Out-of-State Surveillance Investigations in Mississippi

Surveillance cases rarely respect state lines. A Memphis law firm may need eyes on a defendant in Southaven, an insurer in Alabama may have a claimant living in Hattiesburg, and a Mississippi subject may drive to New Orleans every weekend. Delator Group plans each case as one operation across every state involved, with one report and one written price.

Quick answer

Can an out-of-state law firm hire surveillance in Mississippi?

Yes. Mississippi does not license private investigators at the state level, and nothing limits an out-of-state attorney or insurer from retaining an investigator for a Mississippi subject. The work must still follow Mississippi's recording, stalking and trespass laws. Delator coordinates out-of-state surveillance investigations through our Mississippi attorney services desk at $100 per hour.

01Two kinds of cases

Clients From Other States, and Mississippi Subjects Who Leave

Out-of-state surveillance investigations come in two forms. In the first, the client is elsewhere: a Memphis defense firm with a plaintiff living in DeSoto County, a Louisiana carrier with a claimant on the Coast, or a Nashville lawyer whose witness moved to Tupelo. In the second, the client and case are in Mississippi but the subject crosses the line, driving to Memphis on weekends, working in Mobile during the week or spending months with family in Arkansas. Both need a single plan and a single chain of command.

Delator handles both directions. As a licensed Tennessee private investigation firm headquartered in Nashville, we are already set up for the Tennessee side of many Mississippi cases, and we assign investigators to Mississippi counties for the rest. Coverage elsewhere is planned with the destination state's rules confirmed in advance. Our statewide surveillance investigations page describes the in-state work, and our DeSoto County investigators handle the busiest border corridor.

02Mississippi corridors

Interstates, the Trace and Where Subjects Cross

Knowing the roads matters when a subject may cross a state line. I-55 runs about 290 miles through Mississippi, from the Louisiana line near Osyka to the Tennessee line near Southaven. I-20 runs about 154 miles from the Vicksburg Bridge to the Alabama line near Kewanee, sharing pavement with I-59 east of Meridian. I-10 covers about 77 miles along the Coast, and I-22 runs about 106 miles across north Mississippi toward Alabama. Around Memphis, I-269 and I-69 tie Hernando into the Tennessee outer beltway. Our Harrison County team covers I-10 traffic, and our Warren County investigators watch the Vicksburg crossing.

The Natchez Trace Parkway is a slower option some subjects choose. It runs 444 miles from Natchez to the Nashville area, with a 50 mph speed limit and stretches near Ridgeland posted lower, and it passes Jackson, Kosciusko and Tupelo. A long follow on the Trace is conspicuous, so we usually stage ahead rather than trail. Mississippi, Louisiana, Arkansas and Alabama all keep Central Time, which simplifies timestamps, while part of Tennessee runs on Eastern Time, a detail our reports note when it applies. The Adams County team covers the Natchez end of the Trace.

03Method

Planning Handoffs Instead of Long Tails

A single car following a subject for three hours on an interstate is the fastest way to lose a case. Instead, we stage coverage at the likely destination when it is known, use a second vehicle on longer drives, and resume observation where activity matters, such as a job site, a gym or a relative's home. When the destination is unknown, the first shift is often about learning the pattern so later shifts can be placed ahead of the subject. Our Hinds County investigators often run that first shift for capital-area subjects.

Every leg feeds one timeline. The report shows when coverage began in Mississippi, where the subject crossed, where coverage resumed and every gap in between. That continuity is what an adjuster or a jury can follow. When the subject's address in the other state is uncertain, a $102 database trace through our Mississippi skip tracing services often confirms it before anyone travels, saving the client a wasted trip.

