Quick answer
How do I hire a process server in Durango?
Send the filed papers, every known address and a note if the property may be on tribal land. We confirm the La Plata County address, the tier and the price in writing, then assign a server who logs every attempt. Routine service in La Plata County has a published starting rate of $125, and the Colorado rate map lists Archuleta and Montezuma.
01Local service landscape
Serving Papers in a Mountain Town Far From the Front Range
Durango had an estimated 19,700 residents in 2025, and La Plata County about 56,900. The town sits in the Animas River valley, with subdivisions spreading north toward Hermosa and the Purgatory area, south toward the airport, and east toward Bayfield and Vallecito. Many county addresses are on rural roads, private drives or mountain properties where snow and mud change access through the year. We confirm every address before quoting, and papers for the Western Slope can be paired with Grand Junction process serving.
Southwest Colorado is several hours' drive from Denver, so local coordination matters. US 550 and US 160 both run through Durango, and both appear on the state's commercial chain-law list for winter conditions. Servers plan around daylight and weather, and we never promise winter turnaround times. When an address looks stale, our Durango investigators can confirm a current residence before attempts begin.
- Downtown, Animas Valley and college-area rentals
- Bayfield, Hesperus, Vallecito and Ignacio
- Mountain and rural properties with seasonal access
- US 550 and US 160 corridors
02Attorneys and law firms
Service for Southwest Colorado Firms and Distant Counsel
Durango is unusual: the state courts and a federal court location share one building on East Second Avenue. Local firms send us real estate and construction disputes, tourism and hospitality claims, injury cases, domestic matters and probate notices from across the 6th Judicial District. Delator's attorney services for Colorado give each firm one coordinator for the written quote, the field attempts and the signed return.
Front Range, Arizona and New Mexico counsel often need a Durango resident or second-home owner served, sometimes with an address that is only used part of the year. We review the packet before scheduling and tell counsel when an Archuleta, Montezuma or San Juan County address will require a separate trip. Witness research for trial and lost contact searches in Colorado can run while service proceeds.
03Evasive and hard-to-serve
Seasonal Workers, Second Homes and Defendants Who Disappear Into the Hills
Durango's tourism, ski and river seasons bring workers who live in shared rentals or seasonal housing and move when the season ends. Second-home owners may be in town a few weeks a year. Servers vary their hours and days, log each attempt with its result, and report when a property looks vacant or a neighbor says the owner lives elsewhere, so counsel can redirect the serve rather than repeat failed visits.
Some defendants retreat to remote properties or across state lines to New Mexico or Arizona. A Delator investigator can step in through locating people who avoid being served, and the attempt log supports a C.R.C.P. 4(f) motion asking the court to approve substituted service. Collection counsel can add judgment debtor locates, and stolen vehicle investigations help owners trace property taken out of the area.
04Family law, evictions and subpoenas
Family, Eviction, Small Claims and Subpoena Service in Durango
La Plata County divorce and parenting-time cases are generally heard in district court at the courthouse. Under C.R.S. 14-10-107, the respondent generally must be personally served unless they join the petition or waive service, and the automatic temporary injunction applies from that moment. When one parent lives on tribal land, jurisdiction questions belong with counsel. Read how investigators assist in Colorado parenting-time cases and our divorce asset guide.
Durango landlords file FED cases in La Plata County Court. Under C.R.S. 13-40-104 most residential nonpayment notices run 10 days, and the FED summons must be served or posted seven or more days before the appearance date. Seasonal rentals can raise questions about whether a lease is residential or exempt, which counsel should confirm. Only the sheriff executes a writ of restitution, and tenant screening in Colorado helps landlords avoid disputes.
- Dissolution and parenting-time petitions
- FED summonses for La Plata County Court
- Small claims papers 15 days before trial
- State and federal subpoenas

