Quick answer
Is cyberbullying a crime in Colorado?
It can be. C.R.S. § 18-9-111(1)(e), known as Kiana Arellano's Law, makes harassing or threatening electronic communications, including texts and social media, a form of harassment and generally a class 2 misdemeanor. Repeated conduct can also amount to stalking. Our Colorado stalking investigations explain when online behavior crosses that line.
01First, the person
When Online Harassment Becomes a Crisis
Before evidence, think about the person being targeted. Cyberbullying can push young people and adults toward despair, and parents sometimes learn the extent of it only after a frightening comment or change in behavior. If someone is in danger, call 911. Colorado Crisis Services is available around the clock at 1-844-493-8255, by texting TALK to 38255, or by calling or texting 988. Those lines can help in the moment in ways an investigator cannot, and our investigative consulting never takes their place.
Once the person is safe, the next priority is keeping the record intact. Messages vanish, accounts are deleted and group chats are cleared, sometimes within hours of a confrontation. Our first step is preservation, not accusation. Families who also need to understand a tragedy can read about our careful suicide death investigations, and parents worried about an adult contacting their child can review our missing child investigations for the urgent version of this work.
- Danger now: call 911
- Crisis support: 988 or 1-844-493-8255
- Text TALK to 38255
- Then preserve evidence before confronting anyone
02Colorado law
Kiana Arellano's Law and Related Statutes
Colorado's harassment statute, C.R.S. § 18-9-111, includes a provision known as Kiana Arellano's Law that covers harassing or threatening electronic communications, including texts and social media posts, made with intent to harass, annoy or alarm. That conduct is generally a class 2 misdemeanor. The same statute reaches repeated calls with no legitimate purpose and repeated communications at inconvenient hours. When online conduct is repeated and causes serious emotional distress, it may also fit the stalking statute, C.R.S. § 18-3-602.
Sharing intimate images is addressed separately. Under C.R.S. § 18-7-107, an adult who posts or distributes an intimate image of an identifiable adult without consent, intending to harass, intimidate or coerce, and causing serious emotional distress, generally commits a class 1 misdemeanor, and a court may add a fine of up to $10,000. Images of minors raise far more serious offenses and belong with police immediately. Our guide to what Colorado investigators can legally do explains our boundaries, and our criminal defense investigations show how these cases look from the defense side.
03Keeping the record
Preserving Evidence for Cyberbullying Investigations in Colorado
Screenshots are a start, but they are easy to challenge. We help you capture posts, messages and profiles in a way that shows the account name, the profile address, the date and time and the surrounding conversation, and we log where and how each item was captured. Where platforms allow users to download their own data, we walk you through it. Our goal is a file a principal, detective or judge can rely on without wondering whether something was edited.
We also ask you not to delete anything, block accounts in a way that erases conversations, or reply in anger. Each of those can cost evidence. If the harassment involves school devices or accounts, the school may hold logs that only it can preserve, so we prepare a polite, specific preservation request for administrators. Clients worried about how much of their own information is public can add our personal information wipe, and attorneys can read about our support for Colorado counsel.
04Behind the account
Tracing Anonymous and Impersonation Accounts
Most anonymous harassers leave clues. A cyberbullying investigation compares writing style, slang, posting times, followers, linked accounts, reused images and details only a few people would know. Fake profiles often share photos or usernames with a real account, and timing patterns sometimes match a class schedule or work shift. We combine those threads into a short list of likely sources and explain the basis for each one, without overstating certainty.
Some answers sit only in a platform's records. Those can generally be obtained only through legal process, such as a subpoena in a civil case or a request from police, and Colorado's civil subpoena rule gives recipients at least 14 days to produce documents. We prepare the factual groundwork that makes such a request focused. We never hack, guess passwords or create fake accounts to bait anyone. When the harassment spills into real-world following, our Colorado surveillance team can document it lawfully, and witness background checks help assess people who come forward.
05Students and schools
Working With Schools, Safe2Tell and Police
Colorado students and parents have a tool many states lack. Safe2Tell lets anyone make an anonymous report by calling 1-877-542-7233, visiting the Safe2Tell website, using its app or texting S2TCO to 738477, and the program passes reports to local law enforcement and school officials. The Colorado Attorney General's office reported in November 2023 that bullying had been the most reported category for three months running, with 297 reports in October 2023 alone, which is why our Fort Collins investigators see these cases near campuses too.
