Quick answer
Does proof of adultery still matter in a South Dakota divorce?
It can. SDCL 25-4-2 still lists adultery as a ground for divorce alongside irreconcilable differences, and conduct may bear on alimony or custody arguments. Whether to use it is your attorney's decision. Our South Dakota surveillance team gathers lawful, dated evidence at $100 per hour so counsel has facts to weigh.
01State law
South Dakota Still Lists Adultery as a Divorce Ground
Many states abandoned fault divorce decades ago. South Dakota kept it. Under SDCL 25-4-2, a court may grant a divorce for adultery, extreme cruelty, willful desertion, willful neglect, habitual intemperance or a felony conviction, and irreconcilable differences was added as a no-fault option in 1985. Most couples file on the no-fault ground, but the older grounds remain available, which is one reason married infidelity investigations still carry weight here. Our overview of what an investigator may lawfully do explains how that evidence is gathered.
Fault can surface in other places, too. SDCL 25-4-41 lets a court award a suitable allowance to one spouse for life or a shorter period, having regard to the circumstances of the parties, and SDCL 25-4-44 directs an equitable property division regardless of title. Neither statute lists fault as a factor, so we never promise that an affair will change a settlement. What we deliver is an accurate record. A family law attorney decides whether it helps, and our attorney services desk works directly with counsel when you prefer that route.
02Evidence
What a Married Infidelity Investigation Documents
A useful file answers specific questions: where did your spouse go after leaving work on Thursday, who was waiting there, how long did they stay and did they leave together. Investigators work from public streets, parking lots and businesses open to anyone, logging times, vehicles and companions and taking photographs only of what a passerby could see. When a meeting moves to a motel off I-29 or a lodge in the Black Hills, our hotel stay documentation service applies the same rules inside lobbies and parking areas.
Surveillance is often paired with records work. Once a companion is identified, a basic remote background check costs $102 and a deep-dive $300, and our companion background research can show whether the person has a protection order history or a record that matters for custody. Spending patterns matter as well. Cash withdrawals, a second phone bill or unexplained hotel charges may point to marital money being diverted, which our divorce asset tracing guide walks through step by step.
- Departure and arrival times at each location
- Vehicles, plates and companions observed
- Photographs taken from public vantage points
- Lawful identification of the other person
- Spending and travel patterns tied to the conduct
03Legal limits
Recording, Tracking and Privacy Rules for South Dakota Spouses
South Dakota is generally a one-party consent state. SDCL 23A-35A-20 makes it a Class 5 felony to record a conversation without the consent of a participant, so secretly recording your spouse's phone calls with someone else is a serious risk even inside your own home. SDCL 22-21-1 separately criminalizes installing a device to observe or record people in a private place without consent. Our plain-language recording law guide covers the details, and we advise every client to stop any self-help recording before a case begins.
GPS trackers raise another problem. South Dakota has no tracker statute on NCSL's list, but the stalking law, SDCL 22-19A-1, reaches willful, malicious and repeated following or harassment, including through electronic means. Covertly tracking a spouse's car can create criminal and civil exposure, and Delator does not place devices on vehicles it has no right to. If your spouse is tracking or harassing you, our stalking investigations team documents that conduct for a protection order petition instead.
04Children
When an Affair Touches Custody Under the Fuerstenberg Factors
South Dakota courts decide custody on the child's best interests in respect to temporal, mental and moral welfare under SDCL 25-4-45, and neither parent is preferred. Trial courts may, but need not, weigh the Fuerstenberg factors: parental fitness, stability, primary caretaker, the child's preference, harmful parental misconduct, separating siblings and substantial change of circumstances. An affair alone rarely decides custody. Misconduct counts when it is specifically harmful to the child, so our custody investigation guide explains how to keep surveillance pointed at facts a judge can use.
That focus shapes our planning. We document who is present during parenting time, whether children are left alone while a parent spends the night elsewhere and whether a new partner with a troubling history is around them. If domestic abuse is part of the picture, SDCL 25-4-45.5 creates a rebuttable presumption against custody with the abusive parent, and our witness background research can vet the people who would testify about that history. We keep children out of the photographs whenever possible and never approach them.
05Geography
Infidelity Surveillance From Sioux Falls Suburbs to West River Ranch Towns
Where you live changes how surveillance works. Lincoln County grew about 18 percent between 2020 and 2025 as Sioux Falls spread south into Harrisburg and Tea, and new subdivisions with few through streets make a parked car easy to notice. Our Harrisburg investigators plan around cul-de-sacs and school traffic, and our Sioux Falls infidelity investigators cover the restaurants, gyms and hotel corridors along I-29 and I-229 where many meetings happen.
West River is a different job. Towns are small, distances are long and a strange vehicle on a ranch road draws attention within minutes. A spouse in Belle Fourche or Hot Springs may drive to Rapid City for a meeting, roughly 350 miles from Sioux Falls along I-90, so we often stage an investigator near the destination rather than following the whole way. Our Rapid City surveillance investigators handle that side of the state, and appointment times there are quoted in Mountain Time.
