DUI Defense Investigations in South Dakota
South Dakota DUI cases are usually won or lost on a short stretch of facts: the reason for the stop, the conditions where field tests were given, and the gap between driving and the blood draw. Delator Group works for defense counsel to document those facts, preserve perishable video, locate witnesses and rebuild an accurate timeline.

Quick answer
What does a DUI defense investigator do in South Dakota?
A defense investigator gathers facts for the accused driver's attorney to test the State's account. In South Dakota that usually means preserving business and roadway video, documenting the stop location, interviewing passengers and servers, checking each prior conviction against the ten-year lookback and building a timeline of the blood draw. Delator handles this within its criminal defense investigations in South Dakota, always at counsel's direction.
01The statute
What SDCL 32-23-1 Actually Prohibits
South Dakota's impaired driving offense sits in SDCL 32-23-1. As of the 2026 codified laws, it generally covers driving or being in actual physical control of a vehicle with an alcohol concentration of 0.08 percent or more, or while under the influence of alcohol, marijuana or a non-prescribed controlled substance. It also reaches prescribed drugs, alone or mixed with alcohol, taken to a degree that makes safe driving impossible. Each theory demands different proof, so our South Dakota investigation team shapes the field plan around the specific subsection the State has charged.
The phrase "actual physical control" deserves attention in a state where winter nights are long and cold. A driver found asleep in an idling pickup outside a bar in Aberdeen or Watertown may not have been driving at all, and the facts that answer that question are physical: where the keys were, whether the engine was warm, whether the vehicle had moved. We photograph and measure those details. Our page on what an investigator may lawfully do explains the limits we observe while collecting them.
- 0.08 percent alcohol concentration theory
- Under the influence of alcohol or marijuana
- Non-prescribed controlled substances
- Prescribed drugs that make safe driving impossible
02Offense levels
Offense Levels, Priors and the Ten-Year Window
Under the 2026 codified laws, a first offense is a Class 1 misdemeanor with a license revocation of at least 30 days (SDCL 32-23-2), and a second is also a Class 1 misdemeanor (32-23-3). A third conviction becomes a Class 6 felony under SDCL 32-23-4, with a revocation of at least one year and ten days of county jail that cannot be suspended. A fourth is a Class 5 felony under 32-23-4.6. Because the statutory maximum for a Class 1 misdemeanor is one year in county jail, a $2,000 fine or both (SDCL 22-6-2), misdemeanor defense investigations still deserve real effort.
Prior convictions are where enhancement cases are often contested. SDCL 32-23-4.1 generally bars using a prior DUI, vehicular battery or vehicular homicide conviction that occurred more than ten years before the charged violation, and it excludes time the defendant spent incarcerated for an earlier violation when that period is measured. That makes custody dates as important as conviction dates. We obtain certified records for each prior, confirm identity, court and disposition, and map release dates so counsel can test the count. Out-of-state priors receive the same scrutiny through our witness and records background research.
03Court structure
Magistrate Court, Circuit Court and Where DUI Cases Are Heard
South Dakota runs a unified court system with circuit courts in all 66 counties, grouped into seven judicial circuits. Magistrate courts operate inside those circuits and, under SDCL 16-12B-11, share jurisdiction with circuit court over misdemeanors, so many first and second offense DUI cases are handled before a magistrate judge. Magistrates also perform committing-magistrate functions in felony matters. Felony DUI charges proceed in circuit court, where jury pool background research can help counsel prepare for selection in a county where many jurors know one another.
Forum matters for investigation as well. A crash or arrest within reservation boundaries can raise questions about tribal or federal jurisdiction, since South Dakota is not a Public Law 280 state and nine tribal nations govern land inside its borders. We never offer jurisdictional conclusions; we gather the facts counsel needs to decide them, such as exact location, land status records and the identity of every agency that responded. Charges that rise to the felony level are covered in more depth on our felony defense investigations page.
