Wrongful Termination Investigations in Idaho
Idaho employment is presumed at-will, so a wrongful termination claim usually depends on proving an exception: a protected characteristic, a promise in a handbook, a refusal to break the law or a report of wrongdoing. Delator Group works for employment counsel on either side to find the witnesses, records and timeline that test the stated reason for a firing.

Quick answer
What does a wrongful termination investigation involve in Idaho?
It gathers evidence about why an employee was really let go. In Idaho that typically means interviewing current and former coworkers, assembling a timeline of complaints and discipline, comparing how similar employees were treated and collecting handbook and policy versions. Delator does this for employment lawyers as part of its Idaho corporate and workplace investigations, with every step directed by counsel.
01The starting point
At-Will Employment in Idaho Is a Case-Law Rule
Idaho has no statute declaring employment at-will. The rule comes from case law: employment without a fixed term is generally presumed terminable by either side at any time, a principle Idaho courts trace through decisions such as Thomas v. Ballou-Latimer Drug Co. (1968) and later cases. An employer usually does not need a good reason to end the relationship, but it cannot act for an unlawful one. Counsel should confirm current authority, because exceptions are developed case by case. Our Idaho investigators gather the facts each exception turns on.
Three exceptions are generally recognized. An implied contract may arise from a handbook, a policy or specific assurances, though clear disclaimers often defeat it. An implied covenant of good faith and fair dealing exists, but Idaho courts have generally held it does not by itself require good cause to fire an at-will employee. And a public policy exception protects employees who refuse to break the law, perform an important public obligation such as answering a subpoena, or exercise a legal right. Each needs a different kind of proof, which is where a focused investigative consulting session with counsel helps.
- Implied contract from handbooks or assurances
- Implied covenant of good faith and fair dealing
- Public policy: refusing unlawful acts
- Public policy: public obligations and legal rights
02Discrimination law
The Idaho Human Rights Act and the One-Year Clock
Idaho Code 67-5909 prohibits employment discrimination because of race, color, religion, sex, national origin, age or disability, and the Idaho Human Rights Act generally reaches employers with five or more employees, a lower threshold than the fifteen-employee floor of federal Title VII. Under Idaho Code 67-5907, a complaint generally must be filed with the Idaho Human Rights Commission within one year of the alleged discrimination. The Commission, reachable at 208-334-2873, also handles federal charges deferred to it by the EEOC. Harassment issues are covered on our workplace sexual harassment investigations page.
The federal deadline runs separately. The EEOC's Seattle field office, which covers Idaho, states that the usual 180-day charge deadline is extended to 300 days where a state anti-discrimination law covers the claim. Those dates belong to counsel, but they set the investigator's timetable. Evidence of disparate treatment often lives in the memories of coworkers who leave within months, so we start with witness location and interviews. Former employees who have moved on can usually be found through lawful contact tracing.
03Retaliation
Retaliation After a Report, a Complaint or a Subpoena
Many Idaho termination claims are really about timing: an employee reports a safety violation, files a discrimination complaint or testifies, and soon afterward is disciplined or fired. Idaho courts have recognized public policy protection for, among other things, reporting code violations and answering a subpoena, and a compliance audit of the underlying practice can test whether the report was accurate. The investigative task in any wrongful termination investigation is to fix the dates precisely and identify who knew about the protected activity when the decision was made. We build that timeline from email metadata, schedules, badge or login records counsel obtains and dated witness accounts, using our workplace investigation methods.
Public employees have an additional statute. The Idaho Protection of Public Employees Act, Idaho Code 6-2101 and following, protects government employees who report waste or violations of law, and Idaho Code 6-2105 generally requires a civil action within 180 days of the alleged violation, in district court. That is a short window. Counsel handling a city, county, school district or state agency case can use our Boise investigators, where many state agencies are headquartered, to begin witness work immediately.
04Idaho workplaces
Fabs, Labs, Dairies and Campus Employers
Idaho's workplaces shape what evidence exists. Micron is headquartered in Boise and has announced a large memory fab investment in Southeast Boise, so Treasure Valley disputes may involve engineers, contractors and strict badge and data controls. Idaho National Laboratory in Idaho Falls reports more than 5,500 employees, with security-cleared environments where documents are tightly held. Twin Falls hosts Chobani's large yogurt plant, and Idaho ranks third nationally in milk and cheese production, which means many Magic Valley disputes involve dairy and food processing crews. Our Idaho Falls investigators understand how cleared workplaces handle interviews.
Universities are major employers too: Boise State, the University of Idaho in Moscow, Idaho State in Pocatello and BYU-Idaho in Rexburg. Campus disputes can involve faculty handbooks, grievance procedures and public-records rules, since public universities are subject to the Idaho Public Records Act. Agricultural and seasonal workplaces may have bilingual crews, informal supervision and few written records, so witness interviews carry more weight, and some witnesses are easiest to reach through records-based contact research in Caldwell and Canyon County. For Magic Valley matters, our Twin Falls coverage keeps travel short.
05The evidence
Comparators, Handbooks and the Decision Trail
Comparator evidence is often decisive: how did the employer treat other workers who did the same thing? We identify comparable employees through witness interviews and records counsel obtains, then document their discipline, roles and outcomes. Handbook claims require every version of the policy that applied, along with acknowledgment forms, offer letters and any written assurances. Because written contract claims in Idaho generally have a five-year limitation period under Idaho Code 5-216 and oral contracts four years under 5-217, older documents can still matter. If a document custodian has moved, witness and custodian background research helps counsel choose whom to subpoena, and subpoenas can be served through Delator's Idaho process servers.
The decision trail is the third piece. Who recommended the firing, who approved it, what they knew and when they wrote it down. Inconsistent explanations, reasons that appear only after a charge is filed, and discipline that departs from the employer's own policy are all common signs of pretext. We report what the evidence shows, including facts unhelpful to our client's position, so counsel is not surprised later. Background research on decision-makers is limited to lawful sources, as our guide to what an investigator may do in Idaho describes.
06For employers
Investigations for Employers Before and After a Termination
Employers and their counsel use the same methods for a different purpose: to make sure a termination decision rests on documented facts before it is made, or to test the record after a charge arrives. A pre-termination investigation might confirm misconduct such as time theft or diversion of inventory through employee theft investigation, interview witnesses neutrally and produce a written summary that holds up if challenged. Done well, it also reveals when the decision should not be made at all.
After a charge with the Idaho Human Rights Commission or the EEOC, employer counsel needs an honest look at the comparators, the timeline and the witnesses before drafting a position statement. We interview supervisors and coworkers at counsel's direction, assemble the documentary record and flag weaknesses. Where an executive or key hire is involved, our executive background checks can verify claimed credentials that later became an issue in the dispute.
07Timing and cost
Deadlines, Distances and What an Investigation Costs
Deadlines drive scheduling: one year for an Idaho Human Rights Commission complaint, 300 days for most EEOC charges in Idaho, and 180 days under the public employee protection act. Distances drive cost. Boise to Coeur d'Alene is roughly 380 to 390 miles, and the Panhandle keeps Pacific Time, so we treat North Idaho witness work, handled through our Coeur d'Alene investigators, as a separate leg of the investigation.
A wrongful termination investigation is billed as civil litigation support at $100 per hour with a $1,000 minimum. Remote items carry their own published prices, including $102 for a basic background check and $300 for a due diligence report. The scope and total are confirmed in writing before any work starts, with no retainer quietly being drawn down. Counsel can review every rate on our Idaho service pricing page and see how we engage on the attorney services page.

