Quick answer
Is it legal to run a background check on someone you are dating in South Dakota?
Yes, as long as the research stays within public records and lawful sources. Court indexes, protection orders and the public sex offender registry are open to anyone. What is off limits is pulling a credit report without a permissible purpose, hacking accounts or impersonating someone. Our guide to what a South Dakota PI may lawfully do explains the lines.
01Why people ask
Why South Dakotans Verify a Partner Before Getting Serious
Dating apps widen the pool far beyond one town, which is a good thing in a state of about 935,000 people spread across 77,000 square miles. It also means the person messaging you from what they call Rapid City may have no connection to the Black Hills at all. Most of our clients are not suspicious by nature. They simply want the basics confirmed: a real name, a real age, a real address and no history that would change their decision. A short check answers those questions quietly, and our surveillance investigators step in only when a situation calls for observation.
The other common trigger is a story that keeps shifting. A partner who says they work at a Sioux Falls hospital but never mentions a shift schedule, or who claims to be stationed at Ellsworth but cannot meet in person, is worth a closer look. We test each claim against records rather than intuition. When the facts check out, clients tell us the relief is worth the fee. When they do not, our scam investigation team helps you decide what to do next.
02What a check covers
Identity, Marital Status and Court History in One Report
A basic check confirms that the name, date of birth and claimed city belong to one real person, then searches criminal and civil court records connected to that identity. In South Dakota, the Unified Judicial System's PARS index summarizes unsealed criminal cases from 1989 forward and also lists domestic, stalking and foreign protection orders, which is often the single most useful item in a dating check. We also search the state's public sex offender registry at sor.sd.gov and run federal court indexes.
Marital status is a frequent question. Divorce cases are civil filings, and the UJS statewide civil search reaches cases from January 2006 forward, so a claimed divorce can usually be confirmed or disproved through the clerk's records. Older cases, or divorces filed in Minnesota, Iowa or Nebraska, require research in those courts. The $300 deep-dive check adds employment confirmation, business filings, property records and a review of public online profiles, and our non-married infidelity investigations cover what happens if the deeper picture raises a new concern.
- Identity and address confirmation
- Criminal cases and protection orders
- Sex offender registry search
- Divorce and marital status records
- Optional employment and online profile review
03Money and crypto
Romance Scams and the 2026 Crypto Kiosk Law
The most expensive dating problems we see start with a match who never quite manages a video call and eventually asks for help with a frozen account, a customs fee or an investment. South Dakota's 2026 Senate Bill 98, which took effect July 1, 2026, requires cryptocurrency kiosk operators to hold a money transmission license, caps transactions at $1,000 per day and $10,000 per 30 days for each user, and provides a path to a full refund within 72 hours for fraud-induced transactions once its conditions are met. Sioux Falls police have reported kiosk losses in the tens of thousands of dollars, according to local coverage.
If you have already sent money, act quickly. Report the loss to local law enforcement and to the Attorney General's Division of Consumer Protection, reachable toll-free in state at 1-800-300-1986. We can then trace the identity behind the profile, preserve the messages and payment records and organize them for police or a civil claim. Our crypto scam investigations page covers wallet tracing in more detail, and the elder scam service addresses cases where an older relative is the target.
- Kiosk limits: $1,000 per day, $10,000 per 30 days
- Fee cap of 3 percent under SB 98
- Report losses to police and the AG quickly
04Personal safety
When Contact Turns Into Harassment or Stalking
Under SDCL 22-19A-1, stalking includes willfully, maliciously and repeatedly harassing someone through verbal, electronic, digital media or written communication, so a former match who will not stop messaging can cross a legal line. A first offense is generally a Class 1 misdemeanor, and a repeat conviction within ten years can be a Class 6 felony. Separately, SDCL 49-31-31 generally makes it a misdemeanor to use a phone or electronic device to threaten, harass or display a spoofed caller ID. Our stalking investigations focus on documenting that pattern for police and court.
A petition for a protection order under SDCL 22-19A-8 must be supported by a sworn affidavit of specific facts, and the clerk of the circuit court provides the forms. Domestic abuse protection orders under chapter 25-10 can last up to five years. Organized, dated evidence makes a petition stronger, and that is where an investigator helps. If someone you dated is now using fake accounts to reach you, our cyberbullying investigations page explains how we connect anonymous profiles to a real person through lawful methods.
05Children at home
Deeper Checks When a Partner Will Be Around Your Children
Parents introducing a new partner to their children usually want more than a name check. A deep-dive search looks for protection orders naming the person, assault or domestic-related charges in the public criminal index, and any conviction that would concern a reasonable parent. It also matters legally. South Dakota courts deciding custody consider the child's temporal, mental and moral welfare under SDCL 25-4-45, and under SDCL 25-4-45.5 a history of domestic abuse creates a rebuttable presumption against custody with the abusive parent. A co-parent may raise a new partner's history in that setting.