  • Destination staging when the location is known
  • Second-vehicle coverage on long interstate legs
  • Pattern-finding first shift when it is not
  • Address confirmation before costly travel
  • One continuous timeline across states

04Legal limits

Each State's Law Applies Where the Observation Happens

Inside Mississippi, our investigators follow the one-party consent rule for recording under Miss. Code Ann. § 41-29-531(e), the trespass statute, § 97-17-97, and the stalking statute, § 97-3-107, which addresses a course of conduct such as following a specific person. Outside Mississippi, the destination state's recording, trespass and investigator licensing rules govern, and we confirm them before coverage starts. The guide to what investigators can legally do in Mississippi sets out the home-state rules.

Federal law sits on top of both. 18 U.S.C. § 2261A addresses stalking that involves interstate travel or electronic tools, which is one reason Delator does not place trackers on vehicles a client has no right to, in any state. Lawful surveillance is limited, documented and purposeful, tied to a legal question such as a claimed injury or a disputed residence. Our Mississippi recording law guide explains the consent rule in more depth.

05For litigators

Subpoenas, Long-Arm Service and Out-of-State Drivers

Surveillance often feeds discovery. Mississippi has not adopted the Uniform Interstate Depositions and Discovery Act; a 2011 bill was vetoed and the veto stood. Instead, M.R.C.P. 45(a)(3) lets a party submit an out-of-state subpoena to the clerk of the county where discovery will be taken, and the clerk issues a Mississippi subpoena on the same terms. A non-party witness must be served personally, with a day's attendance fee and mileage tendered. Delator Field Services serves those subpoenas through our process serving division in Mississippi.

Two service statutes matter in cross-border cases. The long-arm statute, § 13-3-57, reaches nonresidents who contract with a Mississippi resident for performance here, commit a tort here or do business here. For crashes involving out-of-state drivers, § 13-3-63 treats the nonresident motorist as appointing the Secretary of State, with the Hinds County sheriff serving the Secretary. Our guide to Mississippi service of process explains both, and our hit-and-run driver locates find drivers who left the scene.

06Insurance and benefits

Claimants and Plaintiffs Who Live or Travel Elsewhere

Claims files often cross state lines. A claimant injured at a Mississippi job site may recover at a relative's home in Louisiana, and a plaintiff in a Coast lawsuit may spend weekends on a boat in Alabama. When the claimed limitation is the issue, activity in another state is just as relevant as activity at home. We schedule coverage around the trips that matter, such as a tournament, a move or a recurring weekend, and document activity from public places only.

Our insurance claim surveillance and workers' comp surveillance pages explain how those cases are scoped in Mississippi. Willfully false statements to obtain workers' compensation benefits are a felony under § 71-3-69, and the Attorney General's Insurance Integrity Enforcement Bureau handles insurance fraud matters under § 7-5-301, so referrals require a clean, defensible record. Our Pearl River County investigators often work the I-59 approach into Louisiana.

07Price

Pricing Multi-State Coverage and Choosing the Right Firm

Out-of-state coverage is billed at the same $100 hourly investigative rate used for in-state work, with travel, lodging and mileage estimated and approved before any trip. Staging at a known destination usually costs less than following an entire drive. Field locates start at $1,000 and civil litigation support at a $1,000 minimum. Every rate is on our service pricing page for Mississippi.

Mississippi does not license private investigators at the state level, although local business licenses may apply. When a case crosses lines, ask whether one firm will handle every leg or pass parts to strangers, who will sign the report, and whether the investigator who observed will testify. Our checklist for hiring without a state license covers those questions, and you can contact the Delator team at (629) 310-8667 or [email protected].

How it works

How an Out-of-State Surveillance Case Works

  1. 01

    Case intake

You tell us the subject, the states involved, the legal question and any deadlines. We confirm the destination state's rules before we commit to a plan.

  2. 02

    Written multi-state plan

We set the shifts, staging points and travel, then confirm the hours, lodging, mileage and total price in writing before any investigator travels to the case.

  3. 03

    Coordinated coverage

Investigators observe from public places in each state, resume coverage at planned handoff points and send short updates to the client after every completed shift.

