Quick answer

What is investigative consulting in Idaho?

Investigative consulting is a paid review of your situation before field work begins. A Delator consultant reads your documents, identifies factual gaps, explains which lawful methods fit Idaho law and estimates the cost of each step. You leave with a written plan and decide what to approve. Consulting time is billed at $100 per hour, shown on our Idaho investigation rate page.

Why a Consultation Should Come Before Field Work in Idaho

Many investigations fail because they answer the wrong question. A client asks for a week of surveillance when the case really turns on a document, or orders a background check when the real need is a witness who moved to Spokane. Investigative consulting in Idaho starts by asking what a judge, adjuster or employer will actually decide, then works backward to the facts that matter. Attorneys who use our investigative support for Idaho lawyers often begin this way.

The consultation produces a short written plan: the questions, the lawful methods available, the order of work, the estimated hours and what each step costs. You can approve all of it, part of it or none of it. Because distance matters in Idaho, the plan also accounts for travel between the Treasure Valley, eastern Idaho and the Panhandle. Our guide to what Idaho investigations cost explains how those estimates are built.

02Litigation

Litigation Consulting Matched to Idaho's Court System

Idaho's trial courts are organized into seven judicial districts covering all 44 counties. The magistrate division generally hears civil actions up to $10,000, misdemeanors, family law, evictions and felony preliminary hearings, while the district courts hear felonies, larger civil cases and magistrate appeals. Small claims cases, as amended in 2026, may seek up to $15,000. A consultation sizes the investigation to the forum, because a small claims hearing rarely justifies the evidence plan a district court jury trial needs.

Procedural deadlines shape the plan too. Under I.R.C.P. 4(b)(2), a defendant not served within 182 days of filing faces dismissal without prejudice absent good cause, and an answer is generally due 21 days after service under Rule 12(a). We build locates and service into the timeline early, using our Idaho process serving team and the steps in our Idaho guide to serving papers. Ada County matters are frequently staffed through our Boise case consultants.

03Criminal defense

Consulting on Idaho Criminal Defense Investigations

Idaho changed how public defense is delivered. Since October 1, 2024, trial-level public defense has been run by the Office of the State Public Defender, which in its first year took over 14 county offices and signed more than 150 contract attorneys for the remaining counties. Defense lawyers in that system, and in private practice, often need to know quickly whether an investigation can change a plea decision. We help them choose between scene work, witness interviews and records review through Idaho criminal defense investigations and support for appointed defense counsel.

Charge type drives the plan. Under Idaho Code § 18-8004, driving at 0.08 or more is unlawful, as is 0.04 in a commercial vehicle and 0.02 for drivers under 21, so a DUI defense investigation usually focuses on the stop, the timeline and the testing. Felony files often require more, beginning before the preliminary hearing in the magistrate division. Our felony defense investigators explain the options in writing so counsel can decide what fits the case.

04Individuals and families

Consulting for Families and Self-Represented Parties in Idaho

Family cases are where consulting saves the most money. Under Idaho Code § 32-717, custody decisions weigh factors such as the child's adjustment to home and school, continuity and stability, and domestic violence whether or not it occurred in the child's presence. Section 32-717B presumes joint custody is in the child's best interests, and the presumption reverses if a parent is a habitual perpetrator of domestic violence. Evidence that speaks to those factors matters; evidence that only embarrasses the other parent usually does not. Our Idaho custody investigation guide explains the difference.

People facing harassment need a different plan. Protection order petitions for domestic violence are filed in the magistrate division, and a hearing is generally set within 14 days under Idaho Code § 39-6306. Civil stalking orders under § 18-7907 look at conduct within the 90 days before filing. We help clients organize dates, messages and witnesses so the petition is clear, and we can document ongoing conduct through a stalking investigation. Unmarried partners with trust concerns can ask about relationship investigations for couples who are not married.

05Employers

Consulting for Idaho Employers and Business Owners

Employers usually call after a complaint, a loss or a resignation that looks planned. Idaho employment is generally at will under case law, but courts recognize exceptions for implied contracts, the implied covenant of good faith and public policy, so the way facts are gathered can matter later. The Idaho Human Rights Act generally covers employers with 5 or more employees, and complaints must be filed within one year. A consultation helps plan a fair, documented workplace harassment investigation that treats everyone consistently.

Hiring is the other common question. Growth across the Treasure Valley and eastern Idaho has many companies filling senior roles quickly, and a bad executive hire is expensive to unwind. We help employers decide between a standard Idaho employee background check and a deeper executive hire background review, and we explain which consumer-reporting rules may apply before any report is ordered.

06Second opinions

Reviewing Another Investigator's Work in a State With No PI License

Idaho does not license private investigators at the state level. A 1998 bill, the Idaho Private Investigators Regulation Act, proposed state licensure and a board, but it was referred to committee with no further action shown. Some cities regulate locally: Chubbuck requires private investigator applicants to submit fingerprints for state and FBI background checks, and Coeur d'Alene issues security agency and agent licenses whose form covers detectives. Confirm current local rules before relying on any of them. Our Chubbuck investigator page discusses that city's setting.

