Quick answer

How do I hire a process server in Brookhaven?

Send the filed papers with the full address and any unit number. Delator Field Services confirms whether the address is in DeKalb or Fulton County, states the tier and price in writing, assigns a server who meets the court's requirements and logs each attempt. Routine DeKalb County service starts at $125, and our Dunwoody page covers the city just north.

01Local service landscape

Serving Papers in Brookhaven and North DeKalb

Brookhaven had 55,161 residents in the 2020 census table and about 25,900 housing units. Chamblee lies to the east, Dunwoody to the north at I-285, unincorporated DeKalb to the south, and the Fulton County line forms the western boundary. A majority of the Historic Brookhaven neighborhood technically lies inside the City of Atlanta. Those boundaries matter, because the county decides the court and the return. We confirm every address first, and the published DeKalb County service rate applies inside the city.

Peachtree Road, part of State Route 141, is the main north-south route and connects Brookhaven with Buckhead. Buford Highway runs north toward Buford, North Druid Hills Road gives access from I-85, which passes the southeast border, and I-285 runs along the north. The Brookhaven/Oglethorpe MARTA station on the Gold Line opened in 1984. Defendants across the western line are covered by Atlanta process service, and those north of the Perimeter by Dunwoody service.

02Attorneys and law firms

Process Service for Firms Litigating in Brookhaven

Brookhaven sits between Buckhead and the Perimeter, so firms throughout metro Atlanta see defendants here, and out-of-state counsel often have one. Send the filed summons and complaint, any unit number, earlier attempts and the calendar, and we answer with a written quote naming the court, county, tier and price. Nothing is attempted before you approve it. The Georgia litigation support intake explains the details that help a server reach the right door.

The Civil Practice Act generally expects a server to act within five days of receiving the papers, though missing that window does not by itself invalidate a later service. Proof is generally due within five business days of service, and if it is filed late, the answer period may not start until it is. We send completed returns promptly. For cases that also reach other counties, Georgia-wide process service follows the same standard, and Sandy Springs coverage handles Fulton addresses across the line.

03Hard-to-serve recipients

Dense Housing and Defendants Who Avoid Service

Town Brookhaven alone has more than 1,500 residential units, and the Buford Highway corridor is known for high-density housing. Large complexes with leasing offices, numbered buildings and controlled gates can turn a simple serve into several trips if the unit is wrong. We ask for the building and unit, a vehicle description and the defendant's usual hours, and faster Rush tiers shorten the gap between attempts. Our page on Georgia defendants who are hard to serve explains how we plan attempts across mornings, evenings and weekends.

Every attempt is logged with the date, time, location and what the server observed, so counsel can show diligence later. Georgia law generally allows a person authorized to serve to enter a gated or secured community for a reasonable time after identifying the person sought and showing identification and evidence of appointment; if entry is refused, the log says so. When diligent attempts are exhausted, counsel can ask the court about alternatives, which our avoided-service guide summarizes.

04Family law, evictions, small claims, subpoenas

Family-Law, Dispossessory, Small Claims and Subpoena Papers in Brookhaven

Family cases from Brookhaven, including divorce and custody, go to the DeKalb Superior Court clerk in Decatur. A spouse may sign an acknowledgment of service, and when that is unlikely, a qualified server can make personal or abode service under the general statute. In a large building, we take care not to serve in front of neighbors or children. Divorce papers service in Georgia covers the options and the roughly 31-day wait that generally follows service.

Brookhaven's rental buildings bring dispossessory filings to the DeKalb County Magistrate Court. Georgia's 2025 amendment allows an approved process server to serve the summons, but the statute does not define the term, so we confirm the court's practice before accepting one and never carry out evictions or writs. Claims up to $15,000 are served through magistrate court claim service. For a witness who lives outside the county where testimony is given, a subpoena is generally valid only with a $25 fee and mileage tender, which Georgia subpoena service explains.

05Documentation

Returns That Fix the Unit, the County and the Recipient

A Brookhaven affidavit has to show the county as clearly as the person served. Our returns record the date, place and manner of delivery required by O.C.G.A. 9-11-4(h), the full street address with building and unit, and how the recipient was identified. When papers are left with a resident, the affidavit describes that person and confirms they live in the unit. Failed visits are logged in the same way. Our guide to serving Georgia papers explains how proof fits into the case.

When service is challenged, counsel relies on specifics: times, physical descriptions, the leasing office's response and the words exchanged at the door. Where a detail on a return needs correcting, Georgia courts may allow amendment if no material prejudice results. Papers from other counties or states are delivered with an affidavit drafted to fit the issuing court, as out-of-state service in Georgia describes.

