Quick answer

What does a malfeasance press release review include?

We break the draft into individual factual claims, including names, dates, amounts, roles and actions taken, then match each to a record or flag it as unsupported. We check the draft against court filings, breach notices and public records, and return a marked copy to counsel. Work is hourly at $100, and our mitigation team supports the wider response.

01Stakes

Why the First Statement Matters for Idaho Organizations

The first public description of misconduct is the one people remember, and in Idaho's close-knit business communities it travels quickly from the newspaper to the customer counter to the county commission meeting. A statement that overstates the loss, names the wrong person or promises a result the organization cannot deliver will be quoted back for years. Our Idaho Falls investigators have seen eastern Idaho owners spend months correcting a single sentence.

Statements also carry legal weight. Idaho Code § 5-219 generally gives a person two years to bring a libel or slander claim, so a careless description of a former executive can become a lawsuit. A statement that conflicts with the organization's own insurance claim or court filing hands the other side an exhibit. Counsel controls the legal judgment, and our Idaho attorney support makes sure the facts underneath that judgment are solid.

Silence has costs too. Customers, members, lenders and staff fill a vacuum with rumor. The goal is a short, accurate statement released at the right time, and the investigative work behind it is what makes accuracy possible. When the conduct itself has not been fully investigated, our corporate malfeasance investigators establish what happened first, and a shock audit can confirm whether losses are still occurring.

02Method

How Delator Checks a Draft Before It Goes Out

We work line by line. Each factual claim in the draft, such as when the conduct began, how much was involved, who was responsible, what the organization did on discovery and whether authorities were notified, is matched to a document, an interview summary or a verified public record. Claims without support are flagged with a suggested narrower wording or a recommendation to remove them. Our investigative consulting team handles drafts on short notice.

We also look for what a reader will infer. A sentence saying an employee was placed on leave pending investigation implies a different status than one saying the employee was terminated for cause. Numbers rounded up become claims. Words such as stole or embezzled may be accurate, or may assert a crime nobody has charged. We point out those gaps, and counsel decides the wording. Our Eagle investigators often sit in on review calls for Treasure Valley clients.

Finally we check consistency across every document the organization has issued. The release, the customer letter, the insurer's proof of loss, the board minutes and any court pleading should describe the same events the same way. A loss schedule built by our fraud risk auditors is usually the anchor, because amounts are where inconsistencies show up first and where reporters look hardest.

  • Each claim matched to a record or flagged
  • Implied meanings identified for counsel
  • Figures reconciled to the loss schedule
  • Consistency checked across all released documents

03Alignment

Breach Notices, Court Files and Open Records Must Agree

When misconduct involved personal information, Idaho Code § 28-51-105 may require notice to affected Idaho residents in the most expedient time possible and without unreasonable delay, and public agencies must notify the Attorney General within 24 hours of discovery. A press statement released before the notice letter, or describing the data differently, creates confusion and risk. Our data exposure cleanup service helps affected people after notice goes out.

Public bodies face an added test. Records held by cities, counties, school districts and other public agencies are generally open under the Idaho Public Records Act, and Idaho Code § 74-103 generally requires agencies to answer resident requests within three working days. A reporter can compare a district's statement with its own invoices and minutes within the week, and our compliance audits review how public entities handle those records.

Court files are usually public too. Once a civil complaint, criminal charge or protective order is filed in district court or the magistrate division, its allegations can be read by anyone. A statement must not contradict what the organization has said in a pleading. We pull the relevant filings and compare them with the draft, working with our Boise investigators for Ada County and federal matters.

04Situations

Where Idaho Organizations Most Often Need a Careful Release

Nonprofits and member organizations face the sharpest scrutiny, because donors and members feel personally betrayed. Agricultural cooperatives, credit and lending groups, churches, youth programs and hospital foundations all depend on trust. A statement must explain what happened, what was lost and what changed, without speculating. Our Twin Falls team works with Magic Valley organizations on the facts behind those updates.

Public agencies and districts must assume that every word will be compared with their records. Fast-growing communities in the Treasure Valley, where Canyon County grew about 19 percent between 2020 and 2025, have many new districts and agencies with young controls. Private employers face a narrower audience: customers, lenders and staff. In each case, our Nampa investigators gather the documents that support the release.

05Litigation

Writing Around Pending Idaho Litigation and Charges

When a prosecutor is reviewing the case, or a civil claim has been filed, the organization's statement should not try the case in public. Describing a person as guilty before a charge or verdict invites a defamation claim and can complicate the prosecution. Neutral wording such as referring the matter to law enforcement, cooperating with the review and placing the person on leave is usually safer. Our criminal defense investigations team knows how defense counsel reads those statements.

Civil disputes add discovery risk. Drafts, emails about drafts and notes from communications meetings may be requested later. Routing the review through counsel, as we recommend, gives counsel the opportunity to consider privilege. Where the dispute will be decided in federal court in Boise, Pocatello or Coeur d'Alene, we note which filings are already public, and our Pocatello investigators support Eastern Division matters.

What Delator Does and Does Not Do on a Release

We are investigators, not a public relations firm. We verify facts, identify unsupported or risky claims, compare drafts with the record and gather any missing evidence. We do not write promotional messaging, manage media relationships, place stories or contact reporters on the organization's behalf. Many clients pair our work with their own communications staff or outside consultant, and our corporate investigations group coordinates with them directly.

