Licensing

How Arizona Licenses Private Investigators

Arizona regulates private investigators under Arizona Revised Statutes Title 32, Chapter 24. The program is run by the Licensing Unit of the Arizona Department of Public Safety. The license is issued to a private investigation agency through a qualifying party, and associates and employees who investigate for that agency must be registered with DPS. Applicants go through fingerprint-based background checks, and agencies must keep a surety bond on file.

For a client, the key point is that an Arizona investigator should be able to name the licensed agency they work under. DPS shows license and registration status on its Public Services Portal, and it notes that a photocopy of an ID card is not proof that a registration is current. Check the status yourself rather than relying on a card or a website badge.

Courts

How Arizona Courts Are Organized

Arizona's general-jurisdiction trial court is the Superior Court, which has a branch in each of the state's 15 counties. It hears felonies, larger civil cases, divorce, custody, probate and juvenile matters. Justice courts handle smaller civil claims, landlord-tenant cases and misdemeanors within their precincts, and city and town municipal courts take local misdemeanors and traffic cases. In larger counties such as Maricopa, the Superior Court has several court locations, so the filing location can vary.

The Arizona Department of Public Safety, Licensing Unit, under Arizona Revised Statutes Title 32, Chapter 24 (A.R.S. 32-2401 et seq.). Private investigation work in Arizona is done under a DPS agency license held through a qualifying party, with associates and employees who investigate registered with DPS.

How do I check an investigator's Arizona license?

Get the agency name and license number, then check the agency license and the investigator's registration on the DPS Public Services Portal license status page.

Is Arizona a one-party or two-party consent state?

Arizona is generally a one-party consent state. A.R.S. 13-3012(9) allows an interception made with the consent of a party to the communication or a person present during it. Recording a conversation that no participant agreed to can be a crime under A.R.S. 13-3005. An attorney can confirm how this applies to a call that crosses state lines.