Without a state credential, quality varies widely. Clients sometimes bring us a report from another firm and ask whether it will hold up. We review how evidence was gathered, whether methods complied with Idaho law, whether video and notes are complete and whether conclusions follow from observations. Our checklist for vetting an Idaho investigator lists what to request, and Pocatello consulting coverage is available for eastern Idaho reviews.

07Evidence

Preparing Investigative Evidence for Idaho Courtrooms

Good evidence is planned, not collected by accident. We advise clients on chain of custody for video, keeping original files, writing dated notes at the time of observation and recording statements openly under Idaho's one-party consent rule in Idaho Code § 18-6702. Time zones belong in every note, because the federal court's Coeur d'Alene office keeps Pacific Time while Boise and Pocatello keep Mountain Time. Those habits carry into our surveillance investigations across Idaho.

Records take planning as well. Idaho's Public Records Act presumes access, but nonresident requesters generally wait 21 days, extendable to 35, for a response under Idaho Code § 74-103, compared with 3 working days for residents. We order records early so they arrive before a deposition or hearing. Clients who want a broader view of the state can start with Delator's Idaho investigations overview, and files in the Kuna prison corridor can be paired with a correctional facility abuse investigation.

  2. 02

    Review and analysis

A consultant reads the material, identifies the decision-maker and the facts that matter, and checks which lawful methods under Idaho law could fill each gap.

  3. 03

    Written plan and price

You receive a written plan listing each recommended step, its purpose, estimated hours and travel, and the price, so you can approve, trim or decline it.

  4. 04

    Optional field work

If you approve any step, Delator assigns investigators under the same scope. If you do not, the consultation stands alone and you owe nothing further.

FAQ

Frequently asked questions

Do I need an investigation, or just a consultation?

Sometimes the consultation is enough. Investigative consulting in Idaho often shows that the needed facts are already in your documents, or that a single records request will answer the question. Other times it shows that field work is worth the cost. Either way, you receive a written plan and decide. We would rather tell you an investigation is unnecessary than sell hours that will not help.

Who uses investigative consulting?

Attorneys use it to scope discovery and trial preparation, defense lawyers to decide whether investigation could change a plea, employers to plan internal investigations, and individuals to understand what evidence fits a custody, harassment or financial dispute. Self-represented parties also use it, though we do not give legal advice. Where a legal question arises, we suggest speaking with an Idaho attorney before acting, and our investigative support for law firms can then work under that attorney's direction.

Is a consultation confidential?

We treat everything you share as confidential and use it only for your matter. When a consultation is requested by an attorney, the work is directed by counsel, which may give it additional protection; that is a question for the attorney. We run a conflict check before reviewing documents, so we do not consult for both sides of the same dispute.

How much does investigative consulting cost?

Consulting is billed at our standard $100 hourly rate. Most reviews take a few hours, depending on the volume of documents and the complexity of the dispute, and we estimate the time before starting. If you later approve field work, the consultation is folded into the overall scope. Every price is confirmed in writing first, as described in our cost guide for Idaho investigations.

Can you tell me if another investigator did good work?

Yes. Because Idaho has no statewide PI license, report quality varies. We review whether methods complied with Idaho law, whether the video and notes are complete and time-stamped and whether conclusions follow from what was observed. We give you a plain written assessment, including what holds up well, so you can decide how to use the earlier report.

Do you give legal advice?

No. Delator consultants explain investigative methods, evidence handling and how Idaho statutes generally apply to fact-gathering, but we are not lawyers. Questions about strategy, admissibility or legal rights belong with an attorney. When a consultation raises a legal issue, we say so plainly and, where helpful, structure our plan so your attorney can review it before any work begins.

Can you help me prepare for a protection order hearing?

We can help organize the facts: dates, messages, photographs, witnesses and a timeline. Under Idaho Code § 39-6306, a hearing on a domestic violence petition is generally set within 14 days, so preparation is often urgent. If conduct is ongoing, we can document it lawfully through harassment and stalking documentation. If you are in danger, contact law enforcement first; our role supports that report.

What makes evidence hold up in an Idaho court?

Courts look for evidence that was gathered lawfully, documented when it happened and preserved without alteration. That means original video files, dated notes with the time zone, openly recorded statements and a clear record of who handled each item. Whether evidence is admitted is for the judge, and our guide to recording someone in Idaho covers the consent rules. Our consulting helps you build those habits before the first observation is made.

Can you consult on cases outside Idaho?

Yes. Many Idaho disputes involve people or property in neighboring states. Delator also works in Wyoming, South Dakota, Alaska and Mississippi and coordinates process service in additional states. A Wyoming investigations consultation can be combined with an Idaho review when a case crosses the eastern border near Idaho Falls or Driggs.

Do you consult on matters involving tribal land?

We can help plan, but jurisdiction is a legal question. Idaho is a partial Public Law 280 state, and investigation or service on reservation land may be governed by tribal law and court rules. We recommend confirming the approach with counsel and, where needed, the tribal court before any field work, and we build that step into the written plan.