  4. 04

    One report

You receive a single dated narrative with photographs covering every state, with time zones and coverage gaps noted, signed by the investigators who actually observed.

Statewide coverage

Border Counties Where Most Cases Cross

Cases that cross a state line usually pass through a handful of Mississippi counties. Tennessee-bound subjects run through our DeSoto County coverage area. Louisiana crossings on the Coast go through the Hancock County investigators, and on I-55 through our Pike County team. Alabama-bound I-10 traffic leaves through Jackson County, and the I-20 and I-59 corridor through our Lauderdale County investigators near Meridian. Each leg is planned with travel quoted before work starts. Out-of-state firms receive the same report format regardless of where coverage ends.

FAQ

Frequently asked questions

Do you take assignments from law firms outside Mississippi?

Yes. Many of our Mississippi surveillance cases come from attorneys and insurers in Tennessee, Louisiana, Alabama and elsewhere. We scope the work with you, follow Mississippi law in the field and deliver a report written for whichever court hears the case. Our investigators can travel to testify, with travel quoted in advance.

Can you keep following a subject who leaves Mississippi?

Yes, within each state's rules. We confirm the destination state's recording, trespass and investigator requirements before coverage, and we often stage at the destination rather than tail a long drive. The report shows one continuous timeline, including the crossing point and any gap in coverage, so the record stays easy to follow.

Has Mississippi adopted the UIDDA for out-of-state subpoenas?

No. A 2011 bill was vetoed. Out-of-state subpoenas are instead submitted to the clerk of the county where discovery will be taken under M.R.C.P. 45(a)(3), and the clerk issues a Mississippi subpoena with the same terms. Our Mississippi process serving team then serves the witness personally. Fees are tendered at service.

How are out-of-state drivers served after a Mississippi crash?

Under § 13-3-63, a nonresident motorist is treated as appointing the Secretary of State to receive process, with the Hinds County sheriff serving the Secretary and the Secretary mailing notice. Your attorney will confirm the steps. If the driver left the scene, our locates for drivers who fled a crash can help find them.

Is a GPS tracker allowed for multi-state surveillance?

We do not use them on vehicles a client has no right to. Mississippi has no tracker-specific statute, but covert tracking can support a stalking claim under § 97-3-107, and federal law addresses stalking that involves interstate travel. Lawful staging and second-vehicle coverage achieve the same goal without that exposure.

What if we do not know which state the subject lives in?

We start with a $102 database trace, which often confirms a current address and state. If that fails, field locates begin at $1,000 and are scoped in writing. Confirming the address first prevents paying for travel to the wrong place. Our skip tracing services in Mississippi explain the process. Results come to you in writing.

Do time zones affect the report?

Occasionally. Mississippi, Louisiana, Arkansas and Alabama all observe Central Time, but part of Tennessee keeps Eastern Time. When coverage crosses into an Eastern Time area, our reports note the zone with each timestamp so an adjuster or court is never confused about when an observation took place. Each entry shows its time zone.

Can surveillance support a workers' comp fraud referral?

It can. Willfully false statements to obtain benefits are a felony under § 71-3-69. A referral needs a careful record: dates, times, the activity observed and how it compares with the claimed restriction. Our Mississippi workers' comp surveillance page explains how those cases are documented. Investigators can testify about what they saw.

Does Mississippi require an investigator license?

Mississippi does not license private investigators at the state level, though local business licenses may apply. Other states set their own rules, which we confirm before working there. Delator Group is a licensed Tennessee private investigation firm and applies that standard on every leg of a multi-state case. Ask any firm for proof of insurance.

What do out-of-state surveillance investigations cost?

Coverage is $100 per hour, the same as in-state work, with travel, lodging and mileage estimated and approved first. Destination staging usually keeps the total lower than a full follow. Locates start at $102 for a database trace. Every rate is on our Mississippi pricing page, and quotes are always written.
