Quick answer

How do I hire a process server in Portsmouth?

Send the filed papers and the defendant's street address. We confirm the address is inside Portsmouth rather than Chesapeake or Suffolk, identify the issuing court on Court Street and send the price in writing. Portsmouth's published Routine rate starts at $125, and Norfolk service across the river runs on the same terms.

01Local service landscape

Historic Districts, Waterfront Streets and One Court Street Address

Portsmouth is one of the older cities in Hampton Roads, and its housing shows it. Olde Towne, Port Norfolk, Park View, Cradock and Truxtun are all listed historic districts, with tightly spaced homes, alleys and porches that change how a server approaches a door. Newer subdivisions in Churchland and Hodges Manor look more like the suburbs next door in Chesapeake and Suffolk. All state civil returns go to the courts at 1345 Court Street. Our Virginia locality rate map shows Portsmouth beside its neighbors.

Interstate 264 is the spine. It begins at Bower's Hill in Chesapeake, crosses Portsmouth and enters Norfolk through the Downtown Tunnel, which has carried a toll since 2014. Water crossings shape routing across the region, so we plan attempts around tunnel traffic instead of promising an arrival time. When a defendant lives just past the city line, the job moves to Chesapeake service to the south and east or the Suffolk page to the west.

02Attorneys and law firms

Help for Portsmouth Counsel and Firms Across the River

Portsmouth attorneys, Norfolk firms and out-of-state counsel suing Portsmouth residents send us warrants in debt, complaints, motions for judgment and witness subpoenas. The circuit court clerk is in Suite 101 and the general district court in Suite 104 at the same Court Street building, which keeps returns simple once the issuing court is confirmed. We check the caption and the issuing office before dispatch, and our Virginia attorney service program keeps the quote and every update with one contact.

Federal cases from Portsmouth go to the Eastern District's Norfolk Division, where summonses follow Federal Rule 4. Many state-court matters begin with a written request to waive service under Va. Code 8.01-286.1, and we step in when that request goes unanswered. For a subpoena from another state, the clerk of the Virginia circuit court where discovery will happen issues a Virginia subpoena for us to serve. See how we handle out-of-state papers in Virginia and Virginia subpoena delivery.

03Evasive and hard-to-serve

Navy Workplaces, Shift Changes and Closed Doors

Portsmouth is home to Norfolk Naval Shipyard and to Navy medical and support facilities, and many defendants work on installations where access is up to the command. Navy rules at 32 CFR 720.20 allow a commanding officer to permit service and designate a place for it, such as the legal office, so we coordinate through counsel instead of approaching a gate. In most cases, home service timed to a shift change is the better plan. Our page on defendants who make service difficult explains the scheduling.

Older neighborhoods bring their own issues: houses divided into apartments with a single shared door, back units reached through an alley, and porches where a knock can be seen from inside without being answered. We log each visit with the time, the entrance used and anything observed. Va. Code 8.01-289 bars Sunday service of civil process, so attempts run Monday through Saturday. When a defendant keeps dodging, counsel can use the record with our guide for Virginia defendants who avoid service.

04Family law, landlords and subpoenas

Family Petitions, Tenant Summonses, Small Claims and Witnesses

A Portsmouth divorce begins with a complaint filed at the circuit court clerk's office in Suite 101, and custody, visitation and support start in the Juvenile and Domestic Relations District Court. Va. Code 20-99.1:1 lets a spouse accept service by signing a notarized writing or signing before the clerk, and counsel often asks for that first. If the other side will not sign, we arrange a discreet personal delivery and describe the recipient on the return. Compare the routes on our Virginia divorce service page.

Portsmouth landlords file unlawful detainer cases in the general district court, and Va. Code 8.01-126 lets a private server deliver the summons so long as it is served at least 10 days before the return day. The writ of eviction that may follow a judgment is executed by the sheriff after at least 72 hours' notice, and we do not take part in it. Small claims up to $5,000 and attorney-issued subpoenas are also common, described on the Virginia small claims page and in the Virginia eviction service guide.

  • Divorce in the 3rd Circuit
  • Custody and support in J&DR
  • Unlawful detainer summons only
  • Small claims to $5,000

05Documentation

What Portsmouth Proof of Service Looks Like

Every Portsmouth return made by a private server follows Va. Code 8.01-325. It includes the server's affidavit of qualifications, the date and manner of service, the name of the party served, a printed annotation that a private server made the service, and the server's name, address and telephone number. The process goes back to the clerk's office within 72 hours unless the court directs otherwise; a weekend or holiday deadline moves to the next business day. The Virginia legal papers service guide shows where the return fits.

Alongside the return, we keep an attempt log: the address, the date and time, who responded and what was seen at the door. That record is what counsel needs if a defendant later moves to quash. Outside Tennessee, serves may be carried out by vetted servers Delator contracts with, all held to one written documentation standard. For quick turnarounds, rush and same day service in Virginia keeps that standard, and the multistate rate map lists the tier prices.

