Quick answer
How do surveillance investigations in Idaho work?
An investigator watches a subject from public places or with lawful access, records what is plainly visible with dated video, and keeps a timed log of every movement. In Idaho the planning carries as much weight as the camera, because distances, two time zones and winter passes shape every shift. Each file is quoted on our Idaho investigation price list first.
01Field conditions
Why Idaho Surveillance Takes Different Planning
Idaho is not one surveillance environment but several. The Treasure Valley has grown quickly, and Ada and Canyon counties now hold roughly two of every five Idaho residents, so a subject may live in a newer subdivision with few through streets and little on-street parking. Out on the Snake River Plain the problem reverses: long, open sightlines mean an unfamiliar vehicle is noticed fast. A Panhandle lake town in summer is busy with visitors, and the same town in January is quiet enough that any parked car stands out.
Distance and season add constraints that a city investigator rarely meets. US 95 is the only road connecting the Panhandle to the rest of Idaho, and its grades at White Bird Hill and above Lewiston can slow winter travel, as can the I-90 passes east of Coeur d'Alene. North Idaho runs on Pacific time and the south on Mountain time, so every log entry for a cross-region file records the zone. We plan a mobile follow from Hayden differently from one leaving Twin Falls, and our Hayden investigation page explains the northern approach.
These realities are why surveillance investigations in Idaho begin with a reconnaissance of the subject's area before the first full shift. The investigator notes approaches, likely departure times, parking options and where a lawful vantage point exists. That groundwork keeps hours down and exposure low, and it is described in the written quote. For files centered on the western Treasure Valley, our Nampa investigators know the commuter routes that link Canyon County homes with Boise and Meridian jobs.
- Reconnaissance before the first full shift
- Time zone noted on every cross-region log entry
- Winter routes and passes built into the schedule
- Separate field plans for North and South Idaho
02Legal limits
What Idaho Law Allows During Surveillance
Idaho is a one-party consent state for recording. Idaho Code § 18-6702 generally makes it a felony to intercept a wire, electronic or oral communication, with an exception when one party to the communication has given prior consent. Our investigators are not parties to the conversations they observe, so they do not record audio of other people talking. Surveillance video captures what is visible from a lawful position, and our explainer on Idaho recording law covers what clients themselves may and may not record.
Two other statutes draw firm lines. Second-degree stalking under Idaho Code § 18-7906 covers a malicious course of nonconsensual contact, and the statute expressly lists following someone or maintaining surveillance, including by electronic means. Video voyeurism, now Idaho Code § 18-6605, makes it a felony to use or install an imaging device where a person reasonably expects privacy without consent for prohibited purposes. Covert electronic tracking of a person can amount to stalking, so Delator does not place trackers on vehicles it has no right to.
Trespass rules shape where an investigator can stand. Idaho Code § 18-7008 generally treats land as off limits without permission when it is associated with a home or business, cultivated, fenced as a boundary, or, for open rangeland, posted with No Trespassing signs or orange paint at corners and access points. A first offense can sometimes be an infraction, but we do not test it. Our page on what a PI can legally do in Idaho sets out the wider limits.
03Family law
Infidelity and Custody Surveillance Under Idaho Family Law
Adultery remains a listed ground for divorce in Idaho Code § 32-603, and Idaho Code § 32-705 lets a court consider the fault of either party when deciding maintenance. Property division under § 32-712 does not list fault as a factor, so the value of infidelity evidence depends on what counsel is trying to prove. Our married infidelity surveillance in Idaho records meetings, overnight stays and shared travel in a neutral chronology that a family law attorney can weigh without having to discount the tone.
Custody surveillance has a different purpose. Under Idaho Code § 32-717 the magistrate weighs factors such as the child's adjustment to home, school and community, the need for continuity and stability, and domestic violence whether or not the child was present. Section 32-717B presumes joint custody, but the presumption reverses when a parent is a habitual perpetrator of domestic violence. We document who handles exchanges, whether a parent arrives impaired, who else stays in the home and whether a claimed work schedule is real.
Unmarried parents and partners face similar questions with different stakes, and our surveillance for unmarried partners is scoped around a shared lease, a home or children rather than a divorce petition. Whatever the family matter, the investigator stays in public view, avoids any contact with the children and never misrepresents who they are. Our guide to custody investigations in Idaho explains how this evidence typically reaches the court through counsel.