04Testing
Implied Consent, Blood Draws and the Chain of Custody
SDCL 32-23-10 provides that anyone who operates a vehicle in South Dakota is considered to have consented to the withdrawal of blood or another bodily substance for chemical analysis of alcohol, marijuana and controlled substances. After an arrest for a violation of 32-23-1, the arresting officer may require the driver to submit to a blood withdrawal as evidence. Because the State often relies on a blood result, the questions that matter are practical ones about who drew the sample, where, when and how it traveled to the lab. Counsel can review our investigator rate schedule before authorizing that work.
We reconstruct that path from records and interviews where counsel approves. That includes the hospital or jail where the draw happened, the personnel present, the kit and its seals, storage conditions and every hand-off until analysis. We also compare the officer's written narrative with dash camera and officer-worn video timestamps. When a recorded conversation is part of the evidence, our guide to recording conversations in South Dakota explains why the state is generally treated as one-party consent under SDCL 23A-35A-20, and what that means for interviews.
- Location, time and personnel for each draw
- Kit seals, storage and transport records
- Written narrative compared with camera timestamps
- Every hand-off listed for counsel
05A South Dakota timeline problem
Two Time Zones on One Interstate
South Dakota is split between Central and Mountain time. On Interstate 90 the line falls at the western edge of Jones County, between mileposts 174 and 175, so Murdo keeps Central time while Kadoka keeps Mountain. Sioux Falls and Pierre are Central; Rapid City is Mountain; Fort Pierre is officially Mountain but commonly observes Central. A DUI timeline that mixes dispatch logs, phone records, receipts and hospital charts from both sides of that line can be off by a full hour without anyone noticing.
When the State's case depends on how quickly a sample followed driving, an hour matters. We normalize every timestamp to a single zone, note its source, and flag any record whose zone is unstated. A bar receipt in Wall, a cell tower record processed in a Central-time system and a blood draw charted at a Rapid City hospital can then be read side by side. For arrests on the I-90 corridor, counsel can pair this work with our Rapid City investigators or with lawful scene surveillance at the same hour of night.
06Field work
Scene Work on Interstates, Section Roads and Small-Town Streets
Stops in South Dakota happen everywhere from the I-229 loop around Sioux Falls to gravel section roads in farm country, and field sobriety tests performed on a crowned shoulder in wind or blowing snow are hard for anyone. We visit the location at the matching hour, photograph the surface, slope, lighting and traffic, and note weather records for the date. SDDOT's 511 service and its published closure notices are a starting point for road conditions. If a crash was involved, our hit-and-run and crash witness tracing runs alongside the scene work.
Video disappears quickly. Convenience stores, bars and parking lots commonly record over footage within days or weeks, so we list every camera that may have captured the client's evening and give counsel the details needed to send preservation letters. Point-of-sale records can show when drinks were rung up and how many. Witnesses in small towns often know the driver personally, which helps with locating them but can color what they say. We document interviews carefully and, where a witness has moved away, use lawful skip tracing to find them.
07Working with counsel
Retained Counsel, Appointed Counsel, 24/7 Sobriety and Cost
We take direction from the defense lawyer, which keeps the work inside the legal strategy and helps protect it as attorney work product. Trial-level indigent defense in South Dakota is funded and run county by county, through public defender offices, contract attorneys or court-appointed private lawyers, so approval for investigative expense follows the local process. Our appointed counsel support page explains how we prepare estimates for that review. Private firms can see how we usually engage on our services for attorneys page.
Some DUI clients are placed on the statewide 24/7 sobriety program, which SDCL 1-11-17 places under the Attorney General's office as a non-jail alternative. Under 32-23-4, a court may also permit limited driving for work, 24/7 testing, school and treatment after a counseling program is completed. Compliance records can matter at sentencing or on a violation. Our DUI defense investigation work is billed at $100 per hour, with minimums of $750 for a misdemeanor, $1,000 for a single felony and $1,500 for multiple charges, confirmed in writing first.

