Quick answer
How do I hire a process server in Hampton?
Send the filed papers, the address and any return date. We confirm the address is in Hampton rather than Poquoson, Newport News or York County, identify the issuing court and quote in writing. Hampton's published Routine starting rate is $125, and the Virginia service rate map shows the neighboring localities.
01Local service landscape
A City Formed From Hampton, Phoebus and Elizabeth City County
Modern Hampton dates to 1952, when the city of Hampton, the incorporated town of Phoebus and Elizabeth City County merged into one independent city after voter approval. Many residents still describe where they live by those older names, along with Fox Hill, Wythe, Buckroe and the Coliseum area. The city sits at the tip of the Peninsula, bordered by water on the east and south and by Newport News, York County and Poquoson on land. The Newport News process service page handles defendants just to the west.
Interstate 64 runs through the middle of the city and crosses to Norfolk on the Hampton Roads Bridge-Tunnel, whose expansion is reported to finish in early 2027. That single crossing affects timing when one case names defendants on both sides of the harbor, and we plan attempts around it rather than promising a time. Most state-court returns go to King Street downtown, where the courts face each other. The Virginia rate comparison by locality helps when a case reaches past the city line, as does service across the harbor in Norfolk.
- Consolidated in 1952
- Circuit court at 237 N. King St.
- General district court at 236 N. King St.
- HRBT on I-64 to Norfolk

Help for Peninsula Counsel and Firms Filing From Elsewhere
Hampton attorneys and the firms that sue Hampton residents from Richmond, Norfolk or out of state send us warrants in debt, complaints, motions for judgment and witness subpoenas. Having the circuit clerk at 237 North King Street and the general district court at 236 North King Street makes local filing simple, but a paper that names the wrong court still causes trouble. We read the caption and the issuing office before dispatch, and our Virginia attorney service program keeps the file with one contact.
Federal cases from Hampton belong to the Eastern District's Newport News Division, and those summonses follow Federal Rule 4. For a subpoena from another state, the paper is first submitted to the clerk of the Virginia circuit court where the discovery will happen, and the clerk issues a Virginia subpoena that we then serve. Counsel can read how we handle out-of-state papers in Virginia and the Virginia subpoena service notes before sending a file.

Base Schedules, Waterfront Homes and Doors Left Unanswered
Langley Air Force Base, now part of Joint Base Langley-Eustis, sits next to Hampton, and NASA's Langley Research Center is also in the area. Many Hampton defendants keep base or contractor schedules, and some are away on assignment for weeks. Installation access is the command's decision, so we coordinate through counsel instead of attempting entry, and we focus on home addresses at the hours someone is likely there. Our notes on Virginia defendants who avoid service explain the scheduling.
Along Fox Hill, Buckroe and the waterfront, homes can sit at the end of long lanes or behind fences, and a parked car does not always mean anyone is home. Every visit is logged with the time, any visible activity and any conversation. Va. Code 8.01-289 forbids Sunday service of civil process, so attempts run Monday through Saturday. When a defendant keeps avoiding the door, counsel can use the record to consider the options in our guide for when someone avoids service.
04Family law, landlords and subpoenas
Family Petitions, Tenant Summonses, Small Claims and Witnesses
Hampton divorce complaints are filed at the circuit court clerk's office on North King Street, while custody, visitation and support start in the Juvenile and Domestic Relations District Court. A spouse may accept divorce service by a notarized writing or by signing before the clerk under Va. Code 20-99.1:1, and counsel often asks for that first. When the other side will not sign, we arrange a private personal delivery. Our service of Virginia divorce papers page compares the routes.
Landlords file unlawful detainer cases at the general district court across the street. A private server may deliver the summons under Va. Code 8.01-126, with service required at least 10 days before the return day. Once a judgment is entered, the sheriff executes the writ of eviction after giving the tenant at least 72 hours' notice, and we take no part in that. Small claims up to $5,000 are described on the Virginia small claims service page, and the unlawful detainer guide walks through the tenant process.
- Divorce in the 8th Circuit
- Custody and support in J&DR
- Unlawful detainer summons only
- Small claims division to $5,000
05Documentation
The Return a Hampton Clerk Expects From a Private Server
Under Va. Code 8.01-325, a return by anyone other than a sheriff must include the server's affidavit of qualifications, the date and manner of service, the name of the party served, a stamped or printed annotation that service was made by a private server, and the server's name, address and telephone number. The return is due at the clerk's office within 72 hours unless the court directs otherwise, and a weekend or holiday deadline moves to the next business day. The guide to serving papers in Virginia shows the full sequence.
We keep a separate attempt log for every Hampton job: addresses, dates, times, who responded and what was seen. If a defendant later moves to quash, counsel has a specific record rather than a general account. Outside Tennessee, serves may be carried out by vetted servers Delator contracts with, and each follows the same written documentation standard. Short deadlines are covered by Virginia same day and rush serves, and Portsmouth service uses the same record across the water.
06Virginia rules
Virginia's Service Statutes Applied to Hampton Cases
Va. Code 8.01-293 permits service by the sheriff or by any person 18 or older who is not a party and has no interest in the subject matter, and a person who does that for a fee is a private process server. Virginia sets no license requirement. Officers keep certain acts: executing writs of possession, levying on property and serving capias or show cause orders. Protective orders are a job for law enforcement. We do none of those, as our Virginia guide on who may serve explains.
Individuals are served under Va. Code 8.01-296. The first choice is personal delivery. If the defendant is not at the usual place of abode, a family member 16 or older who lives there, not a guest, may take a copy after being told what it is. If neither works, the copy may be posted at the main entrance, after which the filing party or its attorney mails a copy and files a certificate of mailing at least 10 days before default. The Virginia posted service guide explains that step.
07Hampton angle
Hampton or Poquoson: Two Cities, Two Circuits
Poquoson is a separate independent city that borders Hampton, and addresses near the line are easy to mix up. The difference matters: Hampton is the only locality in the 8th Judicial Circuit, while Poquoson belongs to the 9th Circuit along with Williamsburg and several counties such as York and James City. A case against a Poquoson resident is filed in a different courthouse, and Poquoson carries its own published rate. We confirm which city the street address is in before quoting.
The same check applies to the York County line north of Hampton and the Newport News line to the west. A process server in Hampton who gets the locality right keeps the quote accurate and tells counsel which clerk, and which sheriff, would be involved if a private serve fails. When an address turns out to be across the line, the Williamsburg-area page or the statewide Virginia process serving page points to the right coverage, and Delator Group's about page explains who stands behind it.