06Virginia rules

Virginia Service Rules in Plain English for Portsmouth

Under Va. Code 8.01-293, the sheriff or any person 18 or older who is not a party and has no interest in the subject matter may serve process; the statute calls a person who does it for a fee a private process server. Virginia requires no license. Officers alone execute writs of possession, levy on property and serve capias or show cause orders, and protective orders go to law enforcement. We do none of those, as our Virginia guide to who may serve process explains.

Va. Code 8.01-296 governs service on individuals. Personal delivery comes first. If the defendant is not found at the usual place of abode, a family member 16 or older who lives there, not a temporary guest, may receive a copy after being told what it is. Failing that, the copy may be posted at the main entrance, and the filing party or its attorney mails a copy and files a certificate of mailing at least 10 days before a default judgment. Our posted service guide covers the mailing.

A Shipyard Named for Norfolk That Sits in Portsmouth

Norfolk Naval Shipyard is in Portsmouth despite its name, and that mix-up shows up on case files. An attorney may assume a defendant who works at the shipyard lives in Norfolk, or that papers mentioning Norfolk belong across the river. The employer's name says nothing about where the defendant lives, and the home address is what decides the locality, the rate and the sheriff who would act if a private serve fails. We confirm the street address before quoting.

The same care applies to the city lines with Chesapeake and Suffolk to the south and west, where newer subdivisions sit close together. A process server in Portsmouth who checks the locality first keeps the quote accurate and sends the return to the right clerk, whether that is Court Street or a neighboring city's courthouse. If the defendant turns out to live elsewhere in Hampton Roads, the statewide Virginia process serving page points to the right coverage, and Delator Group's about page explains who manages the work.

Process Servers Near Portsmouth

Portsmouth cases often name people across a river or a city line. Defendants east of the Elizabeth River fall under Norfolk, and those in Western Branch or Deep Creek belong to Chesapeake. Farther out, Virginia Beach serves cover the resort city, and Peninsula addresses go to Hampton process service or service in Newport News. Each job carries the same written quote, dated attempt log and Virginia-form return as a Portsmouth serve, so counsel can assemble consistent proof for every clerk in the region.

FAQ

Frequently Asked Questions

Who can serve legal papers in Portsmouth?

In Virginia, Va. Code 8.01-293 opens service of process to the sheriff and to any adult 18 or over who is neither a party nor interested in the outcome. A person doing so for a fee is a private process server. There is no Virginia license, but a private server's return must include an affidavit showing those qualifications.

How much does a process server in Portsmouth cost?

Portsmouth's published Routine starting rate is $125, with Urgent at $188, Rush at $250 and Same Day Rush at $375. The real price depends on the papers, the address and the deadline, and we confirm it in writing before a server goes out. Neighboring Suffolk and Chesapeake have their own published rates.

Can you serve someone who works at Norfolk Naval Shipyard?

Access to Navy installations is controlled by the command, and 32 CFR 720.20 lets a commanding officer permit service at a designated place. We coordinate through counsel rather than approaching the gate, and we usually recommend home service timed to the defendant's shift. Counsel handles any Servicemembers Civil Relief Act affidavit before a default.

Is a shipyard employee's case filed in Norfolk or Portsmouth?

That depends on the case, not the employer's name. Norfolk Naval Shipyard sits in Portsmouth, but where a suit is filed is a venue question for counsel, and where we serve depends on the defendant's home or other location. We confirm the street address so the quote and the return are correct.

Can you serve a Portsmouth unlawful detainer?

We serve the summons. Va. Code 8.01-126 allows a private server to deliver it, and it must be served at least 10 days before the return day. The sheriff alone executes the writ of eviction after giving the tenant at least 72 hours' notice. Our Virginia landlord and tenant papers page explains the full sequence.

What is posted service in Portsmouth?

When neither the defendant nor a qualifying family member is found at the usual place of abode, Va. Code 8.01-296 allows the papers to be posted at the main entrance. The filing party or its attorney must then mail a copy and file a certificate of mailing at least 10 days before default. See the Virginia posting explainer.

Do you serve papers on Sunday in Portsmouth?

No. Va. Code 8.01-289 bars serving civil process on Sunday, with narrow exceptions such as persons escaping custody. We plan attempts for weekday mornings and evenings and for Saturdays instead, and the attempt log documents that pattern if the defendant later questions how hard we tried. The Portsmouth-area evasive defendant guide explains what counsel can do next.

How long does a Portsmouth defendant have to answer?

In circuit court, Rule 3:8(a) of the Rules of the Supreme Court of Virginia generally allows 21 days after service of the summons and complaint. General district court defendants appear by the return date printed on the warrant or summons. A waiver under Va. Code 8.01-286.1 changes those dates, so counsel should confirm the exact deadline.

Can you serve a business in Portsmouth?

Yes. Va. Code 8.01-299 permits service on an officer, director or registered agent of a Virginia corporation and on a Virginia LLC's registered agent. When the registered agent cannot be found with reasonable diligence, the Clerk of the State Corporation Commission may become the agent, handled through the Clerk's office. See service on Virginia companies.
