing agent, under SCRCP 4(d)(3). When a South Carolina corporation has no agent who can be served with reasonable diligence, the court or clerk can order certified mail to the corporate secretary under S.C. Code 15-9-210(c). Our corporate service options page covers the rest.
Where do Lexington County federal cases go?
Lexington County is in the Columbia division of the District of South Carolina, so federal cases are heard at the Matthew J. Perry, Jr. U.S. Courthouse on Richland Street in Columbia. We serve summonses and subpoenas from that court under the federal rules, which also allow state-law methods, and write the affidavit for it.
Who can serve a magistrate court subpoena?
Under SCRMC 23(b), a magistrate subpoena may be served by the sheriff of any county where the witness is found, a deputy, a constable of the court, or any person who is not a party and is at least 18. Witness pay is $25 a day plus mileage. Our witness subpoena service covers circuit court subpoenas too.
What if the defendant keeps dodging service?
We keep changing days and hours and log each attempt in detail. If the defendant still cannot be found in South Carolina after due diligence, counsel may seek an order of publication under S.C. Code 15-9-710. Our guide for defendants who avoid service explains how a diligence record is used.
