Quick answer

Can a private investigator help with stalking in Mississippi?

Yes, alongside police and your attorney. Mississippi's stalking statute turns on a course of conduct, meaning two or more acts showing a continuity of purpose. We document those acts with dates, times and photos, check for trackers and identify unknown harassers. If you are in danger now, call 911. Our guide to what investigators can legally do explains the limits.

01Before anything else

Safety Planning Comes Before Evidence

If you are in immediate danger, call 911. Evidence matters, but not more than your safety. Before an investigator does anything that could be noticed, we talk through your routines, who knows your schedule, where you park and sleep, and who else could be at risk, such as children or a new partner. The National Domestic Violence Hotline, 1-800-799-7233, can help with a safety plan. Stalking investigations in Mississippi should never make the situation more dangerous, and our surveillance investigators plan every observation with that in mind.

Tell local police or the sheriff what is happening and ask for an incident number each time. Even if officers cannot make an arrest yet, a series of reports helps prove a pattern later. Keep copies of every message, voicemail and photo, and do not delete accounts the person is using to contact you without advice, because that can erase evidence. Our cyberbullying investigations explain how to preserve online material, and our Hinds County investigators work many capital-area cases.

  • Call 911 if you are in danger
  • Ask for an incident number every time
  • Keep every message and voicemail
  • Vary routes and routines where possible
  • Tell trusted people what is happening

02Mississippi law

How Mississippi Defines Stalking and Cyberstalking

Under Miss. Code Ann. § 97-3-107, as reproduced in the 2025 Mississippi Code, stalking means purposefully engaging in a course of conduct directed at a specific person, or making a credible threat, that the person knows or should know would cause a reasonable person to fear for their own or another's safety, or for damage to property. A course of conduct is two or more acts over time showing a continuity of purpose, including following, confronting, and contact by phone, mail or electronic communication. Our witness background research helps document who saw those acts.

Basic stalking carries up to one year in county jail and a $1,000 fine, and up to $1,500 when a protective order is in effect. Aggravated stalking, a felony, applies when a deadly weapon is involved, the person has a prior stalking conviction within seven years, or a registered sex offender targets a victim under 18. Separately, cyberstalking under § 97-45-15 covers electronic threats and repeated electronic communications meant to threaten, terrify or harass, and is a felony punishable by up to two years. Our Mississippi recording law guide covers lawful capture of calls.

03Evidence

Building a Dated Record of Every Incident

Courts and prosecutors look for a pattern, so the record has to show one. We help you build an incident log with date, time, place, what happened, who saw it and what evidence exists, then add our own observations. When the person follows you or waits outside your home or work, investigators can observe from public places, photograph vehicles and plates, and note times, without engaging. Each observation is time-stamped and written up the same day. Our employee surveillance specialists use the same reporting discipline.

Mississippi generally allows a party to a conversation to record it under § 41-29-531(e), so you may usually record calls you are part of. Recording conversations you are not part of is a different matter: illegal interception is a crime, and disclosing intercepted communications can be a felony. We never intercept the other person's communications, and we will not ask you to; our Jackson County investigators follow the same rule on the Coast. Our workplace surveillance team helps employers when the conduct reaches a victim's job site.

04Devices

GPS Trackers, Hidden Cameras and Shared Accounts

Stalkers often know too much: where you went, when you left, who you met. That can come from a tracker on a vehicle, location sharing left on a phone, a shared cloud or family account, or a hidden camera. Mississippi has no statute that specifically regulates private GPS tracking; a 2020 bill that would have banned placing a GPS device on another person's vehicle died in committee. Covert tracking can still support a stalking charge or a privacy claim, and federal law at 18 U.S.C. § 2261A also reaches stalking through electronic means. Our OSINT exposure reviews show what is publicly findable about you.

We inspect vehicles the client owns or has the right to search, review the account and location settings the client controls, and check the client's home for concealed cameras. Section 97-29-63 punishes lewd photographing or filming in places where people expect privacy, such as bedrooms and bathrooms. If we find a device, we photograph it in place, do not destroy it, and advise the client to give it to police. We do not place trackers on anyone else's vehicle. Our corporate espionage investigations apply similar checks in offices.

05Who is it

Identifying a Harasser Who Hides Behind Accounts

Some stalkers use new phone numbers, fake profiles and burner email addresses so the victim cannot prove who is behind them. Investigators compare writing style, posting times, details only certain people would know, linked accounts and public records to narrow the field. We report what the evidence supports and how strongly, not a guess. Platform records showing who owns an account usually require a subpoena or police request, so we tell counsel what to ask for. Our dating background checks help when the harasser is someone met online.

