Quick answer

How do I hire a process server in Dorchester County, South Carolina?

Send the filed summons and complaint, every address you have for the defendant and your deadline. We confirm the court and the paper type, quote the tier in writing, assign a server who is at least 18 and not a party or attorney in the case, and return a signed affidavit. Routine work starts at $130; see the South Carolina county rate map.

01Local service landscape

A County Divided Between Fast Suburbs and a Quiet Upper End

Dorchester County had roughly 178,397 residents in 2025, and most of them live in the lower county around Summerville and the North Charleston line. The upper county looks different: St. George, Harleyville and Reevesville are small towns surrounded by timber and farmland. A serve in a new Summerville subdivision and one on a rural lane outside St. George need different planning, so our process serving across South Carolina program sets each assignment up under the same written standard.

Two interstates frame the county. Interstate 95 passes St. George at exit 77, where US 78 crosses it, and exit 82 at US 178 serves Harleyville and Bowman. Interstate 26 links the I-95 interchange, which sits just across the line in Orangeburg County, with Summerville and North Charleston. Papers for addresses inside town limits often go to our Summerville process servers, and the published South Carolina county rates show every county's starting figure. Firms in Charleston proper can also use our Mount Pleasant service team for East Cooper addresses.

02Attorneys and law firms

Working With Firms That File in the 1st Judicial Circuit

Dorchester County files come from Summerville and Charleston practitioners, from Orangeburg offices that also appear in 1st Circuit courtrooms, and from out-of-state firms whose clients moved to the Lowcountry. Typical work includes collection and contract suits, vehicle claims from I-26 traffic, construction disputes tied to residential growth, and domestic cases. Our service program for South Carolina law firms gives counsel one contact for the quote, the attempt log and the affidavit.

Before the first attempt we read the papers for practical issues: a Summerville address that is actually in Berkeley County, an employer whose registered agent sits in Columbia, or a defendant who commutes into Charleston every weekday. Under SCRCP 12(a), a defendant generally has 30 days after service to answer, so we send the affidavit promptly. Firms handling several states can compare figures on the multistate process serve pricing map before assigning work.

03Evasive and hard-to-serve

Commuters, Gated Subdivisions and Doors That Stay Shut

Avoidance in Dorchester County often looks like a long commute. Many residents leave Summerville before dawn for jobs in North Charleston or Charleston and return after dark, while others work shifts that keep them asleep at midday. Some newer neighborhoods have gated entrances. We plan attempts at varied hours and days, and because S.C. Code 15-9-17 allows Sunday service except on someone going to, attending or leaving a religious service, weekend timing is planned with counsel. See our page on defendants who dodge service in South Carolina.

When attempts keep failing, the record carries the case forward. Each visit is logged with the date, time, location and what the server observed. If counsel concludes the defendant cannot be found in the state after due diligence, S.C. Code 15-9-710 lets the court or the Clerk of Court for Common Pleas order service by publication on an affidavit. Our publication guide explains the steps, and rush and same day tiers help when a hearing is close.

04Family law, evictions, small claims, subpoenas

Family Court, Rental Disputes, Magistrate Claims and Witnesses

Domestic cases in Dorchester County are heard at the Troy Knight Judicial Complex in Summerville. A family court summons and complaint can be served like any civil summons under SCRCP 4, and a spouse who cooperates can sign an Acceptance of Service. Rules to show cause and protective orders are different: they go through the sheriff, law enforcement or a person the court designates, so we do not list them as routine work. Read how South Carolina divorce papers are served for the sequence.

Rental housing in the lower county produces steady landlord files. The magistrate issues a rule to vacate or show cause, the tenant has ten days after service, and the magistrate courts we checked send that rule through the sheriff's office. We do not serve it unless the court confirms private service is accepted, and we never post or carry out a writ of ejectment. We do serve summonses for unpaid rent or damages, magistrate claims up to $7,500 and Rule 45 subpoenas. Our South Carolina eviction paperwork page has more.

  • Family court summonses and complaints for Summerville hearings
  • Summonses in separate suits for rent or property damage
  • Magistrate court summonses under SCRMC 6(c)
  • Rule 45 subpoenas, with the $25 daily witness fee noted for counsel

05Documentation and challenges

An Affidavit Built for a Contested Serve

In South Carolina, a sheriff proves service by certificate and anyone else proves it by affidavit. SCRCP 4(g) asks that the proof state the date, time and place of service and the name and address of the person served, or a description when the name is unknown. Our affidavits follow that list, and we send them quickly so your office can file with the Clerk of Court in St. George or with the court that issued the papers.

The affidavit is drawn from notes made at each attempt: arrival time, vehicles present, who answered and what was said. When papers are left at the dwelling with a resident of suitable age and discretion, the record names or describes that person and explains how residence was confirmed. Questions about a disputed serve can start on our contact page, and the story behind Delator Group explains who stands behind the paperwork.