04Claims
Workers' Compensation and Insurance Claim Surveillance in Idaho
Idaho takes claim fraud seriously on two levels. Idaho Code § 72-801 makes a knowingly false statement to obtain workers' compensation benefits a misdemeanor and forfeits the person's right to compensation, and the felony insurance-fraud statute, § 41-293, also lists false statements made to obtain or extend those benefits, with penalties of up to 15 years. In 2025 the Idaho Department of Insurance reported a guilty plea by a Post Falls man who had collected State Insurance Fund disability benefits after returning to work.
Our workers' comp surveillance is built to be fair to the claimant as well as the payer. Shifts are timed around medical appointments, therapy and stated restrictions, and the report shows rest as clearly as exertion. Idaho's seasonal work patterns matter here: a claimant on a Magic Valley dairy or a farm near Blackfoot may be busiest in particular months, and a single shift on a quiet day proves little. We review the claim file with the adjuster before committing hours.
Auto, liability and disability claims follow the same discipline. An activity check confirms residence and routine first, and focused surveillance follows only when the check suggests it will help. Our insurance claim surveillance records lifting, driving, recreation and work in public places, and our wider Idaho insurance investigations add witness canvasses and background research. Everything stays in public view: no pretext calls to the claimant, no trespass on a ranch or rural lot, and no social media deception.
05Employers
Surveillance for Idaho Employers and Business Owners
Employers usually call when something does not add up: a manager on medical leave seen at a competitor's job site, a crew billing hours on a construction project that looks idle, or a delivery driver whose routes keep running long. Our employee surveillance in Idaho checks those questions with public-view observation and a timed log, so the company can decide on discipline with facts rather than suspicion. Growth across the Treasure Valley and Kootenai County has made contractor and subcontractor disputes a steady source of this work.
On the employer's own premises the options widen. With the owner's permission, an investigator can observe loading docks, yards and parking lots for after-hours access, product leaving through a side door, or misuse of company vehicles. Our workplace surveillance line is planned around shift changes and blind spots, and it pairs well with an audit when losses are recurring. Where a known employee is suspected of taking money or inventory, the Idaho employee theft line builds the record for discipline or referral.
Business surveillance carries the same legal limits as any other file. We do not record private conversations, place devices in restrooms or break rooms, or follow employees into private homes. Idaho's at-will rule is a matter of case law with recognized exceptions, so a termination based on surveillance should be reviewed by employment counsel first. Larger internal matters move to our corporate investigations in Idaho, where surveillance becomes one tool among interviews, records and financial review.

Evidence and Reports Built for Idaho Courts and Claims Files
A surveillance report is only as useful as its credibility. Every Delator log records the date, the time with its zone, the location, the investigator's vantage point and what was observed, in plain language and in order. Video is kept in its original form, with clips matched to log entries, so an attorney or examiner can move from a sentence in the report to the footage that supports it. Gaps are recorded too: if the subject was out of view for twenty minutes, the log says so.
Idaho matters can land before a magistrate, a district judge, a federal judge in Boise, Coeur d'Alene or Pocatello, an Industrial Commission referee or a claims committee. Our reports are written to be read by any of them without an investigator in the room, and the investigator can testify to the work if needed. Attorneys who want help beyond surveillance, such as witness interviews or records retrieval, can review our attorney services in Idaho for the full list of litigation tasks.
Before delivery, Delator leadership reviews each report for accuracy, neutral wording and completeness. We remove guesses, label opinions as opinions and make sure every photograph is dated and described. Clients receive the report, the footage and a short summary of what the evidence does and does not show. If the subject travels into Washington, Oregon, Utah, Montana or Wyoming, our out-of-state surveillance keeps the record continuous across the border.
- Timed log with the time zone on every entry
- Original video matched to log entries
- Gaps in observation recorded, not hidden
- Leadership review before delivery
07Choosing a firm
Choosing a Surveillance Firm When Idaho Issues No State PI License
Idaho does not license private investigators at the state level, so the state does not check a surveillance investigator's background, training or insurance. Some cities regulate the work locally: Chubbuck's city code covers private investigators and requires fingerprint background checks, Coeur d'Alene issues a security agency and agent license that covers detectives, and Pocatello has reportedly required a bond for investigator and security businesses. Confirm current local requirements before work inside those city limits. Delator claims no Idaho city license.
When you interview a firm, ask who will sit in the vehicle and what their background is, how the firm keeps its investigators out of stalking and trespass territory, and whether it will show proof of insurance. Ask to see a redacted sample report. Ask how it handles a subject who notices the surveillance, because a good investigator ends the shift rather than pressing on. Our guide to vetting a PI in Idaho lists more questions.

How it works
How an Idaho Surveillance Assignment Runs
- 01
Scope the question
Leadership asks what you need to prove, where the subject lives and works, and which days matter. Together we decide whether surveillance is the right tool at all.
