The published Routine starting rate is $125, and our Spartanburg city page covers the county seat.
01Local service landscape
Fourteen Towns, Two Interstates and a Growing Industrial Base
Spartanburg County counted about 380,857 residents in 2025, spread across the city of Spartanburg, thirteen smaller municipalities and fast-growing unincorporated areas such as Boiling Springs. The towns run from Landrum and Campobello near the North Carolina line to Woodruff in the south. Before we quote, we pin down the parcel, because a Greer or Duncan mailing address can sit in either Spartanburg or Greenville County. Our Greer service page explains that split.
I-85 crosses the county from Greenville past Greer, then loops north of Spartanburg on a bypass while I-85 Business follows the older route. I-26 enters near Landrum and runs southeast through Spartanburg toward Columbia. Those two roads decide most of our routing, so we pair Duncan and Lyman attempts and keep Inman and Landrum on a separate run. The hub for South Carolina service shows how coverage works in the other counties.
- City of Spartanburg and the Magnolia Street court area
- West side along I-85: Duncan, Lyman, Wellford, Greer
- North along I-26: Inman, Campobello, Landrum
- East and south: Chesnee, Cowpens, Pacolet, Woodruff

Product, Employment and Contract Cases With Upstate Defendants
Spartanburg County's economy leans heavily on manufacturing and distribution. The BMW plant that opened in 1994 sits in Greer on the Spartanburg County side, and South Carolina Ports runs an inland port in Greer. Contract, employment and product cases tied to that base often name a company or employee here. Our South Carolina law firm program lists the intake details that help counsel move those files, and a plant or warehouse defendant often needs the employer's access rules checked first.
Many of those suits are filed outside South Carolina, and the issuing court's rules govern how out-of-state service must look. Tell us that rule and we match the Spartanburg delivery and affidavit to it, as our out-of-state papers service describes. Federal summonses from the Spartanburg division are handled under Federal Rule 4, with an affidavit written for the federal court.
Delator Group is a Tennessee firm headquartered in Nashville and has no Spartanburg office. Serves may be carried out by vetted servers Delator contracts with under one documentation standard, and every server we assign is at least 18 and is not a party to, or an attorney in, the case. You can read about the firm before sending papers, or ask a Spartanburg question first.
03Evasive and hard-to-serve
Rotating Shifts, New Subdivisions and Rural Roads
Plant and warehouse schedules mean a lot of Spartanburg County residents work nights or rotating shifts. A defendant who is never home at dinner time may be asleep at noon and awake at ten in the evening. We vary attempt times on purpose and log the result of each one. New subdivisions in the county's growth areas add another wrinkle, since house numbers and street names are not always on mapping services yet.
Rural addresses near Chesnee, Pacolet and Woodruff call for daylight visits and careful notes on driveway access. S.C. Code 15-9-17 lets Sunday attempts go ahead, other than on someone bound for, at or returning from church or another religious service. If a defendant cannot be found in the state after due diligence, publication may be ordered under S.C. Code 15-9-710. Our pages on evasive Upstate defendants and court-ordered publication cover the record counsel need.
- Night and rotating shifts at plants and warehouses
- Newly built subdivisions with incomplete mapping
- Rural driveways near Chesnee, Pacolet and Woodruff
- Sunday attempts outside religious-service travel
04Family, landlord, claim and witness papers
Family Court, Magistrates and Landlord Cases Under One Roof
The county says its courthouse on Magnolia Street houses the circuit, family, probate, magistrate and municipal courts along with the clerk, so most Spartanburg civil papers start in one building. Divorce, custody and support summonses are served under SCRCP 4, and a cooperating spouse can sign an Acceptance of Service (SCCA 400.03). Family court rules to show cause are other process under Rule 4(c), handled by the sheriff or a court-designated person. Our family court papers page explains what DFS takes on.
Magistrate civil claims run up to $7,500, and SCRMC 6(c) lets any adult who is not a party or attorney in the case serve their summonses, proving service by affidavit. The magistrate claims service page has more. For ejectment, the rule to vacate is usually served through the sheriff's office, and only a constable or deputy sheriff executes a writ. We serve the rule only where the magistrate court confirms private service is accepted, never post or execute a writ, and do serve rent and damage suits, as our landlord-tenant papers overview shows.
05Documentation and challenges
Affidavits Written for a Single-Courthouse County
SCRCP 4(g) requires proof of service to state the date, time and place of service and the name and address of the person served, or a description if the name is unknown. A private server makes that proof by affidavit. Because so many Spartanburg courts share one building, we take particular care that the affidavit names the right court and case number. Our Upstate rush service keeps the same detail on a short timeline.
When service is challenged, the questions are usually whether the right person received the papers and whether an allowed method was used. If copies were left with a household member, the affidavit should show the person lived there and was of suitable age and discretion. A shift worker's roommate who happens to answer the door may or may not qualify, and our notes say which. The walkthrough of South Carolina service methods explains each option.
06South Carolina service rules
Who Serves What Under South Carolina's Rules
SCRCP 4(c) lets the sheriff, a deputy or any person 18 or older who is not a party to or an attorney in the action serve a summons. Its second sentence sends all other process, such as orders, rules and writs, to the sheriff, another officer or a person the court designates. South Carolina has no statewide license for private process servers, and DFS does not claim any South Carolina license or appointment. The explainer on who may serve legal papers in South Carolina goes deeper.
For a summons, South Carolina allows personal delivery, abode delivery to a resident of suitable age and discretion, delivery to an authorized agent, restricted-delivery certified mail and a qualifying commercial delivery service. A default based on mail or courier delivery needs a receipt signed by the defendant. If the limitations period has run, actual service generally must happen within 120 days after filing (SCRCP 3(a)), and defendants generally answer within 30 days. Your attorney can confirm how these apply.