06Georgia service rules

What Georgia Law Says About Serving Brookhaven Defendants

Individuals are generally served personally, at their dwelling with a resident of suitable age and discretion, or through an authorized agent under O.C.G.A. 9-11-4(e)(7). Businesses are generally served through an officer, a managing agent at a Georgia office, or the registered agent, with the Secretary of State as a fallback after the plaintiff certifies a mailing. Many Buford Highway businesses are small companies, so the registered agent service route is often checked first.

The people who may serve are named in O.C.G.A. 9-11-4(c): sheriffs, deputies and marshals, specially appointed citizens, court-appointed and permanent process servers, and certified process servers working in counties whose sheriff accepts them. Delator Field Services holds no Georgia certification or appointment of its own. We assign a server who meets the requirements of the DeKalb or Fulton court involved, confirm it in writing, and route papers to the sheriff or marshal when a court requires it. Who may serve process in Georgia explains each category.

07Local angle

An International Corridor in a Young City

Brookhaven became a city on December 17, 2012, after voters approved it that July. Its southern portion follows Buford Highway, a corridor known for a large international population, mostly Hispanic immigrants. Papers are delivered as issued, and a process server in Brookhaven does not explain their legal meaning to anyone, in any language; recipients with questions are directed to a lawyer. We note on the log if a recipient appeared not to understand, so counsel knows. Defendants just east are covered by Chamblee-area DeKalb service.

The north end along Peachtree Road is different: Oglethorpe University, newer mixed-use developments and planned medical facilities bring office and institutional addresses. For company defendants there, we confirm with counsel which officer or agent should receive the papers. Defendants who moved toward Peachtree Corners and Gwinnett are handled through Peachtree Corners process serving with the same written quote and affidavit.

FAQ

Frequently Asked Questions

Who is allowed to serve papers in Brookhaven?

Georgia generally allows service by a sheriff or deputy, a marshal, a court-appointed or permanent process server, or a certified process server in counties whose sheriff accepts them, under O.C.G.A. 9-11-4(c). We assign a server who meets the requirements of the DeKalb or Fulton court involved and confirm it in writing. When a court requires the sheriff or marshal, we route the papers there.

How much does a process server in Brookhaven cost?

Routine service in DeKalb County has a published starting rate of $125. Urgent starts at $188, Rush at $250 and Same Day Rush at $375. Fulton County also starts at $125. The final price depends on the address, the papers and the deadline, and we confirm it in writing before the first attempt. See the multi-state rate map for more.

Is Brookhaven in DeKalb or Fulton County?

The City of Brookhaven is in DeKalb County, and its western boundary is the Fulton County line. Addresses just west of that line are in Fulton, which changes the court, the sheriff and where the affidavit is filed. We confirm the county of every address before quoting so the return matches the right court.

Where are Brookhaven cases filed?

DeKalb County Superior Court cases are filed with the clerk at 556 N. McDonough Street in Decatur, and the State Court was listed at the same address in the 2021 directory. Magistrate cases go to the DeKalb County Magistrate Court. Federal cases are filed with the Northern District of Georgia at 75 Ted Turner Drive S.W., Atlanta.

Can you serve someone in a large Brookhaven apartment complex?

Yes. Send the building and unit, any gate code and a description of the defendant. Leasing offices often will not confirm residents, so accurate details save attempts. If a gate or front desk refuses entry, we log it and discuss the next attempt with you. Hard-to-serve defendant planning explains our approach.

What if the recipient does not speak English well?

Papers are delivered exactly as issued, and our servers do not explain their legal meaning to anyone. Recipients with questions are told to speak with a lawyer. If a recipient appeared not to understand, we note it on the attempt log so counsel is aware. Whether translated papers are needed is a question for the court and counsel.

Can you serve a dispossessory in Brookhaven?

Since July 1, 2025, Georgia's dispossessory statute allows service by the sheriff, a constable or an approved process server, but it does not explain how a server is approved. We confirm the DeKalb County Magistrate Court's practice before accepting one, and we never carry out evictions or writs of possession. Read how Georgia dispossessories are served.

How long does a Brookhaven defendant have to answer?

In superior and state court, the answer is generally due 30 days after service, and magistrate civil claims also allow 30 days. Dispossessory answers are due seven days after actual service. If proof of service is filed late, the answer period may not begin until it is filed, so we return affidavits promptly. Your attorney can confirm deadlines.

What if the defendant cannot be served at all?

We keep attempting at varied times and log every visit. If diligent efforts fail, counsel may ask the court for another method, such as publication under O.C.G.A. 9-11-4(f)(1), which generally requires an affidavit showing the defendant cannot be found after due diligence or is concealing themselves. Publication service in Georgia explains the steps.

Can you serve Brookhaven papers from another state?

Yes. When the issuing court allows service outside its state, we deliver the papers in Brookhaven and prepare the affidavit to match that court's rule. Out-of-state subpoenas generally must first be submitted to the superior court clerk in the county where the witness lives, who then issues a Georgia subpoena. Papers from other states are explained on a separate page.
