Quick answer

Can I hire a private investigator to find out if my spouse is cheating in Colorado?

Yes. Colorado no longer licenses private investigators at the state level, but its stalking, eavesdropping, wiretapping and trespass laws still apply to anyone watching a spouse. A careful investigator works from public places, records nothing they are not part of and never tracks a car without a right to. Our Colorado surveillance investigators work inside those limits at $100 per hour.

01Colorado divorce law

What an Affair Can and Cannot Change in a Colorado No-Fault Divorce

Colorado is a pure no-fault state. Under C.R.S. § 14-10-106, the only finding a court needs is that the marriage is irretrievably broken, and one spouse must have lived in Colorado for 91 days before filing. Adultery is not a separate ground. The property statute, § 14-10-113, directs the court to divide marital property without regard to marital misconduct, and § 14-10-114(2) says maintenance is awarded the same way. Our Colorado attorney support desk works with family lawyers who understand exactly where that leaves evidence of an affair.

So why do people still hire an investigator? Usually because the affair is tangled up with something the court does weigh: marital money spent on another partner, a parent's conduct during parenting time, or a spouse who is moving assets before filing. The property factors in § 14-10-113 look at each spouse's economic circumstances and the value of what each receives, and your attorney decides whether affair spending is worth raising. Our guide to hidden assets in a Colorado divorce explains how that kind of spending is usually traced.

02The work

What a Colorado Spouse Surveillance Record Actually Contains

Good infidelity work answers a narrow, factual question: where did your spouse go, with whom, and for how long. Coverage normally begins at a point we can confirm, such as an office garage in downtown Denver or a gym parking lot in Colorado Springs, and continues at a lawful distance. Each stop gets a time, an address and photographs taken from a street, sidewalk or business open to the public. When an evening ends at lodging, our hotel and short-term rental surveillance methods cover the entrance without approaching any room.

Identifying the companion is often the second step. Once the same person appears more than once, we can research them through public records, from a $102 basic check to a $300 deep-dive history run by our relationship background check team. Reports describe what was seen in plain sentences, note any gap in coverage honestly and leave out speculation about what happened behind a closed door. Your attorney can then judge whether more field surveillance across Colorado is worth the cost or whether the question has already been answered.

  • Arrival and departure times at every stop
  • Vehicles used and who was driving
  • The companion's identity, researched lawfully on request
  • Public affection, recorded without commentary
  • Time-stamped photographs taken from public places

03Legal limits

Recording, GPS Trackers and Trespass: The Colorado Rules Spouses Break Most Often

Colorado is a one-party consent state, which means you can generally record a conversation you take part in. The trouble starts when a suspicious spouse records conversations they are not part of. Eavesdropping under C.R.S. § 18-9-304 covers a person not visibly present who records a conversation without the consent of at least one participant, and wiretapping under § 18-9-303 covers intercepting calls and electronic messages. Both are class 2 misdemeanors. Our Colorado recording law guide walks through where that line sits.

Trackers are the bigger risk. Colorado's stalking statute, § 18-3-602, includes repeatedly placing a person under surveillance in a way that would cause a reasonable person serious emotional distress, and a first offense is a class 5 felony. Covert tracking can fit that description, so Delator does not put devices on vehicles it has no right to, and our stalking investigations team regularly sees the harm they do. We also stay off private land, since third-degree trespass under § 18-4-504 covers simply entering or remaining on someone else's premises. Read what an investigator may legally do in Colorado before trying any of this yourself.

04Children

When the Affair Affects Parenting Time and Decision-Making

Colorado courts do not award custody so much as allocate parental responsibilities. Under C.R.S. § 14-10-124, parenting time and decision-making follow the child's best interests, with paramount consideration given to the child's safety. The factors include the child's adjustment to home, school and community, each parent's past involvement, and each parent's willingness to support the child's relationship with the other. Nothing in it presumes an equal split of parenting time. Divorce and parenting cases are generally heard in the district court for your county, one of Colorado's 23 judicial districts.

An affair on its own rarely moves those factors. What it can reveal is how a parent uses the time the court gives them: children left with a new partner they barely know, missed school pickups, or overnight stays that unsettle a routine. Those details connect directly to the statutory factors, and we document them while keeping children out of photographs wherever we can. Our guide to parenting-time investigations in Colorado explains what judges tend to weigh, and our Littleton family investigators handle many south-metro parenting files.

05Colorado geography

Following a Spouse Along the Front Range, Into the Mountains and Out of DEN

Most Colorado infidelity cases happen along I-25, where Fort Collins, Loveland, Denver, Castle Rock, Colorado Springs and Pueblo sit in one long corridor. Rush-hour traffic through the metro and the Monument Hill stretch between Castle Rock and Colorado Springs make a mobile follow harder than it looks, so we often position a second investigator ahead of the expected route. Our Colorado Springs infidelity investigators cover El Paso County, the state's most populous county in the 2025 Census estimate.

Mountain weekends are a separate operation. A spouse who says they are skiing with friends may cross the Eisenhower-Johnson Memorial Tunnel on I-70 into Summit or Eagle County, where chain and traction rules run from September through May and closures can stop everyone on the highway. We build weather into the plan rather than promising a timeline. Air travel adds another layer: Denver International handled more than 82 million passengers in 2025, and our out-of-state infidelity coordinators pick up coverage when a flight leaves Colorado.