Investigators locate and interview approved witnesses, collect each policy version and build the timeline, reporting findings to counsel in writing as each piece is confirmed.
- 04
Report and testimony
Counsel receives a written report with a timeline, comparator summary and witness memos. Our investigators remain available to testify in agency proceedings, at deposition or in court.

FAQ
Frequently asked questions
Can an Idaho employer fire someone for no reason?
Generally, yes. Idaho presumes employment without a fixed term is at-will, so an employer usually needs no reason. It cannot, however, fire someone for an unlawful reason, such as discrimination, retaliation for protected activity or a reason that violates public policy, or in breach of an implied contract. Your employment lawyer can explain which exceptions might apply.
How long do I have to file with the Idaho Human Rights Commission?
Idaho Code 67-5907 generally requires a complaint within one year of the alleged discrimination. A federal EEOC charge in Idaho is usually due within 300 days. Because deadlines can be missed easily, talk with an employment lawyer quickly. Investigation can begin while counsel prepares the filing, as described on our Idaho attorney services page.
Does the Idaho Human Rights Act cover small employers?
It generally applies to employers with five or more employees for each working day in 20 or more calendar weeks in the current or preceding year, under Idaho Code 67-5902. Federal Title VII applies at fifteen employees. A small Idaho employer may therefore be covered by state law even when federal law does not reach it.
Can a handbook create a contract in Idaho?
Sometimes. Idaho courts have recognized that a handbook or specific assurances can create an implied contract limiting the right to terminate, but clear disclaimers often defeat such claims. Every version of the handbook and every acknowledgment form matters, which is why we collect them all. Counsel decides how they affect the case.
What protects public employees who report wrongdoing?
The Idaho Protection of Public Employees Act, Idaho Code 6-2101 and following, protects government employees who report waste or violations of law. Idaho Code 6-2105 generally requires a civil action within 180 days of the alleged violation. Public employees should consult counsel promptly, and we can start witness work as soon as counsel engages us.
Will you contact my former employer?
Only if counsel decides it is appropriate. Most investigation focuses on former coworkers, documents and public sources, and current managers are often represented by the employer's lawyers. We identify ourselves truthfully when we interview anyone and never pose as someone else. Our guide to lawful investigator conduct explains the limits.
Can I record conversations at work in Idaho?
Idaho Code 18-6702 generally makes it lawful for a party to a conversation to record it, but secretly recording conversations you are not part of can be a felony. Workplace policies, confidentiality agreements and federal rules can also matter. Ask counsel before recording anything. Our Idaho recording law guide gives an overview.
Do you work for employers too?
Yes, at the direction of employer counsel. We conduct neutral pre-termination investigations and post-charge reviews of comparators, timelines and witness accounts. We report what the evidence shows, including facts unhelpful to the client, so counsel can make informed decisions before a position statement or settlement talks. Related work appears on our Idaho employee theft investigations page.
What does a wrongful termination investigation cost?
Billing follows our civil litigation support terms: $100 per hour, $1,000 minimum. Remote items such as a basic background check ($102) or a due diligence report ($300) are priced separately. The scope and price are confirmed in writing before work begins. See our Idaho pricing page for the full list.
Does Idaho license private investigators?
Idaho has no statewide private investigator license, though some cities, such as Chubbuck and Coeur d'Alene, regulate investigators locally, so confirm current requirements before work in those cities. Delator Group holds a Tennessee private investigation firm license and applies that standard in Idaho, with insured, vetted investigators and written reports prepared for litigation.