We also do not soften facts. If the record shows a larger loss than leadership hoped, or a longer period of misconduct, we say so plainly in the marked draft. An organization that understates a problem and is corrected later loses more credibility than one that states it accurately once. Where reputational harm to individuals is involved, our cyber bullying and online harassment investigators can document abusive responses that follow a release.

07Timing

Working Fast Across Idaho's Two Time Zones

Idaho splits between Pacific Time in the north and Mountain Time in the south. Nine northern counties, including Kootenai, Bonner, Latah and Nez Perce, keep Pacific Time, along with part of Idaho County. A release timed for 9 a.m. in Boise reaches Coeur d'Alene staff at 8 a.m. We plan review deadlines and release times in the correct zone, and our Coeur d'Alene investigators handle Panhandle organizations.

Turnaround depends on how organized the underlying record is. When a loss schedule and investigative report already exist, a draft review can usually be completed quickly. When the facts are still being gathered, we tell leadership which statements can be made now and which should wait. Our Lewiston investigators cover north-central Idaho, and every timeline is confirmed in writing, including who approves the final text.

How it works

How a release review runs

  1. 01

    Send the draft through counsel

Your attorney sends the draft and the supporting record. We confirm the deadline, the time zone of the release, who approves the final text and the price in writing.

  2. 02

    Claim-by-claim review

We identify every factual claim, match each to a source, flag unsupported or risky wording, and compare the draft with court filings, breach notices and public records.

  3. 03

    Marked draft returned

Counsel receives a marked copy listing the source for each claim, recommended narrower wording and any facts that still need verification before the organization releases anything.

  4. 04

    Updates as facts develop

Later statements are reviewed against the first one and the growing record, so the organization's public account stays consistent from the first release to the last.

Statewide coverage

Statement verification across Idaho

Delator works with Idaho organizations statewide without a local office, coordinating through counsel. Treasure Valley boards use our Meridian investigators and Boise coverage, while Canyon County clients work with the Caldwell team. Eastern Idaho organizations draw on our Rexburg coverage and Idaho Falls investigators, and the Palouse relies on Moscow investigators on Pacific Time. Release deadlines are always confirmed in the correct time zone, and every engagement begins with a written scope and price so leadership knows the cost before the clock starts.

FAQ

Frequently asked questions

Do you write the press release?

No. We verify the facts in a draft that your communications staff, consultant or counsel prepares. We flag unsupported claims, suggest narrower factual wording and identify inconsistencies, but we do not write promotional messaging or deal with reporters. That separation keeps our work focused on accuracy and keeps the investigative record clean.

Why should an investigator review a statement?

Because most problems in misconduct statements are factual: an amount, a date, a person's role or what the organization knew and when. Investigators already have the record, or can build it, and can tell quickly whether each claim is supported. Counsel then makes the legal judgment with accurate facts in hand.

Can a statement about a former employee lead to a lawsuit?

It can. Idaho Code § 5-219 generally gives a person two years to bring a libel or slander claim. Describing someone as having committed a crime before any charge or finding is the most common risk. Counsel decides the wording, and our review flags phrases that assert more than the record supports.

How quickly can you review a draft?

When the investigative record already exists, reviews can usually be completed quickly, and we confirm the deadline in writing before starting. When the facts are not yet established, we tell leadership which statements are safe now. Every timeline accounts for Idaho's Pacific and Mountain time zones and the hour the statement will be released.

What does a release review cost?

Reviews are billed at $100 per hour, and the estimate depends on how long the draft is and how organized the record is. If the underlying conduct still needs investigation, that work is scoped separately. We confirm scope and price in writing first. Our Idaho pricing page lists every published rate.

Our district is a public agency. Does that change anything?

Yes. Records of Idaho public agencies are generally open under the Public Records Act, so reporters and residents can compare the statement with invoices, minutes and correspondence. Employees who reported the problem in good faith are generally protected under Idaho Code § 6-2104. We review the draft with both points in mind.

Should we mention that police are involved?

Only if it is true and counsel agrees. Stating that the matter has been referred to law enforcement is usually safer than describing the conduct as a crime. If a prosecutor is reviewing the case, counsel may want to confirm the wording with that office first. Our Idaho investigations overview explains how we support those referrals.

Does the statement have to match our breach notice?

It should. If Idaho Code § 28-51-105 requires notice to affected residents, the release and the notice letter should describe the exposed information and the timeline the same way, and the release usually should not precede the notice. Counsel decides on notice; we confirm the facts behind both documents. Our Chubbuck investigators support southeast Idaho organizations.

What credentials does Delator hold for Idaho work?

Idaho has no statewide private investigator license. Delator Group is a licensed Tennessee private investigation firm headquartered in Nashville with no Idaho office, and it holds Idaho work to Tennessee's standard. Some cities, such as Chubbuck and Coeur d'Alene, regulate investigators locally, and we confirm those rules first. Our vetting guide explains what to ask.

What if the facts change after we release a statement?

Then the next statement should acknowledge the change plainly. We review updates against the first release and the growing record, so the organization corrects itself before someone else does. A consistent, accurate series of statements builds credibility with customers, members, lenders and courts alike. Our mitigation service helps manage the wider response over time.