If you are a parent worried about who your former spouse is dating, the analysis changes. That is a family law question for your attorney, and any research we do supports counsel's strategy rather than replacing it. Our custody investigation guide explains how the Fuerstenberg factors shape evidence, and our missing child service exists for the rare cases where a parent removes a child in violation of an order.
06Legal limits
What We Will and Will Not Do in a Dating Investigation
Every dating check is built from public records and lawful sources. Because the purpose is personal safety rather than employment, credit or housing, there is generally no permissible purpose to pull the person's credit report, and we do not. We never log in to someone's accounts, guess passwords or install anything on a device. Accessing a computer system without the owner's consent is a crime under SDCL 43-43B-1, and identity misuse can be a Class 6 felony under SDCL 22-40-8. Those limits protect you as much as the person you are checking.
We also never contact the subject, pose as someone else to draw out information, or follow a person into a private place. Recording a conversation you are not part of without a participant's consent can be a Class 5 felony under SDCL 23A-35A-20. South Dakota issues no statewide private investigator license, so ask any firm how it is supervised and insured. Delator is a licensed Tennessee private investigation firm that applies that standard everywhere, and our vetting guide for South Dakota investigators lists the questions to ask.
- No credit reports without a permissible purpose
- No account access, hacking or spyware
- No contact with or pretexting of the subject
- No recording conversations we are not part of
07Distance and travel
Long-Distance Relationships Across East River and West River
South Dakota romance often happens at highway distance. Sioux Falls and Rapid City are roughly 349 miles apart on I-90, and the Central to Mountain time-zone line sits at the west edge of Jones County, so a partner who keeps odd hours may simply be an hour behind. Distance also makes it easy to hide a household. When the story cannot be confirmed through records alone, we can verify an address in person through a short field check billed at $100 an hour, scheduled with travel and winter road conditions in mind.
Some relationships stretch farther. A partner claiming to live in Wyoming, Minnesota or overseas gets the same treatment: confirm identity first, then search the courts where they say they live. Out-of-state field work follows the same written scope. Readers whose concern is a spouse rather than a new partner should read our out-of-state surveillance page, and anyone checking a match in the southeast corner of the state can see our Yankton investigations coverage. The same rules guide dating background checks in South Dakota wherever the person actually lives.

FAQ
Frequently asked questions
Will the person know I had them checked?
No. A dating check uses public records and lawful databases, and we never contact the subject, their employer or their family. Nothing we search sends them a notice. The only way they would learn of it is if you tell them. Some clients later choose to be open about it, and that is entirely your decision to make.
Can you find out if someone is still married?
Usually. Divorce cases are civil court filings, and South Dakota's statewide civil search reaches cases filed from January 2006 on. If the divorce happened earlier or in another state, we search those courts. A marriage that was never ended in any court we can search is a strong signal. For situations where you suspect an ongoing affair, see our married infidelity investigations.
Does a dating check include a credit report?
No. Credit reports may only be obtained for a permissible purpose under the federal Fair Credit Reporting Act, such as a credit, employment or housing decision with consent. Checking out a romantic partner is not one of them. We can, however, find public financial records such as civil judgments, liens, bankruptcy filings and business registrations, which often tell you what you need to know.
What if the person has a sealed or expunged record?
Sealed cases are excluded from the UJS PARS index, and we do not try to work around a court's sealing order. You will see what the public record shows. If the person has a protection order against them, a recent conviction or civil judgments, those generally appear. A clean public record is meaningful, though no records search can promise a complete picture of someone's past.
I already sent money. Can you get it back?
We cannot promise recovery, and no honest investigator can. What we can do is identify who received the funds where records allow, preserve evidence and organize it for law enforcement, your bank and any refund process under South Dakota's 2026 crypto kiosk law. Report the loss to police and the Attorney General promptly, since speed matters. Our cost guide explains how hourly work is billed.
Can you check someone I met who lives in another state?
Yes. Identity confirmation works the same way wherever the person lives, and we search the courts in the state they claim. For a partner who says they live across the Wyoming border near Spearfish or Belle Fourche, our Wyoming investigations page describes coverage there. Field checks outside South Dakota are scoped and priced in writing before anyone travels.
How fast can I get results before a date?
We do not promise turnaround in hours, because some courts and registries respond faster than others. A basic remote check on a person with a clear identity often moves quickly, and we will tell you at intake whether your timeline is realistic. If a first date is imminent, meet in a public place, tell a friend where you will be and keep transportation in your own hands.
What should I bring to the consultation?
Bring the person's full name, any date of birth or age they gave, phone numbers, usernames, photos and the city they claim to live in. Screenshots of key messages help too, especially any requests for money. The more identifiers you have, the more confidently we can match records to the right person and rule out someone with the same name.
Is the person dangerous if a protection order shows up?
Not necessarily, and we will not make that call for you. A protection order means a court found grounds to restrict contact at some point, and the circumstances vary widely. We report what the record shows, including dates, the type of order and whether it is still active. If your own safety is at stake, contact law enforcement, and see our stalking investigation page for documentation help.
