Licensing

How Arkansas Licenses Private Investigators

Arkansas regulates investigators under Arkansas Code Title 17, Chapter 40, which Act 393 of 2015 rewrote. The Arkansas State Police administer the program through the Regulatory Services Division, which also licenses security and alarm companies and polygraph examiners. The law separates the business from the individual: a company license covers the firm, and a credential covers each person who does investigative work.

A client should confirm both pieces. The company needs a current State Police license, and the investigator should hold a Credentialed Private Investigator credential. The division's page does not describe a public online lookup, so the practical step is to call or email Regulatory Services with the company and credential numbers. An out-of-state investigator may hold a temporary credential instead.

Courts

How Arkansas Courts Are Organized

Arkansas's general jurisdiction trial court is the circuit court, organized into 28 judicial circuits that often cover several counties. Since 2002 each circuit court has five divisions: criminal, civil, domestic relations, probate and juvenile. State district courts handle misdemeanors, traffic cases, small claims and civil claims up to a set dollar limit. A few counties have two county seats and hold circuit court in both.

Delator Group is a private investigation firm licensed in Tennessee and headquartered in Nashville. In Arkansas, Delator Group is not licensed as a private investigator or private investigative agency and does not perform, supervise or direct investigations. Those investigators contract with clients directly, set their own fees and are responsible for the work. Delator Group may receive compensation from participating investigators for referrals.

FAQ

Questions About Finding an Investigator in Arkansas

Which Arkansas communities have their own page?

Every incorporated Arkansas city, town or village with more than 3,000 residents, plus every township or town government of that size, has its own page here, 100 in all. Smaller places are covered by the nearest page and the statewide guide.

Is Delator Group licensed in Arkansas?

No. In Arkansas, Delator Group provides investigator consulting and referral only. Investigations are performed by independently licensed Arkansas investigators who contract with you directly.

Who licenses private investigators in Arkansas?

The Arkansas State Police, Regulatory Services Division, under Arkansas Code Title 17, Chapter 40 (A.C.A. 17-40-101 and following). An investigations company must hold a company license from the State Police, and each individual investigator must hold a private investigator credential.

How do I check an investigator's Arkansas license?

Ask for the company license number and the investigator's credential number, then confirm both with the Regulatory Services Division by phone or email.

Is Arkansas a one-party or two-party consent state?

Arkansas is generally a one-party consent state. Under Arkansas Code Section 5-60-120, a person may record a conversation they are part of, or one where a party has given prior consent. Recording a conversation with no consenting participant is generally unlawful, and an attorney can confirm how the rule fits your facts.