- 02
Quote and reconnaissance
You receive a written estimate of shifts, travel and total cost. After approval, an investigator studies the area to find lawful vantage points and likely routes.
- 03
Field shifts
The investigator observes and records from public or permitted positions, keeps a timed log with the time zone, and ends a shift rather than risk exposure.
- 04
Reviewed report
Leadership reviews the log, video and summary for accuracy and neutral wording, then delivers a report built for counsel, a court or a claims file.

Statewide coverage
Surveillance Coverage by Idaho Region
Treasure Valley work centers on Boise, Meridian and Nampa, where a Meridian surveillance assignment often covers subjects who commute across both Ada and Canyon counties. Magic Valley claims and dairy-country files are planned through our Twin Falls investigator coverage. In the north, Post Falls surveillance coverage handles subjects who move between Kootenai County and Spokane, and lake-country matters run through our Sandpoint investigators. Eastern Idaho shifts along I-15 and US 20 are scheduled from Idaho Falls and Pocatello, with Upper Snake files reaching Rexburg and St. Anthony.
FAQ
Frequently asked questions
Is it legal to hire a private investigator for surveillance in Idaho?
Yes. Observing and recording what is plainly visible from public places or with lawful permission is generally legal in Idaho. What is not allowed is trespassing on posted or fenced land, intercepting conversations under Idaho Code § 18-6702, voyeuristic recording under § 18-6605, or a malicious course of surveillance that meets the stalking statute. We plan every file around those limits.
Can an investigator put a GPS tracker on a car in Idaho?
Not on any vehicle we lack a right to track. Idaho's stalking statute, § 18-7906, lists maintaining surveillance by electronic means as a form of nonconsensual contact, and we found no Idaho statute that clearly authorizes covert tracking by a private party. Even owners of a shared vehicle should talk to counsel before using one, because federal law and the facts can matter.
How much does surveillance cost in Idaho?
Surveillance is billed at $100 per hour, including report preparation. A focused infidelity matter may need two or three shifts, while a workers' comp claim may need an activity check followed by several targeted days. The written quote estimates the hours and travel for your region, and you approve it before any shift is scheduled. Our Idaho PI cost guide gives more examples.
Can you record audio during surveillance in Idaho?
Our investigators do not record other people's conversations. Idaho is a one-party consent state, so a participant in a conversation can generally record it, but an investigator watching from a car is not a participant. Surveillance video captures what is visible, and any sound picked up incidentally is not used to capture private speech. Our Idaho hotel surveillance follows the same rule in lobbies and parking areas.
Will surveillance evidence hold up in an Idaho custody case?
Whether evidence is admitted and how much weight it gets is for the magistrate, but careful surveillance helps. Our logs are dated, timed, neutral and matched to original video, and the investigator can testify about how the work was done. Evidence tied to the § 32-717 factors, such as stability, routine and domestic violence, is usually the most useful to counsel.
Do you handle surveillance in North Idaho and Spokane?
Yes. Kootenai and Bonner county subjects often work or shop in Washington, so we scope cross-border observation explicitly and note where Washington law may apply. North Idaho logs are kept in Pacific time. A Coeur d'Alene private investigator assignment is the usual starting point for northern files and for lake-country resort work.
What if the subject notices the investigator?
The investigator ends the shift and reports it. Pressing on after being noticed risks the file, the subject's safety and the client's case, and it can drift toward conduct the stalking statute was written to prevent. We will suggest a different day, a different approach or a pause, and you will not be billed for anything you have not approved.
How quickly can surveillance start in Idaho?
Start dates depend on the region, the subject's schedule and the days that matter most. We will not promise a specific number of hours to launch, but once you approve the written scope, leadership schedules reconnaissance and the first shift as soon as an investigator can be assigned in that part of the state. Winter weather on the passes can affect northern timing.
Can surveillance help with a workers' comp claim in Idaho?
It often can. Surveillance that shows activity inconsistent with stated restrictions may support a surety's decision or a referral, since false statements can trigger forfeiture under Idaho Code § 72-801 and charges under § 41-293. Equally, it may confirm the claimant's limits. Our reports present both, and adjusters can also use our skip tracing in Idaho to confirm a claimant's current address first.
Is Delator Group licensed to do surveillance in Idaho?
Idaho issues no statewide private investigator license. Delator Group is a licensed Tennessee private investigation firm that applies Tennessee's standard wherever it works, and some Idaho cities such as Chubbuck and Coeur d'Alene regulate investigators locally, so we confirm local rules before working inside them.
