Quick answer

Is an investigator worth it for a misdemeanor in Mississippi?

Often yes, because many misdemeanor cases rest on a single report and no one else looks for other evidence. An investigator can locate the witness who saw the start of a fight, secure store video before it is overwritten or show that a trespass sign was not visible. Delator does this work as part of its Mississippi criminal defense investigations at counsel's direction.

01The courts

Municipal, Justice and County Courts Hear Most Misdemeanors

Mississippi's lower courts carry most misdemeanor dockets. The Secretary of State's Blue Book counts 239 municipal courts, most with judges appointed by the city, and 82 justice courts with 198 elected judges. Counties with a county court, which include all of the larger ones, add a third forum that can hear criminal matters a circuit judge assigns. Each court has its own clerk, its own docket rhythm and its own way of handling discovery. We learn those habits before the first field visit so counsel gets facts in a form that court will actually use, whether the case sits in Hinds County or a small town.

Speed is the defining feature. A misdemeanor can go from citation to trial setting within weeks, and witnesses scatter quickly after a bar fight or a parking lot dispute. That is why our intake asks for the court date first. Under Mississippi Rule of Criminal Procedure 7.2, each circuit, county, municipal and justice court must have a procedure for appointing counsel, so many of these defendants are represented by appointed lawyers, and our appointed counsel support in Mississippi is designed around their budgets. Retained counsel can review our investigator services for attorneys for the engagement terms.

02Charges we investigate

Assault, Trespass, Stalking, Theft and Impaired Driving

The misdemeanors we see most often are simple assault and domestic disputes, trespass, low-level theft, disorderly conduct, stalking and first or second offense DUI. Each has a different factual core. Trespass under § 97-17-97 generally requires that the person went or stayed on property after being forbidden orally, in writing or by reasonably visible posted signs, and it carries up to $500 and six months as a misdemeanor. Whether a sign was actually visible from where the client stood is a physical question we can photograph and measure. Impaired driving cases run on their own checklist, described on our Mississippi DUI defense investigations page.

Stalking under § 97-3-107 requires a course of conduct, meaning two or more acts showing a continuity of purpose, that the person knew or should have known would cause reasonable fear. As of the 2025 Mississippi Code, the basic offense carries up to a year in county jail and a $1,000 fine. A defense investigation looks at every act the State counts, the dates, the messages and the context around them. Our stalking investigation team works both sides of these cases, which helps us anticipate how the prosecution will frame the evidence.

03Evidence that disappears

Finding Witnesses and Saving Video Before It Is Gone

Misdemeanor incidents tend to happen in public places with cameras: convenience stores, apartment complexes, gas stations, restaurants and parking lots. Most of those systems record over themselves on a short cycle. The first thing we do is list every camera with a line of sight, identify who controls it and give counsel the information needed for a preservation letter or subpoena. Where footage is already gone, we look for phone video posted by bystanders. Our workplace and premises surveillance specialists know where commercial systems are usually mounted and who maintains them.

People are the second priority. A bystander who saw the first punch, a neighbor who heard the argument, or the clerk who called police may never have been interviewed. We canvass the area, identify witnesses by name, locate them if they have moved and take careful interview notes. If a witness has a record or a relationship that affects credibility, counsel needs to know before trial, and our witness background research supplies that at $102 for a basic remote check. Hard-to-find witnesses go to our skip tracing team in Mississippi.

04Family-related charges

Domestic Misdemeanors and Overlapping Protective Orders

Domestic incidents often produce two cases at once: a criminal misdemeanor and a protective order petition. Under § 93-21-7, a petition may be filed in municipal, justice, county or chancery court, and under § 93-21-15 municipal and justice courts can issue temporary orders after a hearing with notice, while final orders come from chancery or county court. Statements made in one proceeding can surface in the other. Counsel needs a single, consistent factual picture, and we build it once so it can serve both files. Related family matters may also touch our custody investigation guidance for Mississippi.

Our work in these cases is careful and documented. We interview neighbors and family members who were present, gather 911 call times through counsel's records requests, photograph the residence layout and review messages the client provides. We do not contact a protected party in violation of any order, and we confirm the status of every order before planning field work. When a parallel divorce is pending in chancery court, counsel can coordinate with our Mississippi hidden asset guidance or a separate engagement so the criminal and civil records stay aligned.

05Records

Priors, Enhancements and Amounts That Change the Charge

Some misdemeanors are one prior conviction or one dollar figure away from becoming felonies. A third DUI inside five years, an exploitation case under § 43-47-19 crossing the $250 line, or a stalking case with an aggravating factor can move the matter to circuit court. Before counsel negotiates, we confirm what is actually on the client's record by pulling certified court files and abstracts, checking identities and dispositions and noting any entry that looks wrong. If a case is heading upward, our felony defense investigations in Mississippi team picks up the same file without starting over.