06Choosing an investigator

Staying Unnoticed and Vetting an Investigator in a State With No PI License

In a cul-de-sac served by our Parker investigators or a mountain town of a few thousand people, an unfamiliar car on the same street two nights in a row gets noticed. We rotate vehicles, vary positions and often recommend fewer, better-timed shifts over long stakeouts that risk exposure. Updates go only to you or your attorney through the channel you choose. If your spouse shares your phone plan, email account or cloud storage, tell us on the first call so nothing we send can be seen at home.

Colorado ran a mandatory private investigator license from 2015 until 2020, when the bill to continue it was vetoed, and no state license exists today. Vetting therefore falls to you. Delator Group is a licensed Tennessee private investigation firm and works every Colorado spouse case to Tennessee's standard: insured, scoped in writing and reported for court use. Our checklist for vetting an investigator in Colorado lists the questions to ask any firm, and you can read about Delator's leadership before you call.

07Price

What Married Infidelity Investigations Cost in Colorado

Surveillance is billed at Delator's standard $100 hourly investigative rate, the same rate charged in Tennessee. Mileage and travel to mountain, Western Slope or Eastern Plains counties are disclosed before work begins, never added after the fact. Most assignments start with two or three shifts aimed at the hours you are most worried about, which keeps the cost tied to the question instead of to open-ended watching. Every figure is listed on the Colorado service pricing page.

Two add-ons carry their own prices: researching a companion runs $102 for a basic check or $300 for a deep dive, and asset research is quoted separately when spending is the real concern. The scope, hours and total are confirmed in writing, and no extra shift is worked without your approval. If you want to see how a surveillance budget is built before calling, our guide to what a Colorado investigator costs explains typical estimates, or you can arrange a confidential consultation.

We take spouse cases in every part of the state. Metro Denver files are handled by our Denver private investigators, and Larimer County work by the Fort Collins surveillance team. Douglas County cases go to our Castle Rock investigators, while Western Slope assignments are planned from Grand Junction with travel priced in advance. FAQ

Frequently asked questions

Does adultery matter in a Colorado divorce?

Not as a ground. Colorado grants dissolution when the marriage is irretrievably broken under C.R.S. § 14-10-106, and property and maintenance are decided without regard to marital misconduct. Evidence of an affair can still matter when it overlaps with money, a parent's conduct during parenting time or concealed assets. Your attorney decides how, and whether, to use it.

Will proof of cheating get me a bigger share of the property?

Generally no. Section 14-10-113 tells the court to divide marital property without regard to marital misconduct, in proportions it considers just. Where marital money was spent on another partner, though, your attorney may want that spending documented. Our Colorado asset investigations trace where funds went so counsel can make that call.

Can I put a GPS tracker on my spouse's car in Colorado?

Be very cautious. Colorado's stalking law, C.R.S. § 18-3-602, covers repeatedly placing someone under surveillance in ways that cause serious emotional distress, and a first offense is a felony. Owning the car jointly does not automatically make covert tracking lawful. Delator does not place trackers on vehicles it has no right to, and we suggest speaking with an attorney first.

Is it legal to record my spouse's calls in Colorado?

You can generally record a call you are part of, because Colorado requires the consent of only one participant. Recording your spouse's calls with someone else, or hiding a device to capture their conversations, can be wiretapping or eavesdropping, both class 2 misdemeanors. Our plain-language Colorado recording guide covers the details.

Does an investigator need a Colorado license to take my case?

No state license exists for Colorado investigators today, because the old program lapsed after the 2020 veto, so checking credentials is up to you. Delator Group is a licensed Tennessee private investigation firm and applies that standard in Colorado, including insurance, written scope and court-ready reporting, and it confirms any local business-license requirement before field work.

How many surveillance shifts does a spouse case take?

Many cases are answered in two to four well-timed shifts, although a careful spouse can take longer. We report after each shift so you can continue, stop or change the timing. No extra hours are worked without your written approval, so the budget stays under your control from the first shift to the last.

Will my spouse find out I hired someone?

We take real precautions. Investigators rotate vehicles, avoid repeat positions on quiet residential streets and never contact your spouse, their employer or their friends. Every update reaches you through a channel you pick in advance. If your spouse can see your email, phone bill or bank statements, tell us early so we can arrange a safer way to reach you.

Can the report be used in a Colorado district court?

Our reports are written for attorneys, with dates, times, locations and photographs presented plainly and without speculation. Whether a report is admitted, and how, is a matter for your lawyer and the court. Our investigators can be available to testify about what they personally observed, and our support for Colorado attorneys explains how we work with counsel.

What if my spouse goes skiing or travels out of state?

Mountain weekends and business trips are common in Colorado spouse cases. We plan I-70 coverage around chain-law season and closures, and when travel crosses into Wyoming, Utah or another state we coordinate coverage there at the same hourly rate with travel disclosed first. Our multi-state surveillance planning page explains how those handoffs work.

How much does a married infidelity case cost in Colorado?

Field time costs $100 an hour, and any mileage or travel is spelled out before the first shift. Most assignments start with a few targeted shifts, and an optional companion background check costs $102 basic or $300 deep-dive. The full list appears on our statewide Colorado pricing page, and your scope is confirmed in writing before anything starts.