FAQ
Frequently Asked Questions
Who may serve papers in Hampton?
Under Va. Code 8.01-293, the sheriff or any person 18 or older who is not a party and has no interest in the subject matter may serve process. A person doing it for a fee is a private process server. No Virginia license is required, but every private-server return must carry an affidavit showing the server is qualified.
How much does a process server in Hampton cost?
The City of Hampton's published Routine starting rate is $125, so Urgent is $188, Rush $250 and Same Day Rush $375. The price for your job depends on the papers, the address and the deadline, and we put it in writing before a server goes out. Poquoson and York County addresses carry their own published rates.
Can you serve someone at Langley?
Access to Joint Base Langley-Eustis is controlled by the command, so we coordinate through counsel rather than attempting entry. Many service members are easier to serve at home at the hours they are off duty. Before any default, counsel handles the Servicemembers Civil Relief Act affidavit required by federal law. Our Virginia hard-to-serve page covers scheduling.
Which court gets the return in Hampton?
The clerk of the court that issued the papers. Circuit court papers return to 237 North King Street, and general district court papers to 236 North King Street across the street. We read the issuing office on the summons or warrant before filing and include the 8.01-325 details on every private-server return.
Can you serve a Hampton unlawful detainer?
We serve the summons. Va. Code 8.01-126 allows a private server to deliver it, and service is due no later than 10 days before the return day. The writ of eviction is executed by the sheriff, who gives the tenant at least 72 hours' notice first. Our Virginia eviction papers page shows each step.
Is my address in Hampton or Poquoson?
Poquoson is a separate independent city in the 9th Circuit, while Hampton is the only locality in the 8th Circuit. A mailing address near the line can be misleading. Send the full street address and we confirm the locality before quoting, which also tells counsel which courthouse and sheriff are involved.
Do you serve papers on Sunday in Hampton?
No. Sunday is off limits for civil process in Virginia under Va. Code 8.01-289, apart from rare cases like a person escaping custody. Our Hampton attempts fall on weekday mornings and evenings and on Saturdays, and the attempt log shows the full pattern if a court later reviews diligence. See statewide Virginia process serving for other timing rules.
How long does a Hampton defendant have to answer?
In circuit court, Rule 3:8(a) of the Rules of the Supreme Court of Virginia generally allows 21 days after service of the summons and complaint. General district court cases run to the return date shown on the warrant or summons. A signed waiver under Va. Code 8.01-286.1 changes the timing, so counsel should confirm the deadline.
Can you serve a business in Hampton?
Yes. Va. Code 8.01-299 allows service on an officer, director or registered agent of a Virginia corporation, and on the registered agent of an LLC. If no registered agent can be found with reasonable diligence, the Clerk of the State Corporation Commission may become the agent, and that filing goes through the Clerk's office. See Virginia registered agent service.

Delator Field Services coordinates Hampton serves through vetted servers who follow our written documentation standard, and you work with one DFS contact throughout.