Records also matter for the State's witnesses. Public court records, protective order histories and prior complaints can show a pattern or a motive the report does not mention. We search those sources lawfully and present what we find without overstating it. Mississippi's Public Records Act, § 25-61-5, generally gives any person access to public records under each body's procedures, which helps when counsel needs incident reports or dispatch logs from a city such as those in Jackson County on the Coast. Our Mississippi investigative consulting service helps counsel decide which requests are worth making before a short trial date.

07Scope and cost

A Misdemeanor Scope Sized to the Case

Most misdemeanor files do not need a large investigation. They need the right three or four tasks done quickly. Case-based misdemeanor defense work starts at $750, and the standard investigative rate is $100 per hour when counsel prefers hourly billing. A focused scope might cover one scene visit, a camera canvass, two witness interviews and a short written report. We put that scope and its price in writing before anything starts, so neither counsel nor the client is surprised. Our Mississippi service pricing schedule lists every published rate.

If the case grows, the scope grows only with counsel's written approval. Multiple charges start at $1,500, which is often the right model when a single incident produces assault, resisting and property counts together. Travel to rural counties is quoted separately and stated up front. The cost guide for Mississippi investigations explains how we estimate time for field work. Delator has no Mississippi office, so every assignment is coordinated from Nashville under one chain of command, and counsel always knows who is responsible for the report.

How it works

How a Mississippi misdemeanor investigation runs

  1. 01

    Court date first

Counsel sends the citation or affidavit, the report and the court date. We read the file the same week and send a written scope and price sized to the time available.

  2. 02

    Preserve and canvass

Investigators list cameras and custodians, visit the scene at the matching hour and canvass for witnesses, so counsel can send preservation letters while footage still exists.

  3. 03

    Interviews and records

Witnesses are located and interviewed, priors are checked against certified records and any public records counsel requests are pursued through the proper channels. Every step is dated.

  4. 04

    Short written report

Counsel receives a concise report with photographs, interview summaries and a timeline, built for a quick trial setting or a negotiation with the city or county prosecutor.

FAQ

Frequently asked questions

Which Mississippi courts hear misdemeanors?

Most misdemeanors are heard in municipal courts for offenses inside city limits or in justice courts at the county level. Counties with a county court may also hear criminal matters assigned by a circuit judge. Each court has its own clerk and procedures, and your attorney will know which one has the case. We adapt the investigation to that court's pace and practices.

How much does a misdemeanor defense investigation cost?

Case-based misdemeanor defense investigations in Mississippi start at $750, and hourly work is $100 per hour. Multiple charges from one incident start at $1,500. Travel to rural counties is quoted separately. The full schedule is on our Mississippi pricing page, and every engagement starts with a written scope and price.

Can an investigator get store or apartment video?

We identify the cameras, the owners and the custodians and tell counsel exactly what to request, often within a day or two of intake. Counsel then sends preservation letters or subpoenas. Some businesses will share footage voluntarily with the defense, and we document that chain of custody carefully. Speed matters because many systems overwrite within days.

Will you interview the complaining witness?

Only when counsel directs it and only lawfully. If a protective order is in place, we will not make contact that could violate it. When an interview is appropriate, we identify ourselves and our client, and we never pretend to be someone else. Many cases are better served by interviewing independent witnesses first and leaving the complainant to cross-examination.

Do misdemeanor cases really need witness interviews?

Many are decided on whether anyone else saw what happened. A bystander, a clerk or a neighbor can confirm or contradict the officer's account in a way the client cannot. Our Mississippi witness background checks also tell counsel whether a witness has credibility issues before trial, so the defense is not surprised on cross-examination.

Can a misdemeanor become a felony?

Yes, in some situations. Prior convictions, dollar amounts and aggravating facts can raise the grade of an offense, such as a third DUI inside five years. We check every prior and figure the State relies on. If the charge moves up, our felony defense investigation team continues the work with the same file.

Does Mississippi require investigators to hold a state license?

Mississippi does not license private investigators at the state level, although general business privilege licenses may apply locally. Delator Group is a licensed Tennessee private investigation firm and holds every Mississippi assignment to Tennessee's standard. Our guide to vetting investigators in Mississippi explains what to ask any firm. We also carry insurance and keep one chain of command on every file.

Can you help with a stalking or harassment charge?

Yes. Stalking under § 97-3-107 requires a course of conduct, so the defense needs every act, date and message laid out and tested. We build that timeline from material counsel provides and from lawful sources, and we look for context the State omitted. Our Mississippi stalking investigations page describes the methods we use.

Do you work with appointed counsel?

Yes. Rule 7.2 requires every Mississippi trial court to have a procedure for appointing counsel, and many misdemeanor defendants are represented that way. We write short, clearly priced scopes that appointed lawyers can present to the court. See our support for appointed defense counsel for details on budgets, invoices and court approval.

How quickly can you start?

We review the file and send a written scope promptly after intake, and field work begins once counsel approves it. Because Delator coordinates from Nashville with investigators assigned to Mississippi counties, scheduling depends on location, and we state any travel up front. Send the court date with the first email so we can plan around it.