06Discretion
Keeping a Married Infidelity Case Confidential in a Small State
South Dakota has about 935,000 residents, and in many counties people recognize each other's trucks. That makes discretion a practical requirement, not a courtesy. We never contact your spouse, the other person, coworkers or neighbors, and we do not use pretext calls to employers. Communication runs through the channel you choose, and invoices can be addressed to your attorney. Clients worried about their own exposure can add our personal information wipe. When the companion works with your spouse, our workplace affair investigators coordinate timing so the inquiry never reaches the employer.
We also ask you to protect the case. Do not check your spouse's phone, log in to their email or install apps on their devices, because those steps can violate the eavesdropping statute and undermine everything we document. Keep your routine normal and write down dates that seem significant. If you are unsure whether something you already did creates exposure, raise it with counsel before the first shift. Our guide to vetting an investigator lists other questions worth asking any firm you consider.
07Price
What Married Infidelity Investigations Cost in South Dakota
Field surveillance is billed at our $100 hourly investigative rate, the same rate we charge in Tennessee, with travel and mileage disclosed before work starts. Most cases are built around the windows when your spouse is unaccounted for, such as a standing Wednesday evening or a monthly work trip, rather than around-the-clock coverage. We recommend the fewest hours likely to answer your question and put the scope and total in writing. Our South Dakota service pricing page lists every rate.
If the evidence supports a divorce filing, counsel can retain us for civil litigation support, which carries a $1,000 minimum, to organize the timeline, prepare exhibits and serve papers. Delator Field Services coordinates service of the summons and complaint under SDCL 15-6-4 through our South Dakota process serving desk. Nothing is billed beyond the written scope without your approval, and the cost guide for hiring an investigator explains how hourly estimates are built.

FAQ
Frequently asked questions
Is adultery still a ground for divorce in South Dakota?
Yes. SDCL 25-4-2 lists adultery among the fault grounds, together with extreme cruelty, willful desertion, willful neglect, habitual intemperance, felony conviction and irreconcilable differences. Most divorces proceed on irreconcilable differences, but a fault ground remains available. Your attorney decides which ground fits your case and whether surveillance evidence would help prove it.
Will proof of an affair change alimony or property division?
Not automatically. SDCL 25-4-41 allows a suitable allowance based on the parties' circumstances, and SDCL 25-4-44 calls for an equitable division regardless of title. Neither statute lists fault as a factor, so outcomes vary. Evidence that marital money paid for an affair may still be relevant, and our asset investigation team can trace that spending.
Can I record my spouse's phone calls in South Dakota?
Generally no, unless you are a party to the call. SDCL 23A-35A-20 makes recording a communication without the consent of a sender or receiver a Class 5 felony. Recording your own conversations is usually lawful because South Dakota is a one-party consent state. Speak with counsel before recording anything connected to a divorce.
Can you put a GPS tracker on my spouse's car?
We do not place trackers on vehicles we have no right to. South Dakota has no specific tracker statute, but covert tracking can support stalking or harassment claims under SDCL 22-19A-1 and create civil liability. We rely on physical surveillance from public places instead, which produces evidence your attorney can use without explaining how it was obtained.
How long does a married infidelity investigation take?
Many cases resolve within two to four targeted shifts when the client knows which evenings or trips are suspicious. Cases with no pattern take longer because we first have to learn the routine. We recommend a starting scope in writing and report after each shift, so you decide whether to continue.
Do you need my spouse's schedule before starting?
It helps a great deal. Work hours, vehicles, regular stops and any planned trips let us place coverage where it matters. Recent photographs and a description of the people you suspect also save hours. Gather what you already know without accessing your spouse's accounts or devices, which can create legal problems under South Dakota law.
Is Delator Group licensed to investigate in South Dakota?
South Dakota does not issue a statewide private investigator license, so no firm holds one. Delator Group is a licensed Tennessee private investigation firm and applies that standard here, with written scopes, insurance and court-ready reporting. Our checklist for choosing an investigator explains what to ask any firm. The answer should be in writing.
Can the evidence be used in a custody case?
Sometimes. South Dakota courts focus on the child's best interests, and harmful parental misconduct matters when it specifically affects the child. Observation showing unsupervised children or a dangerous new partner may be relevant. Our guide to custody investigations explains which facts tend to matter under the Fuerstenberg factors. Your attorney makes that call.
What if my spouse travels outside South Dakota?
We coordinate coverage at the destination, whether that is Sioux City, Fargo, the Twin Cities or farther. Trips through the time-zone line are logged carefully so the timeline stays accurate. Our out-of-state surveillance coordinators handle handoffs between investigators at the same $100 hourly rate, with travel disclosed up front. One report covers the whole trip.
Can you serve the divorce papers once we file?
Yes. Delator Field Services coordinates service of the summons and complaint under SDCL 15-6-4, with logged attempts and a signed affidavit. If your spouse avoids service, our investigators can locate them first. Published county starting rates appear on the South Dakota process serving rate map, with the final price confirmed in writing.
