Serving Papers Where I-75 and I-16 Meet

Macon and Bibb County operate as the consolidated Macon-Bibb government, and the city counted 157,346 residents in 2020. Nearly every Macon case is filed on Mulberry Street, where the county courts and the Middle District's headquarters stand a short walk apart. That makes Macon a common destination for papers from across central Georgia, and our Bibb County process serving page covers the rural western and southern parts of the county.

I-75 runs north and south through the city, I-16 begins here and heads east toward Savannah, and I-475 bypasses the west side. Those roads put most addresses within easy reach, yet the historic districts in Vineville and Ingleside, apartment complexes along the interstates and rural roads toward Lizella each call for different timing. The county-by-county Georgia rate map shows how Bibb compares with Houston, Jones and Monroe.

02Attorneys and law firms

Service for Macon Firms and Middle District Litigants

Macon is the Middle District of Georgia's headquarters, so federal litigants from across the state send papers here, and the city's firms handle cases from Perry to Milledgeville. Insurance defense, medical malpractice, collections and commercial disputes all depend on clean service, and so do the federal and out-of-state papers we serve in Georgia. Our Georgia attorney service program gives each firm one contact for the quote, the attempts and the affidavit.

We read every document before dispatch. A State Court of Bibb County complaint, a superior court petition and a federal summons each follow their own return path, and we raise gaps early, such as a defendant who has moved to Warner Robins or a company that lists an Atlanta registered agent. When a business is the defendant, our Georgia registered agent service explains how officers, managing agents and the Secretary of State fallback fit together.

03Evasive and hard-to-serve

Rotating Shifts, Rural Lots and People Who Avoid the Door

Central Georgia's hospitals, warehouses along the interstates and the Robins AFB workforce to the south mean many Macon defendants keep shift hours. Someone who sleeps through the day and leaves at dusk will not be found by midday attempts, so we spread visits across mornings, evenings and weekends and record each one. On the rural edges of the county, long driveways and unmarked homes also slow things down, much as they do for Statesboro and Bulloch County service farther down I-16. Read more on Georgia defendants who are hard to serve.

Some people try to dodge service by refusing to answer, sending a relative to the door or moving between addresses. We stay factual in the log: the time, what the server observed, who responded and what they said. That record supports counsel if the court is later asked to allow another method, and our guide to when a person avoids service explains the choices in plain terms.

04Family law, evictions and subpoenas

Divorce, Dispossessory, Magistrate and Subpoena Papers in Macon

Family cases in Bibb County Superior Court, including divorce, custody, legitimation and support, are generally served under O.C.G.A. 9-11-4. Georgia's self-help divorce forms also describe acknowledgment of service, which some couples sign before filing. When personal service is needed, we serve calmly, confirm identity first and avoid confrontation. Our Georgia divorce service guide compares those paths, and the family law papers page lists what to send us.

Landlords in Macon should know that a July 1, 2025 amendment to O.C.G.A. 44-7-51 added an approved process server to the list of people who may serve a dispossessory summons, without defining the term. We confirm with the Bibb County magistrate court before accepting a dispossessory and never carry out writs or set-outs. Statements of claim up to $15,000 and subpoenas round out most local work, as our Georgia magistrate court service page describes.

05Documentation

What a Macon Affidavit Shows When Service Is Disputed

Georgia law requires a private server's proof of service to be an affidavit, and O.C.G.A. 9-11-4(h) calls for the date, place and manner of service and filing within five business days. A late filing pushes back the start of the defendant's time to answer, though it does not void the service. Each Macon affidavit we return covers those points and is supported by a note for every attempt. The Georgia how-to for serving legal papers explains the timeline.

If a defendant later swears they were never served, a precise record answers the question: the address, the hour, the description of the person who accepted and what was said. Outside Tennessee, serves may be handled by vetted servers Delator contracts with, all working to one written documentation standard. Attorneys can ask for attempt notes at any time, the Savannah service page follows the same reporting at the other end of I-16, and deadline-driven matters can move to same day process serving.

06Georgia rules

Georgia's Process Server Categories in Plain English

Georgia's Civil Practice Act limits who may serve a summons. The list in O.C.G.A. 9-11-4(c) runs from the sheriff and deputies to marshals, specially appointed citizens, court-appointed or permanent process servers who are non-party adults, and certified process servers qualified under 9-11-4.1. A certified server must file a yearly notice of intent with each county's sheriff, and a sheriff may refuse to accept certified servers. Our explainer on which people may serve process in Georgia covers each one.