We help families make those reports count. A clear summary with preserved evidence and a short timeline gives administrators something concrete to act on, and it keeps the family's account consistent if police become involved. When a school wants independent fact-finding, we can work for the district or the family's attorney under a written scope. Families in the Boulder area can start with our Boulder investigators, and Douglas County families with our Parker team.
06Adults are targeted too
Online Harassment of Adults, Professionals and Businesses
Cyberbullying is not only a school problem. Adults face harassment from former partners, disgruntled customers, coworkers and strangers who fixate on them. Professionals see fake reviews and impersonation accounts that damage their work, and small businesses face coordinated attacks that spill into threats against staff. The same preservation and tracing methods apply, but the response often runs through an employer, a human resources department or counsel rather than a school.
When harassment happens inside a workplace, our workplace sexual harassment investigations document the conduct and interview witnesses for the employer. When it is part of a broader pattern of following or contact, the stalking page describes how we support a protection order. Executives targeted by organized campaigns may also benefit from our corporate inquiry team, which look at whether a competitor, former insider or group is behind the activity.
07How we work
Measured Conclusions and a Written Scope
Accusing the wrong person can do real harm, especially among teenagers. Our reports separate what we confirmed from what we infer, and we say plainly when the evidence points toward someone without proving it. That restraint protects your credibility with the school, the police and the court. One member of Delator leadership stays responsible for the case from first call to final report, and we never contact the suspected harasser ourselves, the same rule our dating background checks follow.
Delator Group is a licensed Tennessee private investigation firm based in Nashville with no Colorado office. Colorado does not license investigators at the state level, so we apply Tennessee's standard here. Investigative time is $100 per hour within the approved budget, abuse-related investigations start at $1,500, and a personal information wipe with OSINT review is $900. Our Colorado pricing page and our Colorado investigator vetting guide help you decide before you commit.

FAQ
Frequently asked questions
What should we do first when we discover the harassment?
Make sure the person targeted is safe, and call 911 if there is any danger. Then stop and preserve: do not delete messages, reply in anger or confront the suspected bully. Capture what you can with account names and timestamps, and contact us or the school. Crisis support is available at 988 or 1-844-493-8255.
Is online bullying a crime in Colorado?
It can be. C.R.S. § 18-9-111(1)(e), Kiana Arellano's Law, covers harassing or threatening electronic communications and is generally a class 2 misdemeanor. Repeated conduct causing serious emotional distress may be stalking under § 18-3-602. Whether to charge is for police and prosecutors, and many school cases are handled through discipline instead.
How does Safe2Tell work?
Safe2Tell takes anonymous reports by phone at 1-877-542-7233, through its website and app, or by texting S2TCO to 738477, and passes them to local law enforcement and school officials. A clear summary with preserved evidence helps those officials act. We can help families prepare one before or after a report is made.
Is it possible to unmask the person behind a fake profile?
Often we can narrow it to a likely person by comparing writing style, timing, linked accounts and reused images, and we explain how confident the evidence allows us to be. Platform records that confirm identity generally require legal process through a court or police. Our Colorado attorney support explains how counsel can request them.
Does Delator reach out to the family of the student we suspect?
No. We do not contact the suspected harasser or their family, because doing so can escalate the situation and undermine the response of the school or police. Our job is to preserve, trace and document, then give the decision makers a file they can rely on. The school, police or your attorney decide what happens next, and we support them.
What if someone shared private images?
If the person shown is a minor, contact police immediately and do not forward the image to anyone. For adults, C.R.S. § 18-7-107 generally makes posting an intimate image without consent to harass or coerce a class 1 misdemeanor, with a possible fine of up to $10,000. We document the posts carefully and refer the case to police and counsel.
Can a school hire Delator directly?
Yes. Schools and districts sometimes want independent fact-finding, especially when families disagree about what happened or the conduct crossed several platforms. We work under a written scope, keep student information confidential, and report to the administrator or the district's counsel. Our corporate investigations page describes how we handle institutional engagements.
Do you only handle cases involving students?
No. Adults are harassed online by former partners, coworkers, customers and strangers, and businesses face impersonation and coordinated review attacks. The same preservation and tracing methods apply, though the response usually runs through an employer or counsel. When harassment happens at work, our workplace harassment investigations support the employer's response.
What do cyberbullying investigations in Colorado cost?
Time is $100 per hour within the budget you approve in writing. Abuse-related investigations start at $1,500, and a personal information wipe with OSINT review is $900. Many cases are handled remotely, which keeps costs predictable and travel to a minimum. There is no open-ended retainer, and our Colorado service prices list every figure.
How do we start?