06South Carolina service rules

How South Carolina Law Routes a Summons in Dorchester County

Under SCRCP 4(c), a summons may be served by the sheriff, a deputy, or any person at least 18 who is not a party to or an attorney in the case. Court orders, rules and writs fall under the rule's second sentence, which points to the sheriff, another officer or someone the court designates, so we check with the issuing court before taking any of them. South Carolina has no statewide license for private process servers, and every server we assign meets the age and independence requirements. Our explainer on who may serve papers in South Carolina covers the details.

Rule 4(d)(1) gives three routes for an individual: hand the papers to the defendant, leave them at the dwelling with a resident of suitable age and discretion, or deliver them to an agent authorized to receive them. A summons can also go by restricted-delivery certified mail under 4(d)(8) or a qualifying commercial delivery service under 4(d)(9), but mail service supports a default only when the defendant signed. If the statute of limitations has run, SCRCP 3(a) generally requires service within 120 days after filing. This is general information, not legal advice; our step-by-step guide to serving papers adds detail.

07A Dorchester County angle

One County, Two Courthouses and Towns That Cross County Lines

Dorchester County splits its court business between two places. Common Pleas filings and the Clerk of Court sit in St. George, in the upper county, while family court hearings take place in Summerville, near most of the population. A return of service belongs with the court that issued the papers, so we label every affidavit with the case caption and the correct location. Counsel who file in both buildings, or who also have papers moving between states, keep one point of contact.

County lines add another layer. Summerville extends into Berkeley and Charleston counties, and North Charleston reaches into all three, so the same street name can sit under different sheriffs and magistrates. We confirm the county from the street address before planning attempts. Defendants on the Berkeley side are handled through our Berkeley County process serving, and those south of the line through service in Charleston County, all under one quote.

FAQ

Frequently Asked Questions

Can a private process server deliver papers in Dorchester County?

Yes, for a summons. SCRCP 4(c) allows the sheriff, a deputy, or any person at least 18 who is not a party to or an attorney in the case to serve it. Other process, such as court orders and rules to show cause, generally goes through the sheriff or a person the court designates. Our overview of South Carolina service rules explains the split.

How much does a process server in Dorchester County cost?

The published Routine starting rate for Dorchester County is $130. Urgent service is priced at 1.5 times that, Rush at twice it and Same Day Rush at three times. Remote upper-county addresses or gated communities can change the plan, and we raise that before any work begins. The final price is always confirmed in writing, and our South Carolina rate lookup shows nearby counties.

Where are Dorchester County affidavits of service filed?

Common Pleas affidavits go to the Clerk of Court at the Dorchester County Courthouse, 5200 E. Jim Bilton Blvd. in St. George. Family court matters are heard at the Troy Knight Judicial Complex on Deming Way in Summerville, and counsel can confirm where that clerk wants filings. Federal cases belong to the Charleston division. We prepare the affidavit for whichever court issued the papers.

Can a family member at the house accept the papers?

Generally yes. Under SCRCP 4(d)(1), the server may hand the papers to a person of suitable age and discretion who resides in the defendant's home. Someone just visiting, a neighbor or a hired worker would not count. Our affidavit records who received the papers and how the server confirmed that person resides at the address.

Do you serve eviction papers in Dorchester County?

Not the rule to vacate as a standard service. The magistrate courts we checked route that rule through the sheriff's office, and only a constable or deputy sheriff carries out a writ of ejectment. We serve a landlord's other papers, such as summonses in suits for unpaid rent or damages and subpoenas for hearing witnesses. See our guide to ejectment papers in South Carolina.

What happens if the defendant cannot be found?

Our log captures each visit as it happens. If the defendant cannot be found in South Carolina after due diligence, the court or the Clerk of Court for Common Pleas can order service by publication on an affidavit under S.C. Code 15-9-710. A dated attempt log is the kind of record counsel use to show that diligence. Read what happens when someone avoids service.

Can you serve papers on a Sunday in Summerville?

South Carolina allows Sunday service under S.C. Code 15-9-17, with one exception: a server may not serve someone who is going to, attending or returning from a church or other religious service. We plan Sunday attempts with counsel and choose times and places that avoid that situation entirely, and every attempt still appears in the dated log.

How quickly can papers be served in Dorchester County?

Routine service usually starts with a first attempt within several days. Faster tiers cost 1.5, 2 or 3 times the Routine figure, and whether Same Day Rush is possible depends on the address and the hour we receive the papers. Tell us the hearing or filing date and we will say in writing what is realistic before you commit. Details are on our South Carolina rush service page.

Is Delator Field Services located in Dorchester County?

No. DFS works out of Nashville as the process serving division of Delator Group, a Tennessee firm headquartered there, and has no South Carolina office. In Dorchester County we coordinate service through vetted servers suited to the court involved, with logged attempts, a price confirmed in writing beforehand and a signed affidavit on every assignment.

What should I include with a Dorchester County request?

Send the filed summons and complaint, the defendant's full name, every known home and work address, gate or subdivision access notes, a description or photo, vehicle details and the deadline. Subpoena requests should name the witness and give the hearing date and courtroom. Self-represented filers can start with magistrate court service in South Carolina so nothing is missing at intake.