State and Federal Courthouses on the Same Street
In Spartanburg, the new county courthouse at 180 Magnolia Street and the Russell Federal Building at 201 Magnolia Street share a street. The county building, which opened in 2023 according to a local law firm's account, brought most state courts together, while the federal building serves the Spartanburg division for Spartanburg, Cherokee and Union counties. We read every caption before the first attempt so the affidavit is addressed correctly.
Federal cases from the Spartanburg division may be heard in Greenville, Anderson or Spartanburg, so a Spartanburg federal case can involve defendants across the Upstate and beyond. Our multistate rate comparison helps when a defendant lives in another state. When a co-defendant lives outside the county, we coordinate through Greenville County service or York County papers under one written quote, and the county rate finder shows each starting rate.

FAQ
Frequently Asked Questions
Who may serve a summons in Spartanburg County?
The sheriff, a deputy or any person at least 18 who is not a party to or an attorney in the action may serve a summons under SCRCP 4(c). Orders, rules and writs generally go to the sheriff or a person the court designates. Our statewide service page for South Carolina summarizes how DFS handles each type.
What does a Spartanburg process server cost?
Spartanburg County has a published Routine starting rate of $125. From that figure, Urgent is 1.5 times, Rush 2 times and Same Day Rush 3 times. The final price depends on the address, the number of defendants, shift timing and the deadline, and it is confirmed in writing before any attempt is made.
How do you serve someone who works night shift?
We schedule attempts at the hours the person is most likely home and awake, which for night-shift workers often means late morning or early evening on days off. Each attempt is logged with the date, time and observations. If counsel prefers, we can attempt at a workplace, subject to that employer's access rules.
Will you serve an eviction rule to vacate in Spartanburg?
Not as a standard service. Magistrate courts we checked route the rule to vacate through the sheriff's office, and only a constable or deputy sheriff carries out a writ of ejectment. Where the magistrate court confirms it accepts private service of the rule, we can take it on. The step-by-step ejectment guide explains the timeline.
How long does a Spartanburg County defendant have to answer?
Generally 30 days after service of the complaint under SCRCP 12(a). In magistrate court the answer is due within 30 days from the first day after service, and the self-represented divorce summons gives 35 days after restricted-delivery certified mail. A clear service date in the affidavit makes the deadline easy to calculate.
Can papers be served on a Sunday in Spartanburg County?
Yes, with one limit. A process server may serve a summons, complaint or other judicial documents on Sunday under S.C. Code 15-9-17, so long as the person is not on the way to, at, or returning from a church or other religious service. We schedule Sunday attempts only with counsel's approval and log them like any other visit.
How are manufacturers and suppliers served?
Typically the papers go to the registered agent, an officer or a managing agent (SCRCP 4(d)(3)). If the company is a foreign corporation not authorized to do business here, S.C. Code 15-9-245 treats the Secretary of State as its agent for service. A domestic corporation with no reachable agent may be served by court-ordered mail to its secretary. The registered agent delivery page explains the choices.
Do you serve federal papers from the Russell Courthouse?
Yes. Summonses and subpoenas from the Spartanburg division are served under the federal rules, which also allow state-law methods, and the affidavit is written for the federal court. Send the case number, the deadline in the summons and whether counsel has already asked the defendant to waive service under the federal rule.
What if a deposition witness lives in Greenville County?
Any non-party adult may serve the subpoena under SCRCP 45(b)(1), but a non-party deposition subpoena must be issued from and served in the county where the witness lives, works or regularly does business in person. A Greenville resident who works in Spartanburg may fit either county. Our South Carolina subpoena service explains.
What if the defendant never answers the door?
We keep varying times and days and log every visit. If the defendant still cannot be found in South Carolina after due diligence, counsel may ask the court or the clerk of common pleas to order publication under S.C. Code 15-9-710. Our guide to service when someone avoids it lays out the options.