La Plata County Returns That Stand Up to Challenge
Our Durango returns state that the server is at least 18 and not a party, list the documents, and give the date, time, place and manner of service, following the Judicial Branch JDF 98 form. Behind each is a log of every attempt with directions, road conditions and observations for rural visits. Serves may be carried out by vetted servers Delator contracts with, all working to one written standard, and every job is priced in writing before work begins.
If a defendant disputes service, the record shows whether delivery was personal, on a family member 18 or older at the home, on a listed workplace contact, or after a refusal under C.R.C.P. 4(k). The notes are available to counsel whenever they ask. When the dispute becomes a factual contest, investigative consulting for Colorado cases and wrongful death investigations can help build the record.
06Colorado rules
Colorado Service Rules for Durango Cases
The state of Colorado does not issue process server licenses. C.R.C.P. 4(d) generally lets any non-party adult, 18 or older, deliver the papers. C.R.C.P. 4(e)(1) allows personal delivery, abode service on a member of the person's family 18 or older, workplace service on a supervisor, secretary, administrative assistant, bookkeeper, human resources representative or managing agent, and service on an authorized agent. The Colorado process serving overview explains every method.
Service generally has to be completed within 63 days of filing under C.R.C.P. 4(m). Defendants generally answer within 21 days, or 35 if served outside Colorado or by publication, and publication is limited to property and status cases by court order. These are summaries, not legal advice, and the guide to serving papers in Colorado and what Colorado investigators may lawfully do explain more.

Serving Papers Near the Southern Ute and Ute Mountain Ute Reservations
The Southern Ute Indian Tribe, seated in Ignacio, has a reservation that lies mostly in La Plata County, and part of the Ute Mountain Ute Reservation also reaches into the county. Service on Southern Ute or Ute Mountain Ute land may be governed by tribal law and tribal court rules, and whether state process is effective there depends on the parties, the land status and the claim. We confirm the method with counsel, and with the tribal court where needed, before any attempt.
The Southern Ute Civil Procedure Code lets tribal-court summonses be served by tribal law enforcement, the county sheriff or deputy, or any person over 18 who is not a party, and it allows abode service on a family member over 18. It does not say how state-court summonses are served on the reservation. We never give jurisdiction advice; we raise the question early. Families and elders facing fraud can ask about elder scam investigations and scam investigations.

FAQ
Frequently Asked Questions
Does a process server in Durango need a license?
No. Colorado offers no process server license; under C.R.C.P. 4(d), anyone at least 18 who is not a party can generally serve a summons. Because the state does not screen servers, check how attempts are documented and whether the provider is insured. The Colorado provider vetting guide lists questions to ask.
How much does it cost to serve papers in Durango?
Routine service in La Plata County has a published starting rate of $125. The Durango Urgent tier starts at $188, Rush at $250 and Same Day Rush at $375. Montezuma County starts at $150 and Archuleta at $165. The final price depends on the address, distance, deadline and number of people, and it is confirmed in writing first.
Can you serve someone on the Southern Ute Reservation?
Service on tribal land may be governed by tribal law and tribal court rules, and whether state process is effective depends on the parties, the land status and the claim. We confirm the method with counsel, and with the tribal court where needed, before any attempt. We do not give jurisdiction advice and do not attempt service until that question is resolved.
Where do I file a La Plata County affidavit of service?
The return goes to the court that issued the papers. La Plata County District and County Court cases are filed at the courthouse, 1060 E. Second Avenue, Suite 106, in Durango. Federal cases at the Durango location are in Suite 150 of the same building. Cases from other counties go to that county's clerk.
Do you serve in Bayfield, Ignacio and Hesperus?
Yes. Bayfield, Ignacio, Hesperus, Vallecito, Hermosa and Marvel are in La Plata County, where Routine starts at the $125 published rate. Some addresses near Ignacio may be on Southern Ute land, which raises separate questions. We confirm each address and its status with counsel before scheduling any attempt, and Colorado skip tracing helps when an address is uncertain.
Can papers be left with family at a Durango home?
Usually yes, if the recipient is a family member of the defendant, 18 or older, at the defendant's usual place of abode under C.R.C.P. 4(e)(1). An unrelated roommate or a short-term guest generally does not qualify, and a seasonal second home may not count as the usual abode. Our affidavit records the recipient and their relationship.
What if the defendant only lives in Durango part of the year?
Then the usual place of abode may be elsewhere, which affects whether abode service would be valid. We confirm where the person actually lives before attempts are spent, and if they are out of state, Colorado papers can generally be served there by a qualified adult. Out-of-state infidelity investigations are a separate service for family cases.
How long does a Durango defendant have to answer?
Generally 21 days after service under C.R.C.P. 12(a), or 35 days if served outside Colorado or by publication. FED and small claims cases follow the appearance date in the summons. Calendar from our affidavit's service date and confirm with counsel, and see Colorado missing person guidance if the defendant cannot be found.
Will weather delay a Durango serve?
It can. US 550 and US 160 are on Colorado's commercial chain-law list, and mountain properties may be hard to reach in snow or spring mud. We schedule around conditions, tell you when weather affects an attempt, and never promise a winter turnaround time. Urgent and Rush tiers still depend on safe access.