We assign a server who meets the requirements of the court and county involved and confirm that in writing before taking the job. If a court does not allow a private server for a paper type, we say so, and those papers go through the sheriff. After service, the answer period on a superior or state court summons is generally 30 days. These are plain summaries, not legal advice, and your attorney can confirm how they apply to your case. For Gainesville filings, note that the Hall County sheriff bars certified servers, as our Gainesville process service page explains.

How Macon-Bibb Appoints Permanent Process Servers

Macon offers a clear example of how Georgia courts handle permanent process servers. Under O.C.G.A. 9-11-4(c)(4), a court may appoint a non-party adult as a permanent process server, and the State Court of Bibb County does so on a notarized petition filed as a new civil action. Its posted package requires the applicant to be at least 18 and a U.S. citizen, to pass a criminal history check, and to show sheriff certification, a passing score on the state exam or another listed credential.

The appointment lasts three years and covers civil cases in that court, so permanent does not mean indefinite, and the appointed server may not serve where they or a relative have an interest. Other courts set their own schedules, and Gwinnett's magistrate court, for instance, decides applications quarterly. That variety is why we confirm the issuing court's rule before every job rather than assume one answer applies statewide, as explained on our Georgia process serving hub and in Delator Group's background.

FAQ

Frequently Asked Questions

Are Macon and Bibb County the same for service?

Yes, in practice. Macon and Bibb County have a consolidated government, so Macon cases are filed with the Bibb County courts on Mulberry Street. Crawford and Peach counties share the Macon Judicial Circuit but keep their own clerks, and Houston County, home to Warner Robins and Perry, has its own circuit and courts.

How much does a process server in Macon charge?

Routine Bibb County service has a published starting rate of $130. Urgent starts at $195, Rush at $260 and Same Day Rush at $390, which are 1.5, 2 and 3 times Routine. Houston County starts at $145. The final price is set in writing, based on the address, the papers and the deadline.

What is a permanent process server in Macon?

It is a non-party adult a court appoints to serve process in its civil cases on a continuing basis under O.C.G.A. 9-11-4(c)(4). The State Court of Bibb County appoints them on a notarized petition for a three-year term. Delator Field Services does not claim any Bibb County appointment; we assign a server who meets the issuing court's requirements.

Can papers be left with someone at a Macon home?

Georgia's abode rule, O.C.G.A. 9-11-4(e)(7), generally allows the papers to be left at the defendant's dwelling with someone of suitable age and discretion who resides there. Neighbors, guests and workers in the home do not qualify. The affidavit describes the person who accepted, and counsel decides whether abode service is appropriate.

Will you serve an eviction in Macon?

Only once the Bibb County magistrate court confirms it accepts a private server for the dispossessory summons. The 2025 amendment to O.C.G.A. 44-7-51 added approved process servers without defining approval, so practice varies by court. We never carry out writs or set-outs. The how-to on Georgia eviction service walks through the process.

How quickly can papers be served in Macon?

Routine is our standard pace. Urgent, Rush and Same Day Rush move the first attempt earlier at 1.5, 2 and 3 times the Routine rate. Shift schedules and access still affect timing, so we confirm the planned window in writing and update you after every attempt rather than promise a specific hour.

Do Macon subpoenas need a witness fee?

For a witness who resides in a different county from the one where they will testify, O.C.G.A. 24-13-25 generally requires that the subpoena be served with a tender of one day's $25 fee plus 45 cents a mile. Without the tender, the subpoena may not be valid. Our subpoena service for Georgia courts records the tender on the return.

What if the defendant has left Macon?

We report a vacancy or new occupant as soon as an attempt shows it, and counsel decides the next step. If the person has left Georgia, cannot be found after due diligence or is concealing themselves, a court may allow publication under O.C.G.A. 9-11-4(f)(1). Our Georgia guide to service by publication explains the affidavit involved.

Do you serve papers from other states in Macon?

Yes. Share the service rule your home court applies to defendants outside its borders, and the Macon delivery and affidavit follow it. Foreign subpoenas usually need to be issued as Georgia subpoenas through the superior court clerk in the county where the witness lives first. See out-of-state papers served in Georgia.

Do you serve federal court papers in Macon?

Yes. The Middle District of Georgia's headquarters is at 475 Mulberry St., and its Macon Division covers Bibb, Houston and nearby counties. Federal summonses follow Federal Rule 4. We serve them across the division and return an affidavit for the federal file. Contact Delator Field Services with the case details.