Once a suspect is identified, the evidence package goes to the investigating officer and to your attorney. A civil claim may also be possible. Mississippi recognizes invasion of privacy as a tort, as in Candebat v. Flanagan (1986), and § 15-1-35 sets a one-year period for claims such as assault, menace, slander and libel, so counsel should review timing early. Our investigation support for Mississippi attorneys covers both protective order hearings and civil suits.

06Court protection

Protective Orders and the Evidence Courts Expect

Mississippi's protection from domestic abuse law in chapter 93-21 allows a person to file in municipal, justice, county or chancery court, and a parent, adult household member or next friend may file for a minor. Under § 93-21-15, municipal and justice courts may issue temporary orders after a hearing with notice, generally lasting up to 30 days, or up to a year if the parties have no minor children together. Final orders come from chancery or county court and may address temporary custody and support. Your attorney or an advocate can explain which court fits, and our Lowndes County investigators can gather evidence for hearings in Columbus.

Whether the stalker is a former partner or a stranger affects which remedies apply, and an attorney should advise on that choice. Either way, judges respond to organized, dated evidence: the incident log, photographs, our observation reports and copies of messages. Violating a protective order also raises the stalking penalty. If custody is part of the case, our Mississippi custody investigations guide explains how chancellors weigh conduct, and our Rankin County investigators work many Brandon-area chancery matters.

Who Delator Works For, and Who It Will Not

Delator works only for the person being stalked or their counsel, and it screens every request. Stalkers sometimes hire investigators to find a victim who moved, so we ask why someone is being located and decline requests that look like that. Mississippi leaves private investigators unlicensed at the state level, though a general business privilege license may still be required locally. Delator is a licensed Tennessee private investigation firm headquartered in Nashville, with no Mississippi office. Our guide on choosing an investigator without a state license lists questions to ask.

Investigators never confront the person, never trespass to gather evidence and never pose as anyone else. Mississippi's trespass statute, § 97-17-97, applies to us. Work is billed at $100 per hour under a written scope, with the price set before anything starts, and every report is reviewed by leadership. Coast clients can work with our Harrison County investigators, and our published Mississippi pricing lists every rate.

FAQ

Frequently asked questions

What counts as stalking under Mississippi law?

Under Miss. Code Ann. § 97-3-107, stalking is a purposeful course of conduct directed at a specific person, or a credible threat, that would cause a reasonable person to fear for their safety, someone else's safety or their property. A course of conduct means two or more acts over time showing a continuity of purpose, including following and repeated contact.

Is it illegal for someone to put a GPS tracker on my car in Mississippi?

Mississippi has no statute that specifically regulates private GPS tracking; a 2020 bill to ban it died. Covert tracking can still support a stalking charge or a privacy claim, and federal stalking law reaches electronic surveillance. If you find a tracker, photograph it, leave it in place if safe, and call police. Our Mississippi legal limits guide explains more.

Can I record the person's calls to me?

Mississippi generally allows a party to a conversation to record it under § 41-29-531(e), so you can usually record calls you are on. Recording other people's conversations without a party's consent is illegal interception, and disclosing such recordings can be a felony. Our plain-language guide to consent recording covers the details.

How do I get a protective order in Mississippi?

Chapter 93-21 allows filing in municipal, justice, county or chancery court. Municipal and justice courts may issue temporary orders after a hearing with notice, generally up to 30 days, and chancery or county court issues final orders. Whether that chapter fits depends on your relationship with the person, so an attorney or advocate should advise. Organized, dated evidence strengthens any request.

Can you unmask the person running a fake or anonymous profile?

Often we can narrow it down by comparing writing style, timing, shared details, linked accounts and public records. We report what the evidence supports and how strongly. Proof of account ownership usually requires a subpoena or police request to the platform, so we tell counsel exactly what to ask for.

Will the stalker know you are investigating?

We plan every step to avoid that. Observation is done from public places without contact, and device checks happen on property you control. We never confront the person. If any step could be noticed, we discuss it with you first, because your safety comes before any piece of evidence. You stay in control.

What does a stalking investigation cost?

Investigative time is $100 per hour under a written scope. A remote background check on a suspect costs $102, and a deep-dive report costs $300. There is no open-ended retainer, and the price is set before work begins. Our Mississippi pricing page lists every published rate for review. Travel is quoted in writing.

Can stalking be the basis of a civil lawsuit?

It can, depending on the facts. Mississippi recognizes invasion of privacy as a tort, and other claims may apply. Some claims, such as assault, menace, slander and libel, carry a one-year limitation period under § 15-1-35, so speak with an attorney promptly. Our attorney investigation services support civil cases. Evidence gathered early helps.

Will you help someone find a person who moved away to escape them?

No. We screen every locate request, ask why the person is being sought and decline requests that look like an attempt to find a victim. Delator works only for people being stalked and their counsel in these cases. If you are worried someone is trying to find you, our personal information removal service can help.