How it works
How a South Dakota DUI investigation runs
- 01
Intake with counsel
Defense counsel shares the complaint, reports, prior record and hearing dates. We propose a scope and a price in writing before any field work starts.
- 02
Preservation list
We identify every camera, dispatch log and receipt that may matter and hand counsel the custodian details needed to send preservation letters without any delay.
- 03
Field work and interviews
Investigators document the stop or crash location at the matching hour, trace the blood draw, check each prior and interview the witnesses that counsel approves.
- 04
Report and testimony
Counsel receives a written report with exhibits, a single-zone timeline and witness memos. Our investigators remain available to testify at motion hearings or at trial.

FAQ
Frequently asked questions
Is a first DUI a felony in South Dakota?
Generally no. Under SDCL 32-23-2 a first offense is a Class 1 misdemeanor, and a second is also a Class 1 misdemeanor under 32-23-3. A third conviction within the lookback period becomes a Class 6 felony and a fourth a Class 5 felony. Impaired crashes that seriously injure or kill someone are charged under separate felony statutes. Your attorney will explain how these apply to a specific case.
How far back do prior DUI convictions count?
SDCL 32-23-4.1 generally provides that a prior conviction occurring more than ten years before the charged violation cannot be used to enhance it, and time spent incarcerated for an earlier violation is excluded when that period is measured. Custody records therefore matter. We obtain certified records and release dates so counsel can test whether each prior qualifies, as described on our felony defense investigations page.
Can officers require a blood draw?
SDCL 32-23-10 states that operating a vehicle in South Dakota is treated as consent to blood or other bodily-substance testing, and that after an arrest for DUI the officer may require the driver to submit to a blood withdrawal. Whether a specific draw was lawful is a legal question for your attorney. We gather the facts about how and when the draw happened.
When should the investigator start?
As soon as counsel is retained or appointed. Bar and store cameras often overwrite footage within days or weeks, witnesses move, and winter weather can change a scene completely. Early work lets counsel send preservation letters while the material still exists. Our guide to investigator costs explains how a written estimate keeps that first step quick to approve.
Do you work directly for the person who was arrested?
We work through the defense attorney. That keeps the investigation inside the legal strategy and helps protect the results as work product. If you have been charged and do not yet have a lawyer, contact one first or ask the court about appointed counsel. Your attorney can then engage us through our attorney services process.
Why does the time zone matter in a DUI case?
South Dakota changes from Central to Mountain time on I-90 at the western edge of Jones County. Records from businesses, phone carriers, dispatch centers and hospitals may each use a different zone, and some do not state one at all. A one-hour error can distort the driving-to-sample interval, so we convert every timestamp to a single zone and document its source.
What is the 24/7 sobriety program?
It is a statewide program administered by the Attorney General's office under SDCL 1-11-17, created to coordinate non-jail alternatives for certain impaired driving and related offenses. Participation and compliance records can become relevant to bond, sentencing or a violation hearing. Counsel decides how to use them; we can help collect and organize the records when asked.
What does a DUI defense investigation cost?
Investigative time is billed at $100 per hour. Minimums are $750 for a misdemeanor DUI, $1,000 for a single felony and $1,500 when multiple charges are filed. The scope and price are confirmed in writing before work begins, so there is no open-ended retainer. Other rates are listed on our South Dakota service pricing page.
What if the arrest happened on reservation land?
Jurisdiction can differ. South Dakota is not a Public Law 280 state, and arrests involving tribal members within reservation boundaries can raise tribal or federal questions. We do not give jurisdictional advice. We document the precise location, the responding agencies and land status records so counsel can determine the correct forum and plan accordingly.
Does South Dakota license private investigators?
No. The state has never adopted a statewide licensing scheme for private investigators, so asking about training, insurance and court experience matters more here than in many states. Delator Group holds a Tennessee private investigation firm license and brings that standard to its South Dakota DUI work. Our checklist for vetting an investigator lists the questions counsel should ask any firm before assigning a DUI file.
